K-1 Fiance(e) Visa Process & ProceduresK1 Preparing to file - A few questions

Hi everyone!

I've been browsing this site, and it is a great fountain of information. I am preparing to file the paperwork for a K1 visa for my fiancee and I'm just trying to gather as much information as I can to make sure I get everything right. I have a couple of questions that are specific to my case and I haven't been able to get specific information on.

My fiance is a Romanian citizen, but he is living and working(legally) in Hungary. Once the K1 application is processed here, will the packet be sent to the American Consulate in Budapest, Hungary(where he currently resides legally) or to Romania (the country of his nationality)?

There is an age difference between the two of us, (I am older, he is younger) can this be a reason for denial of visa? We have all the necessary proof of a valid relationship (i.e. statement that we intend to marry w/in the stated 90 days, we have met in person during the past two years and have proof of that, etc.) I just wonder if they can legally deny a K1 visa because of an age difference? There is no way they would do that, you shouldn't worry about it with all the necessary proof you have.

Does anyone have an updated timeline for K1 visa (from application to visa in hand) processing and approval with Hungary with me filing the application with the California Service Center? I've been looking on the timelines, but I don't see any information that is recent. From what I see it takes about 6 months, am I wrong in this? I only see 3 cases recorded for Hungary, but I think you should just filter by Service Center, the nationalities shouldn't be the factor for getting approved. currently you should expect 2-3 month through CSC
Any information/replies would be greatly appreciated.
Thanks,
P

K-1 Fiance(e) Visa Process & ProceduresWhere is my NOA2.......

I have been watching the China timelines and none seem to be getting processed with October dates. it is Interesting that there may be some geographic tampering. No way to prove anything. I'm just hapy they seem to be speeding up.

Jim

That's funny, I was wondering the same thing because, when I looked at the Visa timelines, it looked like it was mainly people from the Asia Pacific region who hadn't got their NOA2s yet ... but I think it's just coincidental ... funny how being anxious can make us start reading into things!!!

:clock:

Yes, same thing for me! I'm starting to feel anxious too ... our NOA1 was dated 24 October 2006 and filed at Texas then transferred to California ... in the Visa processing times I can see other people who filed at Texas and California with the same or later NOA1 dates (even November dates) and they have already received their NOA2 ... but our file hasn't been touched at all! The USCIS website says they process the petitions in the order that they receive them but it doesn't seem like it to me ...

I wonder if they seperated them from different countries, then look at them by different groups of people... that might make it slowly? Well I'm happy to see those who filed in Nov. getting theirs these days, but I'm getting worried

I have know people from China on NOV filter getting approved early Jan, it's all luck and the complexcity of the case plays a big role too.

No, nothing in the initial petition packet has to be notarized. The I-134 Affadavit of Support will have to be notarized but you won't need that until the interview.

AS far as I know, my fiance's Birth certificate and Marriage Status was notarized, but only copies of them were attached to I129F

K-1 Fiance(e) Visa Process & ProceduresNOA2---- Still waiting

the order of receipt!???? Well, isn't it kind like the date they received our files?
I read somewhere in this forum about how they bring in a whole batch of files and they are distributed in batches to all the employees. Each employee goes through their stack - some may be more complicated, some may have RFEs, and some may have a whole stack of easy ones that they get through fast. So our fate depends upon whose stack we are in and where we are in the pile (and of course, the complications & details of our own case).
yeah , that would make sense. nothing much we can do except waiting with as much patient as you can bare. good luck people. one thing to believe though is that it will come through ONE DAY.

very HAPPY that so many people got approved today, but even more concerned/panic about my own case now :(.... My NOA1 was 10/20/06, anybody out there in the same situation as I am , please follow the thread, at least this will let us know that we are not alone in the dark.

I used to think USPS is the slowest gov agency, but I guess it's CSC now :) lol......

CheEr UP PeoPLe!

Mine is roughly a month before yours... I received mine NOA2 12/5 ..so we put yours at 1/5 but then you have to factor in the holidays as others have said.. And remember alot of these Gov. people take 4 day weekends for Xmas And New Years.. and then you had Thanksgiven..and Holloween.. ..Id's say your is about due... But know this...you'll most likely receive email or postal mail before they change the web site... mine still says being processed and it's at our Consulates..

Thanks , that's good to know. well pay close attention to my mail box as well from now on.

How do you mean 'outdated'? You do know that you can sort the timelines (by the date the petitions were sent, for example) and choose how many to view at once, so that you can get the information you're looking for...?

By OUTDATED, I meant case information were not updated by some people... I am still hanging here..... thanks everyone

K-1 Fiance(e) Visa Process & ProceduresNOA1 June 9th - No decision yet - Please help
When you input the case number, did you include the first three letter? WAC?
Also, I think you can even by pass it without a case number. I will check tomorrow to see how it works. but I am sure if you listen to the option carefully, you should be able to talk to a real person which is what you need to do.

let's see if other people have any other input /instructions on how to by pass the automated machine at USCIS.

again, sorry to see the struggle. I can't even imagine if I had to wait for 7 month on this, altough I have waited over 3 months and still waiting.

Good luck

K-1 Fiance(e) Visa Process & ProceduresWhat is next after NOA2

Hi Friends
I have applied I-129F from Texas so it sent to California center. I have received the NOA1 on Dec. 25th of 2006. I haven't got any other response afterwards. Is it normal to take this long? Do I have to get any paper work done before I get the NOA2. Please if any of you know send me the information. Thank You all in advance.

With Best Wishes
Kabilan

use the timeline in VJ to see an approximated watiting time between NOA1 and NOA2. CSC is very slow. you are looking at 2 to 3 months waiting period. nothing needs to be done while waiting for NOA2. if during the process they need any more information from you, they will mail the request to you. i have been waiting for 3 month since NOA1, still no result. hope you have a better luck, but also try to be patient.

K-1 Fiance(e) Visa Process & ProceduresApproved! What next?

Hi everyone. Here's my story...
In September '05 I took a 1 year contract to work a construction job in Beijing, China. The month after I arrived, I met a cute, beautiful girl and we started dating. It wasn't long before we were totally in love and we decided that she should come to the US so we can get married.

Well, I got back in September '06 and immediately started working on my I-129F. I turned it in mid-November. Today I got an email saying it has been approved! They say they are mailing me some info.

What I want to know is, what's the next step? This is making me very anxious and I can't sleep, I miss her so much. I know she's probably gonna need to get a bunch of immunizations, but is there anything else I'm missing? How much longer of a wait are we looking at?

look at the process chart in JV, you will get an idea. basicly it will now send off to NVS and then to the US embasy in your country. also, you should update your timelines, as it will help others

fwaguy,

Good for him.

THanks all. I am glad that after recieving inputs from JV, I decided not to send a second petition and the approval come in the same day.

GOOD Luck to you all!

K-1 Fiance(e) Visa Process & Proceduressending I129F twice????

It sounds like you talked to the same people I did a couple of years ago. Most of the time the people answering their 800 number just look at the computer records and give you the pat answer. But, you are just about on schedule. The K-1's out of CSC have been averaging 3 months to process which has been pretty consistent for over a year, except for the people that got caught up in the new IMBRA changes.

Just be patient. If you haven't signed up for email notification, do so now. You can check that for touches daily. Usually when you start seeing a number of touches it means someone is finally working on your file. It's easy to sign up and allows you better access to your account.

You should go to the USCIS web site and take a look at their statistics. The number of applications of all sorts is huge. Also, remember this, CSC is now processing K-1's for the Nebraska and Texas service centers. Essentially, CSC is handling 3/4 of the country's K-1 applications. So, being a little slow is understandable.

One more thing, the USCIS always reports the oldest application that they have to be processed as the date they are working on. Just be glad your not that July guy.

Thanks 1HAPPYGUY.. I am sure we've talked with the same people, oh well, I can't really blame them.... actually feeling really bad about THAT JULY GUYS, I just hope I won't be called "THAT OCTOBER GUY". Later.... talked with fiance today and she is actually more positive about the situation, or maybe she just want to calm me down....... anyways, thanks everyone for the input, I will not send another application...

K-1 Fiance(e) Visa Process & Proceduressending I129F twice????

Did you get the message from the automatic service or did you speak to a live operator...I spoke to a live operator and had them pull my case up...It doesn't give you the option on the phone you have to hit the option that says you never received anything from them and it's been over sixty days or something...

That's what I did and once the live operator came over the phone they pulled my file and told me that it was still being processed...but I swear by that me calling and pulling my file made them look into it...because the very next morning...it was approved via email...for NOA2...

Good Luck!!!

yeah, I actually told to the "real Human being" :). i will try to call again in next few days. thanks for the reply

Yeah I know *****************PATIENT***************. I guess 3 month is sort of a pivot point I had in mind. once passed, I have nothing left but anger. I will see if I can keep myself off the computer for a while, maybe it will help....
bin&jieMaleChina2007-01-24 17:49:00
K-1 Fiance(e) Visa Process & Proceduressending I129F twice????
I tried call them twice. they said:" CSC is processing petitions recieved at July, and you have to wait" also told me to call back after 6 month if I still don't hear anything. Not helpful at all.

never been that impatient for anything, I felt like drove up there to their office and YELL at them to cut the coffee breaks and rush on our papers. oh well, I know it's not the right thing to do.

thanks for the response, I guess that option is out too. i have a feeling if they allow me to apply to VSC and I should hear back from VSC quicker than CSC. well well well .... HUGE mistake at the very begining.

I've been waiting an approval / touch from CSC forever(over 3 month now). i am thinking to apply again through VSC. I work on an contact job and move from one place to another. I lived in NY for 6 years and still holding a NY Driver's Lisence. I can use my parents' address to receive mails. i am just getting crazier every day as i wait for the approval

it sounds like a crazy idea, but I just want to check if anybody has done that before.

Thank you

Hi everyone,

I'm nervous but excited! I have my packet ready to roll...I have to say I did I pretty good job (I hope :innocent: )

I should know this, but my mind is at a blank right now. I will be sending to the Vermont Service Center - to eventually be sent to Amman. What's the best route to send via postal service. (Certified, Signature Guaranteed, etc???).

I really appreciate your help.

thanks!

I don't have an answer for you because our lawyer sent everything off. However, I just wanted to wish you luck! ;-)
