IR-1 / CR-1 Spouse Visa Process & ProceduresOctober / November I-130 2007 Filers
Congratulations to those of you have just received your NOA1s or checks cashed.

Unfortunately for us it has been a roller coaster ride the past 24 hours.

Yesterday Kim opened her mailbox to find a big envelope from USCIS. She thought it was a bit big for a NOA1 and on opening it turned out to be a rejection letter. In her excitement back in October she had mistakenly dated the check October 2008 so they rejected the application. sad.gif

It has gone back in the post today with a correctly dated check and a letter requesting that they honor the original filing date. Hopefully they will look favorably on us and we can stay as October filers. When I first read Kim's email I didn't know whether to laugh or cry. Having waited 3 months for the NOA1 and then to be hit by this. Even if we end up at the back of the queue and become January filers I will eventually get that elusive green card. In the mean time back to watching the NFL playoffs on Channel Five. smile.gif

IR-1 / CR-1 Spouse Visa Process & ProceduresOctober / November I-130 2007 Filers
CSC received our application on 10/9/2007. Chicago supposedly processed that last Monday but so far the check hasn't been cashed. We will give it until the end of the week before pursing matters with the USCIS. It is concerning that there are still several late September filers who haven't yet received their NOA1s. I got quite excited last week when I saw Chicago had processed applications on our date but as each day passes I am now getting more worried whether we will ever see a NOA1.

IR-1 / CR-1 Spouse Visa Process & ProceduresOctober / November I-130 2007 Filers
They have processed the back log in a strict order. Employment visas first which they are now up to date on. Then the N-400 naturalisation applications. Finally they will then work on the I-130s. CSC have made pretty good progress on the N-400s and look like they should have caught up by the end of this week. Hopefully next week we will see the first moves on the I-130s.

Philippinesgoing to the philippines.a few questions

Even for a civil wedding, ya gotta have money to pay the Fixxors...

yeah i agree.thats y im asking about how much if any1 knows it would cost for that.and what about that marriage thing i have to get at the embassy to marry her there?its something like legal capacity to marry or something like that.how do i get that being in butuan?and do i absolutely need it to still have the wedding itself and just get it later instead but atleast say we r married and have the ceremony?

yeah if she will marry u on church yes, she needs a consent from her parents.. and frankly saying here in the Phil. there is no cheap wedding on church... if u mean cheap wedding that cost 50-100k pesos that is the cheapest for me... :) :)

is there a way we can get married without having her parents consent or them even knowing about it until after its done?and im sure there r cheaper weddings then that.like above no decorations or anything like that.basically normal clothes except her and i at the church with 4 or 5 people. extremely simple church wedding

Philippinesgoing to the philippines.a few questions

 :P i think sooo too hopp... u know what in the barrio even u dont invite them they will still come, especially if its ur gf's extended family... :D

but i suggest u can marry her by civil.. yes u can have only her sister her parents, u and ur gf... that will be more practical and less expense... how much?.. i dont know... maybe some can give u idea how much is a civil wedding cost...

what i know is about church wedding... :secret:

they wont know about the wedding.i wont even tell them about it until the last second that i have the money for it.they just think im just visiting for now.and if her family wants to come.they have to get the money.and i know they cant and jenes wont give it to them.and now a lot of her family has moved away to like cebu and manila or here to the states....how much is a small church wedding then just having like me,her her sister and her parents?no special decorations or anything like that.her sister has her wedding dress jenes can wear.and we dont plan on getting matching dresses and everything.just descent clothes that they can all wear.i only been to 1 wedding in my life and it was my dads and i just worse simple clothes as well as my sister and her friends.

Philippinesgoing to the philippines.a few questions
im also told that she doesnt need parental consent or anything to get married although the us embassy websites say that.....she is 20,21 in september.and my father and a friend plan on going to the phils at the sametime as i unless i get the money to go sooner.....but from filipinos im best friends with here in the states and other people i know told me she doesnt not even need to let her parents know that she is getting married let alone getting consent.also how much is a cheap church wedding?i know that sounds bad.but we wont have many people there and she isnt worried now about what is all at the wedding but the fact we will get married.

If you plan on getting married in the philippines please click on the follwing link.

http://manila.usemba...v/wwwha009.html

Spending money in the Philippines.
Man visiting the Philippines and living on 47 dollars a day is gonna be tough. 1,000 dollars for 21 days = 47 dollars a day.
Wow you will be living on a tight budget. Don't forget when you leave the the Philippines you have to pay 500 peso for a exit fee.
So make sure you have a little cash on you when you leave. Do you have a debit card or anything you can have for emergencies?
Visa check cards and ATM cards do work in the Philippines. With only a thousand make sure nothing happes to you. Take along medicines from here just in case you get sick.

all i have is a greendot money card.its a visa....works pretty much the same.but i wont be living on it.im a very small guy and use to eating 1 or 2 small meals a day.and i dont drink a lot.i live in arizona and from lousiana so hot and humid weather im use too.ive been homeless as well for a long time so money is not a big issue when it comes to saving and not spending on a lot of things.and as for the wedding.just a small simple wedding.my dad had his here in the states for 100 dollars but i figured its cheaper there in the phils

Best to take a few crisp "benjies" and use credit cards for the rest.
NOT good if her mom and dad are against the relationship. Especially in the Butuan area. Lots of sharp bolos there

the reason her parents r against it is bcuz im not rish.they dont want to have to work and rely on their daughters to make the money.and also its taking me so long to visit her.but not that she has finished college and moved she will start working.and unfortubately i dont have any credit cards or even a bank account.my credit is shot and i cant open another account.long story...

This is a magic trick that is hard to perform.

haha yeah.we dont plan to tell every1 until after we r married.her sister even agrees to it thats its best that just her jenes and i know(jenes is my gf)and then after we get married will will tell every1.most r atleast 2 hours away and really have no way of contacting them unless they go there.and i know they wont as they told me and they avoid their family.too many family problems nd rumors going around.so they moved away and wont tell any1 but me and her sister husband where they r at.

hehe thank you.i thought it would be enough for something like that....do u know how much it cost for a wedding well not so much a wedding but to get married thru justice of the peace or a jodge or something like that?or maybe a small church?just the 3 of us,her sister, jenes and i?

Philippinesgoing to the philippines.a few questions
to start out i know this is for the spousal visa and im sure some of the questions that i ask have already been asked before, but for my sake and to get some new info and everything.i would like to ask these questions anyways...

1 question i have is that i plan on going to the phils around september of 2010....my gf and i have been dating for over 3 years.....i want to know around the minimum and average every1 thinks i should bring to the phils with me.amount of money....when i go there.ill stay with her and her sister at an apartment that her and her sister rent out.my gf just graduated from college march 30 and is now looking for work.im not going there to spend a lot of money on anything special.im going there to just spend time with her.maybe take her out on a date or 2 but thats about it.i dont wanna bring anything back with me(well except her but need to get married first.which is another question ill ask).

so just staying with her and her sister for 3 weeks.how much money do i need for food, water, and simple things like that?and maybe a few dollars to take her on some dates like a movie.but basically just staying at her apartment bcuz thats all we really wanna do to spend the most time together and not be bothered by anything or any1..

another question is....how much does it cost to get married thru like a judge or justice of the peace or equivalent there?maybe having her sister and possibly her parents there(her parents r against us and she moved out of her parents home bcuz she got tired of them treating her so badly.so now she doesnt talk to them much)..

my plan was to save 1000 US dollars as i have read that should be enough for what i want on other sites.but rather hear from people on here about it as well.again i dont plan on buying anything or bringing anything back.just wanna spend time with her alone with the exception of her sister.and i already have a plane ticket ready for me.all i need is the money for there and to get out of the manila airport.i dont like spending a lot of money and my gf doesnt either.she isnt a big spender even if i send her a lot of money in terms of the philippines.she will make 100 dollars last over a month after paying her tuition fee and buying feminine products.

if i remember anything else ill post.a little more.sorry for it being so long and everything.just excited and now tired, have work early in the morn.

Check the Philippine Embassy's website and see if there is an outreach visit to your city or near your city anytime soon. Outreach is where they will come to your city for a day and conduct consular services to those in need. Visit here http://www.philippin...aq-dc/#outreach for outreach instructions.  Check with your fiancée's local registrar and see if they will accept a notarized application from a local notary in your location.

Keep trying, don't give up if this is what you really want. There is a way, you will just have to keep asking questions as well as your fiancée to the government agency's.

oh yes i forgot about that.a woman i know from brazil did the same thing.you are a genius :) im trying to get donna out of the house but its flooded where she is at.im hoping the water will subside and her mom and her will go to the city hall.i know there has got to be a way we can get married.my step mom is from the philippines and has been here in the states a little over a year but has never been married in the philippines.i guess if all else fails.we could do a fiance visa as well and bring her here that way.ill have to talk to her parents as i know they just wont let her go that easily.

Have your fiancée go to her local registrar and advise them of your intentions to send a blank marriage application to you here in the states and that you her fiancé will be getting endorsements from a Philippine Consulate in the USA. If the local registrar agrees, she obtains the application and fax or scans as a PDF file and sends to you.

You in turn have to appear in person at one of the Philippine Consulate office here in the States. See website http://www.philippin...ate-finder-main for the nearest Consulate Office. Present the marriage application with just your information filled in on the document. The counselor will endorse the marriage application verifying that this is you who is applying. Bring two ID's, preferable your passport and a pictured driver's license. You as the applicant will need to present the affidavit, death certificate or divorce decree signifying that you are free to marry along with the application and id's. I would call ahead and make an appointment and explain what you are doing and verify my details as to what is required before attending the process in front of a Philippine Consular.

Once you have the endorsements then send to your fiancée by LBC, DHL or other currier to your fiancée in the Philippines. She receives the original document with all endorsements from you and takes the marriage application to her local registrar for filing. She will fill out her part of the application when she is in front of the registrar. Again, she should bring two government ID's with her to validate her identity. She will receive the license either on that day or the next day. Each local registrar is different and she should verify all necessary documents that are required by her local registrar.

If she is between the age of 18 to 21 she must have parental consent in writing, those age 21 to 25 must have written parental advice (a written indication that the parents are aware of the couple's intent to marry).

These are your first steps and you should begin the process about three weeks before your trip to PI.

well now unfortunately that option is out for me. im unable to go to consulate here in the states.they are too far from me and i cant take off work as i already requested time off for my trip.hmmm

When she goes to the local registrar and hands them your certified marriage license with your signature and of course she will affix her signature and information, you basically are starting the clock ticking for your window of 10 days. But since it is about 3 weeks ahead it doesn't matter because when you get to PI you go to the Embassy and get your "legal capacity to marry" document for the registrar. She issues the license and now you go and get married before your return back to the states. You don't have to wait 10 days because you did the paperwork ahead of time (remember you started this process really 3 weeks ahead of your arrival, so the 10 days has already been fulfilled) that the local registrar needs to issue the license. Of course you need to finish the marriage counseling session and she needs to have her CEMAR but that is something that she can do while waiting for you to arrive in the PI.

Your now free and clear to marry because you have waited the 10 days because you started the clock literally 3 weeks prior.

If you have questions ask away. Good Luck.

i think i want to do that. how do we go about getting the paper work needed to start the process for the marriage license?

Philippinessame questioned asked a million times

anyone know if this is actually possible to do in 2 days?as we do want to have civil wedding.(i may post this as a new thread as well as to help others possibly)

1. you may need few days to have the marriage license from the civil registrar, but you can pay them some cash for rush processing.

but not all cityhall official are that strict to follow the rules and need the marriage license!

at our case: my friend is also a foreign citizen like you that got married to a Filipino, but we don't have or apply for any marriage license, and also not submit it.... in our case.

2. Go to the city hall at your place, and then ask where the dept. or the office for civil wedding is located

3. submit there your marriage license, even don't have marriage license yet, just give the copy of NSO certify birth certificate of your spouse may do (in our case), then after fill up a form they will get it to the processing and schedule the date for your civil wedding ceremony.

4. Go back again on the schedule day to have the civil wedding ceremony with the witness (if you have), then pay the necessary fees.

we done all of this for only 2 days !!

5. Go back again after a week to have your copy of NSO certify marriage contract,

You need a marriage license in order to get married. There's a ten day wait for a marriage license.

Don't worry about a marriage certificate. That's something you'll get after you are married.

thats the number 1 thing i tell them.i think her mom knows someone who can help.but will talk to her on her next day off.so confusing and tiring.i like to do things in person but on a short times its hard.

Here is one way to do it under 10 days. 1. So have your fiancee check with local registrar to see if this will work for you. Most times you could file for the license in advance and complete other requirements when you arrive.  You need to check with the registrar and see if they will do this. 2. Then you go to the Filipino Embassy near you with a filled out marriage license (just your half) and asked them to certify the document.  They should do this and usually will cost about $25 and a return visit the next day to pick up the form. 3.  Once you have the document and then send it to your fiancee. Next have her fill out her part and take it to her local registrar for filing. Do this about three weeks before your arrival to help in meeting the 10 day requirement.  She also has to give the registrar her CEMAR. 4.  Upon arrival go to the US embassy (you must make an appointment), and get a legal capacity to marry.  Cost $50 fee. 5.  Now take your legal capacity to marry and a copy of passport entry to the registrar.  They may give a release date of the next day for marriage license. However you need to attend the family planning seminar. 6. Returned after the seminar, and get the license. Now go and get married and have a happy life together.

Your actual mileage may vary. Good luck.

thats a lot.i dont even understand some of the stuff in a sense what it actually is.the bad thing is its actually less than 10 days when you consider the 24 hour flight there,.im coming back about a day or 2 early before work to get rested and make sure im back in time so i dont miss work.this is such a head ache :)

I believe it has to be the original document. However, your fiancée could get it to you in three or four days.

Have you ever been divorced? I believe you would need to get your divorce papers authenticated by the Philippines consulate which has jurisdiction over the state you live in.

ive never been married yet. i was wondering myself as well if it has to be original document. i think after her mom gets off work today, they will go find out what they can.but i dont think they understand what needs to be done exactly.especially since im not from there

not sure if they need orig signatures.

i kind of wondered about that.she is telling me we can apply for a license after the wedding but it takes weeks.i dont know if thats possible or not.really we want to just say we are married rather or not we have that paper stating we are legally married.if that makes sense.we can get paper work later.

Yes, he definitely needs the affidavit, but that takes very little time. The embassy now requires an appointment to get the affidavit. He could have the affidavit in his hand a few hours after he arrived in Manila if he wanted to. The real time hog is the waiting period for the marriage license.

Agreed, he also needs to sign the application for his marriage license. However, if he does so while in the Philippines, he's going to face a 10 day waiting period before the license is issued. If he takes care of it before he goes to the Philippines, he won't have any waiting period.

Or, if his fiance's family knows someone...problem solved.

how could i sign for the license while still here?i dont think there is enough time to mail papers to me and then get it back before i visit.im asking if they know anyone.hmmm

nathanpMalePhilippines2013-09-19 21:05:00
Philippinessame questioned asked a million times

I got married in Manilla yes. You need to also go to USEM and get the affidavit from the Embassy that allows you to be married in Philippines. Go to the website for USEM and choose a date when you want to go get it done, it's easy. If you have been married bring divorce decree. Passport obviously. I'm pretty sure some of this such as applying for the Lic will have to have your signature. You might hav to be present for some of it to happen. What you need from Embassy is calle Affidavit in Lieu of legal Capacity to Contract Marriage for United States Citizens.

i thoght the same thing but im not sure. i think my girlfriends mom is out trying to get info now.but she wont reply back to donna telling her where she is.im hoping i can go to the USEM the day i arrive and get it all done.once work approves my time off for sure. ill buy my ticket and have a better idea on the time ill arrive..supposedly you can get the license even though im not there as im told.though never had any proof of that.

From what I understand, one way you can get married in the Philippines in that short amount of time is if your fiancee's family "knows" someone.

The other way which will allow you to get married in the Philippines in that amount of time is if you complete the paperwork before you go to the Philippines. That will allow you to satisfy the required 10+ day waiting period for your marriage license.

thats what we want to do.they are getting paper work and finding out what is needed. how am i able to complete the paper work before visiting?im told another thing is apply for the license but just have it mailed to me then i sign it.something like that

Philippinesmarriage cert?

The 6 month period to wait for the marriage certificate to be registered on the NSO is mandatory. The one that you guys have is the marriage certificate you both signed during the civil/church wedding whichever case and that one is the one forwarded to the local civil registrar where you got married. The local civil registrar is the one to forward your marriage entry to the NSO office. HOWEVER, you may do so too but this won't give you an edge or an expedite. When NSO says it is going to be 6 months, it definitely is. The one you're holding right now is okay to send when you first file the petition I-130 IR-1/CR-1 HOWEVER, the NSO copy will be needed after you get approval and your case will be at the NVC stage. Hope this helps. Good luck!

i know there has been some that paid extra and had it expedited.i have connections and could probably still get it done but i decided im going to wait out the month.plus my wife hasnt gotten everything together yet and we need to get her passport as well.a month will go by fast and this gives me more time to get other things taken care of :)

Philippinesmarriage cert?

I'm not sure what we needed - it was a few years back.  Probably.  I would post this question to the Philippines specific subforum here on VJ.

my wife told me its been registered its just a mandatory 6 month waiting period.we didnt know about the expedition of it and since its a month left i dont know if its worth expediting it now.hmmi wasnt sure if we should just the one she has or wait..the one she has now is the one she got i think 3 weeks after we got married

nathanpMalePhilippines2014-04-10 19:59:00
Philippinesmarriage cert?

You can bring the documentation from your marriage to the NSO office yourselves, and they will register it.  There's no need to wait.

what information is needed?does she just need our marriage certificate she has now along with the receipt?

Philippinesmarriage cert?

learned that we need to wait 6 months to get NSO marriage certs.my wife has one currently she got a few weeks after we got married.next month will make six months.should we use the marriage cert she has now or just wait until next month and get more to start her visa?we want to get the process started.

IR-1 / CR-1 Spouse Visa Process & Procedureschanging address cause problems?

For the beneficiary it honestly does not matter. For the petitioner it does.
But you do what you feel is best.

then i can rest at ease not worrying if she moves or not.its just me only that needs permanent.i may just apply for hers anyways without having an address for her.well ill supply an address i know though where she is currently at :)

nathanpMalePhilippines2014-01-06 21:34:00
IR-1 / CR-1 Spouse Visa Process & Procedureschanging address cause problems?

Personally, I advised to have and use one address all through out the process so there would be no problems later on. My husband and I were planing to move location during the process but decided not to for it may delay the process although we never get any mail from the NVC. All of the notifications we sent to us via email. My husband filed the CR-1 Visa Dec of 2012. I have my Visa on hand November 2013. I hope this helps...

then its probably best to just use my cousins address in pampanga...i think thats where she lives..i know its north west of manila..only a few hours away but i forgot a friend i met when i arrived atr the airport to give her a package gher husband wanted me to give her since it was cheaper for me to carry on then for them to mail lives just south of manila.hmmm...yup checked facebook and thats where she lives :) but im glad its sent in email.for me having a permanent residence is no problem.i was just worried about her especially anything being mailed and the G-325 paper work i have to feel out for Donna and I

nathanpMalePhilippines2014-01-06 19:11:00
IR-1 / CR-1 Spouse Visa Process & Procedureschanging address cause problems?

her moving has no consequence on the petition.  If the petitioner moves, you need to inform the USCIS, if the beneficiary moves, they should make a note of the dates and exact address because they'll need that information for the DS-260 (and the G-325a)   Nothing in the petition will have anythign to do with your wife and nothing during the whole process (unless you really want it to take a long time) will be mailed to her besides maybe the eventual visa.

oh good.thats a relief, i told her i wish her and her family get permanent residence but her parents dont get along too well and were at their current location only for me.even when i was there they argued.but its a relief i dont have to worry too much although i may use my other relatives address to be safe. :)

Were you living together abroad?

no.i was only in manila a short period of time.i was actually there during typhoon yolanda..i stayed a week and a half as permitted by my work

she moves around a lot because her parents dont get along.he last house they were in was because i visited and the old neighborhood they didnt trust with me there.no red flag as i know exactly whats going on.my step mom and a friend my dad works with.his wife has meet my wife before we ever met and got married.they know and trust her.especially over my ex.i know the reason.i asked the questions i needed to ask which are above..we are already married.she has our marriage license.we were in a relationship for over 2 years before getting married.i have been involved with filipinos for nearly a decade.my best friends are filipinos.my family is also.ill upload pictures of our wedding.

IR-1 / CR-1 Spouse Visa Process & Procedureschanging address cause problems?

my wife and i got married back in early november.shes from the philippines and im an american living in Arizona.she constantly moves around a lot and stays at 1 place maybe 3 or 4 months at the most.shes about to move any day now.i havent started her visa yet and want to start it now.but im worried with her constantly moving it will cause problems.shes in the manila area.shes in paranaque now but i think her and her mom will move to makati which is where we actually got married at.my dad contacted a relative(my dad is also married to a filipina)that lives in pampanga i believe and asked if we could use her address as a permanent address for any paper work and everything being mailed to my wife.but im not sure if that will work as its far from where my wife actually lives..my dad suggested a P.O. box but im not sure they have there..

my question is, would her moving and changing addresses a lot cause any problems?

and are we able to use another address thats a little further away as a permanent address?

i dont know how long exactly it will take but any idea on the time frame for a spousal visa?i tried looking at the info on here but the graphs make no sense to me.ill be filling in california.im 27 years old.shes 19.dont know if that makes much of a difference but want to give info that could hep out..if anymore info is needed please ask.
