Hi everybody - I have a 2 year residency requirement which I'm currently trying to get a waiver for.
I am also at the point where the NVC sent me the DS-230 for an IR-1. My question is, do I fill out and send the DS-230 or wait for the waiver/end of the 2 yr?

1) If I do send it in, there is a question in there on whether I have the HRR. If I say I do, are they going to reject my petition??

2) If I don't send it in, how long is the case still active? I already paid the fee.

The ideal scenario is I send in the DS-230, then by the time my interview comes around I have my waiver. If I wait for the waiver before filling out the DS-230, I waste 2+ months! On the other hand I don't want to risk my IR1 being rejected - my I-485 has already been rejected due to this HRR!

I was wondering if anybody knows of similar cases. I did do a search but the only cases I saw were for K1s.

Hi,

It is vital for your USC spouse be the choice of agent. Since if you do not do that, it will add many months to the overall process. If NVC has to send documents to India, they will only send it by regular mail, and can take several weeks for you to receive it.

The USC spouse being the choice of agent will not have to do too much. The USC will receive the Immigration Visa fee bill for $380 which will need to be sent back. After that they will receive the DS230 form which needs to be filled out. For this you can have the USC print off 3/4 copies the DS230 form and send the blank form to you. You can then fill out the form, sign it (DO NOT DATE THE FORM - HAVE THE USC DO THAT BEFORE HE SENDS IT TO NVC) and send it back to your USC spouse. Please note that the DS230 is in 2 parts. NVC only needs PART 1 filled out and signed. You'll also need to send him photocopies of your passport to submit along with the Part 1. You can fill out and keep the PART 2 with you - DO NOT DATE OR SIGN PART 2.. YOU"LL NEED TO DO THAT DURING THE INTERVIEW.

I sent copies of last 3 months of pay stubs. For the Tax stuff, I sent last 3 years of transcripts and corrosponding W-2's only. No need to send in your actual tax return.

I got approved my case at USCIS @ California SC on 02/06/07.
I checked automated message at NVC NH , it says case doesn't exist, however I called
Person told me that the case had been entered into their computer ant told me to wait 60 days.
How come! I see the exact same situation with my friend, but he got 'Choice of Agent' within 3 weeks
. It is been 5 weeks , no answer.
What should I do.

helo guyz!
I want my USC hubby to be the agent of choice since it's far better than making myself as the agent. But the problem is, he is leaving next week and will be away for about six months. We are thinking if it is possible and right to let my hubby be the agent but my mother-in-law will be the one to receive all the papers since they have the same address?Would that need a power of attorney.

That is fine. You don't need a power of attorney or anything. The documents will be sent regular mail so there is no issue with needing your husband to sign for the documents or anything.

Just make sure your mother-in-law is comfortable with helping to submit the neccessary paperwork back to the NVC since your husband will not be around.

I'm not sure that the Authorization for release of Federal Tax Data is actually needed. When I received my AOS packet from NVC, the Authorization for release of Federal Tax Data form was not included. I did not send it, and my AOS was approved without any issue.

The short cuts can only be used by people going through CR/IR1 process. K1/K3 applicants would not use it.

Yes, that is correct. You need the frist 3 letters and the 10digit number.. no space inbetween.

Raja,

For India, you do not need to send anything else. As long as you have the DS230 and the picture and biodata page from your wife's passport you do not need anything else. No need to send a cover letter. You should however, on top of each page of the DS230 write your NVC case number. This is just in case, NVC somehow looses track of your paperwork. They'll be able to reference the case number on the pages

Download the DS230.. send the application to your wife to sign it.. make sure she does not date it. Have her send it back to you along with photocopy of her passport (you'll need to send that with the DS230). You can then fill out the rest of the application. Do all this before the actual DS230 is mailed to you by NVC.

I had sent it to my wife a full month ahead of time.

What visa are you applying for? Your profile states "Naturalization" is that true? We need to know exactly what "benefit" you are applying for before we can help accurately answer the question.

For a CR/IR your wife will need to sign the DS230 part 1 for sure. Depending on which country your wife is in, she may need to fill out part 2 (without signinig it) and submit both parts together. DS230 part 2 is always signed in front of the consulor officer during the interview.

Again, please let us know what visa you are applying for, and how far along you have gotten, so that we can provide the appropriate advice.

First time visajournier----If I have discovered this forum earlier my life would be alot easier. I thas been a full year since I filed the first paper work. Due to some very unfortunate events. Up until now the NVC had just received the DS 230 a week ago. I cant never get thru the phones with them. Can anyone please tell me how much longer I have to wait for the NVC to complete my case. It normally take about 3-4 weeks for the DS230 to be reviewd and approved. I assume that you have also sent in the AOS (1864) form earlier.

I'm not sure what the process is for the Phillipines after NVC approves the documents - whether it's sent to the consulate or if the NVC keeps hold of it until an interview is scheduled. You may want to ask this in the Phillipines forum.

No way to "test" it. As long as you've followed the instructions exactly you should be fine. Again, if you are unsure, just wait for the offical bar code to come through the mail.

A quick clarifications... the Choice of agent can either be the petitioner or the beneficary.

As for the interview packet, who actually receives it depends on the consulate itslef. Some consulates may send it to the Choice of agent (either the petitioner or the beneficary) and some consulates will send it to the beneficary regardless of who the choice of agent is.

In my case, I (the petitioner) was the choice of agent. We are going through the Mumbai consulate in India, and they will send the interview packet to the beneficary (they just sent it to her a couple of days ago) instead of the choice of agent (me - the petitioner).

So again, it just depends on the embassy.

Does anyone know if the form DS-230 part one can be completed and signed ahead of time or will we have to wait for the original to be generated by NVC?
I will be leaving hubby again on Tuesday and we would like to get as much done as possible to save us time.

Thanks for your suggestion. We had considered doing that, but it takes around one month to send and receive mail to and from the US. The DHL prices are ridiculously high. Also I can't even guarantee that my husband will receive his copy or not from NVC. The mail service here is not very dependable. Who is the petitioner the husband or wife?

When you sent the Choice of Agent, who was assigned as the choice of agent? the petitioner or the beneficiary?

If the choice of agent is the petitioner (the person in the USA) then the beneficary print and sign the DS230 ahead of time and send it back to the petitioner. Then when the offical version comes you can replace it with the one already signed and send it back with the bar code cover sheet.

We're pursuing the K3 visa through the Mumbai consulate. I've heard from Yodrak that normally we would need to fill DS230 Part 1, and additionally Part 2 for certain embassies.

So does this change of submitting the forms to embassy Vs. NVC affect K3? Our K3 visa just got approved at the CSC. Do I need to be doing something related to these forms?

UM no "new rules" have come into effect for Mumbai. Just follow the instructions from either the NVC or Mumbai consulate. There are a couple of indian folks going through K3 in Mumbai on this website. Ask them if you have any questions. I'm going through a CR1 in Mumbai so I'm not exactly sure what the differences are in terms of what docs have to be prepared, when, and who they need to be sent to.

guys, i just called NVC and they told me that the supporting documents for the DS230 now have to be sent to NVC and not taken to the interview in bogota. when did this change? did i miss something? i thought the only thing that had to be sent with the DS230 was a copy of my wifes passport.
also, now that i have to ask my wife to get a police report, i asked NVC if she needed one from each city she has lived in, which would be barranquilla and bogota, but the NVC rep told me that she only needed multiple police reports if she has lived in more than one country. if this is so, do the police in colombia give one report that covers the entire country or does she have to goto bogota to get one from there? i'm a liitle confused after thinking i was on top of everything. please clearify, any help is appreciated

I don't think the rules have changed at all.

With all cases that fall under the CR/IR1 bucket, the DS230 part 1 (and in some cases depending on the country/embassy DS230 part 2 and supporting documents) are always sent to the NVC.

Specific to our case, (Mumbai, India), we had to submit the DS230 part 1 only to the NVC. The NVC will then forward that onto the embassy. My wife will need to collect the supporting documents (police cleareance certs etc) fill out part 2 and take that to the embassy for the interview.

As I stated earlier, different processes are in place for different countries. You may want to get clarification from others on VJ that are going through the same embassy as you.

The NVC should also provide instruction on what needs to be submited, when and where, when you or your SO receive the DS230 packet.

We were approved for our K3 and the I-130 April 5th :yes: . It's now the 19th and NVC doesn't have our file. That's 2 wks! :huh: Should it not have been received by now???


Don't get to frustrated. It is somewhat typical. NVC only updates their records on a weekly basis (every Tuesday I believe)
so wait till next tueday, before calling and speaking to an agent at the NVC

You have to meet certain criteria to use the i864ez. I think a coupel of the top of my head are 1) only sponsoring one person. 2) You meet the 125% of poverty level 3) you are not using a co-sponser

There may be one more, but the full list is on the i-864ez.

Hi, we ot our approval from VT a few days ago. Now, having read the timesavers, Im a bit confused! It doesnt take much to do that!

So, whats the next step in reality? Will my wife, the USC be sent something, or will I receive a bunch of papers? ds 3032?

I printed off the ds3032 and i864 and i864ez too, not sure which of the i-864's to use?

Can you clarify what visa you are applying for? Your signature states CR1.. but your profile states K1.

The documents you refer to are specific for CR/IR1's only.

If you are doing CR1.. here is what happens next.

Vermont will send your application to NVC - may take a couple of weeks. Once there, they'll assign a case number about another week or so. About a week after your case number is assigned, they'll generate the AOS fee bill and also the DS3032 (Choice of Agent).

The DS3032 will be sent to the beneficary, the AOS fee bill will be sent to the petitioner. You can use the short cuts - please refer to them - to 1) send an e-mail to NVC to assign the Choice of Agent and 2) generate the bar code payment slip for the AOS and send the fee before it arrives.

The rest of the steps are described in detail on the short cuts. Read them a couple of time to make sure you are comfortable with what is required and how to complete it

I would suggest keeping the "carbon copy" of the certified check or money order and submit that with your documents for the final interview just in case they question it. I wouldn't thik they would question it, but it's better to err on the side of caution.

It normally takes about 4 weeks to complete processing. I think NVC's standard response is 6-8 weeks, but it was approx 4 weeks for me, in other cases it's been much quicker.

Only documents to the consulate are sent via DHL. All other documents to the petitioner/beneficiary are sent regular mail regardless if it's within the USA or overseas.

You can just send an e-mail for the DS3032. MAKE SURE THAT THE E-MAIL ADDRESS IS THAT OF YOUR WIFE. If your wife does not have an e-mail address set up a hotmail account or something similar with her name.

You can e-mail the choice of agent to the following address

nvcinquiry@state.gov

No need for a PDF document or anything. When you e-mail the choice of agent, you do not need to send the actual form to them in the e-mail

Below is what I had sent to the NVC for my Choice of Agent. I received an e-mail back confirming Choice of Agent in a couple of days.

If you send a similar e-mail for choice of agent, your wife does not need to send the DS3032 to the NVC.

It will take on average about 70-80 days for your I-130 to be approved. I-129's may be a little faster. You should sign up for e-mail notification on the USCIS website. You'll need to have your NOA1 receipt number. My I-130 took 87 days before it was approved. Some are quicker some are longer.. it's really hard to tell.

K-3 Spouse Visa Process & Proceduresvisiting spouse
Your spouse can come to visit you during this process. Many people will tell you there is no issues, while others will tell you that a spouse coming to visit the states during this process will cause issues.

Essentially, the issue of concern is around whether the spouse will be allowed to enter the USA. If the immigration officer has any doubts about whether the spouse will return back to his/her country, they will refuse entry into the USA. If that happens, then during the interview he/she will have to explain why they were denied entry into the USA. Sometimes that leads to a immigrant visa denial.

Other people have been able to successfully entry the USA multiple times while going through the immigration process without any issues.

I would suggest that if at all possiable, that the USC go visit the spouse in thier home country rather than risk the non-usc getting denied entry at immigration. That is my person opionion..

If you decide on your spouse coming to visit here, make sure he/she bring along a lot of documents proving strong ties to thier home country, and that they intend to go back after the short visit.. it is upto the visitor to prove that he/she is not coming to the USA with the intention of not going back.

The date in the timeline box is just an estimate based on other VJ members time lines.. it does not mean anything as far as USCIS is concerned. Some approvals come earler or much later than the estimate you see here on VJ. There is no other number you can call to get more information other than the mis-information line at USCIS. I know if frustrating but unfortuntaly not much can be done to ease it.

Have you signed up for the electronic tracking at USCIS? You'll atlest be able to check when they last updated your case based on the date of the update. Typically USCIS will update thier website about your case before you get anything in the mail, or before the mis-information line know about it.

Go to https://egov.immigra.../jsps/index.jsp and create a new account for your case number. Once you finally get approved, they'll send you an e-mail as well.

From my understanding, you can file the I-129 anytime after the NOA1. The question you want to ask yourself is do you really want to file for a K3 visa? It seems to be taking as much time to get a K3 as opposed to a CR1/IR1.. and you'd be saving some money at the same time.

Hi, we're new to the forum and need some clarification about the timelines given here. Is this data only from people who are on this site or is this all the cases at the different service centers? Also, if you go to the USCIS timeline site say for Nebraska they just started working on cases from 7/06, those filed 6 months ago, but the timelines on here say the NOA-2's are averaging in the 100 day range from filing to NOA-2?? This process is very confusing and the USCIS sites really don't give anything but the bare minimum help. I have found more useful information on this site and more help in filing applications than the gov't provides. We are in the same situation as most people I have seen here in that we just would like some kind of a realistic idea of how this process works and a logical estimate of how long it will take. The timelines on this site are based on members imput and not for the entier USICS case load. The timeline here gives you a good idea of how fast or slow on average the USCIS is working. The timelines on the USCIS website is defaulted 6 months back.. so it does not have much meaning. Approvals from USCIS are normally taking on average about 90 days.

Is your question regarding the location of the physical form that you can download from the USCIS website, or are you asking why the I-130 application does not show up on the processing dates it's because all the I-130's are being processed at Calafornia.

K-3 Spouse Visa Process & ProceduresClarification Needed

Hello All,
I'm new to this forum, and the general visa process. My wife and I we're married in India Dec. 15th and I sent in our i-130 and G325A forums. I did receive a receipt (from the Vermont Center), but I'm not sure the next step in the procedure is? If someone can help explain the general procedure and also the acronyms used on this forum (NOA1, NOA2, ect) it would greatly appreciated.

Also the official time table stated that as of Jan 17th 2007, the center was reviewing applications( i-130) from March 2006, does this mean I should expect a 10 month period for approval?

The receipt you received is your NOA1 or Notice of Action 1. This NOA let's you know that they have your case, and will also provide a receipt # which may start with a WAC or something. NOA2 is sent to you by USCIS when they have approved your I-130 application after which time, they will send your approved I-130 to the NVC in New Hampshire.

The timeline on the USCIS website does not reflect the "current" timeline on approvals. They typically have a 6 month buffer, but in most instances, your I-130 will be approved within 3 month. You should sign up for e-mail notifications and tracking of your case on-line at the USCIS website. You'll need to create an account with your receipt #.

As a fellow Indian, it is safe to say that the entier process from the time you submit your I-130 to the time your wife has an interview and hopefully approved is going to be about 9-10 months. Obviously this can depend on individual circumstances for each case. Check out my timeline for a better feel of how long each step will take.

My case is currently at the NVC, and in the final stage of review/approval before being sent to the Mumbai Embassy. I'm hoping that by the end of Feb, the NVC will send it on to the Mumbai embassy, and for an interview to be scheduled for sometime in April - which would be about an 8 month process in total.

You may also want to read up on the process at the NVC. Go to the guides section and look for the NVC process flow. You should also go to the NVC forum, and pinned at the top is a thread about tips and timesavers at the NVC.. otherwise refered to as Jame's shortcuts.. those shortcuts difinately save you significant amout of time at the NVC.

It really shouldn't be a problem.. but if you are really concerned about it, why not get A3 paper and cut it down to the 8 1/2 x 11 size.. or the other option would be for your S/O in the USA printing the form and mailing them to you to fill out (that's what I did)

You'd be able to figure out the actual time from of being reunited based on the approvals

girl37 must have sent of her application some time in late Feb and got her NOA1 in early march. The interview date was in October about 8 months after filing the orignal application
