Processing after interview?

Hi there,
My fiance just had his interview in Naples, Italy. They asked him a lot of questions about our relationship that he was not really expecting and then they requested another police certificate from Albania and told him it would be 4 more weeks of processing! If they deny the visa, do they tell you right there or do they send you away and then mail a letter? Do they process the visa and mail that? They said they needed to process some of the US documents as well. What does that mean? We had everything requested including the police certificates. I am freaking out a little. I could really use your advice.

Im not sure about the denial question but I can tell you that sometimes its a matter of background/name checks and that will create an AP of sorts... AP is a standard name for many different levels of checking whether its the embassy checking the relationship, documents etc or sending for name checks. You should be able to call DOS and find out...sometimes they don't tell you anything and sometimes they do. WIsh you much luck...

Noticed a Mistake on DS-230..Already had interview

We also had a small error on our ds 230 but they allowed him to correct it at the interview. They may just simply ask you to resend a ds230 and sign again in front of them.

I-134 vs Form I-864

yes he will be filing the i134 for his k1 visa but islamabad is very strict with income and its touchy for them to accept assets for some ppl thats why i was telling him to be prepared to show good income (preferably as close to 125% as possible even tho he only needs 100% for k1 visa) especially since he will be filing aos after marriage so they will be looking at the long term as well

Yes but be prepared that they make not look at your 100% above poverty line as being enough it may be they still need to see 125% because a couple of months after the arrival and marriage you will be adjusting which requires 125% above

I-134 vs Form I-864

For a beneficiary in Pakistan is it necessary to complete both I-134 and I-864 as part of Packet 3? Or does I-134 (affidavit of support) alone suffice?

idk what your filing for your info doesnt say you may need to update and put that info in so that its easier to answer your questions.

In the meantime i can tell you that the i 134 is for the k1 fiance visa and the i 864 is for the cr1/ir1 visa.

Idk if they both came in the packet you were sent but if they did i would guess you need to fill them both out. The reason for that would be that while they use the i134 for k1 to get your fiance here and marry they also know you wil be adjusting status prety soon thereafter so they actually look toward the i 864 info to be sure you can support the beneficiary.

If they did not both come in your packet then fill out only the i 134 and understand that they may go by the 125% poverty guideline rather than the 100%poverty guideline.........

co sponsor proving income with bank statements/assets...not taxes

i have a few questions for you:

beings it will be my fiance and his son applying for the visa, will they both be charged the amount of $350?
what medical information needs to be collected for his son? will he need a medical exam, the same as his father?
if, my father (the co-sponsor) is self employed and does not file taxes, but can show more than sufficient proof of income through his bank account and his assets, will this be fine?

Why does he not file taxes? If I'm not mistaken they ask for tax transcripts..not sure how many for k1 visa but they do ask for them and if he is excempt from filing them then he needs proof he has exemption and will need to write an explanation as to why he doesnt file.

Really weird but urgent question

I'm not sure how Thailand works but in the MENA countries its hugely important for the CO to see that you have the family approval for the engagement/marriage to a us citizen. I would repost this in your regional forum for Thailand and see what response they give you there. Best of luck!!

All he needs to make is enough to cover you and him and whoever else he claims on taxes. If his job cuts down to part time he still has time to get another part time job somewhere to cover the rest of the money needed for the i134.. or if he needs to get another job completely he just needs to get one that makes more than what you need on the i134

for 2 at 100% for i134 is $14,710 for 125% for the i864 is $18,387 ( I would recommend looking to the 125% even tho the 100% is the requirement for the k1 visa due to the fact that you will have to adjust status after you marry within a few months and that would require the 125% to be used)

That should be pretty easy to fulfill either between one decent job or two part time positions.

You have time until you get to the stage after noa2 and having to fill out the financial forms. Changing jobs won't affect the petition unless you don't make enough or need a co sponsor. i changed jobs between filing and getting to the nvc stage and didn't have any issues. i just put my employer letter, pay stubs and tax info etc into the packet and sent to nvc. There are a lot of ppl who switch jobs or pay during the petition process...

co-sponsor for fiance visa

Hi guys, my fiance has his interview in Kabul in about two weeks, I dont exactly know what things he has to take with him, everyone keeps telling me different things, Can some one PLEASE give me an exact list of things my fiance needs to take with him to his interview??? also I am so worried about affidavit of support, i hear that they might not give him visa because i dont have the requirements and i have a co-sponsor, is this true that US embassy is too strict about I-134???

He needs to take a copy of EACH file sent with all the supporting document copies. i130, i134, and ds230 (not sure exactly what is sent for k1 but we took i130, i864 and ds230 with each copy of each thing we sent)
Take copies of emails, chats, phone records, letters, cards, gift receipts, lots of pictures, any affadavits from friends or relatives talking about your relationship, anything that may show you have a good relationship and its genuine.

The reason I say to take copies of each sets of documents you ever sent is because when my husband got into the interview the CO needed to locate a paper. He couldn't find it and kept searching, finally my husband took it out of his file and handed it to him which helped us to not have to send that document in after the interview was over. We still had to submit one more thing but it had nothing to do with the papers they needed or already had...they only wanted a clarification of my household size.

But dont you think that they may have just missed out on MY i864? Maybe they didnt catch it the first time but if they review it again they may catch it....i mean the interview was the first time they reviewed i864 and they literally took few minutes to go over them...if i submit my i864 now im pretty sure it wont make much of a difference in review time but then again its just my guess. Lets say if i just submit my dads i864A...the only document they asked for and then later on they notice m,y i864 missing...then it will cause even more headache. Which is why im really confused what should i do?

That's up to you but if you had a co sponsor then your income wasn't enough anyway.. your i864 is the fact you are stil the main sponsor but it sounds like they want to verify the i864a of your father... but if you feel better about submitting the i864 of yours as well as the co sponsors thats up to you but it will take time to review... just get the docs together and send them to your wife and she needs to submit them to the AMEX courier with the pink token she was given. The sooner you do this the sooner they can review and issue the visa...

submit exactly what it is telling you to... don't overanalyze this they are being very specific as to what they want from you...

•They gave a blue form to my wife with 221(g) and returned i864 documents to her and asked her to send in the i864A of my dad

Take these documents to the AMEX courier... the beneficiary should have a pink token which they NEED TO USE TO GET THESE DOCS SUBMITTED PROPERLY they need to be the one to take them there ... submit them to AMEX they wil have you sign a paper etc so that you will have a receipt saying you submitted... it takes 1 day for them to get it to the ISL embassy.. then it will take time to review... there is nothing you can do to make it go faster..

They kept my husbands passport gave him the pink token which he used to submit the extra docs.. then the end of the week we got notification they received them and forwarded to the CO... took about 5 weeks to finish the review and now we wait the AP out for security checks.

The longer you wait to submit what they are asking the longer it will take to get the review of the docs and the approval with visa.

He wasn't denied.. basically we're pending ap.... when ap completes then the visa is issued. It took a freind of mine about 3months for them to review her co sponsors info bcos they requested a different one than she had .. It just depends on the CO workload im sure....hang in there submit the new docs and just wait...im sure within a week or so the visa will be issued.

I have never used the courier service....so am i supposed to MAIL it to the courier service via FedEx etc? Or am i supposed to drop it off at their address? Also, is there a requirement for sending the documents to them? Like am i supposed to type my case number on the envelope etc?

My husband had to submit another document to the embassy in ISlamabad... he went in person to the amex courier service used his pink token to submit the documents.. i think they asked him to fill out a paper for the embassy regarding the documents and then they received it within one day and at the end of the week they forwarded it to the CO in charge of our case. It took about 5 weeks total to get info that our review of the docs was complete and our case was fine but namechecks began so we sit in ap since then.

When she submits the documents dont' count on her getting the visa at that moment. They will have to review them and then issue the visa.

It definitely isnt a denial its just a wait until we get this other document

She wont' need another interview but it could be a week or so before they issue the visa once the docs are submitted

Did they request she submit the docs thru the courier?

Islamabad has a tendencey to ask for documents that they already have or maybe they misplaced them... we also had to submit a doc but we were asked to have a letter clarifying my household size... HUH??? we had it the i864 and lots of other info and docs that were sbmitted but they wanted a clear statement... so thats what we did....

You will be fine just do what they ask and maybe within a week or two after she will receive her visa!!! INSHALLAH

Why is this taking so long

To all those waiting for USCIS approval, has anyone have any ideas as to why this whole process seems to have ground to a halt lately. I watched Igor'd stats seemingly fly by for April, but then i noticed a lot of RFE's for May applicants, and now almost no June applicants have been done (so far). Igor says that they are processing for the 14th of June. I just don't see it. I know that all of this info is based on what us members provide, but looking at the statistics on the different pages there is a lot of conflicting info. I know i am impatient that is just me. I just want to know why it all slowed down so much

The average for noa2 approvals is 5 months..

Unfortunately.... sometimes you see a one month approval and sometimes its much longer but if you just received your noa1 in July then you just have to see what happens.. I do know that's difficult you can call them and see where it is if they are working on it or not but just be strong during this time and before you know it you will be thru this whole process and the interview date will be here. Why does the procedures take so longer for some people and for others it's not

I am reading others profile and I am happy for those who are making it through the whole procedures; however, based on what i've observed on here I don't understand how is that I put in my I-129F b/f some people and they received their NOA2 and their packet3 and 4 before me. Once again my NOA2 was approved 6/17/11. He got packet3 August 4 and send it in the 8th, and my fiance and I are still waiting for packet 4 a month after sending in packet 3, and NOA2 expires 17th of next month. Also, I didn't have any problem with my paper works,which means I did not receive any RFE. Can someone please explain how is that possible?

Wish there were answers... we're asking the same questions about our interview and AP! I'm not sure there are any answers ... we never received any RFE at USCIS or the NVC and was able to complete both in a good amount of time LOL but now... we just have to wait .. and its beginning to not be so patiently...its frustrating, hurtful, depressing ... so many emotions go along with this... just focus on your case and be sure your items and documents are in order and ready... keep collecting good proof of relationship and hang in there!!!

Help me!!k1 interview the case been suspended!

Im reading all this and realizing maybe she doesnt just mean suspended maybe its in AP until the new evidence is reviewed etc. Because GOD knows... AP IS SUSPENSION... in a way anyhow...

She is giving you an option to get new evidence of your relationship to them... they DID NOT DENY YOU!!!!! IF they were going to deny you they would have simply said denied on the spot... case closed. Your case is still open and waiting for you to proceed with the new evidence. When they receive this it may take a few days to weeks to review so yes your case will be hanging until they decide at that time.. This is actually good news... as you did not get denied... if your love is strong and this is the man you want to be with the rest of your life then I suggest getting back up off the floor and dusting yourself off and knowing you have a valid relationship whether or not the CO sees it or is having a bad day.

Immigration is a tough road and some of us know it better than others. My husband is from pakistan so we know the first hand treatment of all beneficiaries from certain countries are considered fraud... but our job is to prove them wrong... to show them to make them understand in that short hour long moment we have to prove what we have in our hearts for our loved ones. IT's not fair but it's understandable... we had a lot of proof emails, chats, letters cards phone records gift receipts pictures of us together and together with sooooo many other ppl at different functins and our wedding and reception but you know.. they looked at about 10 pictures... they didnt read about us wanting to start a family, they didn't read about how we wanted to put money aside so we can buy him a car, they didnt read about our small disgreements that all married couples have or the ones about how we long to be together and don't care if its here or there just anywhere we can be together... in that small moment of time we have a lot to prove. Sometimes it works out and sometimes it needs more proof.

Think of this as on hold until they can review your new documents. STay strong, stay focused on what you and your fiance want, stay faithful this will work out and you will be able to overcome this. Wishing you best of luck!!!!

All you can do is take plenty of proof and be sure of the answers he gives thats it... but here on VJ it's well known that the MENA countries ususally see AP after interview, males especially and you will also see that the advice from all over the vj board to never make plans until you have your visa in hand... but if he is from afghanistan then you may be looking at AP for a couple of months at least. I wish you the best hope that doesnt happen

Your case number should be the number you got from either your NOA(1or2) or NVC (for cr1 visas i know its the NVC number not sure about K1)

Has Anyone Waited OVER 5 Months For Their NOA2?

One week from now on September 26, 2011. I will reach my 5 month limit. I received my NOA1 on April 26, 2011. I have still not received an NOA2! I called my Congressman and I have to wait till Monday to hear any news from him about our NOA2.

I am just completely pissed off right now because there's no one to tell me anything on why it's delayed. If I did anything wrong I should received a RFE by now. I have not received anything! I thought I was very detailed in preparing our I-129F. I followed the guides and had a relative (fellow VJer who is in the USA now after K-1 approval) look over our paperwork with me. I double checked, triple checked, I had everything neatly organized and had a table of contents and all that #######. I guess none of that matters... because I read posts on here where people don't even follow the guides and have barely enough evidence get approved in 3-4 months.

Anyway, sorry for ranting... I have not slept well for the entire month of September because of the whole NOA2 mess. My question is...

Has anyone ever go past the 5 months limit for K-1 Visa NOA2 approvals? Did they ever give you a reason for the delay?

There are a lot of ppl who have gone over the 5 month timeframe... im sure it has nothing to do with anything wrong with your files..its just overload of cases to review... don't worry your time will come soon!!! You can always call USCIS and ask about your case to find out where it is if they know..Best of luck!!!!

even if they get direct deposit into their bank account there is still a paystub record whether it is mailed to them or online like mine is to print they stilkl have some kind of paystub showing each pay put into their account...those along with tax records and a letter from your employer stating the salary and that they work for them should suffice that requirement of proof that it meets the poverty guidelines without co sponso

If your fiance meets the guidelines with their job then it shouldn't be a problem. They just need proof of the job with paystubs and a letter from the employer. If the guidelines are met with that income then no co sponsor is needed.

Ah, yes, I just wanted the OP to know that trying to memorize all the answers to all of those questions - when obviously they asked some way-out there questions - would probably be a waste of time, but he should focus on those questions you mentioned. Sorry, didn't mean to reply to your post, but just to reiterate what you said. It can easily be explained why you wouldn't know what your fiance's brother's last movie was, but not easy to explain why you don't know the financial situation of your fiance.

LOL no prob... and to be quite honest.. I dont even know what my own brothers last movie was.. i think they ask things like that to get your feathers ruffled adn then to for the jugler after that...

I know my hubby had a hugeeee interviw lasted almost an hour but he was able to asnwer every single question and baack it up with evidence... that is hugely important as well to give an asnwer and then show proof of it..

Yes I realize that..i think either you got me mixed up with another poster or misread what I was asking...was actually asking about the original questions the OP posted ....

I didnt ask about those questions (about the brother movie etc..) as that would have nothing to do with the denial .. I wanted to know what things he couldnt asnwer or answered wrong and as you see the info that the OP gave us was huge as the financial and professional info which ws what happened... its necessary to know EVERYTHING about the SO...especially for the MENA countries

i couldn't answer the financial and professional questions that she asked me but anything else was fine and i prove to her that i know almost everything about her personality and how she is and her family !!

Financial and professional questions are huge since that is your SO profession and ability to pay monthly expenses. My husband knows everything about what I do in my job, my pay, what days I work, holidays, my boss' name, when I get paid and even everything about our monthly bills, and income whats in the bank etc...

When you decide to refile k1 or if you go the route of cr1 you and your SO must discuss these things at length as it is part of married life that you know all this ... they CO expects you would know these types of answers ...

Go over the questions and the ones you remember, write them all down and discuss with your SO.. then make a decision as to what to do.. if your case went back they may let it expire k1 so you would need to make a decision to either refile k1 or get married and file cr1.

I wish you the best and Im sure you can overcome this... as I said bfore this consulate is a very difficult one but it can work out for you

What did you reply to these questions? what were your answers and how many of them did you know and how many did you not know?

applying marriage visa after denial is not that simple... the moroccan consulate is very well trained to know if your relationship is valid and they want to know that you defintely KNOW each other and I mean VERY well... a marriage visa after k1 denial isnt a simple solution .... you can apply this but if you still cant answer these types of questions then you may be denied again.

I think its very clear the moroccan consulate is very difficult but it can be overcome.. they look closely to see how well you know your SO and if the relationship is a legitimate one...

years address so i did mention my current address but didn't mention the one which has the Address on my

Question about income requirements I-864

Hello,

I have a question about meeting the income requirements. In 2010 I had 3 lazy friends living in my house I bought food for them, provided them with a residence, water, light, etc... I basically supported them. They are all working now thank goodness! Now the issue is I made $30,000 last year and I would love to claim these 3 people as dependents on my income tax return. But then if I do that will that put me under the poverty guidelines since I have so many dependents? in 2011 I will be just supporting myself so I'm in the clear with meeting the income requirements but will 2010 matter? we are not starting the K-1 until February. I hope I do make sense =) I'm currently employed full-time and salaried at $2517.88 per month. Please help =)

Did you claim them on your tax return? If they file taxes themselves and claim themselves then you can't use them as dependents...it's all about who can claim whom...you may have paid their way but unless legally you were able to claim them on your personal taxes as dependents then that shouldn't show.....and i'm using my children as example for this...i have the legal right to use them as dependents but my ex husband can't...because I already do. Someone correct me if I'm wrong please...Good luck!

Question about Sponsor's Income for I-864P

I guess I'm a bit confused...I just did my taxes for 2009 and i make enough but i got a different job for this year so i know i will have to use that for current income but since its a new year...income isnt so great lol...only bcos it shows the first month of pay...so what do i put for current income? I know i can get letter from employer without any issues...but can i list what the projected income is? or do i only list what ive actually been paid?? this confuses me

TX lockbox received application Monday morning....And I just received the NOA1 e-mail this morning!! I guess this means my fiancee should start collecting evidence etc for the interview, correct? Is there a check list that I can send to her so she can start collecting all the documents for the interview? Is interview the packet 3 thing everyone talks about? Any help would be appreciated. hang on...your i 130 was only accepted meaning it will be processed..you still have to have the final approval...then you submit your evidence...however that said you can work on collecting evidence over the next 5 months because it seems it will be taking about that amount of time if not longer for approval...

Once your i 130 is approved THEN you submit evidence and they arrange an interview...

that's really odd... yeah here in NC you have to be separated at least a year which we were actually separated a year and half before the final decree...and the day that is signed we are too granted permission to remarry... I can't think of anything you can do except maybe have the courts notarize something else saying it is final and you are no longer married per the date the divorce decree was signed...

Wow...that's interesting because I also have a divorce decree that was signed the date the divorce was dissolvd n the courts and we were officially no longer married after a year of separation... I think it too states judgment of absolute divorce but its stamped and signed by the court... Is that similar to what your speaking of? Other than that..I wouldnt know what to include as proof i am divorced because that's what we were told to use by the attorneys as final divorce proof. Keep us posted...sorry I don't have any answers but good luck and hopefully they will take the info you're sending.
