I don't know how accurate that schedule is.  I'd count on July.  If she get's it sooner, bonus.
 

ETA:  By accurate I mean I don't know if it is set in stone, or if they add interviews as the month goes on.

The embassy knows there is a father out there somewhere and in every case I helped with or have seen they insisted the father was to be found. I am not sure if the father was listed on all those B Cs but keep in mind this isn't unusual in Thailand.

You may want to ask the embassy a direct question about this as it applies to your case. They sometimes indicate they will not respond because they view this as " prescreening " the case which they told me they would never do. I would ask anyway.

Your wife could for example buy a special pin number at any Thai post office which will allow her to call directly into the embassy visa unit. If she does this she must understand how to frame the questions in a general manner rather than ask about her own situation. For example- How would the officer or embassy react to a case where the fathers name isn't on the B C?

This subject is difficult and must be taken very seriously. I am not trying to make this difficult for you. I hope you find I am wrong about the embassies stance on your situation but you must prepare so you aren't surprised later.

Whatever happens please take the time to post it here so all of us have first hand recent info in this special situation.

It may be best to ask a mod to move these posts so they are not mixed into slowlymans which have nothing to do with this subject.

I agree with Karee that the RFE isn't about the bio fathers permission. He is right that this comes up at the embassy stage.

The last couple that I worked with didn't want to deal with the bio father so they didn't try to find him. The embassy insisted he could and would be found or no visas for the kids. Two years later they still don't have the kids. The wife was granted her visa and was forced to leave the kids or stay herself. This is a terrible situation to be in especially when they thought all would be ok until the last moment.

I am sending you some info via P M that may help you understand the position of the embassy and their reaction to attempts made by the couple.

ThailandRFE for kids

We're bringing her kids (my step kids) too.  I sent as one packet but with separate I-130s.  Everything has been smooth until today.  The kids all got an RFI today after my wife's I-130 was approved.  Our Thai friends here said that's common and probably has to do with the bio father but to wait and see.  I expect the RFI letters by Tuesday at the latest and then I'll know.  One thing, there is no father listed on the official birth certificates and my wife doesn't want to even attempt to find the father unless there's absolutely no other choice. 

I wouldn't think you would get an RFE from USCIS for that.  That issue usually comes up at the Embassy stage.  But who knows.  Good news is that as soon as you give them the info they want, they'll approve the I-130s pretty quick.  They don't put you back at the bottom of the pile.

UBON RATCHATHANI, 5 June 2013 (NNT) - Police were called in to investigate the missing of 40-million-baht ornamental gold from a gold shop in Warin Chamrap district, Ubon Ratchathani.



Pol. Col. Songsak Sibutta (????????? ????????), chief of the Warin Chamrap Police Station said that the owner of Yaowarat Gold Shop in Warin Chamrap told the police that a number of ornamental gold weighing approximately 1,500 baht with a value of 40 million baht went missing from the shop?s safe.

In the preliminary inspections of the scene, the police found no traces of force opening at any point in the shop.

They suspected that the thief might have been one of the customers who had frequented the shop and known the password of the safe.

Nevertheless, further investigations will be conducted to find the suspect responsible for the missing gold.

So I assume a single person without children does not need the 'free to marry certificate', not even for the embassy, correct?

 

Right.  That free to marry thing is if you are going to get married in Thailand.  You need it to give to the Amphur there saying that you are free to marry there.  I don't think you need to give the embassy anything stating that you are single for a K-1 though.  I may be wrong though since I didn't go the fiancee visa route.

The story they told is a joke but at least they found it. I find it hard to believe it was just simply laying there in the mail room and no one could find it. That just is not how docs are transferred embassy to embassy.

 

It sounded to me like it went from the Singapore police to the embassy in BKK.  I didn't realize it went from the Embassy in Singapore to BKK.

Ok, where should she go? I assume it needs to be a certified translation. And, I assume she needs to translate both birth certificates, and the "free to marry" certificate.

Don't think you need to have the free to marry translated.  That is just for the embassy in Bangkok.  There's all kinds of places near the embassy to get the birth certificates translated.  My wife got it all done in Chiang Mai, so I don't have any specific places in BKK.

Yeah she PM'ed me yesterday.  Good news.  I still don't know why Singapore wouldn't just send it to her directly, but oh well, it all worked out.

No she doesn't need it if she has a birth certificate.  Make sure she get's any documents translated into English for the adjustment of status.  Do it in Thailand now.  It will save you from having to pay big bucks in the U.S. to get it done.

I know now.  You read Sud Yaud's review.  I've been going back and forth with her on PM.  She got the 221g because of a missing police report from Singapore, not the blue book (house book)


She went to her birth town with her mother and an elder. The big boss printed a document in Thai and put a big red stamp on it. I'm told this is the birth certificate for her and her daughter. They generated a similar document they tell me is her "free to marry" certificate.

I just read a consulate review. The beneficiary was given a 221 for not having the house registration.

 

The only place i have seen it mentioned, is for the police report.

 

If we do need it, could somebody send me the name of the document in Thai so I can pass it along to my girlfriend and there is no confusing about what she needs to get.

I don't think you need it for the interview.  It's called the tabien baan  or in Thai ???????????.  Only time I've seen people need that is if they don't have a birth certificate.

 

Ohh and since we're on the subject of birth certificate, you need to make sure she has one for adjustment of status.  If she doesn't, post that here.  I'll let you know what she needs to do.  WHat the Embassy will accept and what USCIS will accept for adjustment of status are totally different.

True, it was $100.00 per ticket to change at the last minute. But, it was chance of a lifetime to go to the interview with her (although I couldn't go in) and then fly home with my now wife

Yeah the Asian airlines don't screw you as bad as the U.S. airlines.  At least they didn't when I lived in Thailand.  I changed my tickets all the time, and it was just the change fee.  They didn't charge the difference in fare like they do in the U.S.

I know I have read lots of advice here about not setting travel plans, buying plane tickets until visa is in hand. Of course, I chose to not heed this wise advice.  So, for crazy people like me, I need to know what the normal turn time is from successful interview to receipt of passport in mail with Visa inside. I know , or at least think I know, that you the beneficiary will leave passport and pre-paid envelope.  Thanks.

 

They do it differently now.  Back when we went through it, you came and picked up the day after the interview.  Maybe 2 days after the interview.  Now I think the send it post.  Hopefully someone with recent experience will post here.  In the mean time you can look here at the embassy reviews.

My wife changed all her documents to reflect my last name after we were married (house book, passport, and ID card). Owning land just because she took my last name is not going to be an issue. Regardless of what her last name is, she's Thai, and that's the requirement to own land. Now, were she to become a U.S. citizen, I could see where she might run into issues since the Thai government prefers its citizens retain one citizenship rather than two. To my knowledge, dual citizenship is only frowned upon, and not illegal.

The problem I can see with having two passports with different last names is this...

You're passing through immigration and customs and they decide to search your items. They find a Thai passport with one name and an American passport in another name.

"Why do you have different names on two different passports?"

"I'm married to an American and took his surname."

"Then way doesn't your Thai passport reflect that?"

"Ummm..."

"What's your legal name? This one or this one?"

"Ummm..."

"Do you have your original or certified copy of your marriage certificate along with the English translation with you?"

"Ummm...no, I don't have that with me."

With the way the authorities are behaving about air travel and immigration, I don't think that conversation is too far off point. Just easier, in my opinion, to have the same name on all official documents. But, "up to you," as the saying goes.

Might not be an issue today. I know there were rumblings about it being an issue a few years back. Something to the effect that the Thai wife had to prove that no farang money was used to purchase the land. And if they could prove it, something about the govt. taking the land. How they would I enforce something like that, I have no idea. I did a quick search on ThaiVisa about it. Didn't find what I was looking for, but didn't spend much time looking.

Personally, I would never invest any of my money on land in Thailand (especially anything that could be considered farm land) the way the laws change on a whim there. But that's just me.

Personally I think it's a mistake to change an of the Thai documents to the married name. That could bring up issues with her owning land in Thailand etc. in the future. They seem to change the rules on that every 6 months. I wish my wife didn't do it, but she did before I knew any better.

I agree with everything Slowlyman said.  Generally they do not accept co-sponsors for K visas. However, I have seen them make exceptions for certain situations like university students etc. That doesn't seem to apply in your case.  I think they will accept assets in place of income if they are somewhat liquid assets.  It's either 5 to 1 or 3 to 1.  I can't remember.  That would mean you would either need to have 5 times the assets needed or 3 times the assets.  So 5 times would be roughly $100k USD in assets.

Mine has told me she wants me to help her get a garden started, but otherwise, she'll take care of the house.  I don't know anything about gardens so I guess I'll be learning soon.

My wife has a Thai friend that owns a house in Grand Prairie.  She plowed the entire back yard and turned it into a farm.  It's pretty impressive actually.  They even have some chickens back there.  I wish I would've taken a photo when I was there last time.  And this is in your normal suburban neighborhood.  It's not out in the sticks somewhere.

I figured it was a fare dispute. As I said above, sometimes it's just better to pay the extra 50-100 baht. I reckon there are sketchy taxi drivers in every big city in the world. But, Bangkok traffic could certainly make one crazy if they weren't already. A tragedy to be sure but, if this guy lived in Thailand for three years he should have known better than to argue over such a nominal fare and if he threw coffee in the guys face then he certainly did not learn much about Thai culture. But really, who drives around with a machete?

I've had a few of them want to hook me up with their daughters.  Even with the wife or girlfriend in the taxi with me.  Always got a kick out of that one.  Maybe next time I'll ask for a photo.

Bangkok, Thailand (CNN) -- A taxi driver in Thailand has been charged with murder after allegedly stabbing an American with a machete during a fare dispute.

Police said they arrested Cherdchai Utamacha in Bangkok over the weekend, hours after closed-circuit television footage showed him attacking Troy Lee Pilkington, an American citizen who had lived in Thailand for three years.

Authorities allege that Cherdchai told police he was infuriated after Pilkington accused him of cheating and threw coffee in his face as the two argued over how much the American owed for a taxi ride.

The fare was 51 Thai baht (about $1.60), according to police, who interrogated the driver.

Security camera footage helped police track down the suspect quickly, Col. Thawatkiet Jindakuansanong said.

"When we traced the man to a house in Bangkok, we still saw blood stains on his shirt (and) shoes," he said.

Police said the driver smacked and stabbed Pilkington multiple times. They have not released a cause of death pending autopsy results.

Sometimes it's better not to raise the issue of the "taxi meter" not being turned on and pay the extra 50-100 baht. One night we got into BKK late so we had a reservation at a hotel near the airport as we were going to go north in the morning. I noticed that the the meter didn't get turned on and mentioned it to my wife. The driver must have heard meter and looked back at me. I decided to shut up, pay the 300 baht fare as it was almost 2 in the morning and the neighborhoods near the airport are certainly not a place that you would want to get dropped off in in the middle of the night.

First thing I do when I get in a taxi is look at that meter to see if it's on.  Especially leaving the airport.  I used to travel out of Don Muang almost weekly.  When I'd come home, I'd always go to the top level where they drop people off and get a taxi there, rather than wait in line on the bottom level.  Every now and then I would get in and they'd either ask me where I was going and then quote some outrageous rate like 400THB, or sometimes they wouldn't turn on the meter and I'd ask them to turn it on.  If they didn't, I got out.  I would tell them in Thai the EXACT route I wanted to take everytime I got in a taxi.  If they deviated from that route, I would give them whatever was on the meter and get out and wait on another one.

It definitely makes me think about my plans to retire there.  When I was living there, they found a German guy hanging from a light pole with his hands tied behind his back and plastic bag tied over his head.  The cops ruled it a suicide and said, "That's a normal way for foreigners to kill themselves."

At 8.30pm Police were notified of an assault involving two men on Soi 68 off Sukhumvit, Bang Na, Bangkok, an American man and a Bangkok taxi driver armed with a sword-style weapon; the scabbard was found at the scene.

The American man was dead when police arrived at the scene, having suffered stab wounds to his head, chest and left arm. Dispute reported to have been over a taxi fare. 

The deceased was identified as Troy Lee Pilkington, USA, age 50 yrs, Customer Services Manager for Caterpillar (Thailand) Co. Ltd, Bangkok. He had lived in Thailand approx three years.

Limited CCTV footage shows the initial attack. The taxi driver (last picture) has since been identified and arrested.

Thanks to improvements in public health and nutrition Thai men under 30 can now boast larger wangs than their fathers. At least that's the implication of a new government initiative, which intends to purchase larger condoms for a better-hung generation of millennials.

Currently the Thai Ministry of Public Health distributes prophylactics in two sizes - 49mm and 52mm in width. But those measurements can't contain today's young buck who would likely find those contraceptives suffocating. To accomodate the new man the Thai government plans to start buying larger 54mm wide products.

Ouch! That's the sound of an older gentlemen being emasculated by junior.

"More Thai men are now over 170 centimeters tall and exceed 70 kilograms in weight. They can no longer use condoms with sizes of 49mm and 52mm," said Pornthep Siriwanarangsun, director-general of the Disease Prevention and Control Department .

"Small condoms make them feel uncomfortable and eventually they won't use them."

About 230 million condoms are sold nationwide each year. The government provides about 40 million condoms annually, the Bangkok Post reported.
