Hey again,


I've been going through old documents, trying my best to build a strong case that my fiance and I have indeed met before. As stated in a previous post, we don't have our physical boarding passes/baggage tags-- because we had no clue that we'd be needing these things in the future.

Anyways, so in total-- I've gone to see her 5 times in the course of 2 years, and she's been able to make the journey up here 1 time (our last stay together). In your experience what would you say is a better approach? (Our goal of course is to do this all in 1 shot without an RFE)

- Concentrating only on the 2 visits required, and providing as much information possible for our 2 strongest cases.

- Or showing a moderate amounts of proof for all 6 visits (though we don't have enough primary evidence for all 6 cases, other than our visa entry stamps)


Also, on another note. My fiance is the one petitioning for me, and I know she has to send her birth certificate. I haven't read anything in the VJ Guides about me having to send mine, but when I read the RFE thread-- there were some cases where people said "Make sure to send the beneficiary's BC as well".

IF this is true, should I send my original or just a copy?

Heck while I'm at it, should I be sending the originals of ANY of my documents? (Other than the obvious forms where they need to see an original signature like the G-325A).

Uhm.. and another thing! I downloaded the G-325A form off of the USCIS website, but it says it expires August, 31, 2012. Is this a concern?

Question 1 & 2 - I would just put your parent's address - that was your permanent residence - dorms are just temporary. For the second part - yes your parent's address then.

For the employment part - I would just attach a page referencing the question number on the application - make sure to put your name on there, the application number and question number

Yes, check off other and write I-129F

the NONE and N/A seem fine.

Oh hi there,


This thread is mostly for peace of mind. As I'm finding it hard to send this form off to my Fiance until it's reached perfection. Yes I've read the example sheets, and yes I've searched the forums for answers. As I said, this is more-so for peace of mind that I'm doing things correctly. If I could get responses from more than 1 person as well, that would be great :).

So, for the below situations-- keep in mind that I am the beneficiary, and this is the G-325A form that's filed alongside the I-129F for our K1 Fiance package.

Begin.


1. Applicant's residence for past 5 years.

Would I include a college dorm address that I stayed at for 4 semesters (I came back home for the summer both times) even though it wasn't my "permanent address". All of my mail still went to my parent's house. And if I do have to put my college dorm down, do I also state that I was home for the summer?


2. Applicant's last address outside of the U.S for more than 5 years.

I, the beneficiary, have always resided outside the U.S . Do I just repeat my the same address in the question above? (If I was there longer than a year)


3. Applicant's employment for last 5 years.

Correct me if I'm wrong, but it's my understanding that I have to state employment dates, as well as unemployment dates? 5 years ago I was fresh out of high-school, didn't know what I wanted to do with my life, and had a new job every 3 months. I know for a fact I'll need an external sheet of some sort. Would it be fine to say "See attached page" in the first blank for that question? And if I were to include an external page, what's the best way to label it correctly?


4. Last occupation abroad if not shown above.

Would I also say "See attached page", or would I just write down my most recent employment even though it's on an external page?

5. This form is submitted in connection for an application for : ?

I've seen some posts say to check "Other" and write "Form I-129F" in the space beside it. And I've seen other posts that say "check status as permanent resident". Which is correct?


6. Signature, as well as the box under the word "Applicant" at the VERY bottom of the page.

From my understanding, I fill out both on my form-- and my fiance fills out both on her own G325A form. Is this correct?


7. Where to put None, and where to put N/A.

Area's where I put "None": File Number, U.S Social Security Number, Current Husband/Wife, Former Husbands/Wife, Alien Registration Number.

Area's where I put "N/A" : If your native alphabet is in other Roman letters.

Correct?

The information on the DOS website is correct in regards to passport photos. You're fine

Birth Certificate for the Beneficiary is not required to be sent in to USCIS with the I-129F petition.

Hey there, quick question.


My fiance and I are unsure about something. I read ( http://travel.state....toreq_5334.html ) that my passport photo is fine as long as it's taken within the past 6 months. But my fiance said she swore she read somewhere in her part of the forms that it has to be within the past 30 days.

I've already sent her 2 different packages via express, and we both kind of want to avoid it a 3rd time if we can. The passport photo's we took were done Nov 27, so about 5 weeks ago.. is this "too late"?


And on a side note, do we need to send a copy of my (the beneficiary's) birth certificate in with the package? I'm seeing RFE's all over VJ about this issue, but I'm not sure if that's for the I-130 (my fiance is filing for the I-129F)

Same thing pretty much just happened to my fiance in Napoli. We would have NEVER done the Fiance Visa if we knew this would happen. I have a job and make above what is necessary to support him but I only have been working for a few months as I was living the year before that with my fiance in Italy. Our joint sponsor also make more than double the amount of the 125 percent above poverty level. We are still pursuing it and I am going to my Congressman and if necessary we will hire an attorney. It is very deceiving and I am so very disappointed in this system. How do they expect me to now leave my new job and go to Italy, get married, return and wait the 1 to 2 year wait for the spousal Visa???? There has to be a better solution!!!


Wait a second. You made above the 125% mark, and they can still reject you for that reason?


Someone please bring clarity to this for me, as my fiance just barely makes above the 125% mark as well, but we figured we'd be okay. Should we get a co-sponsor just in case? Or will that only give them reason to reject us?

Yes, I'm the beneficiary, and we've applied for the K1 Visa.

 

I've called around, and it's hard to get a definite answer on this. It's part chartered accountant territory, and part US immigration lawyer territory. But I've yet to receive any closure haha!

It's very common for people to continue making business calls/emails when going on vacation in Florida or wherever, even when their business is registered elsewhere. I'm not sure, it's such a gray area.

Hey there!

I'm a late January filer, and am hoping to hear back any time now about our package. I have a few questions that I hope someone can shed some light on!

Back when we first filed, I was unemployed for about 2 months-- and for the most recent employment state, we listed "unemployed". Over the past few months I've been doing training to learn how to market online, and have started producing an income from it. I registered a business last October (before filing), but I wasn't considered as "open for business" yet since I wasn't pursuing it yet since I was still employed at that point.

My questions are:





 

1 - Since I'm now making an income, does that jepordize our current package in any way since our most current status said I was unemployed? (All the way back in January)

2 - If my income is deposited directly into a Canadian account, and I'm paying taxes to the Canadian government (doing everything under my Canadian Business name), would I be allowed to continue doing business in the U.S since everything is online?

Your friend does not need to wait for the embassy. The info packet is on there website and it is the same documents they send the fiance. My fiance did the medical, background and other documents before she even recieved a notice from the embassy.


I agree, you do NOT need to wait for the Embassy to notify you. Download the package from the website and have your fiancee' start filling them out. Also you can e-mail the Embassy and ask if your case is already in the system and if so, contact the "call-center" in Poland (number is on the Embassy's website) and schedule your fiancee's interview using your case number (should start with KEV-.....). The Embassy in Kiev updates their system with new applications only on Fridays, so if your petition is not there yet this week, wait until Monday to contact them via e-mail again.

In addition, the VSC had an all out effort on I-129fs at the end of September to get caught up from a year of remodeling, (see the pinned topic at the top of the forum with my discussion with the Directopr of the VSC) moving about 100 people to another facility etc. They have now moved on to other visas (still doing I-129fs, but not in the concentration they were) and should be back to a more "normal" time frame, which before their problems was running 3-4 months.


thanks for the update...just as i though i missed the push and now holiday and "winter fun" is here... i guess that is why i live in warm climet and not worry about such cold wet snow. YOU can have!!!

does anybody know if all starts to slow down during this time of year? by many timelines and postings k1 visas was being sent to kiev in 60 to 75 days. but lately i noticed all starting to move very slow again. painfully slow for all of us

is it normal for end of year slowdowns with all the holidays happening??

on pakcage 3 you know you can go to the embessy site and download it and speed up the process?!! i did that last night and will forward it with a checklist kiev provides and now while we are wating on the gov't to send things over we will have all read for interview and make it fast and smooth.

for us i only have few times in april to go to the interview and she finishes univ in may. so we are trying to fast track as much as possible to have my love her for june!!!!

it moves pretty fast now! with in 2 weeks kiev will have the case and once you get the number you call poland setup a interview date. (you buy a pin like 20$ for i think 3 calls forget) i choose to attend the interview to make sure there was no problems! your lady will be well above super nervous!!!

if she knows no english and u do not know russian or ukrainian, the question arises on how you communicate with each other. that is the only problem. she can take interview in russian or ukrainian, because if she will be nervous and misunderstood something, that is not the problem. they may challenge if nobody knows how to talk on any level.

We got a multi entry visa for my mother n law. but to make it easier we sent her on small holiday to 3 countries that requires a visa first. on bus tour to Italy this past summer. i not know if that was factor but she got visa on first try. the hard part is air fair here now.

also if your wife can show a new job or her current job paying more in the future, ie starting a new job, you can use that income to change the math in your favor. also if you have a job now you can add that income in to the pot so to speak. it is base not on past income but on what is being made now. so any change in jobs for more income is what should be shown backed up with employment letter and so on

no photos no loving calls, skyps, yahoos, anyting like that just send me money or i will blackmail u. she will not ever get in!

you need to cancel all and provide some of this as your proof to make her life harder in futer for another visa.. stand up and be a man and protect yourself :thumbs:

i see some military people replayed. yes go to base and find out what help is there and have them walk you through the process. also many military people here that will help you out also

also remember your husband has to start any process he is asking for you to come over. even thouhg you are married he still has to ask.

enjoy live with him and this is just one more step we all choose in marring somebody form diffent country.

i think you learn the person so much more. and set up better line of communication.

i suggest to leave this crazy woman alone and divorce before she tryies to get you involved with this child.

sounds like true father of child is married or someting like will cause him much problems if found out.

you rely do not need this problem and i doubt if she turly loves you. that is relay we get married for love and desire to be with somebody you care about and cares about you. this one cares about her problem and you can fix it and she saves face.

I am working as a social worker and many Filipinas dont know what they are into. I agree with the Office of President making this department in support of Filipino migrating abroad. I dont know why some find it scary... maybe it depends on the person. I may say it is informative and empowering rather than what other people perceived it to be.

Then why can only filipinos attend these "seminars" My fiance'e is scared enough as it is, coming to a new country and leaving her family and all her friends, why the scare tactics I read here on VJ that one interviewer asked one lady what size underwear her fiance' wore that is totally uncalled for and out of line. The more I read here the more I believe the only way that I will be with my Marissa is if I move there everywhere I turn there is one more form to fill out or one more fee to be paid or one more interview to do I should have married her there then I could get her here quicker, actually I should have never got on that plane to come home. Obama says he wants family unity but seems like he is doing everything in his power to keep us from our families! oh I fotgot we are US citizens they don't have that program for us, only for the "illegals".
