Hey, just checking in with you. Still no case complete? wacko.gif I am sorry. It will happen soon. I finally was able to send off our DS230 and photos and supporting docs today. It is supposed to be there by noon tomorrow. I am hoping for a Dec interview date, but have come to grips with the fact it might not be until Jan. We will see. Best wishes for a quick case complete. good.gif

Thanks.. i know many of us are hoping to get it done before the cutoff... i wish us all that star_smile.gif

Why did I think of "Get'er done" when I read that? lol

All this moving has made me tired!

Do you call and actually talk to the operator. They got onto me for calling too soon since the last time and so I wondered if anyone else gets that.

Sorry you didn't get the good news today. I really hope you get it before the end of the week. You have been waiting too long!

I hope you hear something soon. Sorry they haven't finished your case yet. I got my RFE letter in the mail Saturday. They say I must provide a police clearance from the Jordanian General Intelligence Directorate. I had not read this anywhere so I told my husband to go down to the police station, but apparently the police clearance wasn't good enough, ugh! I pointed out my husband has not even lived in Jordan for a year yet, but they don't seem to care. I sent my husband down there to try and get the certificate, but they said he does not have residency so they cannot give him the certificate. This is so frustrating. I have no way to fix this RFE. I once again called NVC and told them the problem and now I am waiting for the supervisor to review the case again. I am praying they just approve it understanding it is impossible to get this certificate.

wow.gif that's terrible... i am soooo sorry. I hope they pull their head out of their ..... well you know? keep us up to date. So he will have to be there a year to get his certificate or will he have to wait to be a residant then get the certificate??? even still how long is that going to be?

I hope it gets worked out somehow too, lol. He can't get residency as it is nearly impossible to get one as Iraqi these days. He was lucky to get the initial residency for three months but that expired in March. We are trying to work out something else is all else fails.

I saw you haven't got word on your case being complete. This is really taking too long for you. Inshallah they will give you good news this week so you can move along in your case. Hopefully your husband will not need to work on settling you in Spain as I know that would be difficult for you.

That is what they told me is 10 to 15 days for a supervisor to look at it though they also said the police clearance I sent was missing. Good grief, I hope they get things straight soon for both or sakes!

Yeah, not sure if you saw my latest post in the NVC area, but they claim I didn't send the police clearance for Jordan with my husband's paperwork. I know I did so I have to wait for some supervisor to go over the paperwork (10-15 days they say before calling back). This is ridiculous as everything else is good to go. Not only that but the requirement for the police clearance is if he has been there a year, he will not have been there a year until December 3rd! Ugh!

ohhhh that sucks!!! mad.gif I told Reda to get an updated police record from Casa and get one from Madrid even though.... for his interview. I also advised him to get his shot records too so he doesn't need as many hehe

but back to you... that sucks!!!! can you send a copy?

I don't know. I think I'm going to call back Wednesday night and see if they reviewed it yet. Maybe I will get lucky. I have a copy and mentioned that but the guy didn't say they would take it. I don't see why he can't just bring another one with him to the interview. He just got this police clearance at the beginning of this month so it is definitely up to date.

I don't understand they do background checks on our guys why would a local police report matter? wacko.gif

It is only for the benificiary. I am divorced but my husband is not. I didn't send any divorce decrees in for the DS-230 and I didn't get any RFEs. Same with birth certificate. They just need the birth certificate for the benificiary.

IR-1 / CR-1 Spouse Visa Process & ProceduresExpedite Approved for appointment at embassy
Thanks for your replies. Ironically we no longer need the expedite as my husband got approved for refugee. The refugee organization that represents the United States already booked his plane ticket for two weeks from now. We waited most of the year for refugee and didn't think it would ever be finished so we were trying to speed up the spouse visa. I can't believe the expedite was approved and then he was approved for refugee within 24 hours. Thank God I will be together so soon!

IR-1 / CR-1 Spouse Visa Process & ProceduresExpedite Approved for appointment at embassy
The biggest reason I worded in the letter was the threat of my husband being forcibly returned to Iraq where he has had death threats. His visa expired in March of this year for Jordan and his stay was tenuous at best. If he went back to Iraq and managed to not be killed he still would have no way to go to the embassy interview as they don't conduct them in Iraq. I had one other personal issue added to this though I prefer not to discuss that. Basically I wrote a strongly worded letter and so did my congresswoman's office and I provided proof of his refugee status and news stories of other Iraqis married to Americans and the problems they faced.

I'm still confused about the translation issue. Or rather, I'm confused about why people think translations are necessary in most cases. The State Department website clearly states that translations are needed only for documents "not in English, or in the official language of the country in which application for a visa is being made." In the case of my wife, who will interview in Juarez, Mexico, I think this pretty clearly indicates that Spanish-language documents don't need to be translated. What am I missing?

I didn't want to risk an RFE so I sent the translations anyway.

IR-1 / CR-1 Spouse Visa Process & ProceduresSeptember I-130 filers at Vermont
I really hope that all of you get your NOA2's soon. I can't believe it is so out of order. They recieved my I-130 petition on September 24th. I got the NOA1 on January 7th and the NOA2 approval on January 28th. I thought it was processed fast (if you don't count waiting so long for the NOA1) because of my husband's country situation. He is forced to stay with an expired visa in another country just so he can go to his embassy interview (no embassy interviews in Iraq obviously). NVC is slow, they got my case by the end of January. I send everything as soon as I get it, but I still haven't got the visa application and Affadavit of support though I payed for them several weeks ago.

Good luck to all of you and I wish you the best.

It shouldn't be a problem. The US government knows many people had no choice if they wanted to work or go to college. A rather large percentage of Iraqis were in the ba'ath party. I think they would only be concerned if the person is a higher level member.

My congressman was very helpful for me. I was shocked how much trouble their assistant went through. I would write her emails and she would write me back within an hour or less. One day we sent emails back and forth with information most of the day. She called all over the place trying to get info to help me and she called NVC. My husband is not here yet, but my case has made a lot more progress. Not sure, but maybe my case was more unique because I could add the problem of my husband's life being in danger if he was forced to go back to his home country and his stay is tenuous in the country he is in. I just thank God they helped.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhen do they do the background check?
No, the UN wouldn't bother with these checks. Your husband would have already done the ones for USCIS though. So far as I can tell, once they start the refugee the checks are started all over again. Don't ask me why, lol.
S and SFemaleIraq2008-04-14 01:31:00

I looked around, so long as you don't have any hits with your husband's name, if he does refugee he can get all the security checks done within two to three months of his first interview for refugee processing.

What you could do is just get an interpeter for that issue if you just need the correct arabic way of doing it - since each court house has many different people, it may save you time and money to go this route - just a thougth!

Cheers

yes that's an idea but I would be shocked, flabbergasted, almost in a coma if there was a court house within 150 miles of me that has an arabic interpreter.

I wish I could help you if we lived closer to each other. I was able to write my husband's name with no problem. Thank God for those classes. It must be difficult without understanding the arabic alphabet. I hope you can just trace it, that was a good idea. If not, there has to be some arabic speakers in your area, maybe go to the nearby mosque for help.

IR-1 / CR-1 Spouse Visa Process & ProceduresFEB. I-130 APPROVED ALREADY?... FOR AN IRAC SPOUSE???
This really makes me sick to see the post even started. I filed my I-130 back in September. I did not even get a NOA1 until January 7th. I will not feel bad that I got the NOA2 on January 28th. I have been married since May 28th and would have filed sooner if there hadn't been difficulties getting my husbands documents together because he had to flee Iraq for his life after he was threatened by a certain militia. I go to be every night praying he isn't kicked out of his country of assylum before this process is over. If he goes back to Iraq then he is good as dead. I will not apologize that the State Department and USCIS chose to speed up the case, though we are still waiting. The background checks at USCIS are only the beginning. There are further checks at NVC and the embassy. The ones at the embassy taking the longest so don't assume that because Iraqi cases were processed fast at USCIS that they will not have to wait later.

My husband lived a mostly normal life prior to 2003. He often didn't eat well and he had to be careful of what he said so as to not get in trouble with the Iraqi government, but other than that he was happy. He was going to college. His sisters were going to college. His mother worked as a teacher. They were free to wear what they wanted. Iraq was never an extreme Islamic state since Saddam really wasn't that religious. Now they have lost so much since 2003. They never did anything wrong. They didn't participate in extremist activities before or after 2003. You cannot assume they did! That is racism in its purist form and stereotyping. Also, all Iraqis are required to go through enhanced background checks. Far more than most people's spouses on this website. The United States occupies Iraq. Don't you think they formed some databases recording terrorist names and activity and use that when checking a possible Iraqi immigrant? I should hope so.

The person who started this thread is obviously ignorant and if his spouse's life was in danger I have no doubt he would be crying that he/she deserves to come sooner.

IR-1 / CR-1 Spouse Visa Process & ProceduresVisiting Canada on CR-1
The one time I went to see Niagra Falls was back in the summer of 2000. We walked right into Canada with only being asked why we were crossing. When we came back to the United States no one even said a word to us. We just walked right back in. One of the women in my group didn't even have an ID on her! Things have changed a lot since then. I hope you enjoy your time up there!
S and SFemaleIraq2008-07-15 00:00:00
K-1 Fiance(e) Visa Process & ProceduresTiming
I wish you luck in your process, but I have a friend who did a fiance visa that lived in Iraq and interviewed in Jordan. It took nearly a year to get her to the United States (though part of that was due to the fact USCIS lost some of her paperwork and it added months to the process).

If you were to get married it would be a lot easier because USCIS has been approving Iraqi cases in less than a month. His being married to you would also qualify him to apply for refugee which gives him more benifits and could get him to the US faster. Also, he must have the G series passport to get his visa. They do not accept any other passport from Iraq. I know because my husband has been waiting months on his new passport and hasn't got it yet and the embassy says it could be more months of waiting.

I hope things go smoothly for you and if you have any more questions just let me know.
S and SFemaleIraq2008-04-12 14:28:00
K-1 Fiance(e) Visa Process & Proceduresgotta question...does the woman have to be rich....
I am not rich by any stretch of the imagination. I would define myself as a middle income person with average bills and debts. I just manage my money and save the amounts needed for the visa/immigration fees as they come up. It would be difficult for someone with a lower income because they would take a lot longer to save the money and have issues with the income requirements.

On the other hand, some women have fiances/husbands that have good money so they can pay for everything. It really depends on what category you fall under.
S and SFemaleIraq2008-05-09 20:01:00
K-1 Fiance(e) Visa Process & ProceduresVISAS DONKEY
I'm not really sure what this is, but my husband talked to one guy who is doing refugee, the guy's case is taking a lot longer for background checks because he was in the Iraqi military. I hope this doesn't slow your case down. I can tell you that my husband was in the ba'ath party as a low level member and that hasn't been a problem for him. He just had to swear that he wasn't an active or high level member and has no further participation in the party since the fall of Saddam.
