OH MY! I really do not know what to say. I called again the NVC (calling everyday as usual). The previous NVC agents that answered my calls said that the AOS form that our lawyer sent was already received but not our civil docs. So I called again today, the NVC agent said the AOS was completed last March 26, what about the checklist we received last March 27. That's why we corrected the form and sent to them. But our lawyer sent the form and the original documents last April 1 by regular mail. And now we do not know how we can detect where our docs are. T_T Our lawyer really put us in a bad position, emotionally and mentally. Very selfish.

Yes, don't worry, your documents will get there :) Just allow for that lag time between NVC physically receiving and NVC scanning things in. I don't know if your lawyer doesn't know what he's doing or is just careless, but either way, you have every right to be upset with him. It cost me $5.60 to send my documents via Priority Mail, which I think has 2 day delivery. Since I'm in MA and NVC is very close to me, my documents arrived next day. That amount in postage is a pittance for the peace of mind that comes with a tracking number. And adding the tracking or delivery confirmation option to regular USPS mail isn't expensive either! Your lawyer is definitely not putting any extra effort into this for you... or even the baseline level of effort I would expect for a $4,000 fee.

US mail is pretty safe.  If you don't send it priority, they don't give you a delivery range.    If I were a lawyer dealing with original documents that are a key factor is my clients case, I would do everything to ensure the documents were protected and tracked.  But that's just me...   You would assume it would be  normal practice but the lawyers seem to be so  money hungry. Even if its only $5.00     Such a shame
 
 
Keep calling the NVC.. 3 times a day if it makes you feel better. 
 
I tell my husband all the time that if it weren't for VJ, I'd be one of those clueless clients that thinks the lawyer is working on my case and doing everything possible to get it done fast.   My husband was annoyed that it took until yesterday for the lawyer to send us the approval notices.





Yes I called NVC 2x a day except Sat and Sun. Not received yet. Here is our lawyer's reply to my husband when we asked for our tracking no. He emailed this on April 4, 8.34 am

Hi Mike:

The package was sent to NVC via U.S. Mail on April 1, 2014. We do not have a tracking number.

Given the shipping date the package likely arrived yesterday or will arrive today.

My husband used US mail sending our AOS but he has tracking number. Ask your attorney how long it will take your iv package arrive at the NVC..


Thanks for replying. Yes we already asked him about the tracking number (we thought he sent by fedex) before we discovered that he used US mail. And our lawyer replied and said that there is no tracking number bec it is via US mail.

Lawyers piss me off....  Would it really have been a big deal to send your papers at least by priority???   UGHHHHHHH  $5.05 for a letter pack....   I'll have to remind my lawyer to send it like that. I know he sent our original I-130  by priority because it was sent on the 10th of April and our PD was April 12th.

And this what happened. from the beginning I knew that our lawyer care less abt us. Bec e don't hear any updates, so i made an effort to make research until I got to VJ. And I learned a lot from our friends here including you. Without VJ maybe our visa processing would take much longer. I and my husband are worried bec our attorney sent our package by regular mail last April 1. I called the NVC everyday until last Friday to check if they have already received the package and said "NO". So we are still worried bec of our original docs. I am really learning a lot from VJ. I wouldn't know either. Learning from our experience. I would never again hire an attorney to process any visa for my relatives (in case). I will just do it myself. bec now that is what I do, following up to NVC, reading VJ experiences so I think I know now what to do, consult VJ family. LOL

Ok, so if it was put in regular USPS mail from SC on April 1, NVC should receive it within 5 days -- hopefully they physically receive it today or tomorrow at worst. Give it another 5 business days for NVC to scan your package in. Good luck!

I'm not sure where your lawyer is based, but US mail is pretty reliable. I would've thought a lawyer getting that kind of money would pay the few extra dollars to send by Priority Mail so he could track it, but you should still be fine with regular mail service. The thing about NVC is they won't know they've received your package until several days after it actually arrives in their mailroom. You should ask your attorney what day he mailed it so you can estimate when NVC might scan your package as received.

So he asked my husband to sign the AOS form, so my husband did it immediately and sent to him using fedex service. (mind you we paid 4,000 US$ to our attorney). We use fedex service because it is safer and faster (we are buying the time). As usual I did the follow u, I called the NVC 2x a day if they have already received the package. Of course they said no, so I was thinking why it takes a long time. I asked my husband to send our attorney an email to ask abt the tracking no. Our attorney replied and he said, there is no tracking no. coz he sent it via US mail. I and my husband are both upset. We are worried that they might get lost. Please help. Does anyone here have sent original documents via mail to NVC? Do you think it will reach NVC?

How irresponsible is our lawyer they really do not care to their clients. They only want money.

We have the same checklist. The reason why is because the attny left some boxes blank, should put N/A. And also part 2 it's confusing should put the immigrant's mailing address. Not the address in the US.

Internet is very slow where I am in Thailand so unable to read posts. No word from the
Bangkok Embassy about change in interview date. The tears have finally stopped falling
as I am now with my family after over a year apart. I was walking down the street
and holding my wife's hand very tight and I realized something was very different.
In the past I knew that soon enough I would have to let go and return home and all
the pain that would be involved. Just then it dawned on my heart that
I never have to let go of her hand again.

Okay people are really stressin this checklist. Whatever NVC has of yours you don't need to bring to interview. What you bring is all about your comfort level. I know we had duplicate of everything submitted from I-130 to NVC (all 2100 pages. We didn't submit any documents to NVC so we had to bring  all to interview no big deal.

 

Yes every now and then we read how someone went to interview and the CO had nothing from NVC (that's why copies are good). Having copies sure won't hurt just in case. But not required unless the checklist says to bring to interview.

 

But for those who didn't submit 2013 tax forms to NVC I would sure have that with an updated I-864 just in case. Had over if asked.

 

And showing payment receipt isn't necessary because you wouldn't have got case complete and interview if you didn't pay. I do know that you need the DS-260 conformation page they do ask for that.

Yeah, for a petitioner applying for his/her spouse, a birth certificate is not requested as part of the IV docs. Only US-born citizens may submit their BC with the I-130 to prove their citizenship status, or joint-sponsors at the AOS stage. If your lawyer did submit his BC, you should be able to get it back at the interview along with your own BC and marriage certificate.

But our attorney asked my husband to submit to him his original birth certificate. If he did submit it to the NVC, can we request NVC to return it to us or will they give it back to me during my interview? We need it because he cannot get anymore birth certificate because it is from Cuba. And he does ot want to go there anymore, he migrated to the US since he was a child.  Please help me.

congrats to all those who have gotten their interview dates.. still waiting for mine.. has anyone gotten their date today?  called and talked to Joy who said i should call back May 19th if i don't hear anything soon... is she for real???? 19th is sooooo.... far away and i hope i will have gotten a date before the end of this week..


That's what Fiolly told me (NVC agent and I called in the morning), that i will get my interview date on the 2nd week of May. I asked my husband to call NVC again and he did in the afternoon. Yes the agent gave my husband the date of my interview (the same day). So call them everyday until you get your interview date. Good luck to you.

Hello VJ friends. I called NVC and no interview schedule yet. Then I asked my husband to call and he did in the afternoon. He called me and woke me up at 3.50 am just to tell me that I have to prepare for my interview on June 6. And I replied Are you kidding me? Nope, I will not joke you with something like this and then he jumped up and down. We are so happy right now. INTERVIEW DATE JUNE 6. Thank you to all VJ family.

No infact the interviewer saw plenty of our random pics and complimented and all....he did not ask for any additional docs...still the visa was not given back then ....yes his passport is with the embassy....i have emailed the embassy several times inquiring all they tell me is to wait and that they cannot determine how much more time it will take for his visa to be issued..................\ :(((((((((((((((((((((((((((((((((((((((((((((((((((((

As for me, before the CO started the interview she greeted me and then she said all docs is complete.  Then she started to ask the question and got irritated and keep on scratching herself all the time (even after questioning me I could see from the window lol)  Anyways she gave me 221(g) and then she asked me to wait again, called my name again and asked me to go to room #4 and I had another interview and she was very nice (a thai lady fluent in English).  They keep all the pics, chat logs, emails, phone call records, birthday & christmas cards, and .original divorce decree of my husband.  And still ask me to send more evidence such as the evidence I submitted to them.  I think she was so confused during my interview.  Anyway let's see what's going to happen next.

My husband had his interview on january 17th 2014 and his interview went well and was told that all our documents are complete but his visa had to be put under ADMINISTRATIVE PROCESSING....now its been almost 5 months its still under it....no visa luck yet...

hopefully it works out for us....and for you too...

 

 

That long? WOW.  But did they ask anything from him, like documents or proof of the relationship?  Did they keep your hubby's passport after the interview?  They gave me back my passport bec I need to renew it.  Did you call them?

Yes, they took my passport.

Oh yes, I forgot that I need to renew my passport.  Our lawyer did not even mention anything about my passport  and other civil docs.

My husband had his interview yesterday and they consular officer said that they were missing some documents. My husband was able to leave the Embassy, retrieve the documents from scans that I sent, and deliver them back to the Embassy. Last night, the CEAE web site said: Refused

 

Then, this morning my husband recived this email message from the Embassy:

 

Mr. WXXXXX DXXXXXX,

 

We have all the documents we need from you at this time.   You case is now pending additional administrative processing.   We will let you know as soon as we are cleared to issue your immigrant visa.  

 

Thank you for your quick response and patience.

How can my husband put married on his tax if i do not have a SSN yet bec I have not lived in the US?  They will ask for the spouse's SSN.  So my husband put single.  Are we going to have an issue bec of that?  My husband told me if they ask tell them the true answer.

Any luck getting the visa?

 i haven't yet submitted any docs, waiting for my passport and the tax docs that my husband sent to me.  Maybe on Tuesday next week, I will send them.  I do not have the eagerness anymore to get the visa.  What I want now is to be with my husband. We have options already.  I got hurt and have cried so much already.  Getting tired but we will still wait until we get the visa even it takes several weeks or months.  But the good side is we have learned and our love for each other is getting stronger.  With all this visa journey stress, disappointments and frustrations makes us more stronger and more in-love.  Of course with the help of you and other VJ members.
