Good day to all of you. I got a questions about K2 visa. I been here in the US last Jan. 1, 2012 and we got married last Jan. 27. I already filed my AOS last march 30 and the last time I checked my status it says the papers transferred in California. I want to get my child who is in the Philippines and already called the US Embassy in Manila, Philippines and they said all I need to do is pay for his visa and make sure my child will be in the USA before Dec. 1, 2012 (my visa issued last year). My child is 13 years old and they said he will use my MNL Case No. in paying his Visa, but I am a little bit confused cause I read here somewhere in VJ that I need to file an I-824 form and that's another $405.00. Now, I thought that I don't need to pay another application fee since a K2 visa has one year to be here in the US.

Hopefully someone can help me on this matter cause I am truly confused on what to do, the fact that I already had all the paper works done and ready to sent it to my child .

you can find it in your husband's tax return whom he claimed as his dependents, whoever he claimed then that's all you need to put in your affidavit of support. but then in counting your household size his income must meet for another 2 household for yourself and your child, that is if your child will go with you if not then you will only add one more yourself.

I am really so confused with my son's entry to the US. My visa will be one year this coming December 1, 2012, I am now in the US and my child who is K2 have an interview this November 19, 2012 in the US Embassy Manila, and I don't think he can get his visa before December 1. My question is.

1. Does he need to be here before Dec. 1, 2012 or
2. Does he need to have his visa be approve before December 1, 2012.

The spouse will not be able to work for at least 6 months upon arrival in the U.S. With that and along with all the other expenses that a new spouse will generate, your beans better be in order.

 

I hate seeing couples trying to build a marriage on 30,000.00 USD petitioner salary.

 

Are you serious? I make way more than that and there are times where it is tough for me and my non-working wife.

 

Wow, 30,000.00 for a couple that's already a lot of money if you know how to manage it. We are only getting less than $50,000.00 a year but within 2 years since I got here we got our own house, a 2013 suv, and all the things you would wanna ask you can find it in our house and we are a member of 5 will become 6 cause my other son will soon be arriving from the Philippines. And for the fact that we need to pay our greencard here for both me and my son and petitioning my other son it really needs a lot of $$$$$.. and we still able to had a vacation for a week outside the state every summer. As long as you live the life on what you can afford and debt-free you are fine but if you live like a king spending money that you don't need you will be in trouble. Set your priority and be responsible handling your money. We started from scratch when i got here my husband is living with his parents too when we moved out the only thing we got is his bed and his computer, lol , but we're a good teamwork . 

 

I am not bragging but I just wanna inspire the OP , go get a job where you can be able to get your fiance and when she get here maybe she can help you. I only work part time but still it counts . Don't be discourage let the situation be your guide on how to make it better. Every situation is different it depends on how you handles it. Before making a decision always ask God's blessings first and you will be fine. God bless you in your journey.

I have few questions....For those Filipinas who got their NOA2 and are now in the process of obtaining their documents for the interview.

 

We just got our NOA2 last May 13. Can I now get my documents like Cenomar, NBI, Police Clearance? How old should these documents be before I present them to the embassy? Let's say if I will be scheduled for an interview sometime in July, can I present a document that is dated late May or early June? I need your advices, please. I wanted to collate some documents already while waiting for my MNL Case number.

I just thought that I'm still in K3 since we first received a notice from NVC of my approved I-129F, Then 2 days ago, my husband received a notice
to pay AOS. He paid it immediately and we have to wait 2-3 business days before the fee status is paid, right? before taking the next step.

that means you'll soon get your NOA2, it gets forwarded to NVC where you will have to call and get your Manila Case number, once have that you can go ahead that pay your Visa fee in BPI, sched your interview online or by phone then go for medical at St. Lukes

The above would be correct for a K1 visa, but this is for a spouse. It is also not going to be a K3 visa. It will be CR1 or IR1. USCIS doesn't issue visas, so their decision would be to approve the petition that allows you to apply for a visa. Three more times to mail papers to the National Visa Center and two more fees to pay. THEN, NVC will schedule your interview and you can get the medical.




I already have a case # for I-129F (k3).My husband paid $88 for AOS. What papers do we have to mail to NVC?

Are you saying you want to send tax returns for 2011? If so, I don't think this is necessary as US law does not require employers to supply employees with the W2 until February 2012. I sent tax transcripts from 2008, 2009, 2010, a letter of employment and my most recent paystub. I didn't have any problem.



What did you mean of tax transcript? is it the W2? my husband has 2009 and 2010 W2 and also he can provide recent paystub and also he has letter of
employment but no income tax return yet.

1. Is there any payment I have to pay aside from medical fee? (I am the beneficiary)
2. wud it better to wait the NVC to sked my medical? or it is ok to go for medical in advance?
3 how do I know that I will be sked for interview? my hubby is unable to contact or call NVC due to job situation
4. is it neccesarry to bring a lot of pictures aside from wedding pictures and put in album. for i will bring our wedding pictures

We have the cover sheet thingy. What happens next. Do they contact us or we contact them?




Hi, try to look at www.travel.state.gov, you can find there also the instruction on what to do next and the AOS form that your hubby has to send out.

If I ended up mailing the I-129F for the K3 anyway, will it affect the progress of my CR1? I was not sure of that initially and since it was free I thought what the heck let me file it anyway and see what is quicker. Does it make a difference?





Base in my experience, my husband mailed 129F with NOA1 from 1-130 for K3. We receive both approved I-130 and I-129F same date, but we are notified later that NVC processed my CR1. So, I don't think mailing I129f will affect the progress of your CR1. I think K3 is very rare nowadays. They still process it because I knew someone here in my country, she is under k3 process.

I included a cover letter, but I'm not sure it is required. You can add one listing all the documents enclosed in the package, in the same order they are placed.

Here's the instructions I received (after my package was sent but I did just what they said):
Please include a copy of this letter (bar code) with your correspondence and write your case number clearly (exactly as it appears below) on the upper right-hand corner of all documents.

You know how to print the bar coded coversheet, right?

Of course you can send them directly to NVC, but you NEED to enclose the bar coded coversheet. If you can print it and put it on top of your package, then you're good to go!
I sent my IV package from France, no problem.

You mailed it at the same time as the DS3032? So it means you hadn't yet paid the IV fee. I'm afraid your package may very well be rejected and sent back to you.
You don't have to wait for the instructions email, but you DO have to wait until your IV fee is invoiced, paid, and payment cleared.

I would call and ask them what's gonna happen now.




I am willing to resubmit the DS-230 package if they're going to send it back to me. I know it's my fault.

If you didn't wait for instruction and had no barcode coversheet, does that mean you submitted the package before paying the fee for the Immigrant Visa Application?

Either way, not following the correct procedures is a big no no and you're going to have to follow the instructions on the checklist in order to get everything sorted before NVC will process your application.

It's probably a good idea to give them a telephone call and ask them if you must resubmit all documents, or if you can just send the application with the barcode coversheet.

I submitted DS-230 with other required documents without waiting for the instruction from NVC to do so. I mailed it the same day I mailed the DS-3032 (choice of agent).
Today, I received an email from NVC the CHECKLIST and instruction for the next step. My concern is, the instruction says that I must include or use that bar code sheet
when submitting physical form, and my mistake was that I used the Document Cover Sheet for Affidavit of Support and also the instruction says that I must write clearly
my case number at the upper right hand corner of ALL documents which I failed to do. I hope and pray that they will consider all the documents I sent. Does anybody here
did the same thing I did? Thanks in advance for your input.

I'm confused what is missing on your form. What line in Part 5 did you actually leave blank?
It sounds like it is not the line that they claim you left blank?
Please clarify.



I think line 17 of part 5, Name of Employer (if applicable), hubby did not write the name of his employer.

We have mistake in signature but what confuses me and my husband is about Part 5 Sponsor's Income and Employment.
We checked the form I-864EZ part 5 that hubby submitted and he did not leave it blank. Wonder what's wrong.

Wife has NOT updated her passport or other official documents to use her married name yet. Wondering if/when she should do that or if we just use her maiden name for all the processing except of course the marriage certificate.



hello, i'm a filipina and my husband is american. when we filled out forms, i listed the last name name of my husband as my last name and my maiden name as middle name, no problem. Your wife must update her passport because it would be complicated if you will use her maiden name and yet your married. What I did, I attended seminar at CFO ( Commission on Filipino Overseas) to avail that certificate of attendance which is required for renewing passport ( it is only required for those women who married foriegner). Then I asked a copy of marriage certificate from NSO (National Statistic Office). When I got them both, I made an appointment at DFA for passport renewal. I used my husband's last name as my last name and maiden name as middle name. I have now my passport using my husband's last name.

Since I am going out of country i have quick question. Where will be choice of agent form which DS3032 form will be mailed.I will be with my husband for couple of months and I am worried that they will send me here in US. Will my husband receive copy of DS 3032 too. if he does then I should be okay.Does anyone know and also does my husband need to sign that or not.




Only the benefiary signature is needed. I used FEDEX to mail my DS-3032 and it took 2 business days to reached NVC. If the beneciary chose the petitioner to be her/his agent, then
the NVC will notify the petitioner through email or mail with the instruction of Immigrant Visa Bill.

well, try to apologize, there are many reasons why she done that things, first maybe she thinks she's worthless and that's why you treat her that way in front of her friend. Secondly, maybe its the outcome of her medication. I must say i am also a little freak when i get mad but just for one to two days only , but if that happens everyday after the incident, then its not normal. As I read your first post again, your case needs a good advice from an immigration lawyer. Looks like there's something going on her mind. Whatever it is she is the only one who knows it. They separated 2 months after they got married and even then she already started talking to you. I don't think she totally lost her communication with her husband since you stated her husband filed her marriage her in the Philippines 2 months ago and even filed a marriage visa. and that's 22 months (if i'm not mistaken) after they got married and at the same time you filed K1 visa for her. Don't you think someone would file a marriage visa for her wife more than 20 months after they got married if they don't have any means of communications? Does it means she was talking to you and talking to her husband at the same time? I'm sorry but its looks like "whoever visa comes first" basis here. I'm sorry its just my point of view but thinking about that, maybe that's why she got denied, she put single on her application while the truth is she was married. Does she tell you the cause of her denial?.... Seems like she lied from the very start.... Your fiance maybe can hide something from you but not with USCIS.....
