I'm implying it will be more helpful if he's really coming over to Bulgaria and going with Dani to the K-1 interview. Not implying at all that Dani will have her visa refused, only that his presence at the time of interview would be great (if what people in the other thread are implying is true) and considering that this is Shad's second time petitioning someone (which might be a red flag).

Got it.

The answer to the "Has anyone ever filed....." question would be "No" if the only petition ever filed for your fiancé is your current I-129f (which apparently is the case).

My advice is to get married in Canada, and then file for a CR1. If you get married in the States with a visitors visa then you don't need to file anything, just stay in the US and adjust status, but that would be visa fraud because you intended to marry before you came to the States. And yes, you are correct. The K1 is a single entry visa, so if you entered on a K1 you would not be able to leave the USA until your status is adjusted or your AP is approved. Welcome to VJ!! :) Here is a great place to start! http://www.visajourn...mp;page=k1guide You must first petition on your financee's behalf. This is done in the states. After that gets approved they send all the paperwork to Bulgaria. She will then go to a doctor specified by the Embassy to complete her medical. She should have all vaccination records compiled beforehand. The doctor will give her any missing vaccinations at that point.

One thing is for sure this is a "one step at a time process" I suggest focusing all your attention on the I-129F and supporting documents first. If you have any questions along the way send me a PM. I'm always happy to help a fellow Bulgarian :)

Hey, we were wondering what happened with you guys. Unfortunately we don't have a very good advice for you this time. Best thing to do is call USCIS and ask them. I hope someone else here will know more in a complicated situation like yours. Usually you file according to your permanent address - the one on your driver's lisence or other kind of ID. If that's Tennessee then here is your answer but if it's still Hawaii I have no idea. :( Keep us posted on what happens. Good luck!

It is my understanding that it is good for up to 6 months from date of issue to enter US, then 90 days from that date to get married.

If you have a lawyer, the NOA1 likely will go to them.

Before I even knew about NOA1s and NOA2s . . . VSC sent NOA1 to my lawyer. I didn't even know about it until I e-mailed lawyer, just to see how things were progressing, and she mentioned that she had receipt. I guess she assumed one was sent to me, too. I didn't even think to look for it, because approval (NOA2) is all I was looking for.

Because of that, I signed up for e-mail alerts by USCIS.

I hired a lawyer long before I even knew VJ existed, so the dye has already been cast. Not cheap, but with an NOA2 in 77 days I'm not complaining, either.

I guess an interesting poll would be to see whether using a lawyer typically reduces the chances of receiving an RFE (since they've done this hundreds of times, and this is uncharted territory for most of us). Of course, if your petition is done properly you should not receive one. But we're all human, right?

Given what I know now I might not hire one. But I had peace of mind for those 77 days. I can't say I would have if I had done it myself (worried sick that something might have been left out).

Nope, he was born and raised in the UK. I'm worrying about this hopefully more than I need to, but I'd hate to get most of the way through the process and then get denied because I didn't do enough paperwork.

When they're looking at the financial assets, do they look only at current pay, or only at past pay? My tax return from last years posts a gross income of 15,000 because I was looking for work, but this year I have a steady job where my gross income will be around 27,000. I'd really rather not talk my long suffering mother into co-sponsoring me.
