As someone who waited 8.5 months for my noa2, I can tell you your congressman won't be much help. But your 2 touches could mean it was being adjudicated and the approval could be on its way already. I never got a 'touch' from a call, unless they actually did something to the file.
If it goes on your best bet IMO is the USCIS ombudsman. There is a form you can download, dhs 7001, or something that you can request he look into your situation. I believe it's more effective then a congressman who only gets a form letter back saying the same thing they tell you on the phone. I can email you the form if you can't locate it online.

Well I'm not counting my chickens before they hatch, anymore. Assuming everything goes smoothly she'll arrive in May sometime. But she has an extra requirement there of a fiancee' seminar by the government there, she's waiting on a replacement passport as hers was too close to expiration - long story short there are still complications from here to there wacko.gif

Everybody wonders what the deal is with some petitions getting an easy ride and others tough sledding. My new theory is they pick some to screw up and then they just keep screwing them up at every possible step of the way. It seems to happen to many who have had long waits,etc. Makes as much sense as any other reason blink.gif

I thought I was out of the woods when our case made it to the embassy, but they have a FUBAR new interview scheduling system with no packet 3 or 4, have to call to schedule but they don't tell you that you need to call, it's $9 a call and it's never the right time to call ARRGGHH

Hi US Wendy & Virgillionaire:

First of all, thank you for taking the fight to the streets for us all. I for one, really appreciate your efforts a great deal.

Here are some points to make please. I am sure you probably have thought of most of these, but just in case:

It is obvious to us that especially since April 2007; things at USCIS appear to have gotten gradually worse instead of better. For example, at the Vermont Service Center, the average time for our community members to get their K1 VISA NOA 2 has gone from less than 30 days in May 2007 to over 120 days and still climbing now.

Some of our concerns include:

1. Significant delays in the processing of petitions. Many of us who filed in May are noticing that an extremely small number of petitions have been processed/approved since September 1.

2. Information provided by USCIS’s call center employees is often misleading, incorrect or incomplete and almost always apathetic.

3. We feel it is entirely inappropriate to prioritize WORK VISA applications over Family-Based, Non-Immigrant Petitions and to add insult to injury, allow many types of VISA seekers to pay extra for 15-calendar day premium processing service, but not us.

4. We understand the need for security checks, as we are aware of our national security issues, but we have good reason to believe this is not the source of the most recent delays. Only the truth and some swift action on the part of USCIS can alleviate some of the stress associated with this process. Our lives, along with our loved ones abroad, are on hold and we have no idea when this first part of the immigration process will conclude.

5. The wait for a petition to clear the USCIS Service Center, reach the National Visa Center, then the appropriate Embassy and, finally the attendance of the beneficiary at the scheduled embassy interview can add an additional 4 – 12 months to an already excruciatingly slow process. The USCIS needs to set a reasonable goal of 90 days and/or have expedited processing immediately available for K1/K3 VISA applicants.

6. The strain of this process (both financial and emotional) is taking a serious toll on the health and well-being of many US law abiding citizen’s who are trying to follow the laws to bring their loved ones to the US by legal means. Our frustration level with USCIS' inability or unwillingness to ease/improve this process is reaching a critical point.

7. We, as a collective, have some expectations which include:
a. A formal response to our concerns and continuing empathetic communication with customers suffering separation from their loved ones.

b. Immediately improved processing times with a new goal of 90 days for petitions as we believe the USCIS goal timeframe of 6 months to process a K1/3 VISA at the service centers is insensitive and inadequate for our needs. As with any company, if the new 90-day standard cannot be met with good management and talented professionals, then the organization should increase staff or streamline processes—maybe even outsource the function utilizing the creative talent of a good US company to provide our citizens with better service.

Many find that the wait and the visa process take such a toll on their relationships. We have members who are married and just had babies, but the husbands petition is delayed or held up in this red taped process. They haven't met their own children yet. We have some that were denied and really have no true understanding why. I myself will go through the Egyptian Embassy in Cairo, which is known as one of the slowest ones. After waiting 4-6 months for our NOA2, we then wait for NVC to forward the petition to the Embassy which can take another month or more. After 5-7 months from filing we hope to have our interview. After our interview the Egyptian Embassy can take an average of 4 more months of Administrative Processing. Some have waiting 10 months or longer for their visas to be approved and issued after an interview. What makes it hard is that each Embassy is different. Some give the visa the day OF the interview..some a few weeks. This is why VisaJourny is so important to us who belong. We understand each others pain. We travel this road together in hopes that one day, we will each find our own happy ending. For now, we have our hopes, our dreams and the support of others who travel the same road we do. Byron, Mirla...and others from early May deserve answers as to what the wait is on their petitions while others of us in June are starting to get approvals...Im happy we are...but they deserve an answer. What if it was one of us June filers and December comes along most others in June are done and we still wait. How would I feel???? I went to the Dentist this morning, always fun....then I arrive home to find all this depressing information. Just when I was about to throw myself off the balcony, I see this post by Mirla. Anyhoo, the reporter from Washington Post is coming to interview me for a second time tomorrow night and when the article hits the press, I'll let you all know. I am hoping it comes out good and there is some MORE publicity for our cause.

Just keep writing EVERYONE with any kind of political or media power whatsoever-->AGAIN, Congress COULD give the Ombudsman more power to effect change. Right now he can only rattle a few cages, but he can not change the outcome of our petitions or make them work any faster, really. It is very strange that a non expedited (i.e. Cuban, military, etc.) petition filed on June 21 has been adjudicated when there are tons of May filers still waiting. And how does a petition get adjudicated, approved and a NOA2 mailed without even a touch being recorded? I have no explanation for this. wacko.gif

It is inexplicable that they would jump ahead that far. The only logical answer i see is maybe being from Germany they don't feel fraud checks, etc are needed cause it's not exactly a step up from there to here these days.

I think it has to do with the security checkes to be sure we are eligible. As stated before and read in recent postings that included news type articles or USCIS information...I think batches are sent off for security checks... the way I understand it or see it going is as follows:

1. they get our petition, receipt it then put them in date order recieved
2. they then pull batches to send off for background/security checks
3. as those checks complete the petitions are then filed again in order recieved BACK. Maybe NOT in the order they were ORIGINALLY received. But in the order the check is completed.
4. Adjudicators then get a batch to work....mixed dates at this point but still within reason.
5. The adjudicator then processes each petition in this batch. At this point one of a few things can happen
A. Its approved immediately
B. They RFE it
C. They have to "dig" and "wait" for verification or other information they have privy to
6. The approved petitions get immediate noa2
7. The RFE's are placed in files...worked as soon as they receive the return RFE info
8. Or for those files they are waiting on "other" checks or info on from other agencies...they get filed to...till that info comes in.

Several things can make one petition much later than another... Regardless of the date they recieved it. They only promise to "work" the petitions in the order recieved. But many things can happen along the way to slow it up.

I hope this helps...I do feel for those May filers still waiting...but hang in there..every day is one day closer to your noa2.

I still think they are working on other priorities and it will be an uphill battle to get them off that track. While I'm being negative ... whistling.gif I wonder due to the consolidation of centers, and the Iraq visas if the employees and contractors they are adding are going to be enough to improve things. It's ridiculous to raise the rates to $440 from $170 saying you need to fund good service and then throw all the k1s in a pile and say will get to you when we get to you protest6wz.gif so I'm still in protest mode protest6wz.gif

Immigration Security Checks—How and Why the Process Works
Background
All applicants for a U.S. immigration benefit are subject to criminal and national security background checks to ensure they are eligible for that benefit. U.S. Citizenship and Immigration Services (USCIS), the Federal agency that oversees immigration benefits, performs checks on every applicant, regardless of ethnicity, national origin or religion.
Since 2002, USCIS has increased the number and scope of relevant background checks, processing millions of security checks without incident. However, in some cases, USCIS customers and immigrant advocates have expressed frustration over delays in processing applications, noting that individual customers have waited a year or longer for the completion of their adjudication pending the outcome of security checks. While the percentage of applicants who find their cases delayed by pending background checks is relatively small, USCIS recognizes that for those affected individuals, the additional delay and uncertainty can cause great anxiety. Although USCIS cannot guarantee the prompt resolution of every case, we can assure the public that applicants are not singled out based on race, ethnicity, religion, or national origin.
USCIS strives to balance the need for timely, fair and accurate service with the need to ensure a high level of integrity in the decision-making process. This fact sheet outlines the framework of the immigration security check process, explaining its necessity, as well as factors contributing to delays in resolving pending cases.
Why USCIS Conducts Security Checks
USCIS conducts security checks for all cases involving a petition or application for an immigration service or benefit. This is done both to enhance national security and ensure the integrity of the immigration process. USCIS is responsible for ensuring that our immigration system is not used as a vehicle to harm our nation or its citizens by screening out people who seek immigration benefits improperly or fraudulently. These security checks have yielded information about applicants involved in violent crimes, sex crimes, crimes against children, drug trafficking and individuals with known links to terrorism. These investigations require time, resources, and patience and USCIS recognizes that the process is slower for some customers than they would like. Because of that, USCIS is working closely with the FBI and other agencies to speed the background check process. However, USCIS will never grant an immigration service or benefit before the required security checks are completed regardless of how long those checks take.
How Immigration Security Checks Work
To ensure that immigration benefits are given only to eligible applicants, USCIS adopted background security check procedures that address a wide range of possible risk factors. Different kinds of applications undergo different levels of scrutiny. USCIS normally uses the following three background check mechanisms but maintains the authority to conduct other background investigations as necessary:
• The Interagency Border Inspection System (IBIS) Name Check— IBIS is a multi-agency effort with a central system that combines information from multiple agencies, databases and system interfaces to compile data relating to national security risks, public safety issues and other law enforcement concerns. USCIS can quickly check information from these multiple government agencies to determine if the information in the system affects the adjudication of the case. Results of an IBIS check are usually available immediately. In some cases, information found during an IBIS check will require further investigation. The IBIS check is not deemed completed until all eligibility issues arising from the initial system response are resolved.
• FBI Fingerprint Check—FBI fingerprint checks are conducted for many applications. The FBI fingerprint check provides information relating to criminal background within the United States. Generally, the FBI forwards responses to USCIS within 24-48 hours. If there is a record match, the FBI forwards an electronic copy of the criminal history (RAP sheet) to USCIS. At that point, a USCIS adjudicator reviews the information to determine what effect it may have on eligibility for the benefit. Although the vast majority of inquiries yield no record or match, about 10 percent do uncover criminal history (including immigration violations). In cases involving arrests or charges without disposition, USCIS requires the applicant to provide court certified evidence of the disposition. Customers with prior arrests should provide complete information and certified disposition records at the time of filing to avoid adjudication delays or denial resulting from misrepresentation about criminal history. Even expunged or vacated convictions must be reported for immigration purposes.
• FBI Name Checks—FBI name checks are also required for many applications. The FBI name check is totally different from the FBI fingerprint check. The records maintained in the FBI name check process consist of administrative, applicant, criminal, personnel and other files compiled by law enforcement. Initial responses to this check generally take about two weeks. In about 80 percent of the cases, no match is found. Of the remaining 20 percent, most are resolved within six months. Less than one percent of cases subject to an FBI name check remain pending longer than six months. Some of these cases involve complex, highly sensitive information and cannot be resolved quickly. Even after FBI has provided an initial response to USCIS concerning a match, the name check is not complete until full information is obtained and eligibility issues arising from it are resolved.
For most applicants, the process outlined above allows USCIS to quickly determine if there are criminal or security related issues in the applicant’s background that affect eligibility for immigration benefits. Most cases proceed forward without incident. However, due to both the sheer volume of security checks USCIS conducts, and the need to ensure that each applicant is thoroughly screened, some delays on individual applications are inevitable. Background checks may still be considered pending when either the FBI or relevant agency has not provided the final response to the background check or when the FBI or agency has provided a response, but the response requires further investigation or review by the agency or USCIS. Resolving pending cases is time-consuming and labor-intensive; some cases legitimately take months or even several years to resolve. Every USCIS District Office performs regular reviews of the pending caseload to determine when cases have cleared and are ready to be decided. USCIS does not share information about the records match or the nature or status of any investigation with applicants or their representatives.

I suspect you are correct. Which means the only short term solution is an adjustment in how they prioritize petitions for processing. Who makes that decision? USCIS or congress? Does anyone know? I get the feeling it is a combination of the two.


If congress set them for K visas it would be law, not a guideline. A couple types of visa have a time limit by law though.

Back to Hershey's good.gif :

1) Ok we send them to P. Novak. How about P. Novak, adjudicators and staff? We want to stay under the gift limit to one person remember. And we want the staff to get some and think of us also.

2) I'll check on a special price and call in setup. But I don't know if we'll have enough orders to get them to do this - it may be cheaper for them to grab orders off the shelf even if they include a mug. They don't even offer a 5% discount til orders get over $1000.

3) One message sounds like a good idea. Want to focus on our being lowest priority, I think. I like some of the catchy slogans by Amrssnowangel as a start. Here's another draft:

Hershy kisses are a good idea and we can have them ship directly from Hershy's as long as we all agree and set a special K-1 friday and deliver a truck load, that way we can get some media attention or atleast Oprah show or some other TV Shows. I am for it.



Ok how about this - at www.hersheygifts.com click on hershey kisses and they have the kisses as a small gift package in different themes. Like a half pound with a crystal dish or with a coffee mug, etc.

The prices are $20, $25, $30 for these. This way we can stay reasonably close to the gift limit of $25. And people can send as many or as few as they like. I might send 5, e.g.

We can also add a gift message at the site 'checkout' where you pay ... something like "just thinking of you working so hard on my case, hope you are thinking of us k1 people waiting to KISS our loved ones". Or put your name and loved on it if you like so they know it's personalized. Of course all sent on about same day and maybe address to "VSC adjudicators and staff".

These gift baskets are under the "Thank You" theme under hershey kisses on the website. I know we may not have that much to thank them for right now, but it's kind of reverse psychology or something to get them to feel a little twinge of guilt about forgetting us.

If it was up to me the whole world would stop until no one was hungry or abandoned. Of course it's nice they are helping these people, maybe they could even manage to make Iraq less of a living hell someday. And maybe some help from Iraqi's themselves would go a long way, frankly. But if they were doing refugee processing and the K1s it would be easier to take. Maybe leave behind the office slacker for us, surely he could manage one NOA2 a day and I think we would be happy.

I don't think it is too much to ask to get some consideration. Because the NOA2 is really such a minor and historically fast step, 6 months is a little ridiculous. And BTW, what's to stop them from cruising past the 6 months date? Nothing, it's only a guideline as I understand it. Some of the other types of visas have a legal requirement to be done in 2 months. And that's probably what we'll start hearing at 6 months ...

There's no rule against calling. And the only way people here have been getting any answers is to fake an rfe. But you have a real one, so if you sent what they wanted I'd call right away and ask if it's what they need. Somewhere in this thread is the technique on how to get to a real person ...
