Ok..No problemo now...After further reading, I got my answer...Duhhhhhhh..On the "step by step" instructions, it says and I quote.."For purposes of this affidavit, the line for gross (total) income on IRS 1040 and 1040A will be considered when determining income. For persons filing IRS Form 1040EZ, the line for adjusted gross income will be considered" So, to answer my own question...On Question no 23 My current annual income will be my gross(total) income from my last year's tax return...and Question no. 25 (since I file the IRS 1040), I will put my gross (total) income...not adjusted gross income

No, I don't pay myself a salary. I am a Sole Propriertorship type of company...not Incoporated. It's just me..DBA (doing business as)...No way to say that what I've made currently this year is my "current annual income"...keyword "annual"..My income varies month to month. I base everything on what I made last year. That is what I would consider as my "current annual income"...and I understand that Question 25 deals with previous years..Just need to clarify the questions asked on the form.

I'm just concerned with all these others getting BOTH their petitions approved on the same day. USCIS says "if the I-130 is approved first, then there is no need to process the I-129F", so I don't know. I've looked at my timeline comparing to the others, receipt dates, transfer dates, marriage dates, country involved, etc. and I can't figure it out. I'm pretty sure that both of my petitions made to CSC at about the same time too. So there wasn't a problem of them getting my I-129F late. Really nothing can be done, but.....wait

Well, I guess you can put me on the list too...My I-130 was approved first and not sure which path I will choose (K-3 or CR-1).. Really confused and frustrated.. Lots of other people having both of their petitions approved on the same day..Only one of mine was approved..Also, it's been since July 12 and my case hasn't been received at NVC. I check every day..Frustrated there too, since I notice a lot of others are at NVC before me or in less time...:(

"Current Individual Annual Income" Enter your "current earned or retirement annual income" that you are using to meet the requirements of this form and indicate the total on this line. Annual current income is different from adjusted gross income...If I'm wrong, someone correct me

Hey man, I'm sorry. Nobody's perfect. That the name on the visa can only match the name on the passport is a given. If it doesn't then that is a mistake so major it boggles the mind. You won't have any trouble getting a new visa issued in the correct name. Just contact the Consulate and they should fall all over themselves to correct this supremely stupid error.



You guys are funny...My wife's passport is in her family/maiden name..All the paperwork/petitions we've filed are also in her family/maiden name. We were married but didn't "legally" change her name. I figure if we ever make it thru this process that somewhere down the road, when we can relax...We'll just change everything at once..If anyone sees a problem in that...I guess I'm screwed

It would be nice if there's someone who has dealt with the embassy in the Philippines, since that's what I'll be doing. I have 2 horses in a race, a K-3 & a CR-1. Now that the I-130 has been approved and progressed like it has, plus the advantage of a CR-1 (saving $,1010.00 feee for AOS with the K-3) I want to pursue the CR-1...I already have established a pretty good timeline for the NVC/CR-1 process too..Just not sure what's going to happen now that the I-129F(K-3) has been approved.
Anyways...

Originally applied for a K-3...I-130 is already approved and at NVC. Case number has been assigned. AOS Fee Bill & DS-3032 has been generated by NVC and in the mail to me. Per James' shortcuts, I've already sent both forms back in...just waiting for them to be processed. Yesterday my I-129F was approved by the CSC. I think it takes 2-3 weeks for it to get to the NVC. Below are my questions:

How long does the I-129F stay at NVC, before being sent to the Embassy?
What will happen if the I-129F gets there first before the I-130?
Would the K-3 interview come first before a CR-1?
Can I request a CR-1 interview, since that's what I really want now?
Is there a procedure to make this change?
Can I call the embassy, once I know it's there and make the change on the phone?
Is there a fee to change to CR-1?...shouldn't be since I've already paid the applicable fees.
Would I have to abandon the K-3 process?

Sorry if these questions sound stupid..just questions in my head..
I appreciate any responses

Another important thing is this...Under Part 1.."Qualifying to use the I-864EZ, If you are self employed, you can NOT use the I-864EZ...you must use the I-864

I think that the line for current annual income is the amount income that you filed taxes for in the previous year..I don't think they are asking what your income is currently to this date..I think the key word there is "annual"..

From reading others' experiences with this, I think you'll have to wait until the Manila Embassy has the I-130 file in their hands. Once they have received the file, you can call and ask to have the CR1, instead of the K-3, interview on Nov 8. I just called the Department of State and was told this..."if my I-130/CR-1 petition gets to Manila before my K-3 interview date, they would "automatically" change my interview to a CR-1 Interview"....Soooooooo as usual, I gotta wait, hope and pray that NVC approves my DS-230 and sends it to the embassy before November 8. Originally filed for K-3, but I-130 was approved first. Decided to pursue the CR-1 Visa. I used James' Shortcuts for submitting all documents for CR-1 to NVC.

My I-130 (CR-1 Visa) is at NVC..Final document (DS-230) has been received by NVC and is currently under review.

Now my I-129F was finally approved (K-3)and has already arrived at Embassy in Manila. Today I got a notice of our interview date (Nov 8, 2007) for the K-3.

I've talked to someone at the Embassy and didn't get any answers. The Embassy sets the date for K-3 and NVC would set the interview date for the CR-1. They also told me there were no available interview slots for October and November. But 2 days later I got my interview date.

I want to know if I can somehow change my interview to a CR-1 and what steps I'd need to go thru or who to call? Since my interview date is already set for the K-3, can I change it to a CR-1 or will I have to wait until the NVC sets another interview date, once the I-130 is approved?

Anyone out there that has had this happen?

I have the same situation as you...I already have a Nov 8 interview date for the K-3, and my CR-1 is waiting approval at NVC. I too was wondering, so I called the Department of State and they said this "Your K-3 will AUTOMATICALLY change to a CR-1 once the Embassy receives your CR-1...provided it gets there before your K-3 intervew.

hola banda.. aqui medio mal y de malas.. aunque estoy agusto ahi en cemex, hay un chingo de gente a la q le vale madre si te corren o no, con tal de que ellos no queden mal (y no, no es mi jefa, es otro pinche vendedorsete, q ni siquiera es mi superior)... hoy me mandaron a mi casa y me 'suspendieron' por unos dias por un pequenio descuido que tuve, empezando ayer, no estan tolerando nada de errores, asi q basicamente me toco mala suerte de ser el primero, aunque se que hay gente que no me quiere trabajando ahi...

si a la smithfields ya le cayeron.. hace un buen.. pero sigue la misma chingadera.. es mentira q los latinos les quitan el trabajo, esos pinches trabajos ningun americano los quiere hacer.., sin ilegales esas empacadoras quiebran, asi de simple..

no no es esa smithfields... jaja, esa smithfields es de NC directamente.. y es uno de mis BBQ's favoritos, especialmente porque es eastern bbq, que es mas avinagrado

esta es smithfields packing.. ellos comercializan puerco.. jamones y todo eso.. lo encuentras en el super.. aca en esta empacadora trabajan 8-9 horas, trabajan extra en el 2do turno para limpiar, y no les pagan la hora extra.. pueden llegar a matar 8000 marranos por turno.. que es casi 100 y tantos cerdos por minuto, muchisimo para los estandares de trabajo... los trabajadores solo tienen 2 breaks de 15 y 30 min.. y no descansan..
obvio atras de ellos hay 100 empleados mas con papeles falsos que quieren trabajo, entonces a smithfields no le importa que ya no vayan a trabajar..

y ni hablar de los accidentes, te lastimas, y te corren, simple

De veras, tan tan pesado y como aprovechan a la gente sin documentos. Es mama soltera, trabajando desde las 6 de la manana hasta las 4 de la tarde. 10-11 horas como empacadora y regresa en las noches a su nino fragil. Es increible lo que se puede aguantar uno. Lo bonito es el carino entre mama y nino--ademas el apoyo de su familia. Pues, veremos que pasa.

Tavo-espero que no te cobran tanto y suerte en la puente--que te toque un carril rapido.

sip. trabaje en smithfields unos meses.. y desde que sali de ahi (mas bien, usaron una ridicula excusa para correrme), nunca mas he comprado sus productos, y trato de decirles a mis amigos y familiares, que no compren productos de esa compania... es inhumano la manera en que trabajan...
