US Embassy and Consulate DiscussionAR? HOW DO YOU KNOW IN MANILA
Hi,
AR is when they want to check something.....
Security check, or they might want to have NSO send them another copy of your MC or her BC just to make sure you are all legal and stuff. They could also ask NBI for another certificate if yours is older. The point is, that this is VERY common in PI and usually takes 4 to 6 weeks. Sometimes less.

You can call the Embassy at this number which is a normal long distance call (no fee) Try to call around 8:30am their time.

Manila Embassy 011-63-2528-6300 ext 5184 or 5185

Hey be happy and thankful! We were given a 221G (refusal) and I had to find a joint-sponsor. What a headache! We sent Embassy the papers of our new joint-sponsor yesterday. Hopefully we will finally get Lorna's visa in a couple of weeks.

God Bless,
Mike

US Embassy and Consulate DiscussionImmigration time at point of entry USA
Hi,
My wife will arrive in Portland, Oregon and will only have 90 minutes to catch her next flight to Medford, Oregon.

I'm hoping immigration doesn't take to long.

Can you folks please give me your experience on length of time in immigration at your POE?

Thanks alot,
Mike

US Embassy and Consulate DiscussionFINALLY! Visa in hand!
Well today the Delbros courier handed Lorna her Visa. Still can't believe it.

At her interview March 19 the CO told her there was no way I could support the both of us based on my earnings. Even though I had plenty in property assets and sailed through NVC with no problems.

He said we needed a co-sponsor.
So after 6 weeks and beginning to lose hope, one of my best friends offered to co-sponsor Lorna.

Sent the paperwork in and 6 days after it arrived at the Embassy, Lorna's visa was released to delbros.

Thanks to everyone for their prayers and also to the regulars who were a GREAT help in the total adventure.

God bless you all......
Mike & Lorna

US Citizenship General DiscussionSimple ? about address to send to......
Hi,
I don't want to blow it on such a simple thing so I will ask:

The instructions say:
"Send your application to the USCIS Lockbox Facility at the following address:
USCIS
P.O. Box 21251
Phoenix, AZ 85036"

Sooooooo, Do I send to:

USCIS Lockbox Facility
USCIS
P.O. Box 21251
Phoenix, AZ 85036

OR

USCIS
P.O. Box 21251
Phoenix, AZ 85036

Dumb.... I know, but knowing the USCI I want to be sure!!

Thanks alot, Mike

US Citizenship General DiscussionN-400: March 2010 Applicants
Hi everyone.......
My wife had her interview 6/24 in Portland, Oregon. Waited about 15min. then she went in for the interview and was done after 15 min. The waiting room went from 10 people to zero I think because of lunch time.

Anyway, she said it was a breeze and the interviewer was VERY nice! Lorna answered the first 6 questions correctly and she was asked to show some proof so the lady looked at photos, tax transcripts and some of our bills.

She said my wife did great but on the paper she gave Lorna, the "Congratulations! Your application has been recommended for approval" wasn't checked.

Also she said that same day oaths were canceled the day before....(of course!) but we can go to Eugene for the oath ceremony. She said that you used to be able to do the oath ceremony in Medford but they closed that one down....(of course!)

So now we wait for confirmation of approval and the oath date paper.

All in all it went very well except I left my purse/wallet at a restaurant in Salem on our way home. Luckily I found their phone number and they are sending it to me.
Mike

Same problem here..... I went to the Portland, OR. office today for early biometrics (our appointment was for April 27)........

They told me no walk-ins and I would have to come back on the appointment date or after that date.

Then when I told her I just drove for 5 hrs. She said she would sneak us in. We had to wait 3 hrs but finally my wife got her Finger Prints done. They were VERY nice though!

So beware...... not all offices take walk-ins!!!

Removing Conditions on Residency General DiscussionPhilly Biometrics
Hi, I'm just beginning to learn about AOS and I-751 for my wife.

I'm trying to learn about the biometrics appointment.
Can you tell me what they do at this appointment and what we would need to bring.

We will have to drive 250 miles to Portland, Oregon, which is the nearest office. To bad we have to be there in person.

Anyway, I thankyou in advance..... Mike

Removing Conditions on Residency General DiscussionQuestion about joint taxes
Hi,
We are getting ready to send in the Removal of Conditions package in March and I have a question concerning joint taxes.

I (USA citizen) was unemployed all last year and my wife(from Philippines) works part-time as a care-giver.

What we would like to do is have my wife use me as a dependent for tax refund reasons. She will have a W2. Then I wouldn't file any taxes forms.

But I don't know how this would go over with the I-751 process.

Maybe it would be better to file jointly even though I don't owe any taxes and sacrifice any refund she might get for me being her dependent.

Any insight would be appreciated......
Thanks, Mike

John, Thanks for replying....
Do you have a link to a webpage that declares that? I haven't found one....

The examples that I have seen are from 2002. I imagine the rules have changed since then.
Thanks though, Mike

Removing Conditions on Residency General Discussionquestion about notorized affidavits
Hi,
I've been reading everywhere about getting my friends affidavit about knowing us and seeing us together.
I see different explanations.

Some say these affidavits don't need to be notarized and some say they do.

What's the rule as of 2009?
Thanks a lot, Mike

Removing Conditions on Residency General DiscussionI-751
Hey franklocks,
just an update on my situation....

Today my wife received her biometrics appointment letter.
We never got the NOA.

Lorna sent packet 3/9 priority mail
Received 3/12
Personal Check cleared 3/16
Received Bio Appointment 3/30 (scheduled for 4/15)

So it took 18 days from the time they received our packet to today when we received the Bio appointment letter.

If we don't get the NOA before we go to the bio appointment, we will ask them to stamp her passport for the 1yr extension.

Hope this is helpful for you...... Take care, Mike

I would be curious about this as well.
I see my cashed check in my bank dated 3/16 and they received the packet 3/12. I'm just hoping they don't screw up my mailing address like they did for the visa notices. Please tell Franklocks and me how long it took to get your NOA after they received your packet.

And good luck Franklocks!

Hi,
Just to let you nice folks know, My wife received her approval notice today.
They received our package March 12. I'm amazed how fast it was......
Online updates still show only that they received our petition. :-) No email.
Anyway, I hope this is good news for those in the process.

PhilippinesAfter over a year.... here she comes!
Thanks Mike,
I'm happy your sweety is adjusting so easily.

Lorna has been here about 4 days and time is flying... She is doing well here in Oregon. I live in the woods and she loves the quietness, birds and squirrels.
A couple of issues....
She is cold until about 70 degrees. so she dreeses warmer than usual right now. I'm sure she will adjust.

All I have is american tv.... she has trouble with the speed of talk sometimes and slang. Again she will adjust and I'm thinking about getting the Filipino channel(I have directv)

One problem is her skin is getting very dry.
We asked around and it seems it could be because of the dryness in the air here compared to PI. I bought her some stuff for her face and one lady recommended drinking a lot of water because her body is used to absorbing the wetness in the air in PI.

If anyone has suggestions on how to remedy Lornas dry skin, please post.

But otherwise its great! She is delightful and easy to be around!!

And YES! It's FANTASTIC to have all the immigration stuff behind us!!!! Thank you LORD!!

Lorna & Mike

Congratulations Mike and Lorna!!! It is such a relief to have all of this finished, isn't it? A big load lifted, huh? Now you can get along with living and learning. I must admit since Milah Jean arrived here a bit over 2 months ago, I've had very little time to browse VJ or do anything else internet related. We've just been so busy, and I absolutely love it!!! We're praying that Lorna's adjustment is as easy and amazing as Milah Jean's. Sometimes she thinks she's never left her place since we can find nearly everything here she is used to eating there. She's a great cook, so I'd say that 8 of 10 meals we enjoy are totally Filipino food. The negative side effect...we have both added a few pounds...but it's oh my soooo good!!!We thank God every night for this amazing miracle and the blessings He continues to bestow upon us. What a fantastic adventure. Good luck!!!

Michael and Milah Jean

PhilippinesAfter over a year.... here she comes!
Hi everyone,

Finally after a year+ of immigration stress, Lorna leaves Cebu today for Manila.
She'll spend the night there and leave in the morning for Tokyo.

Then to Portland, Oregon. Then finally arrive in Medford, Oregon Wed. afternoon.

The positive for taking so long is I have been able to add a master bedroom and a brand new bathroom as well as MAJOR cleaning, hehehe!

I just wanted to thank everyone at this site for all the great info and help and friendship to help get us through all of this.

I can't imagine how we would have done all of this without this site and you folks.

Thank a bunch and good luck and God Bless everyone going through the journey!

Love and peace!

PhilippinesManila Embassy Interview/Visa Status
Ooops! Sorry PW!

I forgot to post in this thread, hehehe! Going crazy now! :-)

Yes we finally got our visa after being refused at the interview cuz of my small income. Don't need much to live on here in Oregon and I had plenty of assets that NVC accepted.

Anyway, the CO told Lorna I needed a co-sponsor.

Yes, the papers got to the CO only 6 days after getting to the Embassy. I was shocked cuz it was so fast.

And actually it took 5 biz days for delbros to deliver to CEBU(lapu-Lapu)

Anyway Its been so great having this site to learn from and ask questions and read about other's adventures. But especially to keep me company while I went through the visa process without my wife.

Thanks everyone. Bought the tickets (NWA $850.00 to Medford Oregon)
Lorna will be here June 6 after she spends a week in Basilan visiting her family and saying goodbye!

Love you guys.... God bless and I pray for everyone's happiness and success.

The Boat leaves Cebu on Monday, but it is Election Day Monday.

Does anyone know if the boat will still leave on monday? If not will it leave on Tue. instead? Or will boat delay until the next monday?

Thanks,

Kim,
I also am wthout my wife due to AR during her interview March 19.

I didn't see why you are on AR....

For us, it was my lack of income even though I had plenty in property assets.
The CO told my wife "there is no way your husband can support you on what he earns." (Not true!) And that she needed a joint sponsor.

This has been killer for us as I had no one to be the joint-sponsor. We were going crazy with all hope fading.

But Glory to God a good friend's wife stepped up and signed the papers!
Finally I will send in the required papers tomorrow. Hopefully get our visa within a month. We are overjoyed and thankful.

Anyway Kim this just shows you and us that it's God's speed....not ours... and He has a devine plan for us.... in His time frame.

Good luck and God bless!!
Mike

It looks like everyone's getting their visa and I'm only the one left here. I feel so depress. :crying: :crying:WAH!!WAH!!

Thanks alot PW...
Actually Lorna is a CR-1.

I get confused on who is the visa petitioner me or her...???

In an immigrant visa case, once a consular officer has issued an immigrant visa, no Form I-864, I-864EZ or I-864A may be withdrawn unless the visa petitioner also withdraws the visa petition.”

God bless and good luck to you!
Mike

Hi guys, Im off for our medical, leaving soon, hope to be there before lunch, I dont like driving in Manila too much of a hassle. Wish me and my baby luck :)

Good luck!

I agree on the driving in Manila.....I was very much in shock with the driving in the Philippines when I arrived the first time. :o

Guilty! I drive like a Manila bus driver hehe. My fiance steps on his "imaginary brakes" all the time

You posted something recently for Glenn about if Lorna was to leave me before her lifting of conditions (CR-1) then (1) she would need me to do the lifting of conditions process? I mean...I'm trying to cover all bases for my co-sponsor. (2) If she can't get her conditions lifted after 2 yrs because I'm not in her life, then her visa status would be terminated? (3) Which would relieve the co-sponsor of obligation?

(4) This is a "what if" scenario that must be looked at.... just like what happens if I die before she becomes a citizen.

1. Since Lorna will come on a K visa, her conditional residency would be based upon her marriage to you. The major condition that she needs to fulfill to remove condition is for her to stay married to you and nobody else. A CR-1, however, may lift conditions on her own if she married in good faith but is a victim of violence or abuse by her US citizen spouse. So never, never hit a wife or she may use this against you in the future.

2. If you are not in her life and there is no proof of spousal abuse, her petition to adjust status would most likely be denied. She will be asked to leave the country but most people just stay and become illegal immigrants. If you and your co-sponsor do not withdraw your I-864, both of you will be responsible for her for 10 years (?) I believe. A sponsor or co-sponsor has the option to withdraw I-864 while the adjustment is pending. Do note however that if your spouse came as CR or IR, which is an immigrant visa, you cannot withdraw I-864 without withdrawing the visa petition itself. Here’s what the USCIS say:

Withdrawal of an affidavit of support or Form I-864A . A person who has signed a Form I-864, I-864EZ or I-864A may withdraw the Form. If the person does so, USCIS will adjudicate the application for adjustment of status as if the withdrawn Form I-864, I-864A or I-864EZ had never been filed. In an adjustment of status case, a withdrawal of the Form I-864, I-864EZ or I-864A is not effective unless it is in writing and USCIS actually receives the withdrawal before the final decision on the adjustment application. In an immigrant visa case, once a consular officer has issued an immigrant visa, no Form I-864, I-864EZ or I-864A may be withdrawn unless the visa petitioner also withdraws the visa petition.”

3. Lifted from http://www.uscis.gov...d3f01ed23e3e117

Termination of Sponsor’s Obligation and Enforcement. The obligations created under Form I-864 and I-864A terminate when the sponsored alien:

• Becomes naturalized
• Is credited with at least 40 quarters of employment in the Social Security system;
• Loses or abandons his or her lawful permanent resident status; or
• Dies.

4. If you die before you marry her, she has to go home as she will be unable to fulfill the K visa requirement, that is, to marry the petitioner within 90 days. But if you die before she becomes a citizen, she can adjust status on her own. Death will not deprive her of her right to stay in the US if she married in good faith.

Hi Patiently Waiting....

I'm really excited I finally found a co-sposor for my wife Lorna.....

You posted something recently for Glenn about if Lorna was to leave me before her lifting of conditions (CR-1) then she would need me to do the lifting of conditions process? I mean...I'm trying to cover all bases for my co-sponsor.

If she can't get her conditions lifted after 2 yrs because I'm not in her life, then her visa status would be terminated?

Which would relieve the co-sponsor of olbligation?

Believe me I have no reason to beieve she will leave me. This is a "what if" scenario that must be looked at.... just like what happens if I die before she becomes a citizen.

Anyway, any help on this would be appreciated.
God bless, Mike

What should I do? It has been over 48 hours now since I have heard anything related to her.I have no choice but to feel that I have been used. We were married in the Philippines on December 29, 2005. Do I file for divorce here in USA? I have emailed my attorney, but no response. I think he is only good at cashing checks. He was a major waste of $3000 for sure. Did she do this just to get here in the USA? If so, how can she stay? We had not applied for AOS. I don't like being used and want to know where she is.

Rosemarie will not be able to adjust status without you and remember, you are the only way she can legally adjust. However, since you are married to her already, she can legally stay in the US for two years before she will need your help in removing conditions. As suggested earlier by another poster and since you don't know what she is thinking right now, protect your finances in the meantime. She may have broken your heart but don't let this situation break you financially too.

Even if you were married in the Philippines, you may file for divorce in the USA. A US divorce between an American citizen and a Filipino citizen is recognized here.

Luvbugs, I will update the list tomorrow night. I'm sleepy. Good night everyone!

I'MMM BAAAAACK!

Wow sorry to impose on Gelnn's problem/thread and my heart and prayers go out to you Glenn.

I think I finally got a joint-sponsor to finish up my wifes's visa stuff. Wow! What a journey/nightmare the last 2 weeks have been.... more on that later.

I have a question about Alien # on the I-864.

Lorna has never had an alien # and I just wanted to make sure she still does not have one.

We got all the way to the inteview with her CR-1 before being put on AR so I'm asking you folks if she has been given an alien # somewhere along the process.

Since she is not an alien yet, I assume she doesn't have this # yet until she actually becomes an alien.

Any thoughts? I really want to make sure we get the joint-sponsor's I-864 correct at this point. :-)

Thanks for all your help and prayers.... and God bless you all!
Mike

IR-1 / CR-1 Spouse Visa Process & ProceduresNVC is awaiting biographic forms from the petitioner.....
what I have done with my sweety for certain docs is.....

Have her go to a internet cafe, download the specific doc we need her sig on, and then have the cafe print out the page that needs her sig.

Then she just takes a blank sheet of paper and puts it on top of the doc. and she signs the blank sheet of paper in the correct spot as if she was signing the doc.

Then she sends me the blank sheet with her sig. I fill out the doc on my pc.... and then print out the doc.... On the blank sheet with her sig.

Now I have the doc in my hand with her original sig on it. Worked for the G325A (Biographic doc) and I'm receiving another blank from her with her sig on it for the DS230. Works great.

IR-1 / CR-1 Spouse Visa Process & ProceduresNVC is awaiting biographic forms from the petitioner.....
Hi,
Yea this is kind of confusing.
I read a post here that for the original petition, the USC is the petitioner, and your wife is the beneficiary.

But once you start the actual visa stuff at NVC, your wife becomes the petitioner/beneficiary since she is actually the one applying for the visa, not you.

IR-1 / CR-1 Spouse Visa Process & ProceduresOriginal of all documents
interesting answers....

I wonder if this question makes things more complicated, hehehe.............

I am supposed to send originals(her BC our MC etc.) to NVC. I ssume these originals will get forwarded to the embassy. Are these the originals that you are saying we will get back at the interview?

Because others here have posted that my sweety should also bring with her, originals to the interview.

So now this is confusing.... if the originals sent to NVC are forwarded to embassy for interview, why would my sweety also need to bring originals to the interview. Hmmmm....

:help: Ok,
I mailed my I-130 July 3.
Nebraska received it July 7.

Finally got my cashed check back to my bank July 26 it was cashed in California(case transfered I suppose)

Got my case # off the back of check and signed up at their website.

Now nothing... no update at website, no email, no nothing....until,
I got an email from CSC Aug.8 that said docs were returned by the post office and I needed to call them and update my mailing address. There was also an update about this at the website.

So I did....called them the same day and this time I gave them my P.O. Box.

Ok now nothing, nothing and nothing.

I have never gotten any kind of update for NOA1, no confirmation on mailing address update and now it Sept 10 over 30 days since I updated my mailing address.

Wow! I sure would like to play  with you guys here but I don't even have a NOA1 date. What do you think?
I'm being patient  here but I would like at least to know that they got my updated mailing address and it would be nice to know my noa1 date.

Since they sent me something.... it must have been my NOA1. Ahhh! But i never received it.

Any ideas?
Thanks
