Thanks again everyone. I've talked things over with my fiance, and we think we may try and go for the spousal visa as the majority of you have suggested.

My fiance is really bad when it comes to going through customs-- she's worried that she'll mess up going through and blow our "back-up" if the US rejects our IR1/CR1 application. So with that being said. We were going to try and look into a destination wedding.

When applying for the IR1/CR1, does the marriage license have to be the native country of 1 of us in order for them to even consider it? Do we HAVE to get married in either USA/Canada (in our case) in order to be considered for acceptance? Does anyone have any cons against a destination wedding? We were thinking somewhere we could get a good deal on a vacation package like the Dominican or something.

Is there a number I can call or something to see if I'm screwed? If I call Border Patrol at the airport that questioned me, will they know the status of my case? Or is it up to a higher power?

If you get married in Canada you will go through the CR-1 process. If you do this I suggest you make sure you BOTH get Marriage Certificates.. one for each of you. You'll need one for any legal/financial transactions needed in Canada and she will also need one when she files the Petition for your immigration. Also..suggest you complete two copies of DS-230 (Part 1 only) and G-325A (for you, she will generate her own G-325A for the package going to Homeland Security, USCIS).
Generate and print them out. BE ACCURATE ON ALL DATA! Double and triple check everything is correct!!! You need to sign and date those after your married and she brings them back to the States with her.
Doing this will save you time and postage later. Sign and date both of each of them in case your Wife has some unforeseen event like a coffee spill or whatever.
I married my Wife in her Country on a Tourist Visa to her Nation, and this is common. The other process (Fiance' Visa) is faster at first but has more steps involved and expense later. Not good or bad, just different. A big plus is that your green card will arrive quickly using the CR-1 process. You will be able to get a job or own a business much sooner in the States using this process. You will have more time apart until you get your Visa. Bummer; but it's part of the deal.
If there were any "flags" because of your ignorance of the process at the Border your Lady will be allowed to file an explanation on your behalf. The fact that you are now aware and willing to follow the process should go a long way to success.
It is important to ask this next question. Is she a Citizen born in the States or a Naturalized Immigrant? If so your ok, if not then your not going to get through this until Naturalization is complete for her. Only US Citizens (Born or Naturalized) are allowed to Sponsor. Very important to know and follow the laws..and much pain has been caused to those unaware as you discovered.
Ask your Lady to join in here at the Forum. There are good people and much assistance for her here. Many years of experienced people who will help you and her every step of the way and that have been through or are currently going through the Visa Journey. Don't worry too much...just do each step as the law says from now on and be patient. The process works if you stay on course. Welcome to Visa Journey. As bad as this sounds, they gave me a piece of paper when turning me away. But when I went to grab my bags and put my coat on, I think I left it on the chair. I was in such a state of emotional turmoil that I couldn't think straight. Is there a number that I or my fiance can call to find out?

They got a picture of my face and had my fingerprint's done. And I think they had me sign something as well.. I just can't remember clearly. So I feel like it might be a big deal..

not if she doesn;t stay in Canada to live, no. She will be returning to the US. I married my husband in his country and returned to the US to file everything while he stayed put.


Interesting! I do like the idea of being able to work right away/leave in case of emergencies.

In my opinion it is not the 'intent to marry' that caused the problem. The one way ticket and the documents you had said 'intend to marry, stay and adjust status'.

Hello there,

First off, I'd like to say hello to the VJ community-- as I'm completely new here. I've read so much on this site about the Visa process over the past few days, I feel like my head is going to explode! Well I guess I better start explaining myself here.

Me and my beautiful U.S lady have been together for the past 2 and a half years. Back in August 2012, I finally popped the question and now we're engaged to be married. Now, as the title states-- we were both very uneducated in how the immigration process worked. My "school of thought" was to take advice from those who'd undergone the process successfully. We got in contact with 3 different couples who now have green cards. And unfortunately for us, they ALL gave us this 1 piece of terrible advice.

"Just get married when you're already over the border. It's faster, you get to be together during the waiting time, and it's one less step where they have a chance to deny you."


...I bet you can see where I'm going with this story.

We weren't told it could be looked upon as immigration fraud. We were told it may be slightly "frowned upon" because you're skipping a step-- and that we might have to provide additional proof to prove of the relationship's legitimacy. Which was the least of our worries, considering we have flight tickets, pictures, passport stamps, and pages and pages of emails telling each other how hott we think each other are.

So with that being said, we never even attempted to hide our "intent to marry". My fiance and I plastered our Facebook wall's with countdowns and gushy text. With the help of Pinterest my fiance planned a full-fledged wedding in only a couple months, and we were ready for the big day in December of 2012. So I purchased my one-way ticket to the U.S-- packed my bags to leave forever, and made my way to the airport to what I thought would be the beginning of a new life.

Boy was I wrong.

I reached the USCBC at my local airport, and told them I was going down for 3 months to visit my girl and her family. They saw that I had previously gone to visit her in May for 3 months as well and were quite suspicious since I only had a one-way ticket. They brought me to the back and started drilling me with questions about where I was going. One officer opened my bag to find a file-holder of all my life's important documents (Record of Employment, T4's, Diploma, etc.), and sitting right at the very front of all these files was the only tangible evidence that I did in fact have a wedding to attend. Me and my groomsmen measurements.

Officer: "What are these?"

Me: "My tuxedo measurements sir."

Officer: "Oh? Whose wedding?"

Me: "Mine sir."


A long 2 hours passed by, followed by tears of reality-- as I tried to plea my case to the officer, and then his supervisor. That was it, I was told that I would never enter again unless I could prove strong ties to Canada. Or, went the route of a K-1 Visa. The hardest thing about it all though, was the phone call I had to make to my sweet American girl-- telling her I wouldn't be able to make it to our own wedding.

So here I am now, a part of the VJ community. Hoping to God that applying for a K-1 visa is still possible, and hoping that the pile of proof we plan to provide with our application will be enough to override the current red flag placed on my head for access to the States.

Does anyone know if my efforts at a K-1 Visa will be completely in vain? Or should we scratch that plan and have her move to Canada instead?

lovelylovegia, they should have definitely notified you that they received the RFE by now. Honestly, I sent in my RFE reply overnight shipping through USPS and I believe they sent me a notification the next day saying that they received it. I would contact the USCIS and talk with the second level (first level don't have too much power) and ask them if they have your reply on file so you can know if anything is required on your part. Good luck!

 

 

Thanks for the words of support, Brent! I had the same thing happen to me, they notified me on May 15 that they sent me another RFE but I'm still confused on whether that really is the case? Takeo was saying that sometimes that is done in error on the USCIS part. I think it would be a good idea for you to contact the USCIS on their number and make sure you talk to the higher level (second level) guy/girl and ask them whether this is the same RFE you received before or if it is, in fact, a new RFE. I haven't received my NOA2 yet they had received my RFE reply on May 9. It is definitely nerve-racking and frustrating sad.png Good luck buddy

K-1 Fiance(e) Visa Case Filing and Progress ReportsApril RFEs

Hi Everyone!  My wife received an RFE notice on April 23rd.  They lost her medical exam DS forms and wanted an updated g-325a.  She ended up taking another medical exam to get her I-693 and sent it all in asap with a receipt date of May. 6th.  We were looking forward to approval as this RFE was pretty straight forward and easy. Last week, however,  on May 23 my wife received an email notifying her a second RFE has been mailed.  Talk about a riding a roller coaster this has been crazy!  We should receive the hard copy today or tomorrow.  I am leaving around June 10th to catch a ship overseas so hopefully we can get my wife's new RFE sorted out before I leave so we can have piece of mind.  This has been nerve racking lately.  

 

Anyways congrats to all of you who have been approved and wish those still waiting like us best of luck.

More tips on the interview below??

1. Speak slow, and answer questions in detail. Stick to the question and don?t veer off the subject. Respond clear, and descriptive. Should not be longer than one minute to answer, but be sure to explain yourself.

2. If you do not know the answer to a question, do not lie. Say, "I don't know the answer to that at this time." or "I don't remember."

3. The answer to many questions will be in the papers that were sent in the petitions. Questions like, "what are your wife's parent's names". They will expect you to know the information given in your petitions. Review everything in your paperwork with your husband before his interview, and do a mock interview to see how the information may be applied.

4. Avoid saying "I think . . .". Women do this a lot. The examiner will expect you to know not be unsure, of your answers. Alwife, avoid adding "umm", "you know" and "ahh" type fillers to your speech.

5. When applicable, don't just state, demonstrate. If the examiner asks a question that can be answered with a document or photograph(s), provide it along with your answer.

For example, if the examiner asks, "What does your family think of your wife?", give them a picture or two with your answer; "They like her very much. Here is a picture of her with my mother at my home."

Or, "How many attended your wedding?" Answer, "(give a number, then say) We have wifeme lovely wedding photos of our guests having fun. Here are a few that I can show you."

6. Give American answers for dates and times. 12/24/07, not 24/12/07.

7. Dress well, but not overdressed.

8. Try to appear calm, well organized, and friendly. Nervousness raises suspicions.

9. Remain focused. If the examiner makes jokes, smile and enjoy, but do not make jokes too.

10. Make proper eye contact when conversing with the examiner, and try to control your own facial expressions assure that your face remains pleasant and cordial.

11. Be audible (means speak up) your examiner doesn't have to ask you to repeat your answers.

12. Organize your papers in a way that will allow you to retrieve them easily and quickly. Examiners appreciate order and someone who doesn't waste their time.

13. When the interview is over, always ask for the results. "What should I now tell my wife about my visa status after our interview?" Before you leave, have them explain any papers they give to you and/or any procedures they will be taking to complete your case. Try to get the examiner's name for future reference, if needed. Write it down. Remember to verify the phone number so they can contact you to pick up the VISA.!@! hurray@@!!!

14. Arrive early to the consulate, but always be prepared to wait for a time past your scheduled interview appointment time. Be careful of thieves around the consulate if you have to carry cash. Bring ID; you cannot enter without it.

We called and they said nothing is wrong with our application and they are putting in a request for the bio. Also gave us another tracking number that people recieve on their bio appointment form. It actually works when you enter it online. Hopefully that will get something going.



Good for you! We called USCIS and person just said that everything is fine with application and that we should get BIO in the next 10 business days...

Hey again!

I need to make this post for the sake of my sanity-- as my interview in Montreal (K1 visa) is only 3 days away and I'm worried about forgetting/overlooking something I need. Here's what I have:
 


 

I. Loomis/CSC Appointment Info

  • Appointment confirmation email
  • CSC "Fiance- K1/K2" details print-out
  • CSC "Register for Courier Services Only" details print-out

II. Packet 4 Contents

  • Passport & Photocopy of Passport biographic page

That's pretty much all I've got, and I've made 2 sets of photocopies of everything (one for the interview, the other for my filing cabinet)  Some of our relationship evidence is a little older now since we haven't seen one another for a year and a half now (as we kept under-estimating how long this whole process would take for us).

Does anyone see anything in this list that I'm missing that I'll most likely need? Any tips or advice given is GREATLY appreciated! Sooo close, and sooo nervous haha tongue.png

When I opened the mailer, there was a big brown envelope with a piece of paper taped to the outside.

It read:

IMPORTANT NOTICE





 

"This envelope is part of your visa and must not be opened for any reason by anyone other than an official of the United States Government. Please present your passport and this sealed envelope to the U.S. Department of Homeland Security Officer at a United States Port of Entry."

THIS ENVELOPE MUST BE HAND-CARRIED
DO NOT PACK IT


DO NOT OPEN IT

I know there's something I'm not allowed to open. Is that the Loomis mailer itself? Or is there an envelope inside the mailer that I can't open?

CanadaDouble checking documents for interview + a few questions

Hey there,

My interview was 8 days ago (in Montreal as well). They didn't ask me for the DS-156, the 156K, or even the 160 confirmation page. I think the reason was as you said, these documents were already sent off with Packet 3. But yeah, doesn't hurt to bring them just in case!

As for the receipt, there was a page that says "Your transaction was approved. Thank you for your payment.." etc etc.

Maybe just highlighting the MRV Receipt # on your loomis detail page and showing a credit card statement to prove payment if you don't have it? Someone else might be able to confirm that!

I stapled a ziploc bag to a sheet with the photo's in them-- but the officer just took them out and passed the sheet with the bag back to me haha. So just bringing it in the costco sleeve is fine tongue.png. I wrote my MTL# and name on the back of the photos.

Also, you said your fiance has only been living in the U.S for a few years? I'd bring a photocopy of your fiance's birth certificate/passport to prove U.S status, and anything you can to prove his U.S domicile. I don't think I see that on your list.

All the best at your interview!! Remember to breathe. You'll be fine, they're actually quite nice.

CanadaWhen to sever residential ties to Canada?

Hey again,

Another question for my fellow Canadian immigrants tongue.png. I just finished my taxes yesterday, and was told that I need to make sure I fill out this CRA form (NR73). Though after doing some reading, it seems a little extreme.. especially since I'm only coming in on a K1 Visa, and technically don't have permanent residence status. I kept trying to explain that I might be in the U.S, but I'm not officially a permanent resident till I have a green card.

 

Am I supposed to wait till I have a green card in hand, after AoS, before filling out this form/severing my ties to Canada?

I've got both good, and (possibly) bad news.

The good news, is I just POE'd at Peaceful Bridge (Ontario - Buffalo) and have my I-94! (Sitting in the Buffalo airport right now haha)

The bad news, is the officer said he asked his supervisor if he could photocopy my medical records for me, but was told I wasn't allowed to have a copy of anything in the sealed envelope. He said everything gets forwarded to Immigration Services anyways.

Is this going to be an issue for me? Was I supposed to have a copy of the medical results (in-hand) after my POE..?
