My husband sent the form I-864 to our lawyer but hasn't submitted to NVC. My husband left some boxes blank and we are afraid that by doing that we might get another checklist. So is it ok for our lawyer to just use hand wrting for N/A or None with black ink pen.

keep calling NVC. when both packages are accepted (no checklists for missing information ) it will be completed. fastest way to know is by calling them daily. once case is complete they will let you know if you are on wait on interview date.


How did you fill up the AOS form? Did you just leave some boxes blank or put N/A? Please i really want to know bec we are sending our AOS. Thank you in advance for your reply.

I called the IRS in Texas and they looked up his number. At first, he told me the numbers usually expire after 3-5 years but when he came back on the line, he said, yep, it's his. So I got to use it and he told me I wouldn't have to submit anything else. What a relief and I get a refund which is always nice!!

My husband lived and worked in the US in 2003 for <1 year and already has an ITIN number. So, wouldn't I be able to use it on my taxes for MFJ and send it in? No other documentation needed? Or would I also send in the form regarding foreign income? I forget the number but it was in a different forum like 255 something. Thanks for your help if anyone knows.

well.. do as you feel.. on the hand, i think you do have to be careful not too over-visit.. somewhat cuz they might think you are trying to make things up... and i think after you have seen him in April, you necessary shldnt have to be there for interview.. they won't let you in anyways.. and he shld be able to handle that himself... but of course when possible, visits are usually positive.. but don't get pressured by VJ pple.. do ur mind and what you can stand behind..





Well, not to go elsewhere on this thread but I have been to Jamaica approximately 22 times in 2 years. It's less than a 3 hour flight from me (cost/intl. taxes keep me from going more). I would've moved there but I have 2 children and can't go there with them. We have been lucky in this regard but should I worry?

It is totally normal and SUCKS...I had to take breaks away from the site because reading everyone's stories (sometimes it seemed more bad than good) got the better of me. A friend who brought her love from the Dominican Republic told me about the site so I feel lucky to get so much info but it can be overwhelming. Take a break sometimes, exercise, try to get through everyday the best you can..... it is so hard sometimes. Keep the faith.

OK, thanks so far. I already contacted Kay Hagan's office and I just sent her an email with message forwarded and left voicemail. I only spoke to a Tier one person on the phone who is less than helpful. I am going to call back and ask questions such as those given to me above. Did anyone else get a service request that states extensive background check? Is it because I have been fingerprinted?? I had to do that for nursing license. Why are we special, we are just like anybody else. I'm a nobody. It seems this is a standard letter but 6 months???

What about the Freedom of Information ACT? Would having a lawyer be beneficial to get further answers? HELP, anyone have 2 cents?

Well you didn't ask and no one is saying. But for now the letter is of no need. What you need to be doing in about a weeks time is have NVC on speed dieal and get that case# and start getting things lined up for embassy. Go to their website and get your documents together. Schedule interview and pay Visa fee. Go run do it, do it. You are Approved!!dancin5hr.gif goofy.gif .

You received official communication from USCIS, this information was not posted in some chat room and addressed to you, c'mon.  

I can understand you wanting to receive the letter in your hand but I believe the fact that this information is now being provided on the official website of USCIS is a great asset. 10 days before you receive the official letter in the mail, you know that your petition has been approved and you can spend those two weeks working on the next steps of your journey.

 

Anyways, good luck to you on the next steps of your journey.

Woo!  Expect the approval letter in 10 business days.  You will need that letter for AOS, down the line after you are married, too.  Sept 30 is only 3 days ago and this day is not yet over, so don't panic yet. smile.png  The letter will be mailed to the USC.

Why did you write assumed? I mean what part of the email was ambigous as to it being an approval?

I used `assumed `because I have not received an official letter, all the information I have at the moment is from the website. It was not an email.

I am not 100% sure I will adjust status with them here when they come to visit again. That being the case, is it permissable to file the I-130 now and then adjust status when they're here again in two months if I choose to go that route? They just left after a 9 day visit.

Hello all,

 

We were recently married in her country (Colombia). I have not filed the I-130 as of yet. She and her daughter (7yrs old) have a 10 year tourist visa to the USA. I was reviewing the I-130, and it asks for the current address and what USCIS office they would use if in the USA. My question is, if they are in the USA on a tourist visa, can I submit the I-130 with them in the states and are they legally allowed to remain until the package is processed? My understanding is that they can visit here on the tourist visa, but would have to return for the interview to get the visa in her home country. Any feedback, legal suggestions or anything would be appreciated. Thanks!

I need some clarity on the fees and process for the I-130. I know the filing fee for the I-130 application. From what I understand, after the NOA2 is issued, it is forwarded to the NVC, where there is an AOS fee of $70 and an IV fee of $400. I will be submitting two I-130 applications for my wife and step-daughter.

 

My questions:

 

1.  Do the NVC fees apply to each person I am filing an I-130 for or will the payment of the fees for my wife's I-130 also cover the fees for my step-daughters I-130?

 

2.  Are there any other fees I will be paying after the NVC's AOS and IV fee?

 

3.  Once a visa is issued and they arrive in the USA on a CR-1, are there any other actions or fees I need to be aware of, or is that it until they potentially apply for citizenship?

You have to refer back to the I-130 instructions and read it carefully. For your wife's case, you have to submit one G325a for your wife and one G325a for yourself. Your stepdaughter does not need a G325a for her case.

It looks like I don't need a photo for my step-daughter either at this point, correct? Only for myself and my wife from what I can decipher.

I am working on my I-130/CR-1 package for my wife and step-daughter as I write this. Regarding the G325-a, my understanding form the guide here is I only have to send in one. Somebody told me recently you had to send in four, but I don't see that anywhere. Can you please confirm how many 325's are required with each application?

 

Reagarding the G325a for my 7 year old step-daughter...what goes in the signature box? Her attempt at a signature? Her mothers signature?

I am currently looking at the G-325a form for my wife to be submitted with my I-130 petition. Towards the bottom of the form to the left of the signature block, it asks what this form is being submitted in connection with. What do I check? "Other" and type in I-130/CR-1, or should I check a different box?

In reading the directions for the I-130 petition from the USCIS website, it seems I do not need to submit original or certified copies of anything with my initial I-130/CR-1 filing...photocopies are acceptable. Am I understanding this correctly? I can send in a photocopy of my birth certificate, divorce decree, and marriage certificate? Do any of the three require a certified copy at this point, or a photocopy is acceptable? Thanks!

I did the translations on my own when I submitted my I-130. I translated all the words but the format wasn't necessarily exactly the same.

 

For example, if the circular stamp was on the bottom left corner, I translated the text and placed it on one or two lines at the bottom left.

 

For "subtitles" that were placed under boxes where information was filled out, I just translated the subtitle and used a colon. I did try to keep the spacing somewhat similar.

 

I did not get an RFE and was approved.

 

So it's not like I need an exact template of the original. I can basically summarize the information along with the certified statement of translation, correct?

Hello...I am getting ready to have my marriage certificate and the birth certificate of my step-daughter translated from Spanish into English by a competent Spanish-speaking friend of mine, to be turned in with the I-130 petition.

 

How detailed is it required to be compared to the markings and stamps on the original? What I mean is, do you have to transcribe the information from the little circular stamps on the document or other certified markings? Is it allowable to basically translate all of the information in summary on paper? Do I have to follow the same template on the translation?

 

Any feedback or examples on how you did it would be appreciated...thanks.
