I have bills for both of us with the same address; car insurance with both of our names; drivers licenses showing same address; I as the benficiary of his insurance and vice-versa; joint tax returns for the last two years; I am listed as my husband's beneficiary for his IRA accounts....and of course pictures of us on vaction and with the two cats we asopted together.

I need some advice.  My husband and I haven't really "comingled" our finances.  We have seperate bank accounts except for one, for no other reason then he had his accounts established and I am banking with another bank that lets me access my Candian banking easily.  His name is on the mortgage because he already owned the house when we got married.  We also don't have any joint credit cards.  Am I totally screwed???  I have been happily living my married life, and unfortunately, never really thought about having to prove that it is real.  I am supposed to submit my packet this Friday, and  I guess it is my own fault for not being more prepared.  Help!

I received my notice of trransfer today, dated 9/18.  It seems as though I have been transfered to the California Service Centre as well.  It said that my case was transfered because Vermont was the wrong service centre...but according to their website, Vermont is the service centre for North Carolina... Here's hoping that the process moves along a little faster now!

Hi Dirk,

 

I just added my fiance as an authorized user on my Capital One card.  When I called to add him, the customer service rep said that they would mail me a letter stating that he is an authorized user on my account.  I plan to use this as evidence of bona fide relationship during the K1 interview.  I haven't actually received the letter yet so not sure how it will look.

Right, but those charges were not dismissed because you were wrongly charged, which is what you claimed in your first post, they were dismissed because you gave some type of restitution to the victim of your crime. You gave restitution because there was enough evidence to either find you criminally guilty or sue you in civil court. You happen to be fortunate enough to live in a state that allows civil compromise.

 

Anyway, good luck with your ROC.

 

You're assuptions are fantastic, I did it cause I was in the middle of applying to grad school. Thank you for your rediculous support and judgments.

You may not have a record, but you weren't wrongly charged and all of the charges weren't dismissed. A civil compromise means that you gave some type of restitution to the victim of your crime. In return for your restitution, nothing goes on your record.

 

To answer your question, this should not affect your ROC or naturalization process.

 

I appreciate the reply, but first of all, as this is a public forum, you do not know on what basis this happened or what evidence (lack of) there is, so you cannot say I was not wrongly charged.

 

Secondly, in my desposition it says all are dismissed. each state is different, and that is why I am always confused when it comes to immigration's definition and my state's one.

 

But I do thank you for taking the time to read this and reply. Its much appreciated :)

Hey everyone!

 

I am seeking some advice, I know no one is a lawyer but maybe som help from those who have been through this

 

Long story short, I got arrested for assualt, harrassment, and strangulation. Got charged with harrassment, strangulation, and disorderly. 2 were civilly compramised, the 3rd was dismissed after I did one day of community service BUT I DID NOT plead guilty to anything, I did not take a plea bargain.

 

All dissmised and expunged, I made sure to get copies of all my court documents and sent it with my application, I am very prepared for an interview as I was wrongfully charged, and I had never been in trouble not even a traffic ticket before, also I am a hard working student who got accpted into gradschool. So I have nothing to hide.

 

What are my chances here? and will this affect my n400 also?

Hi everybody,

quick question about affidavit..when I got the affidavit from a friend, I forgot to use my wife's "legal" name. Her name is Victoria but the affidavit says Vicki.

is anyone aware of any problem with that? I dont mind getting the affidavit again but i have 1 1/2 month prior to my GC to expire and I want to send it ASAP.

the instructions are not mentioning anything about it

"Affidavits sworn to or affirmed by at least two people who have known both of you since your conditional residence was granted and have personal knowledge of your marriage and relationship. (Such persons may be required to testify before an immigration officer as to the information contained in the affidavit.) The original affidavit must be submitted and also contain the following information regarding the person making the affidavit: his or her full name and address; date and place of birth; relationship to you or your spouse, if any; and full information and complete details explaining how the person acquired his or her knowledge. Affidavits must be supported by other types of evidence listed above."

Based on other that already went through the process..it seems that as soon as you get the first NOA your status should be updated for 12 months. I dont think you are going to be in trouble as long as you get that NOA and you have that with you when you leave the country.

Regarding the first question..just include the data after the AOS until now. submitting evidence from time of marriage till now..I dont know but it does not make a lot of sense to me. I imagine that they just want to make sure that you are "in good faith".

I've sent several bank statements since december 2007 (when I got my GC) to now (one every semester more or less..) to make sure that they see we use our joint bank account regularly. Other things were the insurance policies..I've printed a confirmation at work where my wife (US Citizen) is in my health plan, my life insurance (only beneficiary). Also some pictures (9). Not sure how relevant they will be but..it is better to be safe than sorry.

Regarding your second question..sorry i did not send hte 2009 taxes. Just sent 2007/8. Sorry for the confusion.

I've sent my package via UPS yesterday. USPS was not close to work and the only location that used to be good for me now reduced the times that's open.. sad.gif

Instead of getting at home the confirmation of the receipt of the package, I paid the tracking service. which is the same thing but may cost less? So I will not get the confirmation card, but I'll see online that the package made it safe to destination smile.gif

other than that..I just believe that if all the requirements that are in the procedure are complete, you are in good shape. When I did my AOS I was so stressed out because of "what could go wrong" that i finished sending the package to the wrong location hehe (was sent to Texas instead of Chicago) so this time I decided to take it easy, read carefully the instructions and get it done ASAP. We'll see in 4/6 months.

another question about my form i751. Here is a list of things that i'll send

• 2 money orders ($465/$80)
• Cover letter with the list of what is being sent

• Photocopies of the passport and green card.
• Photocopies of Credit Cards, Health Insurance cards, Drivers License, Debit Cards, showing joint Credit Card, joint Health insurance and joint Bank Accounts.
• Copy of the tax statements for 2008 and 2009.
• Two sworn affidavits, attesting to our relationship and marriage.
• Benefits Enrollment Confirmation from my work where my spouse is the beneficiary of my Life Insurance.
• Original of two recent statements from joint Bank Accounts.
• Copy of Certification of Coverage by car insurance. Also copies of car insurance notices.
• A copy of our airline reservations for a vacation that we took to Argentina in December of 2008.

do you consider that the following will add more value to the data that is already there?

• Pictures (we travelled to different countries, different states, etc..)
• additional reservations/airplane tickets to other trips
• another affidavit from a friend


I know that I must "submit copies of as many documents as I wish to establish this fact and to demonstrate the circumstances of the relationship from the date of the marriage to the present date" and I want to send as much data as I can but I dont want to send too much data that is not going to add any value to the data that is already sent. I mean, joint bank accounts, life/health/car insurance, taxes, are already a lot, and I don't think a picture or an additional affidavit will add "valuable" data but..on the other side, i am not sure if "less is more" smile.gif

Please let me know if the list looks fine as I am looking for a second opinion on the amount of data prior to submitting the form.

At 3:30am I got another text message on my cellphone from USCIS informing me that my case is now updated. So I got worried so I got up went to my laptop and checked my case, the date now shows 2/4/2010 which is I guess a touch, but no change in the status.

I guess they are just screwing with me now :huh:


not sure why you got that, but anyway it takes a couple of weeks to get the card. Regardless of that, if the request is now approved..it's all good :)

Removing Conditions on Residency General DiscussionOctober filers
So I got a letter yesterday from USCIS (I filed my i751 to VSC)

"Congratulations! Your request for the removal of the conditional bases of your permanent resident status has been approved."

I went to the website and I got the confirmation

"Post-Decision Activity
On January 22, 2010, we mailed you a notice that we have approved this CRI89 PETITION TO REMOVE CONDITIONS OF PERMANENT RESIDENT STATUS RECEIVED. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.

For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations."

So...WOOOHOOO! Everything seems to be OK! Now to look forward to the next steps..not sure if file for citizenship will be the next step.. but on the other side.. dealing with this stress every 10 years is not something that I want to to through again. So I think I will apply.
