Be prepared for a long process. Currently, I-130 are taking about 9 months to process at USCIS. Then it goes to NVC - could be another 3 - 5 months before it is forwarded to Manila - another 2 - 3 months. Everyone's case is a little different. USCIS got bogged down with Obama's pet project called DACA (Deferred Action for Childhood Arrivals) - which, effectively, put US Citizens and their spouses/immediate family members on the back burner while 521,815 undocumented residents in the US got deferments of deportation and Green Cards in the past 1-1/2 years!! More of this sort of thing is likely to come - Obama isn't finished with playing with Immigration. So, get your paperwork put together. You do need a copy of your NSO Marriage Certificate...it took us 4 months to get that...supposedly "expedited" service. 

 

As others have mentioned here...there's a lot of help and resources available. Unless you don't feel comfortable doing this yourself, don't bother with an immigration attorney...unless there's something quirky - such as overstaying a visa or having been denied a visa for false statements or something...everything should go through pretty easily. Triple and quadruple check that you've properly filled out the paperwork and included the required documentation and signatures in the right places.

the time is ok for now due to the fact it gives me more time to save for her arrival.i want to have as much money saved up as possible for when she is here especially with the economy the way it is.time goes by fast for me anyways :) my wife has our marriage license.i dont know if she can apply for another one.im assuming she can go to NSO to do it.we went there when i was there to get some paper work she needed.her mom can go with her.she always helped us before.i know the sooner i start the process the better.we got married in november.so its been several months and its time.i also have someone coming here in march so im hoping all paper work can be ready before this woman leaves and can bring it back/her husband lives in same apartment complex as i and my dad works with him.i brought her a care package and gave it to her at the airport when i landed so it shouldnt be any problem to bring me paper work needed :) i had a question.but i forgot.my dad ios calling me to help get things ready haha

shes still in the philippines.i will check out the link.a friends wife i met up with in manila when i was there will be here next month so i can get her and her husbands help.but for now i want to get the visa started.so i will surly check out the link :)

If you fill in your timeline accurately you can get an estimate by the forums (at the bottom of your timeline when you view it) based off of others' information.

VSC is slow to begin with disaster that hit that coast recently they may be more backed up as of right now.


My timeline is filled in accurately, the forum provides the following estimate.......

"Based on timeline data, your I130 may be adjudicated between November 4, 2012 and November 23, 2012*.

If this date range has passed or your application is past due per USCIS processing times then you should consider calling the USCIS to inquire on your petition. If you have been approved please update your timeline."3

I clicked on the "Processing Times" link http://www.visajourn...m/content/times .....

Selected the CSC office and clicked on "Get Processing Dates" button....

But there is no information on this chart pertaining to an I130, filed by a US Citizen filing for a spouse.

So, here I am, way past the "Estimated Date" by the forum, no information on the USCIS website for the type of visa I submitted, am I missing something?

No it has got nothing to do with that! When you two go to register your marriage in Persian way, you will only have your name registered in her Certificate of Birth and her Persian last name will not change in her Persian ID card because in Iran we do not change our name after marriage, so all the documents which are to be used in Iran only, like her Persian passport & ID card will have her Persian name (maiden name) - But here in the US, she changes her last name to your last name and her ID card, driver's license and in the future her American passport will have her new American last name!
So as you see, the documents which are to be used in Iran have her Persian name, and the documents which are to be used only in the USA have her American name... it will make no conflict!

She wants to change her last name to mine when we are married in the USA, how does that work with her current Persian Identification Card? Will there be any conflicts with her last name changing? Her current Persian Identification Card has her listed as single, never married, although she was married for a short period of time 23 years ago.

There won't be any trouble. She will enter Iran with her own Persian passport in which her maiden name is written. But if you want to be able to go to Iran together with her, the story changes and definitely she knows about it so good! I'm talking about having you registered in her Persian Identification card. In Iran, a birth certificate some how looks like a passport, I mean it has some pages that each page has a different usage. One of the pages is for registering your spouse name in... if that page is blank, you are still single! I do not have my husband's name registered in my ID card yet, but I suppose we have to contact The Foreign Interests Section of the Embassy of Pakistan in Washington DC, which acts as protecting power for the interest of Iran in the USA to learn about what to do! (Iranians please correct me if I'm wrong)

Help, I'm looking for some insight.

My girlfriend, soon to be wife, is an Iranian citizen with an Iranian passport.
She has lived in Sweden for the last 22 years, she is also a Swedish citizen with a Swedish passport.
We will be living together in the USA after the IR-1 / CR-1 process is complete.

I'm not familiar with Iranian culture & customs so my questions are as follows.......

Are there any special requirements on our part to visit her family in Tehran as a MARRIED COUPLE after the IR-1 / CR-1 process is complete?
Will we need to be married a second time in an Iranian Embassy or equivalent?
Will she need to retain her own surname?
What affect will her changing her surname to mine have on reentry to Iran?

If she changes her last name to mine on the American Marriage Certificate will she still be able to travel to Iran to visit her family?

If she does not change her name on the American Marriage Certificate, maintains her maiden name, what affect if any does that have on our IR-1/CR-1 application? Will it cause delays, suspicions, or investigations?

Only problem I see is if you don't have a Muslim ceremony the marriage won't be recognized in Iran.


We are planning on a Muslim ceremony sometime in the future, preferable in Iran with her family, after our marriage in the USA.

I was informed that she need only register my name in her Iranian Passport/Birth Certificate to be recognized as her husband, is this not true without the Muslim ceremony?

While it is possible, the scenario you illustrate is illegal. You can't come on a tourist visa with intent to marry and adjust status. If there is any whiff of that (like possibly posting that intent on a board somewhere) and you get asked, prepare to run into major problems. It has happened that people came to the US on tourist visas, married, and adjusted status. It's the intent that is the biggest problem, and the intent you have is to commit fraud.

Go the legal channels, it is the safest and least expensive if you were to get caught. The legal route can be a tough wait with time apart, but having it done legally offers a lot more certainty that you can be together without raising the government's ire.

The number at the top is your naturalization certificate number. The registration number was your A#.

This is probably a rookie question with a simple answer.....


The I-130 application asks for my naturalization number, there are two (2) numbers in the upper right hand corner of my "Naturalization Certificate", the first number is an eight (8) digit number, the second number below it is a "Registration Number", it starts with an "A" and is followed by nine (9) numbers.

Which number do I use?

Also, the first box on the I-130 asks for "Name (Family name in CAPS)", is this the only part of the form t be filled out in CAPS, or should the entire form be filled out in CAPS?

Hello fellow VJ members, I have reviewed the example forms and guidlines here on the VJ forum, as well as those on the USCIS website for both the I-130 and G-325A forms, and have the following question.

It is stated to leave no question unanswered, if the question does not apply it is to be answered with "None" or "N/A".

If my wife has no middle name, do I leave it blank or do I use "None"?

I don't want the USCIS thinking her name is "Last name", "First Name", "None".

Example... Bunny, Bugs None.


Perhaps this is a silly question, perhaps I am being overcautious, but I just had to ask.

You advice has been extremely helpful to me in the past, not only by your replies to my questions, but also by reading your replies to other questions asked on this forum.

My situation is similar.
I-130 filed, still in review process, no updates so far.
My wife wants to travel to the USA from Sweden so we can vacation together in Mexico.
If I'm understanding the process properly, she needs bring proof of strong ties to Sweden and her intent to return to Sweden after our vacation.
Proof of strong ties can include proof of car and property ownership, current employment, current bank statement, etc......

Just my opinion, but why would anyone jeopardize the I-130 process and forfeit their rights to immigrate to the USA by not returning to the home country?

Is there a phone number or website link, either here in the USA or in Sweden, that my wife can call just to put her mind at ease about this subject?

Get married, make sure she leaves before her i94 expires so she doesn't overstay which means troubles in the future. Start the process asap after you get married taking advantage you are together and make sure she's home to get her medical exam and blood test and interview scheduled, etc...

Let them know she will be returning home for the interview in her homeland.

Let us know what the USCIS Customer Service line tells you. Don't settle for the word of the first person you talk to. Request to be escalated to a tier 2 rep who can see more information about your case.


I received yet another notification from USCIS the following day, see below, which prompted me to call and discuss the notifications with them, I was forwarded to a tier 2 rep, she told me they were experiencing issues with their notification system and to disregard this notification and the previous one.

She informed me she was the rep handling my case, no additional information is required, and that everything was on track for completion within the normal six (6) month processing time for an I130 at CSC.

You were supposed to provide that A#, which is on your certificate of naturalization. Perhaps someone looked it up for you, which is pretty nice since you could've gotten an RFE for that.


I inquired with USCIS about that when I was filling out the I130 paperwork, they directed me to only include my Naturalization Certificate number.

Your response prompted me to dig up a photocopy of my surrendered Permanent Resident Alien Card, the "A" number on the card matched the "A" number I used when filling out my Naturalization paperwork, but it does not match the "A" number on the USCIS correspondence to me, and neither match the "A" number on my Naturalization Certificate.

I could have bigger problems on my hands than not putting it on my I130 paperwork.

yes that number will always be with you, however the message that you got on the USCIS page has to do with your petition for your wife, they have assigned her an alien number and that's why it says that it's been changed, as mentioned before mine said the same thing, on the approval notice my husband's alien number was the same as we had filled on the I-130 but now they had given me a number! I think it's a good thing and that you will be approved soon since you've also been waiting for a long time.

I had the exact same message, my husband is also a USC and we were also very confused and worried when we got this I know a few other ppl on VJ that got this message, but after I think a week or two of this message our case was approved, mine and some other members case that also got this message. I'm not saying that it had anything to do with it but you never know, because when we received our notice of approval they had assigned me an alien registration number, so I'm guessing it had something to do with them assigning that number. good luck

Yes, an I130 petition for my wife.

I am beginning to understand, from input and replies from other VJ members, that the Alien Registration Number I had prior to becoming a naturalized citizen will stay with me for life and I'll need to reference it on future correspondence.

I'm just glad I received my first communication from USCIS since receiving my NOA1 on July 26th, 2012. I now feel like a human has placed their hands on my file and it is being processed in some manner.

I was gonna write that too. My wife she was adopted when little so she was naturalized right away but still got assigned an A number in order to come here first, like part of the process. That number sticks with you even for this kind of process. We used it on our i129f process and AOS process (her number, also mine of course). Basically they are telling you the number you had prior you became a US Citizen has changed and want to make you aware of that, no big deal really. Just keep in mind this new number to use it with all the new forms you will fill in the future when asked :).

A# follow you even after becoming citizen (meaning it never ever goes away, even when it might not be used in forms); I never heard they would change it tough; but in any case, at some point, you will receive a NOA (related to the 130 you filed) where the A# will show up next to your name.
I am naturalized as well and when I petition for my now wife, in the NOA (for AOS I believe), there it was, the A# I had more than a decade ago.
I didn't get it changed tough.

I'm taking this notification as a positive sign that someone at USCIS has actually placed their hands on my I130 application after more than five months. :dance:

Just a quick Q for the OP:
When did you initially send in your I-130? My husband is naturalized USC as well and we didn't fill in his Alien Number but his US Citizen Number. I wonder if we will receive the same notification as well and would like to know roughly when to expect it.

I'm guessing you'll receive the same notification as I did based on the reply from another VJ member just prior to yours.

A# follow you even after becoming citizen (meaning it never ever goes away, even when it might not be used in forms); I never heard they would change it tough; but in any case, at some point, you will receive a NOA (related to the 130 you filed) where the A# will show up next to your name.

I'm confused and USCIS won't give me an answer.

I received the e-mail below from USCIS today, it states "your Alien Registration Number was changed".

I'm a Naturalized US citizen, I no longer have an Alien Registration number, nor did I write it on my I130 application, so what does this mean? Anyone else out there in VJ land receiving this type of notification?

I checked the USCIS website as directed to in the e-mail I received but it provides the same information contained in the e-mail.

You don't need to send originals of anything to USCIS. A photocopy of the birth certificate along with a certified translation is fine.

This is also a required "Civil Document' needed when the DS-230 "Visa Application" is submitted to NVC, do you know if this documents will be forwarded to NVC when the petition is approved?
 

Or will I need to obtain another copy for the NVC?
