For those of you doing CR/IR1 process and have already gone for the interview or will be in the next week or two.. I wanted to inquire about the whole VCF process.

On the Mumbai site, it says that all the required documents need to be submited to your local VCF office. Does this also include the results from the medical exam? The reason I ask is that my wife is in Rajkot Gujarat, the medicals can only be done in Mumbai, and VCF states that all documents need to be submited 10 days prior to the interview.
So would that mean my wife would need to go to mumbai and get her medical done so she can submit it 10 days prior to the interview? Or can she go to the VCF office in Ahamdabhad and submit all the documents except the medical and do that a couple of days before the interview and take the results with her for the interview?

Also, at the VCF, what are the total fees that need to be paid?

Devblt ....man just hang in their.....time will fly away....and if your wife have broadband connection then take an account in the SKYPE in your name and Id if your wife dont have credit card.......it only costs 95 paisa per minute.....it wld be cheaper only if you have to talk more and have unlimited usage broadband connection.....hope it helps......we did that and atlast last month my wife came to be with me ...........and we will fly together.....

My wife has an internet connection, but not broadband connection so using skpe is not an option. We do have webcam chats but not ideal when she is on dial-up

When i go for my citizenship interview they have asked me to take my passort, my passport is from Great Britain. What i am asking is, do they keep it or give it back to you ?

Any help would be great on this, and can i have duel citizenship.

They'll give it back to you. I think they use it for I.D verification and that's all. They have no right to keep your British passport. They certainly did not keep my British passport when I went for my interview.

P.S. The citizenship test is fairly easy.. don't stress it too much! Also, don't plan on taking a trip abroad after the oath ceremony (sp??).. you'll have to hand in your Greencard, and they'll give you your certificate of naturalization. You'll not be able to travel with that certificate abroad, so you'll have to apply for a U.S. Passport which may take several weeks. I made that mistake, and had to drive to Washington DC from Charlotte NC, to get my U.S. passport issued in 2 days, so I could travel to London the following week.

Does anyone know the status of the proposed fee increase for the N-400? I haven't heard about it for awhile. We are planning on sending it out next month. If it does pass, will the increase be immediate? Or should we be safe for another month or so?

Just to clarify, getting a 10 year green card does not entitle you to petition for your parents. You'll need to become a US citizen before you are eligable to apply for parents.

It means that in your orignal filing, you did not provide the neccessary documentary evidence they were looking for, or that they are looking for some additional information. The RFE will be a document that you'll receive stating what additional evidence is required.

:help: We are almost able to send our paperwork in for the I-751 (May 1) . Here is the problem. I (the us Citizen) just got a job offer across the country. They want me to start right away. This means we would be going through another Service Center depending on when we send it in. If we send the papers in on May 1 then we would file with NSC, if we wait a couple weeks until we move then we would file with CSC. I don't know wether we should file on May 1 or wait and file with CSC. Also, could we send it in on May 1, knowing that we are moving? Should we wait an not move until he is done lifting conditions?

Any comments or help would be gladly appreciated.

If you can wait, and are still within the 90 day timeframe, that would probably work well. I read on this site that USCIS is very bad at updating their records (address changes) after the fact.

Fellow VJ'ers,

I've just begun this long and ardous journey, and I'm am very optimistic that this journey will be painfree (somewhat), based on postings that I have read.

I'm a Naturalized citizen got married in India in early August, and came back to the States at the end of August. I applied through the i130 process (CSC) in Sept and received my NOA1 on Sep 15th or so. Looking at some of the time lines, it seems as though CSC is working on August and some Sept applications, and so I hope that means I'll have my NOA2 by end of December at the latest. Am I being too optomistic???

My question is, does the process go any faster if I had also applied for a K3 visa as well? or does it not make a difference?

If it does, is it too late for me to submit a K3 application (i.e. will it make a significant difference to my timeline at the point?)

Reading other post's and time lines it seems on average once the NVC get's the approved application, the process with NVC take on average about 2 months before it get's sent to the embassy abroad. Is that 2 month average about right?

Finally for those of you how have been through the entire process or coming to the end of your process, I've heard conflicting responses as to how long the embassy process takes i.e. the time from when the embassy receives the application from NVC to the Interview date.

Is there anyone who is applying through the Mumbai office? What has your experience been with them?

Overall, assuming everything goes smoothly (assuming and smoothly being the operative words here) is an 8 month journey starting in Sept 06 and finishing in May 07 in my stars :star: or am I just dreaming? :huh:

It normally takes about two weeks or the "second Tuesday" from when NVC assigns a case number for your application. You should phone the NVC around that time and the Automated Voice system will tell you that the AOS fee bill and the DS3032 have been generated.

Read the pinned NVC time savers section in the NVC discussion board for more detailed information.

Be carefull about this. I know of someone who was in the same boat as you. He's wife came on a number of occasions without any issues while the process was ticking along. The last time she tried to come over, the immigration officals denied her entry because they found out (somehow) that she was in the process of getting an immigrant visa. She was refused entry and had to fly back to London on the next flight out.

She then had to declare on her application that she was refused entry into the USA. During her interview they ask her questions about it.

Thankfully this expereince did not negatively impact her ability to get approved for the immigrant visa, the possiablity was there. My friend and his wife were very concerned about it.

If I was you, I would seriously consider going to see her in London rather than taking the chance of her coming to the States while her immigration process is in the works.

i would recommend u go 2 the nvc forum and start studying the thread pinned at the top called "timesavers for nvc plus knowing ur case number". it all sounds complicated, i did several "dry runs" printing out forms and getting myself familiar with the procedure, i think that thread helped me more than anything else in the nvc process, plus some great help from some other vj'ers who had done it already. good luck!

End of March seems a little to optomistic from my perspective. From the time NVC receives the paper work from USCIS to when they send complete it and send it on to the embassy is approx 3 months (using James' shortcuts - go to the NVC section it's pinned there) At the embassy, the interview is scheduled for 2 months from the date that the embassy receives the paperwork.

Personally I've not got to the interview stage yet, but looking at other people's timelines, 5 months is probably more of a realistic timeframe. I don't want to be the barer of bad news, but I think it's unfair to set unrealistic expectations/timeframes for either yourself or your SO.. and be disapointed when they don't pan out.

If you check out my time frame, you'll see I've already been at the NVC for a month, and I still havn't submited my I-864 or my DS230.. I'm hoping to have all the paper work submited by end of Jan. NVC to complete the review by mid-late Feb and forward to Mumbai (India) in late feb to early march. This will put our interview out to about April/May depending how busy the embassy is.

Read your post about the bar codes. I've been able to use it successfully.

Here are the steps you need to take.

1) Use Jame's instructions to actually generate the bar code.

2) Do a "right click" with your mouse over the bar code and click on "save picture as"

3) Save the picture on your desktop.

4) Go to the file on your desktop and do a "right-click" on the file

5) Go to "Open with"

6) Select "Microsoft Office Picture Manager" as your first choice if you don't have that then use "Microsoft Paint"

7) If using Picture Manager, open the file put your mouse over the picture and do a right-click and go to "edit pictures" A panel will pop-up on the right side of the screen

8) Under "edit using these tools" click on the crop function. You'll see thick black lines around the picture.

9) Put the mouse over the middle - dottom horizontal line. Left click and move the mouse up so that the black line are now above the verbage "Powered by IdAutomation.com" and click on the "O.K" button on the pop-up window on the right hand side. That will crop your picture for you.

10) Now do a right click over the cropped picture.. click on "copy" go to the document where you need to replace the bar code and paste it.

11) Simillary if you are using Microsoft Paint.. you'll do something similar.. where you crop out the verbage and copy and paste it on the appropriate document.

I actually come over to the USA on a greencard. I think our visa came in when I was still in school. My parents were not ready to move over here permanently at that time due to my schooling. So the first time we came over here, we really came over here on a "vacation" of sorts for about 4 weeks during my summer holidays. The first time you go through the POE your process is pretty much complete. The greencard is mailed to the address in the USA you designate along with your SSN. By the time we were ready to head back to England, the Greencards had arrived to the address here in the states, we then applied for a re-entry permit, since we knew we would be out of the country for more than a year, and that was about it. The re-entry permit was delivered to the US address a couple of months laters, and was forwarded to our house in London.

It can be that simple, just there are certain conditions that apply. You say you'll not be ready to move over permanently until after the IR visa expires. If you come to the states and then go back "home" you'll have to ask yourself one very important question. This is will you be out of the U.S.A for more than 1 year from the time you go back home? If the answer is yes, than you have to apply for a re-entry permit - not sure what form that is. The re-entry permit will allow you to be out of the USA for more than a year when you hold a Greencard. You have to apply for it before you actually leave the USA. If you are only going to be out of the country for less than a year, say 6-7 months, than you don't need to apply for a re-entry permit

I understand that when I-130 gets approved (counselor processing, US citizen, IR category) from the appropriate service center you get a visa bill which is $380 + $70 for finger printing. Two questions ...

1) How long does it generally take after submitting the I-130 application before you get the visa bill?

2) Do they take personal checks and the real question ... who is the check made out to? Department of State, Department of Homeland Security?

Check out my time line below. Typically takes about 3-4 weeks or so. You need to make it payable to the Department of State, and you can't use personal checks - certified or money orders are only accepted.

Go the the NVC section you'll see a pinned thread that gives you all the information about the process you'll go through after your I130 is finished at the USCIS.

I had my wife print the application sign it and send it to me. My wife being in India. The size of the paper was slightly larger in length and shorter in width than the standard paper we use here in the states and the color was not white.. it had a slight ting of blue if i recall correctly.. I sent what the orignals my wife sent me to USCIS and they did not have any issues with that.. you should be good to go.. but again it needs to be the orginal keep photocopies for yourself though!

Once your family is approved and complete the POE here in the states, you'll receive a greencard in the mail within 2 weeks. Once you have your greencard, you can leave the USA and come back freely. In your daughters case, she may want to apply for a re-entry permit before she leaves the country if she plans on being out of the USA for more than a year.

I would not let your present situation hold you up in submiting the papers and getting the process stared right now.

Go to the USCIS website at https://egov.immigra.../jsps/index.jsp and sign up to track your case status. You'll have to create an account for yourself and provide an e-mail address. You can only do this if you have your NOA1 with an assigned case #. If you don't have this just yet, wait until you do.

Also, anytime they update information on the website about your case that is known in VJ terms as a "touch".. sometimes you'll get many touches before it's approved, sometimes (like in my case) you don't get any before it's approved.

When it is approved, and provided you've set up an account on the USCIS website, they'll send you an e-mail notification that your case has been approved, before you get the offical letter through the post.

Embassy or the NVC?

The NOA2 is typically a letter from the USCIS stating that they have finished processing your I-130 and that they will be sending it to the NVC (National Visa Center) in New Hampshire. That is were they will process the actual Visa you'll have to pay several fees and fill out a couple of applications I-864 and DS230 only after that is complete will they send it on to the embassy to schedule the interview...

You don't have a timeline posted, so I can not be sure where you are in the process.. if you've completed the I-864 and DS230 then you are off to the embassy, and I don't believe that is what "we" VJ'ers call a NOA2..

....What address should be given?Is it the last address we have lived together after we got married or just the last address we lived together before marriage? We never lived together as a married couple becoz he was already living in US and just went home to the Philippines and stayed for a month and married me. And also, we did not live together before we got married, he'd just visit me in my province and stay for a month or so, and I would also visit him. That was just our set up from the time we started our relationship until he left for the states...would that count as living together? And the big problem is that, my husband put my address and his address (on Section C-Q#21)when he was still living here in the Philippines plus the date from the time we started our relationship until he left for US. I'm really confused pls help?

Would that cause a problem in our I130 approval?Any idea?

With your AOS packet, you should have received a page that read "National Visa Center Barcode Sheet" and that "you must send this page back with your completed AOS package" or something to that effect.. check your documents to see if you have it. You have to send that with your documents.. it has a bar code at the bottom of the page...

I don't think that should be an issue.. I sent tax transcripts for 03 04 and 05.. I didn't send them a W2 for 06 since I have not received my W2 just yet.. but did sent my last 3 months of pay stubs..

NVC has not finished reviewing it yet.. so I can't be certain that it won't be an issue..

In the end, from my understanding, when your spouse goes for the interview, you can submit the additional tax information for 2006 if needs be.

Also, just looking at your time line, it seems to me that it'll probably be about mid to late Feb before you need to send your AOS information to NVC.. I would suggest, if you can, to submit your tax's before that time, so you can submit that for your AOS and be confident that it will not be an issue.

just got a quote for a parcel from fedex (they don't distinguish parcel/letter)

8 inches by 11 inches by 1 inch weighing 1 pound max is £56 cheapest and £75 quick

I don't want to pay more than £20 for a letter so i guess I am stuck with 'airsure' from royal mail which drifts across on a large red balloon with a label which says 'if found, please send to USCIS Nebraska' as far as I can tell

Do you have any family or friends here in the USA? If so, perhaps you can send the documents ahead of time to the USA, and then when the time comes for the paper work to be sent to NVC your family/friend can send it from here. It costs me $14 to send my paperwork to NVC by the US postal services for next day delivery... just a thought..

My immigration lawyer said that we did not need to be engaged prior to the interview, but it was imperative that PROOF OF RELATIONSHIP be established and seemd to put a bit more emphasis on the Intent to Marry letter than the sample letter presented here on VJ. It might depend on the individual consulate or the individual interviewing officer that day, but supposedly the "official" guidelines do not require an actual engagement. However, I wanted to formalize my intent with my fiancee, so we are officially engaged with ring, family party, etc. and photos to boot.

There should definitely be no issues. They require two years between K1s if the first one did not end in marriage, but even then you can petition for an exemption. In your case after a 10 year marriage and subsequent divorce, there shouldn't be any flags. And if the second marriage lasts "only" 10 years, you would be doing better than 50% of American-American 2nd marriages (but let's hope that it's much longer than that!). Good luck!

You can get one-way or round trip, it doesn't matter I believe with a K1. Round trip is usually cheaper I think, but if you can find a one-way cheaper then I'd go for it!


Having travelled extensively around the world entering a continent in one city and returning from another, I found it usually cheaper to buy a round -trip and simply not use the return leg from the original destination city. In the case of your arrival under a K1 visa, you do not need a R/T ticket, BUT... just in case things don't work out AND if it's cheaper to buy a R/T ticket, you might want to set the return date at 88-89 days after your planned arrival (since the K1 expires on day 90). That way, the cost of a R/T ticket is DEFINITELY cheaper than 2 one-way tickets.

Actually, I own my own company and I am in International Business Development and had contacts in Colombia. Plus, I am able to be almost as effecient out of my office as when I am there as long as I have a broadband connection. So, I was fortunate to be able to combine business with getting all my work done, which I guess might not be an option for many people. But I would say that they would have a VERY difficult time questioning that a geniune relationship occurred with that many visits, especially because we also had an engagement party with her whole family present (and photos of that event were included).

You should make it easy for the interviewing officer to see the sequence of the relationship, by organizing your package as much as possible. I would include color copies of your photos ON THE SAME PAGE as copies of the boarding passes and copies of the pages in her passport with the immigration stamps for each particular visits. The fact that you have had such a long relationship (even though there are long lags in the timeline, which you could chalk up to your youthfulness) is beneficial. The jury is out as far as whether or not the US Petitioner should attend the interview (theoretically it is not necessary), but in genuine relationships, I think most VJ posters would encourage it and say it can only help. So, her being there will be a plus.

One more thing you might consider is including an updated letter from the petitioner reaffirming her love and relationship (as was required in your initial I-129 package). If any of your photos show you with family, that would be helpful (it implies a family knowledge and acceptance). Our interview in Bogota was one question (the interviewer had already gone through our paperwork): "So, you saw each other 14 times in 18 months?", to which my fiance replied "yes" and the interviewer said "OK, visa granted".

Hey "Huggle" - I am with you - Colorado, mpore specifically out near Vail/Beaver Creek. I live in Charlotte now (funny how I am posting this right after you), but I just came back from visiting Beaver Creek (where I used to have a condo with my ex (now she has it sad.gif ), but it is beautiful out there year 'round if you are an outdoor person. I grew up in Florida (West Coast), but also spent a lot of time in Ft. Lauderdale area where we used to keep a boat and I wouldn't want to live there. But for our retirement, we are heading to Belize....
