Oh wow, ok well I will definitely try coming back over once we have applied! Seen as though it seems lots of people do it without any problems!

I only have one birth certificate, so I am worried I won't get it back argh.... if a copy is allowed though then I would prefer to send that.

We submitted our K1 petition whilst I was in the US last July for an 89 day visit.  It made sense to do that whilst we were together.  However, I was a bit concerned at POE, if I had my bags searched, what they would make of me having my birth certificate and divorce papers o me.  They might think I was entering the US with the intention to marry and then AOS from within the US (not allowed).  Therefore, I mailed the papers to my fiance in advance of my arrival so we had everything in place.

 

I traveled to see my fiance about 5 times in 15 month.  The shortest time was 6 days and the longest was 90 days.  I always took evidence of ties to the UK (which was more tenuous with each trip I took).  The only thing I was ever asked for was my return ticket on my last trip - I was taking a 6 week trip after being back in the UK for only 5 weeks.

Yeah i was thinking I might send my birth certificate over first! Good idea! Did you send a copy? Or the original? Also you don't need a police check or medical at this point? Is that correct?

When you say you travelled to see your fiancee 5 times in 15 months, do you mean after you had applied for the k-1?

We applied July this year, had one Request for Further evidence, and got our case number from NVC 4 wks after our NOA2, so far so good!!! Let me know if I can help in any way x

I think I will try and go back over once we have started to process but would suck if all that money on the flight was wasted and immigration are just so terrifying! haha. But definitely worth the risk!

Hi,

My boyfriend (US citizen) and I (Australian) have been together for almost three years now and are planning on getting engaged when I visit him for three months in January. I know it's a little unromantic to have to plan when we get engaged haha but I guess it's all about planning in long distance relationships! The reason we have planned it like this is so that I can get one last trip to the US before we apply. Im concerned that I won't be allowed to enter the US once we start the K-1 process so I thought this way we can limit the time apart a little bit. 

 

My question is, what should I take over with me so that I can start the process over there? Birth certificate? Do I need a police check at this point? I want to be organised in advance so that we can apply soon after I arrive there. This is all very, very overwhelming! I feel stressed already! I have been reading so many posts on here, everyone is so helpful and supportive!

Any help/advice would be so appreciated! Thanks so much in advance :)

Hello! This is my first post; my fiancee (who is a Russian citizen) and I are preparing our I-129 petition for the K1 visa and I have some questions about the Affidavit of Support forms.

1) Is the Affidavit needed for the peition application or after the petition has been approved?
2) Which form do I use, as I have found two: I-864 or I-134?

If they are not needed for the petition, is it still a good idea to include one of these forms to avoid an RFE on the petition?

Hello Friends!!!

 

I am getting our packet organized and ready to be submitted this week and had a few final questions.

First, does the petition and all the documents need to be binded or put into a 3 ring binder or just submit a bunch of loose paper in the envelope?

 

Second, do I need to pay first and then sent in the receipt with the petition or send in a check or money order with the petition?

 

Third, what is the best way to submit the pics? Send them in loosely with names, dates, descriptions written on the back or attached them to a piece of paper or in picture pages (like ones used for scrapbooks)?

 

Finally, how much is too much in terms of supporting documentation? I have 37 pages of skype conversations that I have edited down, 20 or more pages of other supporting docs.

Is it based on region? For example, I live in North Carolina and if Vermont is the only Service Center on the East Coast, is that where our petition would be sent?

Hopefully your situation is different, but we recently received an RFE specifically asking for proof of wedding plans, such as reservations for a venue, documentation of discussions of plans, etc.  We were also specifically asked for engagement photographs.  We are also an interracial couple with an Indian beneficiary.  I completed the I-129F application correctly per the instructions, and even included Facebook and Skype logs, i.e. those things recommended for "front loading" a petition.  However, I did not include specific plans of weddings, beyond our declaration of intent to marry letters.  Given our recent experiences, I think it may be wise to address it in some way

I think a letter of explanation similar to what you have written here would be sufficient, and write "unknown" on the G-325A.  My fiance and I had a birth certificate totally missing information for one parent.  I filled in "unknown" for each space of the missing information, and included a copy of the birth certificate to back this up.

Not to begrudge Eresh's thread tracking NOA-1 to NOA-2 timelines (s/he did a great job), but I thought it appropriate to start a new thread.

I began tracking just NOA-1s after USCIS stopped issuing NOA-1s for I-130s in late 2007. The tracking spreadsheet has evolved as USCIS has evolved and I added the NOA-2 dates for I-130 only filers as well as breaking out separate sheets between VSC and CSC and averaging the days between filing and NOA-1 receipts, NOA-2 dates and dates from filing to NOA-2s. You can find separate listings for Vermont and California right under the header.

I update the sheet every few days based on VJ time lines of CR-1/IR-1 filers. I do exclude time lines that appear to be either erroneous or DCF to try to keep the information as accurate as possible. But, it can only be as accurate as the information entered in the VJ time lines. Please make sure your information is correct and keep in mind, only California and Vermont process this type of petition.

Hello Delicia or Anyone who can help,

I have question regarding the receipt date on the NOA1. Our timelines are pretty close along with a few other folks. I130 was received in mailroom 9/6/07. The NOA1's have the date the I130 was data entered into the system at the Sevice Center. Does everyone have the data entry dates on the NOA1's or are there any who actually have the true date petiton was recvd in the mailroom? I'm getting nervous since folks are getting approved after me and I'm beginning to think they have me as a January filer due to the data entry date instead of the actual date petition was recvd in the mailroom.
Someone please help me out.

Congrats to all for being able to finally view cases on line. Someone already asked this question but I did not see a response. My I130 was received in the mailroom on September 6Th, 2007-NOA1 is dated 1/18/08. This 1/18/08 is the date that's showing online. Des anybody know if this is the date their going to use for processing our cases??? I really hope not because that would mean another 5 mths for an NOA2 if they're working on August dates of data-entry.

I used the RFE trick twice in the last few days, including HEARTFELT prayer and it looks like I'm finally with an Adjudicator. Sighs - they are so screwed up and tis wrong - MAO - did you get political party involved yet - They are destroying what America was built on - family values and oh yes, honesty, but that little goodie does not apply to their website. Yes, the same thing happened to me. The system had me as a January filer since this is when I received my NOA1, but I filed and petition was received on September 6Th, 2007. I had to call the Vermont center with the RFE trick and they corrected it. I knew the dates were going to get screwed up with the long recepting delays. They finally have me as a September filer.

Well I believe that the only reason USCIS is having ALL forms go to the Chicago lockbox is because CSC and VSC can no longer house applications that are coming thru their doors and just sitting in a pile. What I am assumming is that the current mailroom at CSC and VSC is overwhelmed and flooded with apps that just keep coming in and piling up. This probably makes it much difficult to get the receipting in a timely fashion when the mailroom is constantly overworked. So they implemented the Chicago Lockbox(CLB) so that apps can stop coming into their mailroom before they are ready to process them.

I think this is a good move. It may help in the organinzation process plus allieve the stress of the workers there so they dont just up and quit from all of the frustration. I am assuming CLB will start housing all applications until said service center is ready to receive them. Maybe CLB will start issuing out NOA1's too so that people can at least know that their application was received safely. I don't think this means CLB apps will get processed faster than the apps at CSC or VSC, but they could receive an NOA1 before others. There apps are still just sitting in a que waiting to get shipped off to the designated service center. I think this process is just for organizational and catch-up purposes. They obviously have workers at CLB who will be alleviating the work load from the service center workers, so maybe the service center workers can then start focusing on actually processing the apps.



Yes on trying to help the backlog and proces what is outstanding but the receipts will still come from appropritae area of filing aka CSC or VSC as per memo.

And i also agree good move, l think it may help.... ok need another paddle for our canoe lol

I would think all applications will be handled based on priority dates they were sent. That only seems to be fair and USCIS will work on cases piling up in Vermont/CS offices from July/August instead of processing new ones coming to Chicago even it means sending NOA1 notices. Atleast i hope thats what will happen..

Ok, This is what I did.

The Officer at the VSC told me that and I'll quote word from word "Once your K3 petition goes past 3mos of the NOA1 date then you can file an expedite"
My response was, "how can I when the website says they are working on September 07 for K3's", She said, inside information is we have to make a decision of the I129f in a matter of 3mos or you are entitle to file an expedite for being out of the processinf time". Well, may 19th came around and I called the Main # to file my expedite-800-375-5283 this is how it went. "Hello I'm calling to file an expedite on my case", Customer Service-"Well you don't qualify for being outside of the processing time since they are on September 07 and you filed the 129f in Februrary. My response"I was told staright from VSC that I could, Cust Serv's response-All I can do is give you a list of qualifying reasons for an expedite-My response-Ok, go ahead
She begans to read and the 1st reason was extreme financial loss-I stopped her and said 'That's it, I am facing an extreme financial loss and proceeded to tall her all about my financial issues being without my husband. She said Ok, I've typed it all up and for me to take down my Expedite # and wait 48hours for a response. At this point I was waiting for someone to call me so I could fax them all of my past due bills or whatever mortgag papers they needed etc. etc. -They never did. So after 48 hours I called back to VSC and said I have an expedite # and was told i could call back with it and my case would be pulled. i was told Ok-give us 3 days to pull it and respond. The next day I was touched, the following day again and the 3rd day approved. I cant explain why they didnt ask for any documentation unless they were geting ready to approve it without the expedite being needed.

I'm back..... Been calling everybody I could think of. I enjoyed all the Congrats and the responses. It's like we've all become a big family who's never met one another. Thank You all for the comments. Man, right now I am flying HIGH! you began to think that maybe you're under some kind of security check, maybe they need something, maybe they just don't trust your case. Like it has been posted already, just to reiterate, make those calls until you get that person who will want to help. I called and called and called. Filed a Congressional Inquiry, Congresswoman jumped right on it but was told i just had to wait. I really made it a point to call every morning until I got someone who actually had a heart.
