I spoke to a Tier 2 representative just now and they told me that my case arrived in Texas on June 3rd and is now in the 'final stage'.  He said I should know by August 3rd, he didn't want to commit to even saying it'll get done any earlier.  

 

He also told me that the reason for the transfer was for the backlog in Vermont and they are processing October 15, 2012 applications.  Ironically, the same representative told me they were on October 18, 2012 applications 3 weeks ago.  So, I feel there is a disconnect with a lot of things :(

 

He said had they not transferred them to Texas, the December files (My NOA Date is 12/12/12) would not be given a decision till December 2013.

 

Finger crossed for a quicker turnaround time!

Yes, I understand how it all gets into the system. From what I understand, the applications have been getting processed faster if you submitted after a certain date this past year and basically, others that applied sooner were still having to wait longer because it went to the normal processing center and not a different center due to a backlog. Again, I don't know if this is applicable to the K1 visa apps.

I logged into my account today and noticed that there was an update dated 8/7/2013 and that our petition had been transferred to the local field office. At first I thought this meant the field office in Charlotte, NC since that is where I live. However, when I called the customer service line and went through the automated menu it told me that my case had been transferred to the local field office located in Saint Albans, Vermont.

 

On the drive home today I get a text message and an email that my case has been updated, then when I get home there is a letter from USCIS and it says that our case has been transferred to the Texas Service Center? Now I am really confused, can anyone point me in the right direction of who I should contact to find out exactly what is going on with our petition. Do I call the office in Vermont? The service center in Texas? Is the customer service number listed on the letter the only number to call? Is it frequent that they report out conflicting info such as this? Anyone else run into this?

 

Please help! :-)

Beth the status still says ready which is at a stand still for seven days now. Updated on today.I was in AP status before then. Called to check status here and they said waiting to be issued "perhaps". What??? Just so frustrated.

Hey everyone! I just wanted to swing by and let everyone who is still keeping up with this thread that my husband's visa was approved!
To recap, I am white, he is desi, we do not have any significant age difference, this is the first marriage for  both of us, we have no children, and we met in person while my husband was on a J-1 visa in the US.

 

The interview went very smooth. We attended together and my husband was very glad I was there to support him by his side. Overall, all staff at the New Delhi embassy were pleasant and polite. Our interview lasted about 15 minutes and the CO told us my husband's visa was approved at the conclusion of our interview.

 

Nothing was brought up about his past F-1 denials and they did not ask for a Thai PCC (we thought they might since he lived there for 11 months). The CO focused on his previous time in the US, the time spent with my family, his time in the UK, and my relationship with his family.

 

It is unreal that he will be arriving soon and no more sad airport goodbyes! dancin5hr.gif

 

Congratulations!!!  I'm just sort of catching up here.  Glad that everything went so smoothly for you two.  I think it's great as well that you were able to attend the interview.  Did you feel that your attending the interview influenced the positive outcome?  Do you think everything would have been as great had  you not been there?  Congrats once again!  I'd I would love to know about the rest of the process (POE, etc).  Thanks

My guy and I decided that, prior to applying for a K1, we would apply for a visitor visa.  We don't know exactly when we plan to apply for the K1, we know it can be a lengthy processes, and we really wanted to visit with each other more, have him meet some of my very elderly relatives, etc, prior to getting married.  The visitor visa was denied, basically saying that he should apply for a fiance visa instead.  I posted in the B1/B2 forum regarding this.

 

I am angry more about the reason for the denial than the denial itself.  It is wrong to apply for a K1 just for the purpose of visiting, just as it is wrong to apply for a B2 for the purpose of getting married.

Hello, not sure whether this thread is still alive.  I am a total newbie, and my guy and I have not  even begun filing for any type of visa yet.  We are still trying to decide which route may be best for us.  We are a mixed-race couple (I, the USC, am African-American), with several additional "red flags", and don't anticipate this process to be easy.  I am very glad to find this topic, and I hope that we can gain some insight and support from others who are or have been in a similar situation.  Thanks!

Consulate: New Delhi
Gender of beneficiary: Male
Religious difference? Sort of, but not really.   I am not baptised in any religion and will attend religious activities with him.
Religious background of beneficiary: He is baptised Sikh, and as such, respects all religions.
Age Difference? significant difference: I am 5 years older than he, but we are both 30+




Race/Class/Education Difference: I am an african-american woman, he is an indian man born and raised in india.  This type of relationship is even uncommon in my part of the US.  Our education is roughly the same (B.S. for both), though he has had a few years more than I of formal education.  Not sure we can really compare class.

Method of meeting (online, in person, etc): We met while working together remotely; he was part of the off shore team that supports are processes in the US. We continued our relationship online, away from work.
Engagement Ceremony? None
Has beneficiary ever been to the US? No
Does beneficiary have relatives in the US? No
Family approval? Yes from my side, his side does not yet know about the relationship, though we plan to tell them before filing any paperwork



Co-Sponsor required? No
How much time has petitioner spent with beneficiary in person?  10 days recently (November 2013).  Trying to plan another visit in the next few months, finances permitting.

Has the beneficiary or petitioner ever been married: No

Did the petitioner attend the interview: N/A

I can see potential problems with the lack of face time (we're poor and travel is expensive), racial differences, potentially age as well, though I really hope that the fact that we are not children works in our favor.  Right how we are weighing both the decreased processing time and increased expense of a K-1 visa with the likelihood of rejection the first time around.  The CR1 may have a greater chance of initial approval (maybe), but takes longer to process, plus getting married in the first place will be problematic if I have to establish any residency in Delhi first (conflicting accounts of this) or he cannot get a US visitor visa for long enough to get married and then leave.  We have a lot to consider, but wanted to make an initial post.  Thank you for listening!

My fiancee's K1 visa was rejected. We were not even interracial. Same religion, same ethnicity. I was older to her by 5 years but that is normal per Indian tradition for the guy to be older. The CO treated her like a piece of garbage. We got married and filed an CR1. Come hell or high water, I am going to the interview to be with her. 

 

The emotional and financial turmoil that you will go through after a K1 rejection is unimaginable.  You will spend money on lawyers. You will also spend money on at least 3 trips by the time your C1 comes through. The NVC is currently taking 60 days to touch a document.  You could potentially be looking at a 2 year wait from this point if your K1 gets denied. Do you want to take that risk? 


I re read your case. Your fiance is a Sikh. I am also a Sikh. There is a high amount of fraud that goes on in Punjab. I think they treat everyone from Punjab as a fraud case and work their way backwards to an approval. 


 

Thanks for your feed back Harry.  I read some of your old posts, so I see some of what you and your wife have experienced.  My fiance and I will have a very long discussion this weekend.  I just got notice today that our file is with the embassy.  I know that one can never predict the timing when it comes to visas, and I'm not trying to be cheap.  But, even with all my planning and saving things still happen that make finances difficult sometimes.

If you can't go, there are a lot of examples on VJ where the couple is denied or goes through hell specifically when they have all of the red flags you have.

Thank you for the advice.  I've read your case and pretty much all of the other ones pertaining to interracial couples in New Delhi.  I've used the feed back from the 221g notices and denials to compile the list of evidence to be submitted.  I'm also thinking to contact the embassy to see if they would be willing to extend the validity of the petition past the current expiration date of Jan 4, 2015, which is only 3 months away.  My fiance and I will discuss and decide together.  Thanks again.

Hi VJ friends,

 

I would really appreciate input from those of you who have recently gone through the New Delhi embassy for K1, or who are familiar with the K1 process in India at all.  My fiance and I received NOA2 for our K1 petition and had it sent to NVC literally a few days before I came to visit with him in New Delhi.  I am here in Delhi with him now for 10 days, and I'm leaving in two days to go back to the U.S.  Plane tickets plus hotel plus other expenses to India aren't cheap, and I'm really concerned that I can't afford to spend this kind of money again within only a few weeks to attend the interview.

 

However, our case has some "red flags" for this region:  I'm older by five years, racial difference, religious difference (sort of), no engagement ceremony, haven't been able to meet each other's family.  We met each other in Spring/Summer 2013 and have visited twice since then totaling 20-22 days.  I understand that under these circumstances it's advised that the petitioner attend the interview.  But, I don't want to put myself or the two of us in a financial bind knowing that best case we have visa, medical, plane ticket for him and adjustment of status fees to deal with, in worst case the cost of coordinating a marriage and filing CR1 petition, in addition to the medical and visa fees for the K1 process.

 

Below is a list of the various pieces of evidence that we would submit for the interview.  Some have already been submitted in our application which the embassy will receive.  This evidence would be submitted whether or not I attend with him.  I know that no one can predict the embassy's decision.  But please review and tell me what you think just based on the evidence, and whether or not you think we might have a shot without my attendance.

 

        Notarized copy of my entire passport (I'm also willing to send him my actual passport in sealed envelope, notarized signature over the sealed flap, for him

               to present unopened to the embassy).

       PAN card copy from fiance

        Passport biographic pages from fiance

 

        Proof of relationship

                       Skype and Facebook printouts from beginning of relationship to application

Thank you Katie!  This is me in contingency mode.  My fiance and I will have a K1 interview coming up shortly.  Of course I hope for approval.  But, if that doesn't happen, I'm just looking ahead to other options.  There is no way that I'll be able to take 30+ days away from work to get married in India, and he has already been denied a tourist visa to the U.S.  So we would have to find a 3rd country to get married in.

IndiaWhat is the required residency period for a USC to register a marriage to an Indian citizen in India

I have read two different answers from several sources around the Internet.  Can anyone with experience tell me whether 1) BOTH parties are required to be in residence for 30 days in the locale where the marriage will be registered or 2) ONLY ONE party is required to be in residence for 30 days.  This is regarding a civil marriage, not religious.  My fiance and I have different religions, so I may be difficult to find someone to conduct a religious marriage.
