Ok, was all prepared to get the NOA1 and have it say, like everyone had been saying, that our app to TSC had been forwarded to CSC but when we got it today it said that it was being processed in Vermont. Has CSC stopped taking the transfers and now they're going to EAC across the board or what? Is Vermont a good thing? I mean, I know it's inevitably better than it staying at TSC (as always, this I even remember back from our K1!), but is EAC better than CSC at this point?

As was said, TSC applications WERE being forwarded to CSC for a good long while. Now apparently it's VSC's turn to more or less bend over and take it. What I want to know is why the transfers are ALWAYS going FROM either Texas or Nebraska TO somewhere else and neither of those two locations is EVER able to get their act together enough to TAKE some transfers at whatever point. But regardless...all will be processed in the government's time and there's nothing we can really do about it (other than contacting senators, that is) so why get so worked up over it? You're here, you have your significant other, you SHOULD have a letter extending the conditional residency for a year soooo...what's the problem?

I got there to the ASC at 10:30 for my 11am appointment and they called me in around 10:45 and was out of there by 11:15 or 11:20 or so...

Yep, Terry had his biometrics appt there on Thursday last week and said he was in and out. No problems so far so keeping our fingers crossed that it'll stay that way!

So Terry put in his resignation at his current job tonight...and then I started thinking and realized he'd never done one of the things I'd told him he should do before his conditional permanent resident card expired: get the unrestricted social security card. He has the letter extending the permanent resident card for a year. Can he use that to get the unrestricted card so he doesn't have a hard time with getting a new job...?

So we got our original NOA1 in early January saying that the package was received December 26th and we should be receiving an appointment letter for biometrics soon. DH got said letter and went for biometrics in Charlotte in late February. I checked the status online in mid-March and it wasn't yet showing any change in status after the biometrics BUT it was at least acknowledging the case number and showing that they'd received the package, etc. Now we just got a duplicate NOA1 in the mail stating that we will be getting a biometrics appointment letter in the mail and when I checked the case status online, it's not acknowledging its existence. What the hell?!?! Any ideas? This happened to anyone else?

Same thing as reported above - a big "Duplicate" watermark over the body of the document. And we received a bonus - they misspelled my wife's first name this time around. There is a different receipt number too.

My first thought was that my wife's biometrics were somehow not right, and a request to come back again for biometrics was on the way. Now that I see others posting the same thing, I think it is more a general condition of VSC being seriously disorganized.

At this point, it is speculation to try to state what they have done. Some kind of records problem I fear. About the least troublesome I can think of is that perhaps they have had a lot of people who have not received the NOA about status extension (1 year) and are send out a mass of duplicates.

Our duplicate NOA1 and the original have the same receipt number BUT the receipt number listed on the biometrics letter is different. We can get case status on the one from biometrics but it's not registering from the NOA1s. Has anyone else found this? Has anyone else checked into the two different receipt numbers and whether that is a problem? I'm worried. I know they're only processing from Feb 2007, but still...if there's already a problem with receipt numbers not matching up, it won't get any better the longer we wait to figure it out!

We can check the status on the case number that was on the appointment letter but not on the original letter and the status that was on the appointment letter (biometrics appt) shows nothing other than that they received our file on Jan 10th (which isn't an accurate date anyway) and shows nothing of biometrics that were done in Feb. Do we need to check on this or is the update just lost in cyberspace somewhere?

Ugh, I was around toward the end of that horrible time and now that we're coming up on the filing to lift conditions I'm baaaack. I know, I know, I'm not officially a TSC loser so far THIS time BUT I'm still twitching and flinching and groaning from the last time. I do have to say that the year and nine months reprieve of no immigration ####### has been very nice and I'm soooo not looking forward to going through it again. We were stuck in TSC hell with the I-129F petition and K1 and then the idiot in interview for AOS decided that Terry needed a NEW background check from Canada before they could approve (in spite of the fact that he'd only been there for a MONTH after the I-129F was approved!) and couldn't care less that we hadn't gotten Advanced Parole so he couldn't go back to get an updated one which meant we had to go to the Canadian Consulate which was really no help and then ended up calling an RCMP sargeant who seemed sympathetic and gave us an out for getting one quick and easy but still...we got the run around for no good reason and it SUCKED. Hopefully there will be no problems here as we now have 3 birth certificates besides our own along with 2 adoption decrees to show for how crazy we are and that whether we like it or not we're kinda stuck with each other and the kids at this point (not that we mind, but still!), our bank statements showing how dreadfully little money we have jointly, our mortgage showing precisely how in debt we are and the list goes on. Anyway, just wanted to say that I feel your pain and (sorry!) am hoping not to join your ranks (again) soon!

Well, it happened to me too...Just got email notification that my I-129F was approved on August 21, 2007--(120 days)
I had decided to change from the K-3 and pursue the CR-1 (which I'm gonna continue doing).

My I-130 was approved first on 7/12/2007 and it's already at the NVC...already has a case number, the DS-3032 & AOS Fee Bill has been generated. I've already returned the DS-3032 and paid the AOS Fee Bill, soooooo..

2/14/07...married (Valentine's Day)
4/03/07...mailed I-130 to TSC
4/21/07...I-797C NOA received
4/24/07...Check cashed
7/12/07...Received email saying "I-130 Approved"

Well, my experience is this "JAMES' SHORTCUTS" work !!!!..I used them and everything is working great, as you can see below from my timeline. Just follow the directions..Really easy. So far I've probably saved close to a month.

I read that press release...several times. It's in writing as to what their procedure is, but they DO NOT always follow procedure.
As in my case, I originally filed for a K-3 Visa (4/3/2007). My I-130 was NOT held back at the service center, like the press release says. It was forwarded to the NVC. Since that time my I-130(CR-1) has gone thru all the steps and is presently waiting for the final document to be approved(DS-230). It will be approved in the next day or so and will be forwarded to the Embassy. I did not stop or abandon my I-129F. Since then my I-129F was approved and has already reached the Embassy. I already have a K-3 intervew date set up in 3 weeks. What I am expecting to happen is in the next day or so, my I-130/CR-1 will be approved and sent to the Embassy. According to the Department of State, once m I-130 reaches the Embassy, my interview will AUTOMATICALLY change to a CR-1 interview. My timeline is 6 1/2 months on the
I-129F/K-3 from submittal to interview and 7.25 months for the I-130/CR-1...really not that much difference. If you use James's Shortcuts you can save a lot of time. I highly recommend it!!!!
I think everyones journey is different and there are a lot of variables that come into play. I have learned that the USCIS does hardly anything per procedure. There are people here who filed before me and still haven't gotten approval. Some get both petitions approved at the same time, then others are approved in order as they were designed to be...You just don't know what will happen.

made it to NVC and just got a case# this week. Probably be getting a packet soon..I'm getting ready to go the CR-1 route, I guess. My I-129F hasn't been touched since it was transferred to CSC..And I still don't have a clue as to when this thing will end..My wife and I are trying to plan, but not knowing an actual date or even a good estimate is hard. She's has sensitive timeline with her job there and not knowing when she can give her resignation is tought too...Soooo, we just wait...

Well...Before I had no patience..hahahha..still don't have any..Just trying to make it day to day..I check this forum daily..sometimes 3 to 4 times a day..I keep hoping that one day there will be lots of people here getting their approval notices. I see a lot of people who filed after me with very little patience..I'm thankful of finding this site, at least there are other people in the same boat. If it would make anyone feel better, you could search the timelines of a year or two ago and see that there were a lot people waiting 500, 600 and even 700 days for approval. I have a calendar and am marking the days off with the hope that it won't take near that long..I really don't have a clue how long this process will take.

Anywaysssss..Everyone hang in there....In the meantime, I am planning a trip to be with my Honey maybe next month.

NOTE TO "edp333": Our timelines are very close and we both have an interest in the Philippines, so if you're ever down and out and need a friend to talk to, I'm here. We could talk by phone and share our stories and maybe, be some sort of moral help in this time of "waiting"...

First, thank you very much for providing this filtered (for good data points) spreadsheet. Would you mind answering a question regarding your estimates?

My VJ Timeline suggests my I-129F NOA2 is expected on September 13, 2007. This of coarse assumes users have entered their data correctly and interpreted the fields accurately.

What are you basing your estimates from? I like your estimate MUCH better, but after visiting the March filers' thread, I think your estimate of my NOA2 will not be realized.

Just curious and not criticizing at all.

Hi Robin, I do not have good data for 129F NOA2 lead time so i did some prem analysis and i am using 120 days for CSC and 140 days for VSC. This is rough at the moment and i will improve it once some of the folks in March and April start getting approvals.

How about this data for an idea, since some I-129F NOA2 data is starting to trickle in for March applicants?

Taking NOA2s received since July 1, 2007, I come up with the following.

For CSC:

Days from I-129F NOA1 to NOA2:
Data points: 224, 98, 141, 133, 133, 132, 105, 112 (8 total data points)
Drop the high and low gives a total of 6 data points totalling 756 days.

Average Days from NOA1 to NOA2 for CSC: 126 days.

For VSC:

Days from I-129F NOA1 to NOA2:
Data points: 134, 105, 95, 93, 123, 133, 111, 87, 125, 105 (10 total data points)
Drop the high and low gives a total of 8 data points totalling 890 days.

Average Days from NOA1 to NOA2 for VSC: 111.25 days.

Using my I-129F NOA1 of 4-25-2007 and adding 126 days, I come up with an estimated NOA2 receipt date of August 29, 2007.

The US marriage certificate, while valid, cannot be registered directly with the NSO without proper endorsement from the Philippine Embassy or DFA. A US marriage certificate is a document issued by another country hence there is a protocol to follow.


Thanks to everyone for your responses. I do appreciate all of them.
After further review, this is what I have decided to do.
I am going to continue on towards the CR-1 interview. We will have the CENOMAR document, but will not submit it, because we're already married. The Philippine law does not require a couple to register a marriage that took place abroad, so we won't have to worry about that part. No need to file a document about a late marriage. We also won't worry about having an authenticated marriage certificate. If at some point in the future we want to do it, we can. She is going to continue using her maiden name, since that is the name on all the petitions, passport and marriage license. In the state of NC, you are not required to change your name. We were legally married in the US and, once my wife enters the US Embassy compound she will be on American soil. So, any certified marriage license from the state/county that she was married in will be acceptable to the US consulate. Both my I-130 & I-129F were approved with the same documents that she will have at her interview. As far as the NBI/Police background check, there will not be any outstanding warrants or such.
So, based on all that I am good to go!!!...

if she fills out any official forms that request information on marriages and fails to report the marriage in North Carolina, she may be subject to legal penalties for putting false information in the form. So when this situation arises she would report the marriage on the form and file the paperwork to report the marriage.
International legal tangles can get really messy since the governments rarely have procedures to allow their court systems to exchange records. blink.gif




Ok...What if I go to the Phils in 2 weeks and get married there?....Would this help?...I would then have cerified marriage..Of course I'd get the Legal Capacity to Marry form beforehand....Would this help my situation with an upcoming interview and the background checks, etc..

The report would normally be filed with the Philippine Embassy in USA immediately after marriage. Since the report wasn't filed at that time, she will file a Late Report of Marriage Abroad when she renews her passport. The Late Report will be included with the passport application as a supporting document.The requirements for a late Report of Marriage Abroad are HERE


I will have to check with the city to find out if they "automatically" forward marriage licenses to the appropiate embassy..If it has been forwarded, then it could possibly show up at NSO on the CENOMAR, but most likely it won't...So I'm in a predicament

Or, should we just leave it the way it is, and that will be no problem with USEM? This question is brought about in preparation for her interview. We basically just wanted to make sure that when USEM runs a background check on her current status and sees that she has registered her NC marriage to the USC, they would be rest assured (no doubts or whatsoever) that it was a bonafide marriage.

(2)Will it be a problem that she is not using her married last name yet on any of her documents such as passport, I-130 application, etc? Most likely change it after all the immigration process and gets here in the US.

I am pretty sure that there will be more question after I hear your opinions, thoughts and suggesttions.

she MUST register her Marriage here in the Philippines and if she wont do that she will have a problem later on because the US embassy do ran a background check at the NSO.

The $2.50 charge is only ONCE a month. If you use the typical service, you have to dial the access number:
704-xxx-xxxx, then enter your code xxxx, then dial your recipient's number 63-xxx-xxxx...which is a lot of numbers to dial. For the $2.50 per month(not per call), all you have to dial is your access number 704-xxx-xxxx, and it connects directly to your recipent. Basically paying $2.50 for your own private local access number that dials straight to your recipient.. Sometimes we talk for 3 hours at a time. The longer you talk the cheaper it is.

I was using calling cards at $5.00 each with 40 mins per card. Sometime I'd spend a $100.00 a month and now....

I pay $59.99 a month and I can call my wife anytime and talk unlimited...I can use a land line or a cell phone. Also, since I have nationwide long distance, I can call her from anywhere in the USA and talk as long as I want.
She can take her cell phone anywhere, and no matter when or where she goes, I can call her.. I have local direct access number.....no calling cards, no per minute charges...just UNLIMITED.. kicking.gif

I live in Charlotte North Carolina....about 4 hours drive to east coast. When I travel to the Philippines, it's USAIR non-stop to Los Angeles or San Francisco, then Philippine Airlines non-stop to Manila. That's about as close as it gets to a direct flight.
