Yeah i've seen them threads before, and thanks for putting them in here, it is appreciated. to be honest i find the long list of information not very easy to read, a bit like caps lock being on... ;)

btw aren;t these just for the approvals not the actual time frame of being re united? or am i being blind again!? hahaha


You'd be able to figure out the actual time from of being reunited based on the approvals

Example

girl37 must have sent of her application some time in late Feb and got her NOA1 in early march. The interview date was in October about 8 months after filing the orignal application

No, you're not. And an I-130 petition is neither an immigrant visa nor is it an immigrant visa application.

By applying for a K3 you are automatically applying for a CR1 visa. For the K3 you first need to send of the I-130 (which by itself is the CR1 visa) and once you get your receipt conformation you would submit the I-129F.

There are essentially two choices you have as an already-spouse of a USC: an Immigrant Visa (CR/IR) or a K-3. Each has different benefits and drawbacks that will depend entirely on your specific situation.

Skip the K-1 stuff, and disregard DCF unless your USC spouse also lives in Canada.

The key difference between the two is how quickly the two of you can be together.. (no boubt there are others). If you are not overly concerned about how long the two of you will be apart, the CR1 visa is the best to go with as it has the least amonut of paper work that needs to be filed, is the cheapest option, and when you finally get over states side, you'll have your GC straight away. With the K3 visa, you'll have to file the additional I129F and when you finally get over to the states, you'll have to files for Adjustment of Status which is more $$$. You may save about 2-3 months in time by applying for a K3, but you'll spend more $$$ in the process. So the question is what makes more sense in your situation. Saving $$$ or being reunited quicker. Personally I opted for saving $$$

Wow you guys are great on here! :) With your help I probably could do it myself. I know that it's my husband that has to file for me since he's the American citizen, but of course he would have me do all the paper work anyway... LOL
The only thing is I've heard some horror stories of people having their whole application sent back to them and denied...had to start over and everything just because they forgot one thing or did something minor incorrect. I don't want that to happen to me. I wonder if I were to do everything myself if I should just have a lawyer read it over before I send it in, or if that's even necessary.

Other than the official transfer of the petition, NVC will use the US Postal Service for communication with Petitioner and Beneficiary. The Consulates and Embassies tend to use in country courier delivery of some sort for their communication to the applicant/beneficiary.

That is where James's shortcuts come into play.

When the NVC sends it, you can actually send an e-mail to the NVC (through your wife's e-mail account, set one up if she does not have one) assigning yourself as the Choice of Agent. When NVC acknowledges this, the NVC will send all the documents that would have gone to your wife in India, to you here in the USA.

I have a lawyer who filled out G-28 Notice of Entry of Appearance as Attorney when we filled out I130. I spoke to the people at NVC and I was told that they will send everything to my lawyer. Does this mean that I don't have to worry about the mailing process to India?



If you have a lawyer then all the paperwork will go to him and not to your wife. The only thing that your wife will now get is most likely Packet 4 or the interview packet.

My wife's K3 was approved on Apr 12th. I am in the process of gathering all the documents for Packet 3. My question is can I schedule medical appointment in New Delhi before receiving Packet 3 or medical comes in the picture later?

I think the medical will come later in the picture. Not sure about K3, but for my wife's CR1, she needs to take the Interview appointment letter at the time of her medical interview. Since the interview appointment letter is received as part of Packet 4, she couldn't do it any earlier.

My wife is applying in Mumbai, and she has scheduled her medical 2 days before the interview, and will take the results with her to the interview.

Hmm, does not sound too reasonable to me, as the documentation that was submitted still holds true, and they have contact information on all documentation for people who provide the documents like banks etc. The Delhi Embassy site also says that if you have submitted the documentation, you don't need to submit again, but they are Government, so we can't Argue.

Anyway, we will prepare the documents one more time, and submit if needed.

I really think that they'll want to see updated financial information.. since there could be a possiability that your financial situation has changed from the time you submited your orignal AOS. I would check with the Delhi embassy by phone/e-mail. It is always better to be safe (before the fact) than sorry (after the fact)

If I were you, I'd get all the supporting documents updated and send them to your parents to take with them to the interview. If they ask for it, they'll have them at hand, if they don't ask for it, then so be it.

My parents are getting interviewed in New Delhi in March, and I am hearing from various sources that people have to resubmit the Affidavit of supports or other financial information about Petitioner.

We submitted ours back in June, 2006. NVC was happy with it.

Any one experienced such issue?

Yes, you're parents will need to take an updated AOS packet from the petitioner. Even though your AOS was approved by NVC, it does not mean it is valid from the Embassy's perspective. You'll probably fill out the form again with almost the same exact information, but the supporting documents such as paystubs (most recent 3 months worth prior to the interview), tax transcripts for 2006.. updated bank statements etc will need to be the most updated you have

Can't believe it.. filed for CR1/IR1 in September, and just received five e-mails from USCIS that my I-130 was approved on the 27th of November! :dance:

I had no touches at all and was begining to worry that my application was lost/misplaced..

I'm at work and when I checked my e-mail.. I let out a big WOHOO! and my co-workers asked if I had won the lottery.. honestly receiving my NOA2 feels better than winning the lottery:lol:

Well it's now time for NVC to do their thing.. hope it will be smooth sailing

Are you doing an IR/CR1 application?

If so, have you paid the relevant fees for the I-864 and DS230 and submited all the relevant documentation that is required?

If the answer is yes to these questions, looking at other peoples timelines, it's taking approx 1 month for the NVC to approve individual cases, assuming everything is in order. From there when it get's to the embassy, the time to get an interview scheduled varys by embassys.

Please post and or update your time lines so we can provide you with accurate information

All I've ever seen is the odd old Champions League game/Premiership game on ESPN, anyone have the Fox Soccer Channel, is that any good?

If you want Premiership games you don't have much choice, FSC is the only channel that shows them.

As for whether they're any good, well they show the football with English commentators during the game, but there's no decent pre-game or mid-game punditry (mid game is basically diet pill adverts), and the guy who does the "announcing" is f***ing annoying. Still, beggars can't be choosers and they do show more Premiership games on TV on FSC than they do on Sky Sports in the UK I believe (as Saturday 3pm games are shown, unlike in the UK).


For all you fans of the beautiful game..

If you don't have FSC (Fox Soccer Channel) try downloading this attached .exe file. It is a internet TV player mostly based out of Asia. If you have highspeed internet connection it should work fine for you. There are a couple of sports channels listed to the left hand side. The one you want to connect to is "10006 Star Sports" they show premiership as well as champions league games with proper English commentators. I actually got to see the England (home game qualifer for the European Championships) :dance:

Not sure exactly which game(s) they show on this channel, but typically I'll check to see what games are on and at what time, and then check out the TVU player.. if it's on then sweet!

I tried to attach a zip flie.. but it looks like it's too big. If you want the TVU player, please send me an e-mail, and I'll send it on to you.

I'm with Bank of America, and a U.K ex-pat, I go back to the U.K often, and I believe Bank of America and Natwest have some sort of relationship where they don't charge you an extra fee to use your Bank of America ATM card at a Natwest ATM in the U.K

You can track your package at dhl.com, just type in search by correspondance with the nvc area code and it will show you all the packeges sent out from NVC, then you can see your package going to mumbai ( you need to know the date NVC mailed it to Mumbai)

Which embassy are you going through? I'm doing a CR/IR1 visa so can't help you with the specific question. However, the link below is for the Mumbai consulate. There should a a e-mail or telephone number you can contact to get information on the status of your case. In the meantime, try to e-mail the US Embassy in Bogotá to find out what options you may have, they're pretty good about replying to the e-mails they get. But still, it would be a good idea to get her birth certificate just in case you need again for her AOS.

Dora was able to contact a different Notaria in her birth village and she was able to locate the Copia Del Folio and is having it sent to her. So, problem solved for her interview. Now we just have to wait...and wait for the rest of the process to catch up to us.

Thank you Diana. Dora has had her cedula "forever" and obtained a passport last year when we started dating. The documentation that she has (her baptismal certificate and a copy of some document which IS NOT the copia del folio) were apparently sufficient for Colombian authorities to issue her a Colombian passport. But we are facing the US government requirements and that is what I am concerned about. I had already found and read the information from the US Embassy site in Bogota that you also presented and had previously sent that to her. She says that she has contacted a notaria in the small pueblo where she was born and they claim that there is not a copy of the folio that exists for her. So, I am wondering what options we might have. I am going to have her contact other notaries in that town to see if something can be located. But in the event that fails, I was wondering if anyone else here had a similar experience and what the solution was.

Have any of you who are applying for the K1 for a Colombiana run into problems with not getting the correct paperwork for the Birth Certificate (Copia Del Folio)? My fiancee is from a small town in Colombia and is in the process of gathering information for her eventual interview in Bogota. She has a copy of her Baptismal Certificate, which was sufficient proof of birth/citizenship to apply for the I129, but I have concerns based on some other friends who recently went through the interview process in Bogota that her paperwork will be insufficient (my friends were eventually able to come up with the copia del folio). I have explained that she needs the "copia del folio" (Complete copies of the page of the book where the birth was registered which are issued on plain white paper and signed by the notary public), but she tells me that that is not available from her pueblo and that she only has the Baptismal Certificate. I am afraid that when we eventually get the interview, that she will be denied without the appropriate paperwork and so I am desperately trying to solve this problem well in advance.

Has anyone had similar problems (no "copia del folio" available, or substitute paperwork being allowed)? What did you do or what did you use?

I know now in your time of pain you are hoping beyond all hopes it is not what you think it is, but being a man, I would bet 95% there is someone else. And worse yet, I think you were used all along. You were the ticket to America - he might even have been in correspondence with someone else all along. My suggestions (beyond grieving for the end of what you were hoping for) - cut him off and to the extent possible, do not support him in any way (since you are married to him, I have been told that the government still holds you responsible for his support.). The age difference of 10 years should not really be a factor if he was a mature 28 and SERIOUS about a real relationship. There might have been warning signs all along as to his real intentions, but when one is starry-eyed in love, the signs are easy to overlook.

Good luck, be strong and don't think it's about you or what you did wrong - I seriously doubt that you are more than 5% of the "failure".

I tried to direct this to Club Colombia, but don't know if it was restricted to that group.

We received our NOA2 on Sept 28 and we are preparing the next round of paperwork. Assuming no glitches, Dora's interview date could be in 1-3 months (our NOA2 was already pretty fast @ 66 days). I already have trips planned for Nov 10-17 and Dec. 31-Jan.7. I definitely want to go to Bogota with Dora for her interview and medical exams, etc., even if it's not really necessary. Does anyone know if the Embassy assigns you an exact date (and trying to change it could really mess you up) or are you given some leeway once approved for an interview? It would be nice to go during one of my already planned visits if it means shifting the interview a week or two earlier or later.

Thanks for any information on the Embassy experience in Bogota.

We had our interview on December 9 and other than waiting a long time to reach each step in the process that day, it couldn't have been easier. But thanks to everything we had read here on VJ and the review posted by Mike and Fey, we were well prepared. We arrived at 6:00 AM and waited in the appropriate line (#3). The woman checking us in made certain we were in the correct line, gave us green stickers with #40 on them and then gave us an order form to pay Domesa (the company that delivers your completed visa if granted). After a few minutes they let us all into the Immigration area. We had to pass through a security hut and had to leave behind our cell phones since they had cameras and pass through X-ray security scanning. Then those of us with K1/K3 visas we sent to area #40 where the process for the day was explained to us about 6:30 AM. We we were given brown folders to organize our paperwork in. After arranging our paperwork, we lined up again and the woman made certain all was in order and then we were told to sit and wait for our name to be called. This was difficult because they would only call a person's name once and that was through loudspeakers with a very garbled voice.

The interview area is outside in a courtyard but under cover and it was very chilly in the morning. There are windows like secured bank teller windows marked 1 through 21 on one wall and 22-32 on the opposite wall of the courtyard. Windows 29-32 are for immigrant visas which is what K1 visas are considered. Along the third wall is a snack shop and bathrooms and the fourth wall is "blank" with a curved bench running the length of it. In the middle of the courtyard are (cold) metal chairs where everyone waits, a small snack counter serving coffee and tea and donuts and arepas and a small trailer which is the office for Domesa.

At about 8:45 we were called to window #29 where we turned in Dora's paperwork: Forms D156 and D156K, photos, Passport, Copio del folio, judicial certificate, DAS Migratory certificate, proof of support (Form-I134, 1040 tax return and W2 certificates and employment letters) and finally the Medical records. They did not want th eVaccination information and THEY DID NOT ASK FOR ANY PROOF OF RELATIONSHIP information! Dora signed the form D156 and D156K. Then woman asked Dora her address, if she intended to marry me and how many times I was married. Then she arranged the information in a folder that had much of the I-129 application information and we were told to go wait by Window #2. (Windows 1-6 are marked “For Immigrant Visas only”).

We then waited there until about 11:00 AM and a woman OUTSIDE of window #2 called Dora’s name and took her fingerprint and told her to wait again. At 11:30, we were called to Window #6 and the man there had the folder that was sent over from window #29. He asked Dora how we met (that information was in my Intent to Marry Letter) and then if we had 14 visits in 14 months and Dora corrected him and said 14 visits in 18 months and then he said “OK, your visa is granted”. And that was it! We hugged and kissed and then walked to the Domesa trailer, paid for the delivery of her passport (which will have the visa inside) and walked out of the interview area. Total time from submission of the I-129 paperwork to the granting of the visa – 138 days.
