Its not an issue of fixing a mistake on a form I can reprint. Its a mistake my fiance made on his g325a, which he already signed. So given what folks are saying, I will probably cross it out and initial it OR wait until he sends a corrected form with his signature.



I will probably wait on the corrected form. it will take couple of days for you to get it. once you sent out, you will not have control of it , so better to make things as perfect as you can. just my opinion.

also, try to have him print out bank forms with singnature from now on , that will help to save time.

after logging in and out USCIS's website for more than 2000 times over the past 3 months, after hoping, screaming and yelling for 3 month, there comes the GOD DAMN NOA2 at 10:00PM EST on 1/24/2007. After jumping around all over the apartment, hugged my indian roomate(almost choked him :lol: ), and ran around the building for 15 munites, I am finally able to sit my ### down and share this news with all of you. WAITING IS NEVER EASY, I just hope all of you who are waiting for NOA2 will soon join me for the sort of excitement I am expereiencing now.

also want to thank everybody for being positive while I was waiting, your message didn't help me to get NOA2 ,but it does help great amount to survice this increditable waiting period.

I don't understand what you mean when you say "it's been processed at washington". The NVC is in New Hampshire. I don't know what Washington has to do with it. If you were given a new NVC case number that is good; it means the NVC has at least done the initial processing on the petition. So then the question is why it hasn't been sent on to the US Embassy yet. I hope you are not under administrative review. If it is, you could be in for a long wait, and you should get your congressman involved. Did they say when the NVC received your approved petition? I hope it won't be long for you! Good luck.

First, for K-1 visas, do not bother with the automated system. They do not put our status on there, so it will always say that the NVC has no record of your application. You have to talk to an operator to actually find anything out. Most people should find out within a month that their approved petition was received and then forwarded to the US Embassy. If that's the case, get your NVC case number and ask what day it was sent. This will help you find out if the US Embassy has received the file or not. In my case, my fiancee was able to use the case number to pick up her Packet 3 and Packet 4 materials directly from the Embassy.

Second, if it has been more than six weeks and the NVC still hasn't received your approved petition. They'll probably just tell you to contact USCIS, and USCIS will give you the run around. You might eventually get them to put a trace on your petition through your service center, but then they'll tell you that it will be up to 45 days before you hear anything. What you should do after six weeks is contact your congressmen and get them involved. You'll probably find that your case gets a touch and within a couple days is back on track for processing at the NVC. This is what happened to me.

This is a computer batch work. what happens is that cases are being approved during the day, but computer system will send out emails at 5PM to all the applicants who's cases are approved during that day.

Just a general observation, but I notice that most people seem to get a their NOA2's towards the end of the business day... (5pm ET)

However, is this just because this is the time people come back from work or is this when USCIS posts the actual change? I know touches are updated there and then... but not neccessarily any change to the case.

I can't remember anyone getting notice during the day... Can anyone correct me?

I remember seeing some post talking about visiting while applying a k1 visa. I am gonna say you can come to the US with either passport. They have to fringerprint you anyway. But at POE, make sure you tell them about your k1, any buy returning ticket, show them proof you will not stay, you will go back.

Here is what I think Mitch. K1 visa has an over all about 97% approval rate for people to get married in the US with in 90 days. She will be eligible to apply adjust her status. But what if you we're in the US military, you got deployed overseas. You wife follows you right? What if you have a better job opportunities oversea? You will go right?
As a tourist visa, you will geta much less approval rate since you have to prove your intention. And you never see a tourist visa suggest you to get married in the US, have you?
One last thing, what if she comes to the US, and she like it here? She desides to stay. Don't leave your back door closed.
Your intention to apply a K1 visa was to bring her to the US so you can get married in 90 days, isn't it?
I feel like you are over thinking your problem.
As to me, I don't see you have a problem in this visa application at all.
You deside to come her and get married because not all your family can join your wedding in China, but you want them to witness the wedding, so the wedding has to be in the US for them, and for both of you. But because of your current employment situation, you have to go back to China for your job. ( seems you care about the job a lot since you mentioned you can not leave too long. )
As your future, leave it for the future you to decide, how about that?

I think what you need is more of a five years b1/b2 visa. Of course you only get one year the first time. And you can renew later. I suggest you guys apply a b1/b2 visa again. And not enter in with your k1 visa. And have your official marriage license registered in China. Have your wedding in the US? Giving up an immigration visa is a very bad record for future visa applications.

I did think that there was no need at this stage (I-129F) for a police cert but my girlfriend was sure she read threads where it was needed, I read the guides and searched via the search box and was getting conflicting stories.

I was planning on returning to the USA, (I`m in Ireland), for almost 3 months like I did last year at the same time, mid october to mid january.

 

Do you think I would need to be at home in Ireland to complete my part of the visa application?

It`s really a question about processing times I guess. I was thinking that the NOA2 should come through about the end of October.

So...in your opinions....do you think I would need to be home sooner than mid january to complete my side of the application?

 

I was thinking it should take about 9 or 10 months to complete and thought it would be ok to be there through the mid October to mid January period?

We are finding it very difficult to work out processing times.

If I do need to fly back home to complete paperwork etc I can but obviously I dont want to be in the USA if I`m going to be needed at home in Ireland to complete things.

I would like to check that I have the process correct....
Firstly, I am a South African engaged to an American lady and we are aiming to get married next year in America, it wilk be mid-year, or perhaps even towards the end of the year as she will first come and stay with me in Soith Africa for 3 months in the first third of the year.

So, the process...
1. My fiancee applies for the K-1 visa and sponsors me into the country.
2. Within 90 days of arriving in the USA we must marry
3. Within 90 days of arriving in the USA I must apply for Form I-765, Application for Employment Authorization (EAD). As long as I comply with the USCIS regulations I will get this without a problem. This is valid for 90 days
4. I am then eligible for an extended work authorization at the same time I file for permanent residence. That is Form I-485 and I send it through as soon as we are married
5. Once married we need to file a joint petition to adjust my status to Conditional Permanent Resident (CPR)

If I want to travel (I have two children and I doubt their mother will allow me to take them with me to America) while the CPR is pending, I can apply for an Advanced Parole. As I have never been in America illegally or worked illegally, I should be able to get one. It is valid for 1 year and is used in a similar way to a passport. However, on re-entry into America I would need to go through the same process as anyone on any visa entering the States. If they think I am up to anything fishy, then they might refuse me entry. The most common reason for being refused entry would be if I had worked illegally in America. The only real requirement on all this is that I am not out the country for any single stay of more than 180 days.

The process of getting my CPR takes up to 12 months. Once I have it, I can live, work and travel in the USA like a normal citizen. Once I have been there for 3 years (and they say that I would need to file within 90 days of the aniversary of getting my CPR) I can apply for nationalization. However, if I am out the country for a single trip of more than 180 during the 3 years, my clock is reset from the time I return to the USA.

Can anyone let me know if I have gone wrong anywhere in my understanding of the process?

Okay, thanks for these replies, they make complete sense and were as I thought.

 

I ask your patience while I ask another question....

If I come over there on my tourist visa in January and we petition for the fiance visa once I get there, do I have to return to South Africa in order to complete my visa and do the interview? Or can that part of the process be done here?

Obviously it would depend on how long it takes for the petition to go through as I cannot stay for longer than a 6 month stretch on my tourist visa.

I have met and am going to be marrying a wonderful American lady. I have, however, not completed the process of divorce of my past relationship. I am thus in the process of divorce, which should be finalized in the next 7 weeks (first week in December). Is it possible for my fiance to petition for a K-1 visa before I have received my divorce papers, or will these be needed? I understand that the petition for the visa takes about 6 months, which is quite a while, so I wanted to know if we could start the process now as I my ex-wife and I have already signed the settlement agreement and it is just a matter of it walking through the court process and waiting for our court date to get the papers.

 

Also, I wanted to know if there would be any problem with me traveling over on my tourist visa (I have a new 10 year visa) for the months before the K-1 visa is issued.

 

Any revelations of this would be greatly appreciated.

She can check www.kln.gov.my/ for info and apply online. After they received her application online for Certificate of Good Conduct they will email her to submit the supporting documents at the Malaysian Embassy. My mother kept her old passport so it was easy because they asked the information of her work visa that stamped in her old passport such as name of employer and employer's address.

Thanks for the help. I don't know if I'm making this a bigger deal that it is. I just don't want any mistakes. 

 

The thing I'm concerned about is that I travelled a few times between contracts, between 'residence' addresses and so if I omit travel, I am going to have gaps. I never returned to the same residence address (went home to SA and then back to Korea to a different job and city) and my passport/Korean visas cleary show that. 

 

For example (from most recent) 

 

South Africa April-current

Nepal TRAVEL Jan 2013-April 2013    (5/6 month gap)

India TRAVEL Nov 2012-Jan 2013

Korea City 1 Aug 2011-Oct 2012

South Africa June 2011-Aug 2011

Nepal TRAVEL May 2011-June 2011 ( about 1 month gap)

I would think that I can type this up super accurately with addresses, specific dates acc to passport) and attach it?

Hello, 

 

I am the fiance of the US petitioner filling out my G-325A. In between contracts abroad, I sometimes travelled (didn't have residence) and then travelled for 6 months in 2012/2013. Do I need to show this somehow? I am worried that big 'gaps' in my timeline (or even small gaps every so often) could be a problem. Does anyone know what I should do in this case? 

 

Also, I know that I need to apply for a criminal record check in places I've lived. (residence) Surely not for all the places I've travelled? 

 

I appreciate any help/guidance!

This site has been so helpful over the past month, but now we're ready to start the process and I feel so overwhelmed! 

 

Right now my US fiance is going to assemble the I-129F package and I have 2 questions. 

 

1. We were working abroad and he has recently returned to the states but is unemployed. He is looking for work, but we would still like to start the process and be together as soon as possible. Is it possible for him to do so being unemployed? If so how? 

 

2. Statement of intent to marry by me (alien fiance) Do I need to send him an original? Or could it be an email/scanned copy?
