i dont understand why u couple dont want them, the parents, to know that ur getting married... :unsure: :unsure: :unsure:

why bcoz ur not rich.. ok... can u support ur gf when she comes in ur country..? if not are u willing to come here in the phil. to live with her...?, u know what i think u need to bal. everything... marriage is not like that.... its very difficult to live each other so far... think all over again... and are u sure she will be happy with u or u will be happy with her to think that situation is not that good... uhmmm... how old are u...? she is young she might change her mind in the future... just a piece if advice... but its ur life and both of u will be one responsible to that...

well i dont know if u can get married w/o parents consent maybe some other's here in VJ do it too... and marrying in the church is not that easy.. u need to attend seminars, ect... even if it simple... that's their rule...

its just her parents.yes i can take care of her.and if we werent sure and not happy.we wouldnt have gone thru everything we have gone thru for over 3 years.ill just say after talking to many friends and other people about our situation.both would have left each other in a heart beat.but for us its just a lot of stress causing simple problems that go away after a short while.really not a lot of problems.just heart ache on both our family and friends sides.they r still for us to get married.but its just money the also want.they like me and everything.most of their problems is that i havent visited their yet.they keep saying it.i dont send them a lot of money when i do send and sometimes ill wait months b4 i send anything.her dad is an alcoholic and abusive at that.1 night she called her friends to help her dad drive his motor cycle home and her dad asked a 22 year old guy to have sex with jenes in exchange he has sex with a 17 year old girl.her parents always call her stupid and dumb and say she is worthless and cant cook.yet she takes care of her baby sisters,cleans the house,the laundry,cooking,cleaning and then school as well.so she got tired of being treated so badly and left after she graduated to get a break for a while.but i know her parents will let us get married when i get there.they just want me to be there in person.

and i thought about living in the phils.im getting a website up and running shortly after i meet her.i dont want to put anymore time or money into it until after i get back.i shut it down for now.but for now i just wanna find out roughly how much money i should bring there and things like that to get married and to stay with her and he sis in the apartment.is 1500 dollars enough for my stay there,a small civil or church wedding including the documents we need to make the wedding legal?or is it possible to get married but supply all the paper work and everything after we get married.(i ask bcuz we decided not to have kids or anything until after we get married and we both really want a baby.we had 3 years to talk about it and everything.as well as not have sex b4 marriage.although we both have said it will probably happen anyways b4 getting married but we will see).but i want to be married to her.i am religious and trying to change my life around and go by the bible.

Provided you satisfy the IRS regulations for disposal of a main residence most if not all of the gain on the sale of your UK home will be exempt from US tax. It won't matter how you get the proceeds to the US the disposal happened on the date of disposal. Whether it will even impact your US tax return will depend on how you file for your first US tax year. There are at least three different scenarios to calculate for the first filing to see which one is best for your circumstances.

Thanks for the replies.. This is the sort of thing I'm worried about, that there's something I need to file because of my pension and I'll miss it offand get in trouble. So I need to file that FBAR thing because of my pension? It won't be a huge amount. Will I need to do this every year?

 

Edit: It says on the FBAR link on the IRS that certain things are exempt from FBAR, inc.

Does that mean I don't have to do FBAR? :S

 

 

The FBAR is required every year if in a calendar year the total value of all your foreign financial accounts exceeds $10,000 at any time in the year.  Financial accounts includes the obvious ones such as bank accounts, unit trust savings accounts, investment trust savings accounts, brokerage accounts, ISAs etc plus defined contribution pension plans.  In the UK this would mean personal pension plans and some company pension plans where the pension you get is based on the fund value rather than your final salary.  UK final salary schemes are not reported on the FBAR but are reportable assets for the form 8938.

 

The exception for "Participants in and beneficiaries of tax-qualified retirement plans;" is for US pension funds such as 401Ks.

 

The form 8938 needs to be attached to your US tax return for a married couple living in the US if the total value of their foreign financial assets exceeds $100,000 at the year end or $150,000 at any time in the year.  Foreign financial assets for this form is a much wider range of assets than for the FBAR.  It also includes defined benefit pension schemes (ie UK final salary schemes) as well as direct holdings of foreign corporations or partnerships.

 

All I can say, is welcome to US tax reporting for Green Card holders who keep any of their foreign assets. smile.png

I'm happy to agree with your second paragraph, but the first is controversial.

When I searched for "Uk US pension tax", or similar, the first thing to come up were two threads on britishexpats.com that stated most but not tax specialists believe that the lump sum is not free from US tax.



 

Owen, thank you for pointing that out.

 

When looking at the US/UK tax treaty I always forget about the "savings clause" Article 1(4). Subject to the exceptions in Article 1(5) this allows the US to tax its citizens and residents as if the tax treaty did not exist.  In otherwords on worldwide income.  Unfortunately lump sum pensions are not included in Article 1(5).  I also found a 2008 letter from the IRS which confirms their interpretation of the treaty and that UK lump sum pensions are taxable in the US. :-(

 

Another thing to add to the list of tax issues that people moving from the UK to the US need to be aware of.

i.e. Pension lump sums, FBAR, Form 8938, PFICs, ISAs, VCTs, Form 5471.

United KingdomTax on UK pensions?

Under the UK/US tax treaty any UK pensions will only be taxed in the US if you are a US resident at the time of drawing the pension.  In addition, if you take advantage of the UK rule allowing you to take out 25% tax free when you first start drawing the pension, the US is required to follow that rule even though there is not a similar provision in the US tax code.

 

In the meantime the only US tax reporting you need to worry about for UK pensions is the FBAR (due on June 30) and form 8938 for the US tax return.  If you have UK defined contribution pension schemes you may need to report them on these forms if their values are high enough.  The pension is not taxed by these forms as they are information returns to enable the US Government to track your overseas investments.

Whether you need to amend your US tax return will depend on why the Canadian tax authorities have amended your Canadian tax return. Have they reduced your income, increased allowances etc?

Take your Canadian tax assessment to your US tax adviser and they will be able to work out if you need to amend your US tax return.

Today I had my bio at the Phoenix ASC at 2545 E Thomas Rd.

The building is about 200 yds east of 24th street with a clear sign showing you the side road to go down to get to the car park.

The whole process was very straightforward and took about 5 minutes. The longest part is taking the finger prints as they have to check and double check each finger.

So, hopefully there will be no interview request and the next stage will be the 10 year green card in the mail. :)

I called USCIS last Friday about this issue.

The first guy I spoke to immediately recognized it as something he couldn't answer so escalated it to somebody more senior.

They confirmed that they have had several calls about it and they are still trying to identify what has happened. She confirmed that she can see on my file that they have received my biometrics which is why they don't know why these letters are being sent out.

Her advice was to send to the service center a copy of the odd NOA and a copy of the ASC receipted biometrics so that the service center can see that the biometrics have been done. That seems sensible advice to me.

According to my on-line status it still shows "initial review".

I am also a September filer and received the same letter today. From what you have gathered from USCIS it does sound like an error on their part and we still need to wait for the formal approval.

I would say I am a September filer. All the time I have been on VisaJourney I have always considered the important measures have been how long between actually filing the form and getting each of the notifications from USCIS.

Depends on the work load at Skatteverket. Took me about 2 weeks when i did it in august, but I was on them everyday, can take up to a month if you are unlucky

That aside, just as a 411 upfront, just like the U.S., Iran does not recognize dual citizenship, whereas Sweden does (since 2001). So if your (then) wife will eventually naturalize as an American, she'll have to carry 3 passports.

I grew up in Canada, paid into the Canadian Pension Plan for years, and am still able to draw on the Canadian Pension Plan when I retire.

I have read that my fiancee will able to do the same with her benefits from Sweden, at the correct age, as an American citizen. Am I correct in my understanding?

It will most definitely not affect her Swedish citizenship at all. Since she has no status in the U.S. the name change is entirely a Swedish concern at this point. She can register the marriage and apply for the name change at the same time when she gets back to Sweden. wait for the name change to take effect before handing in any paperwork for the CR1.

I am an American citizen, we are getting married in the USA in April 2012 then immediately starting the IR-1 / CR-1 process.

Yes I am going through the process as we speak :) I came to the US on a K1 Visa 2 weeks ago and I am marrying the love of my life in just about a month :) The reason i know so much about how to obtain a valid divorcee decree is that I have been divorced twice before, 1 divorce about a year ago and one divorce more than 10 years ago. the recent divorce decree was easy to obtain and the divorce from more than 10 years ago not so easy.... because of that law concerning "gallring" that I wrote about in my previous post. But no matter what anyone would tell you Divorce Decrees from a long long time ago can be found amybe not just in the archives of the Court House...... In my case the oldest Divorce Decree was found at Landsarkivet a place were they send really old documents in that county...

this might not be an issue of urs though but maybe someone elses, who knows :)

I have this urge of wanting to "pay it forward" because of all the, at many times helpful information here on VJ that Ive got during my visa process and maybe help prevent simple mistakes that would pro long the process for somebody else....

I know that my process is far from over but atleast now I get to do it togheter with the love of my life at my side EVERYDAY :)


First and foremost, congratulations on receiving your K1 visa, your recent immigration to the USA, and most importantly on your upcoming marriage. Three weeks ago, I married the woman of my dreams, the woman I consider to be my Soul Mate, the woman I truly believe I was put on this earth to find and spend the rest of my life with. What an amazing feeling it is.

Secondly, the divorce documents we need to obtain are 17 years old, so it is refreshing and extremely helpful to receive such detailed and complete information on the correct agencies to contact in an effort to obtain them, from someone that has recently been in the situation we are currently in. This will reduce the amount of time spent tracking down the paperwork and help expedite the overall process of completing the initial I-130 package by receiving the documents we need quickly.

Input from VJ members helped me with the process of becoming an American citizen through Naturalization last year, and I have “paid it forward” whenever I can to others. As I learn more about the CR-1 & I-130 process, through my own experiences and advice from other VJ members such as yourself, I intend to the same as you have just now done for me.

I hope the information you have provided to me also helps others here on VJ.

You go to or call the Court House ( Tingsrätten) where your divorce was filed, if the divorce was filed more than 10 years ( in Sweden there is a law called " Lagen om gallring" wich means that they after 10 years are allowed to put certain documents in other archives than were they were initiaaly filled) ago they might keep the papers in another place but the Court House will be able to tell you were.

Very important!!!!!!!!!!!! Make sure that a clerk of court stamps and signs the Divorce Decree. That will make the Divorce Decree certified.

Make sure that you translate the Divorce Decree with the use of an authorized translator, they have a specific seal to show that they are authorized. I used www.snabboversattarna.se for this. They were fast, accurate and easy to get in touch with, very proffesional and cheaper than many of the other agency's i talked to. ( No I dont get comission to reefer them :)) Tell them what the translation is for and that u want an authorized translator to do it.

This might be more info than u asked for but ah well maybe someone else will find use of it :)

One last thing. Do not send in pappers from the Tax agency ( Skatteverket) to prove ur divorce) We did that and got an RFE on it, they want the "real deal" from the Court House.

I'm not sure I understand, and it's none of my business really, but I'm still wondering... Are you divorcing your wife or does she need papers to prove she and her previous husband are divorced?

I really don't know how these things work (and I definitely hope to never find out for myself) but my best guess is to get in touch with the local administration (religious or secular) where the marriage took place. Or perhaps Skatteverket's Folkbokföring (the Tax Agency), since they issue Personbevis which fill the same function as marriage certificates/birth certificates.

Hmm, now that I think of it, maybe previous marriages are listed on a complete personbevis. Mine didn't, but then again, I have have never been married before I married my American wife.


No, I'm not divorcing my wife, we just got married on April 26th, 2012.

A certified copy of her divorce decree is required for the I-130 application, we're just not sure where she needs to go, or who she needs to contact, in Sweden to obtain a copy of it.

I'll start looking into those suggested in you post.

My wife resides in Sweden, she is a Swedish citizen but born in Iran and also an Iranian citizen.

 

Her visa application (DS-230) is at the NVC, one of the required "Civil Documents" is a Birth Certificate which is in Farsi.

 

Her interview will be at the American Embassy in Stockholm, therefore her Birth Certificate is not in the language spoken at that Embassy. I was informed that NVC will accept a photocopy of this document sealed together with certified translation of it rather than the original document sealed together with a certified translation of it.

 

Anybody out there in VJ land had experience with this

Hi everyone,

I just completed N400 application but have a question regarding "permanent residency" on this form. It asks: Day you became permanent resident?

I came here on a K1 Visa. First I had a 2 yr conditional residency and later I received a ten year green card. On my green card it says: Resident since 02/07/2006 and Card expired: 01/11/2018.

My question is: am I a permanent resident since 02/07/2006???? I received my first conditional residency on this date, that's why I am confused. What date did you use?

I just went through the N400 process, I'm getting sworn in on 1-14-11, I used the date on my second card, which would be 02/07/2006 for you and everything was fine.

They are not responsible for sending you a new SSN card, you are responsible for getting a card without these restrictions. Just go to SSN and bring your green card to get a new card.

I don't know why did you wait all this long? It should have been removed years ago,since you became a permanent resident.


This is the original Social Security Card mailed to me with my original Permanent Resident Alien Card 16 years ago, the condition was not removed when I renewed my Permanent Resident Alien Card 6 years ago either.

Is there a form available to have these conditions removed?

You have to go to the SSN office and request a change on it to US CITIZEN after you become a US citizen or you will be a LPR on your SSN.

There is no firm number- most countries either allow dual (and multiple) citizenships, or they do not (Japan doesn't, for example). I currently hold three citizenships (Swiss by birth, Irish by naturalisation due to living there, and US by marriage/ living there), and so do my kids (by parents/ where they were born).

My wife's situation is, or will soon be, a mirror or yours with only the country names being the difference.

If a country allows dual, do they also automatically allow multiple? If that is the case then I see no issues with my wife becoming an American citizen and maintaining the other two. Unless it is a case of "only" single, "only" dual, or multiple?

You can be a citizen of many countries without a limit as long as those countries allow/recognize that. So it depends on those countries citizenship laws.

Regarding the US, the Department of State "recognizes that multi-citizenship exists." So they are OK with it, though not very happy if you read the wording carefully. In a nutshell, according to the US you can hold passports of different countries, no problem. However, for the US you are officially a US citizen only (regardless whatever other passports you carry) and hence, you need to leave and enter the US with a US passport.

So, based on what you are telling me, and the fact that my wife is currently a Swedish and Iranian citizen, both of those countries are OK with being a citizen of many countries, correct?

And obviously the USA is OK with it due to the fact that I am both an American and Canadian citizen, correct?
