Yeah there are people who get issued two visas. Also people who supposedly requested a CF1 at the time of K3 and received it. Of course we want the CR1. We're planning on going to both, I think it would be stupid not to ignore the first interview and at least request a CR1 then if nothing else. But my question was what if we didnt say anything about the CR1 on K3 day and ended up getting both? Any implications with that etc?

I can't keep track of that huge Manila thread so I thought I'd go for it out here. We have a K3 interview this coming 16th of May and CR1 on the 30th. Has anyone ever just interviewed for both without mentioning to the embassy they have another interview soon? I think it would be cool to do both and have both visas. Kind of a security blanket. But on the same token it would be nice to tell them and try to get the CR1 on the 16th instead of the 30th if at all possible.

My question is are there any risks involved with that?

2nd question about the medical. Since we have 2 interviews I assume 1 medical exam is OK? So like if we interviewed for K3 on the 16th and then the CR1 on the 30th, the initial medical will be there at the embassy for them to access yes?

Hey everyone :) Thanks for the info! We just received the Packet 4 yesterday via DHL. They had sent us a text message asking to call them. When we did, they informed us that the packet had been sitting at the local DHL office for a week! They also told us they did not have anyone to deliver the thing the whole time. Pahuway! Give me a break! So if anyone seems delayed in getting there packet 4 in the Philippines, may want to make a follow up with DHL to make sure they are not sitting on it. *sigh*

I have a question. You said you were asked by the pre-screener for the marriage certificate, birth certificate, I-864s, and NBI Clearance. Didn't you send these documents to the NVC? Should I be having my wife getting additional originals of all these documents to take to her interview? Thanks.

Yeah we actually sent in all original documents to NVC then also took originals to the interview. Even when packet 4 arrived it confirmed that. I would definately take official copies\originals printed on the NSO paper with you, even if you submited originals to NVC. I think the packet 4 instructions emphasize that too.

We actually did not receive any of that back either from the CO or releasing when we were finished. Not sure if thats normal or if it will be returned to us with the visa?

Ahhhh where to begin. I will try to detail this out in a way that will (possibly) calm nerves that we experience prior and during the interview process.

We stayed at the Blvd Mansion which is right (caddy corner) accross Roxas Blvd from the US Embassy. Great hotel for anyone looking to stay close to the Embassy. Our K3 appointment was set for 7:30am and we left the hotel at 6:30am. It only took a few minutes to walk to the Embassy enterance which is in front of the Bayview hotel, not the larger gated enterance that we first thought was it.

At first site it appeared to be a long single line, but as we got closer the security guards were there to view our appointment letter and direct us to the correct line. It was quick and painless after showing them the letter and ID, we were inside the door for security screening within 5 minutes.

After passing security we simply followed the blue arrow on the wall that pointed to the immigrant visa unit. Once inside the security directed us and all others to the seats. Nobody had nunmbers so with our nerves the way they were, we were kind of concerned. Within a few minutes the two ladies at the receiving counter started calling people by name to come over. It moved quick and we were called within 10 minutes. They took our proof of payment, DS-156, DS-157, appointment letter and gave us a number; then we sat down again.

Now anyone that has followed our story knows we had two visa interviews. One for K3 today and one for CR1 May 30th. Mai asked the ladies at the receiving counter if we could get the CR1 but they just told us to ask the pre screeners.

The numbers were called at a good pace, not like motor vehicle back in the states. Some would be called to get finger scanned while others were called for pre screening first. In our case, we were pre screened first before the finger scan.

We had to stand up and sit down quite a few times as we were called then told to go sit down again. At first we were worried about that, but it is no big deal.

At the pre screener winder we discovered the pre screener was very friendly. I asked him right off the bat if we could just go through with our CR1 interview since our paperwork is complete and that interview was only 2 weeks from now. The pre screener was very cooperative and pleasent and asked us to take a seat while he went to get our CR1 file. About 5 minutes later he called us back to his window and said it's no problem whatsoever. From that point on all processesing was done for CR1 and not K3.

On an interesting note, the pre screener told us that if they had not received our CR1 paperwork, we could STILL PROCEED WITH THE K3. They never suggested we return to the embassy for the CR1, they were quite happy to just give it to us right then.


The pre screener told me I could not help Mai answer the questions he was about to ask. The questions the pre screener then asked are these:

Who is the petitioner?
How and when did we meet?
Whats your job?

He took our marriage certificate, birth certificate, I-864 from myself and my co sponsor, NBI Clearance and proof of relationship.

It was a bit unnerving because he was scribbling comments on a green peice of paper all the while he had us at the window and as he leafed through our paperwork. I tried to catch a peek but he kept it pretty well out of site.

He then told us to take a seat and wait for the number. This was the start of real wait and when the biggest test of nerves came to be. With every chime of the number bell, our hearts stopped beating for a moment. Some people were in the consular interview room for a while and some were in and out. It appeared everyone was happy that came out of those rooms.

Finally about 30 minutes later our number flew up on the display and we went. The CO was friendly and polite and we shared a couple jokes and laughs, even though I was freaking out inside. The CO then asked us these questions:

Have we been married before?
Do we have kids?
What was college course of study?
Whats your job?
What do you plan on doing when we get back to the US?
Whos your current employer?
Was I domiciled in the US still? (I've been in the Phils since April of 2006)

It was really pretty painless and good. He leafed through our thick packet, taking a brief moment to look at photos and all the documents.

I noticed when he was leafing through the packet that there was a pink stamp on the front that said approved. We did not notice him stamp the packet, but it was already there before we got into the interview.

When he was done leafing through the packet he looked up and said he was convinced and said it is "the real deal". He also complimented us on the quality of our supporting documents and papers, which really felt good to us. Then he said we are approved, congratulations and said to take a seat and wait to be called to releasing.

5 minutes later at most, we were already called to releasing. They put some stamps on our paperwork and gave us the delbros slip. We went to the delbros desk, paid them and left. WOW!!!!!!

All in all it was a quick and painless prodeedure. The only thing that surprised me was the interview. I had always figured it would be like a job interview; personal behind the scenes\closed doors type atmosphere being probed and grilled in more detail. Instead, it's just a simple small room with no door and people are outside of that doing there own things all the time we are interviewing behind that thick pane of glass.

So now we wait for Debros to deliver the CR1 then head back to Cebu and try to get back to the US by May 30th.

For anyone who had two interviews like us, you should have no problem getting the CR1 if you ask the pre screener about it and all your paperwork is in order.

I have no advice other than wear a smile, be confident and crack some jokes of the opportunity presents itself. It cant hurt and it helps release the tension and develop maybe even a very slight repor with the CO :)

People who pull a stunt like this makes it harder for the rest of the Filipinos to get US tourist visas. When I was about 8yo, we had a neighbor who went to the US to "visit" her brother. She never came back. She left her husband and 3 sons. I heard that she got married to a USC, how could this be when she was still married to her husband in the Philippines? This was back in the late 80's, so I guess tracking records across the globe wasn't as easy as it is today.

I'd say give ICE a call.


Yeah I am really considering it for several reasons. Not only for her own good if she ever wants to reside in the US but for the families sake. Well of course the small reason that it pisses me off she would do such a thing and makes it harder on us.

Well his wife is there illegally. She is overstayed by 2 friggin years! Her mom is there legally for quite some time to an american.

I talked to her last night and she said she has no intention to go back and will lie on her paperwork. So of course now I have lost all respect for her and I refuse to even visit her once Mai and I get back to the US. Just makes me sick. If I get her address can I help get her deported? hehehe

Greetings all. I am writing on behalf of a cousin of my wife. She came to the US on a visitors visa but remained after it expired. She was pregnant upon her arrival into the US and gave birth to her son there. The father is not in the US and continues to live in the home country of his birth. She is trying to become a legal citizen of the US. Is that even possible? If so what would be her course of action? I am thinking that because she over stayed her visitor visa, they wont allow her to become a citizen. But then we have her child that was born in the US. Any information on her situation would be greatly appreciated. Thanks everyone!

Yeah I kind of figured there is not much hope. I think she is going to try and file an adjustment of status. It's hard to tell her those things because she is my wife's cousin and I really don't know allot about all of this stuff. One thing I forgot to mention was that her mother is in the US as a legal resident and it was because of her that she was able to come visit in the first place. First: why would you, or she, think she can become a citizen? One must begin as a Permanent Resident first.

Second: on what basis does she plan to apply to adjust status? Ask her which category she fits at the beginning of the application.

Her mother can not petition for her for an immediate immigrant number.
Her child can not petition for her until the child is 21 years old.

She needs to go home, or live here illegally. Unless she has some other basis for immigrating, she is wasting her money and time to apply for benefits.


Well first off, she is my wife's relative so I am handling this with kid gloves. I don't know enough to make any assessment on whether or not she can become a resident or not, thats why I am posting my questions here. I am not sure why she thinks she can fill out an adjustment of status and thats another reason I wanted to ask in here. I have no idea what basis she would apply, I will ask next time we talk about the catergory.

I was just trying to figure out some basic information and confirm my feelings that she wont be able to stay or change her status. Yes, it makes me upset that she is there illegally when we are here fighting and suffering to do our case legally and through the normal channels. I just pitty her husband who is stuck in the Philippines without her or there newborn son and she has no intentions to come back. I am sure he has no chance of getting in legally now that his wife pulled this stunt.

Can we attend both the CR1 and K3 interviews? If so what might the outcome be? Our K3 is May 16 and our CR1 is May 30. We want the CR1, but were told we could go to the K3 and request the CR1. With a CR1 interview pending is that wise of us to do still? Or just wait? We'd certainly LOVE to get back to the US sooner and if we can secure the CR1 on the 16th would be great.

Also, if they issues a K3 on the 16th and not CR1, can we still go on the 30th and get the CR1???

IR-1 / CR-1 Spouse Visa Process & ProceduresNVC Request for AOS I-864
Hello once again. I have been stuck at this now since December and it's getting really really old (because fastk3 wont give me a straight answer). Okay, I am needing to send off my I-864 and co sponsor's to NVC, just recently sent off the IV-Fee Bill.

I have here 3 seperate packets for both myself and my co sponsor. I realize one is not a I-864 so please bare with me. Here they are, as stated in the upper right corner of the forms:

Affidavit of support under section 213A of the act. (this is the one my co sponsor originally filled out in June but not me) OMB No. 1115-0214. (No vis expiration)

I-864, Affidavit of support under section 213A of the act (This is the one I recently *this week* completed as dir by my lawyer, but not my co spon) OMB No. 1615-0075 expires 09/30/06!!!!!

*Note: These two forms above are visibly different of course.

Finally I have I-134 affidavit of support (both me and my co sponsor. Fastk3 said to fill these out 5 months ago)

So you can see and understand my confusion in the matter. FastK3 said just this week (and sent me the I-864 that expired last year)

FastK3 wants me to send the two different I-864's claiming it's all good, no worries everything is ok. I cant bring myself to believe them after all the bad advice I have received from them to this point.

Please someone set us straight on the truth! I am at my witts end with these people at fastk3 and to think it takes them days to respond to each of my emails :(

Greetings! My lawyer at fastk3.com (he he) just informed me I need to be sure and send the barcode with my I-864. I recently sent off the IV Fee bill and now sending off AOS. I had bar codes for the fee bills but not one for the I-864, I am pretty sure I am right when I say there is no barcode to put with the requested I-864's right?

My friends at fastk3 said I need to wait for the DS-230 to arrive and actualy use the form they send me. The form I have here (In PDF format) expires in July of 2007 and it is already completed. Why cant I use that? And why can't I send it in to NVC after receiving word the DS-230 has been generated?

Greetings again. I am ready to send off my I-864's to the NVC and my DS-230 is on it's way to us here in the Phils. My question is this:

Do I need to wait for my co sponsor to receive his 2006 returns before I send the packet in? I have been in the Phils all year so I don't have any 2006 taxes to send in.

My reasoning is that it is so early in the year yet. Is there a deadline for these to reach NVC without an 06 return?

Hey everyone. My I-129F was just approved. From what I understand now it goes to NVC and then to the embassy which takes really very little time, maybe less than a month. We are also waiting for the DS-230 to arrive, it hasnt yet. Both CR1 and K3 processes are going on at once here. Is there anything I need to be concerned about? Is it possible they will generate 2 interview dates or how does that all work? I am thinking that the K3 paperwork (I-129F) will reach the embassy here before we receive and submit the DS-230. How does that affect our case?

I am also thinking that if we can can save at least a couple months time by the K3 finishing up quicker, we are just going to go for it because we really want to get back to the US.

I may have read the guide wrong, but it appears at even this stage in the game, the K3 will get done faster. Anyones input on all this would be great! Thanks all!

Ugh, was really hoping one of the two would generate an interview so we could be home by mid May in time for graduations. The US Embassy website in Manila said the waiting period for non immigrant visa interviews was under a month right now. So was hoping it was the same for CR1's. Is that even a possibility?

On another note, if we are scheduled for a K3 interview, is there any possible way we can just interview for the CR1 then instead since everything is submited?

I'm sure someone will sigh when reading this, but the flowcharts and numbers really are confusing to us. We know that the K3 visa interview (once scheduled) is pretty short, maybe a month. What about CR1's? Are they the same wait period when scheduled as K3's? I didn't see any info (like the K3 flowchart) here nore at the embassy site in Manila. Again only non immigrant visa info. Any insight would be appreciated. Thanks!

Hey everyone. My co sponsor is gathering his tax papers so we can take them to the embassy for the interview (Whenever that may arrise)

My lawyer says we need certified copies. My co sponsor took his completed forms all over town and nobody knew how to certify them. What is a certified copy anyway? I figured it means a simple notary.

A copy of an official document, like a birth certificate, marriage certificate, or divorce decree, that has been certified by an official to be authentic and bears an original seal or embossed design.

By the way, you don't need to certify a ITR document.


ITR? Not sure what that is. How does one prove an "official" declairs it genuine? Wouldnt that just be a notary with his\her notary seal? Still confused.

Actually I assume from the information on VJ, that the K3 interview will come by default since I did not personally submit a form to have NVC release the I-130 to Manila. So I guess I dont need to even worry about following up with the I-130 and I-864's now.

Philippine attorney notarizations are no longer accepted by U.S. Immigration.
Taking U.S. Tax Papers to the Embassy? - never heard of that.
Submitting U.S. Tax Papers to NVC - that is standard along with the I-864 "Affidavit of Support".
Not sure about the "lawyer" you are referring to - I prefer to just read the U.S. Immigration instructions and follow them to the letter and then call them if I have any questions.
I personally would never hire a Philippine attorney for U.S. Immigration purposes.

Umm Philippine lawyer? Not sure where that came from :) Lawyer is in the US. My co sponsor is finalizing the affidavit paperwork with supporting documents that my wife will be taking with her to the interview.

My co sponsor is struggling to find out what a certified copy of his supporting documents are (his W2's and tax information papers). Personally I have no clue either and he even works for the city.

Nothing needs to be "Certified" Copies.

USCIS no longer routinely requires submission of original documents or "certified copies." Instead, ordinary legible photocopies of such documents (including naturalization certificates and alien registration cards) will be acceptable for initial filing and approval of petitions and applications.

At the discretion of the officer, original documents may still be required in individual cases. Please be advised that USCIS no longer returns original documents submitted with the exception of Certificates of Naturalization, Forms I-551, Permanent Resident Card, Forms I-94, Arrival/Departure Document, valid passports, or those specifically requested by the officer. Such documents will be returned when they are no longer needed.

No where in the I-864 instructions do they request "Certified" copies. and if you read carefully at the bottom of the form.

e. Each of the Federal income tax returns submitted in support of this affidavit are true copies, or are unaltered tax transcripts, of the tax returns I filed with the U.S. Internal Revenue Service; and
g. Any and all other evidence submitted is true and correct

Just by signing the form you are "Certifying" that all evidence provided are True and Correct.


I was told that the primary sponsor (myself) didnt have to, but the CO Sponsor had to provide certified copies. And I know I saw it somewhere, I am not crazy. I can't find it at the moment thanks to Murphy and his crumby law.

Who of you out there use a co sponsor? And the I-864 info they provide and tax paperwork.... Has to be "certified". Yeah I am still stuck on this and even my corny lawyer said to hold off until they figure it out :/ Now my interview is coming down the pipe and within site and I still don't have my co sponsors AOS yet. He is waiting to hear how and what to do.

So those of you with Co's under condition of CR1 visa interview, what did your Co Sponsor do to get this right and "certified"? And what documents exactly was it applied to?
