it doesnt make a difference as all iranian beneficiaries in the end of the day have to go through AP,in CR-1 your fiance / husband will be able to work right away,and get his green card as he arrives,its not the same in k-1,keep in mind in cr-1 you have to prove a marriage,but for k-1 just a bona fide relationship.
at the very tipity top simple cases ( no over stay,no previous marriage,no criminal records ) take about a year.

Yeah I sent my original birth certificate, I had no choice as the copy doesn't show the seal, and it's not that hard to get another, I did it for my driver's license when I moved from state to state, did it for this, no big deal...

I was just stating that the guides say to send a birth certificate or all copies of the pages of the passport....and I don't know if he sent his birth certificate or not...I was just thinking out loud.

a high resolution full color copy would have.we have very delicate stamps in our birth certificates,and while it wasnt necessary i did add copies of his and my passport,all pages,with my birth certificate.we used a high resolution black and white copy,the stamps still showed

here is my point: I 130 leads to a complete green card for your spouse with a timeline about 12 months.
I 129 leads to only a temporary visa for your spouse with a timeline of about 7 months not
to mention more $$$.
When you do the math it comes out that the K 1 visa is kind of lame, that's why I would go I 130 if I had to do it all over again. I heard some I 130s get processed much sooner than the I 129s. The longer they stretch the timeline for the I 129, the less sense it makes.

well look at it THIS way,in I-130 you will receive greencard and EAD right away,BUT you have to prove a bona fide marriage,in I-129F,its just a relationship.a lot of people couldnt prove a marriage for whatever reason ( the USC unable to reside in their country for long periods of time,etc ) if it came down to it.thats why its so popular

Because she started her MA in English program five days after she arrived with a 50% grant. She wondered why she had to wait THAT long. Pretty stupid eh? It was waiting there for her to sho wup and sign some papers. had she been a month later, it would have been there then also. How is making plans for you family stupid as compared to staring at a computer screen waiting for a "touch"?

You can get transcripts translated and evaluated anytime.

Here's how we roll...

SSN 16 hours after arrival, son starts school 36 hours after arrival, new bank accoounts 40 hours after arrival, start driver training on day 3, sign papers for grant on day 4 (weekend got in the way) start MA program on day 5, SS card in hand on day 6. Drivers license in 2 months. We were DONE with waiting.

im not talking about YOUR fiancee,im talking about the advice youre giving others.im actually glad we didnt set anything up for me personally in the beginning of the process,because it seems like we are stuck in this system for another at least 5 months before we can get our interview.it would have been a waste of money and time.

Alla rarely asked if I had "heard anything" as I had told her that we "file for it and we wait" and I had told her it was "about 6 months or more" But we talked every day about our future together, things she needed to do, things I needed to do...none of it had anything to do with USCIS, they just were not a topic of conversation. That part will take care of itself, you need to do the things YOU need to do. USCIS is not going to enroll anybody in school or get them a scholariship or get their transcripts evaluated. When they say "How do I get a drivers license?" USCIS does not have the answer. Will you?




with the amount of uncertainty surrounding USCIS,how is setting up job interviews or educational opportunities smart?not to mention USCIS isnt the only slow step of the process.consulates can be equally if not more frustrating and slow when it comes to it.

Everyone is entitled to post what they want to post, freedom of speech. Quite frankly this process is long and stressful and we should be able to vent. If you don't like the 5 month complaining of NOAS then I don't recomend you ever check out the africa sub forum because most of us from Ghana constantly complain considering they are backlogged over a year from the time you are completed at the NVC until the time you get an interview. We have a right to complain, lol just saying!
And considering the people at the USCIS and NVC are clueless and always have a stupid response and barely can answer any questions, we defintly have a right to complain. Just my thoughts on this.

not all of them are as big of visa buffs as we are ( B-) )but i dont think thats the case.they are instructed to not give more information than required,specially for the petitions that are still within the five months time frame.why you may ask?i suggest you check the progress report subforum in k-1 section.someone contacted USCIS and a naive " officer " shall we say told him that all the petitions are on a five months long pause.what she meant was that there is no way anyone is getting their noa 2 in less than five months,she worded it out wrong,and all hell broke loose.i dont blame them,but i think they shouldnt give false hope.We personally were told it " can " take up to five months,not that it most definitely will,thats why we were so bummed and stressed.

I know a lot of what is said about the people who process our cases is in jest or the heat of the moment because of the amount of time our cases are taken...

but before you start complaining and calling them lazy and all names under the sun :) am sure there are doing there best to try and get through our cases and there work...(well maybe apart from a few bad apples)

at the moment i work for the CSA (child support agency) in the UK and a Data Protection Officer...which when a client wants all there information there come to us and we send out everything we hold on them bar 3rd party infomation...

now from the date of when we get the request in our office we have 40 days to supply our customers with there information....now a while back there was a great influx of work and because we were short manned we were not meeting the deadlines...but we were trying our best to get the information processed and sent out...
(we are now all caught up with work may i add lol)

but before you start posting OMG NOA2 IS TAKEN AGES (and I know sometimes its just to vent and its always nice to vent every now and again) but all am trying to say is please bear in mind that these people (hopefully lol) are doing all there can to process our cases as fast as there can :)

maybe we could have a sticky at the top of this page where users can go to vent and let off a bit steam?

1.NO ONE called USCIS officers anything.the problem people have is with people who order officers to completely abandon a type of visa in order to catch on with another.
2.The amount of people that go over the five months processing time is growing.I am in no way saying its the USCIS employees fault,but it is USCIS's fault
3.I wish you would have checked processing and report subforum,there are support posts there.
4.Freedom of speech gives people the write to state whatever they want whether its politically correct or incorrect and they are entitled to their opinion.

PS: I see you have been waiting for about two months,let me know if you believe in the same things when youre a week away from the five months mark.

honestly,while people are given the opportunity to attend the interview ( the USC) most of the time they are not allowed inside the embassy.
the solution to that is USC contacting the embassy beforehand,get an email that states he or she will be able to attend the interview,print it out and show it at the entrance .just a little piece of advice and information for others who are reading this post

im a week ahead of both of you,only had two touches,one the day we received noa1,one when we changed our address,dont count on USCIS website too much,they dont update it as often as they should,sometimes even miss some members.

they most likely wont ask her as they dont care.its not unusual for USC petitioners to support the beneficiary even tho its not suggested ( for moral reasons rather not visa related ones ).if asked,she can tell the truth,and you can be sure it wont effect her,unless there is a cultural requirement like pre marriage payment that could indicate you sent the money as to get married ( i dont know if it made sense or not,but i recently saw a case where the beneficiary got denied because the petitioner sent her money and it was a pre marital cultural requirement for the groom to pay the bride's family money,so the CO thought that they were already married,if sri lanka does not have cultural requirements like that,youre good to go.its also good to know that consulates judge each case based on the cultural requirements rather than financial status of the country )

Ryan H., if he did come on a VWP and we got married, would this at all be a problem when we apply for a spouse visa? Or would the fact that the intent was not immigration during that specific entry show to immigration officials that we aren't trying to skirt the rules? I'm really new to all this, so thanks again for your help!

it would be a problem if he came to the states on a VWP,got married then stayed and applied to adjust status,that would be visa fraud,but coming,getting married THEN LEAVING,is perfectly legal

1.majority of people who go through their process quickly get lucky with service centers,mostly vermont,since the slow times in vermont are rather short.
2.they have everything needed for packet 3 ready for nvc
3.their consulates schedule interviews quickly
im working 40 days of fasting myself B-)

A) get her money and deposit it in your account before you get the bank statement needed for the interview ( Philippines doesnt have packet 3 )
B) usually the primarily residence and vehicle does not count as assets .considering you are disabled,i highly doubt it would count specifically in your case.the definition of assets is a residence or vehicle that could get turned into money within a year without any financial and/or physical hardship.so you see where im coming from?
C)how hireable ( made up word i know ) your fiancee is does not matter to the consulate in general.it varies from CO to CO tho.

your biggest pickle is the financial issue,which can be solved with a co sponsor,so worst case scenario your fiance goes in with your I-134,a letter proving that she is hireable and will be able to make a decent amount of money herself,and the co sponsorship documents just in case,if things go well,amazing,if not,she can give them the co sponsorship paperwork and it will be done.dont worry too much.

For the I-134, which is required at the interview, you are only required to make 100% of poverty level. The 125% doesn't apply until the AOS part of your journey.

actually only the armed forces can go through the first part of the pricess with 100% of the poverty guidelines.civils have to meet the 125%
