I remember when I was going through this and wanted my wife here ASAP.  I had a decision to make.  I could get her here 2-3 months earlier if I went the K-3 route, or go the IR-1 route and be apart the extra 2-3 months, and not have to deal with USCIS until citizenship.  I chose the IR-1 route.  Glad I did.  Dealing with USCIS sucks.

NOA-1 September 19 to being ready to send in packet 3 by November 24...unreal.I have studied the timeline between "sent packet3" and the interview date, seems to be 3-4 weeks.My boss has allowed me to extend my trip and I will be in Thailand from Jan.9-Feb24.We have our hearts set on traveling to bkk for the interview together,also we want to have time to prepare for the interview.Also we want to use the beginning of my trip as additional evidence. I can only bring as additional evidence phone and text records,i was just there in aug-sept. Karee and others have said pictures,pictures,pictures which we would have time to provide.We are considering delaying submission of the packet 3 until maybe early December for there reasons.thoughts please...thx....steve

 

I don't know if I'd delay the interview over it.  You can't attend the interview anyway.  As long as she has her ducks in a row and she's wasn't/isn't a bargirl, then I don't see the problem.  At worst they just ask you for more relationship evidence, and you submit that later.  Slowlyman's girl just went through it recently, and it seemed like a pretty easy deal for her.

I just got a Non-O visa in March through the Oregon consulate, only thing I had to show was a bank statement from a US  with the equivalent of 40K baht.

 

As for staying in Thailand and doing a  extension of stay based on marriage is 400K in the bank, or 40K in income. The law or requirement has not been changed, and I know several people over the past 2 months that have done the extension of stay in CM and the requirement is 400K or 40K, or combination of both.

 

There was a Thai Visa thread where people were saying it has changed, and it was proved to be completely false, and the people quoted had no idea what they were talking about, as proven over and over in the thread.  Thai Visa is a very reliable and unreliable source of information.  Just like on this forum and getting any visa everyone's circumstances are different, some people might have overstays in their passports, possibly multiple tourist entries, and it looks as though they are living in Thailand on the wrong visa and abusing the system, which is more of what I believe they are trying to crack down on.  I

 

The land border crossing now have a sign that says you have to show you have X number of baht when coming in (20K for tourist, 40K for Non-O), I have never been asked to show I have the money, however a friend of mine has been asked, and almost they almost wouldn't let his Chinese GF in with him because he was carrying all of their money.

 

This post sums it up.  It's hard to say what the deal is over there.  There's no consistency with anything.

So, I guess being married really doesn't help me much as far as the "o" is concerned. That must be a pain in teh butt if you stay long term and need to report ever 90 days.

 

You wouldn't be able to get the O unless you were married.  You could go the O-A retirement route and not be married.  I hear that is a bigger pain in the a$$ though when it comes to showing income and money in the bank.

To me what needs to be done and how would depend on where slowlyman is going to be staying. I say this because in the Issan area things have changed some. There is a new option in Udon from what I am told because there is now an immigration office there especially for the farang population. There is also an office near Nong Kai just South of town or people can continue to the Mekong at the Lao border where they can cross to meet the requirement. Vientiane has a tiny American embassy as well.  

From what I've been reading on TV, almost every province has an immigration office where you can do your 90 day report now.  I think some of them even let you do it by mail.  Of course I also read on TV that all of them seem to have different rules from each other.  You know how it is there.  Today's rules will be different tomorrow.  Best bet is to just follow the posts on TV.

The land borders are doing 15 days only, and some of them are limiting the number of times you can do it back to back.

 

With the Non-O multiple entry you get 90 day stay on each entry, but you still have to exit the country and come back every 90 days.  You can do an extension of stay based on marriage at immigration which removes the need to exit the country every 90 days, but still requires you to report to immigration every 90 days.  With the extension of stay you need to have 400K baht in a Thai bank for 60 days, and/or have income of at least 40K baht per month.  

 

Doing the paperwork and getting the extension is not bad, and is a lot easier than doing any of the paperwork for the US.  The biggest issue is that there really is no standard guidelines at Thai Immigration, some follow the immigration code, some officers don't and make you bring extra paperwork.

 

Yeah when I had my Non-O I left every 90 days.  I didn't realize at the time that I could get an extension and just report at immigration every 90 days without having to leave the country.  Could've saved me a few all day bus rides to Poipet.

I should probably post this on Thai Visa, but we have some pretty sharp folks here on VJ.

 

With my new Thai wife in tow, what options do I have for a visa on my next visit to Thailand?

How long are you planning on staying?  If you're planning on more than 30 days, you might want to look into a Non-O.  If not, just get the 30 day stamp at the airport.  You can actually make a couple visa runs if you want and turn that 30 into 90.  That would require a quick flight to Penang or something like that.  I hear they're only giving 15 days at the land borders now.  Like the other poster said, best to ask on Thaivisa.  Anything more than that, you need to look at a Non-O.  Non-O is 1 year visa that requires 90 check ins at immigration.  You can actually turn it into 15 months if you do it right.

 

I lived there for 2 years on 30 day stamps.  The coup in 2006 brought that to an end.

so the only copy of her proof of birth (no birth certificate) is in the hands of the us embassy BKK... maybe i should extend my vacation a little bit and go to burma after my girlfriends thai visa expires on 21 jan, then she could get additional copies...

 

My advice would be yes, do that.  There have been numerous members here that gave the embassy what they thought was fine for proof of birth and the embassy accepted it without a problem and issued the visa Then once the K-1 fiancee comes the U.S. and goes to adjust status, USCIS wont accept the document.  The you're stuck trying to get family members back in Burma or Thailand to run around and get the right documentation.

Tens of thousands of demonstrators continued to rally on Ratchadamnoen Avenue on Monday night after Prime Minister Yingluck Shinawatra made the announcement on a national television and radio broadcast.

It is effective from today, however many demonstrators were staying put at the protest site this morning. Those who made the symbolic seizures of the Finance Ministry, the Foreign Ministry and the Public Relations Department on Monday were remaining inside the compounds of those offices, although not within the buildings.

One very big, very valid, question asked by the protesters is why should they respect the ISA when the government itself has rejected the Constitution Court?s judgement on the draft constitutional amendment.

Moreover, the prime minister has refused to ask for the return of the rejected amendment from the palace, claiming that the case is unprecedented and needs to be studied first.

No, it is not over yet. A group of Pheu Thai MPs have lodged a complaint with the Department of Special Investigatiion, accusing five charter court judges who voted down the amendment of sedition. As usual, DSI chief Tarit Pengdith appeared overly enthusiastic to take up the case.

The logic is simple and straightforward. If the government and the main governing party, Pheu Thai, have rejected the court's authority, rejected the law of the land, why should the protesters and the people in general abide by the Internal Security Act?

If anyone is to blame for this political mess and the country's steady descent into a state of lawlessness it is the government, the parliament and the Pheu Thai Party.

Yet, the anti-government protesters must follow the path of ahimsa -- a Buddhist and Hindu doctrine holding that all forms of life are sacred and urging the avoidance of violence -- in their fight against the "Thaksin regime". The use of civil disobedience as a gesture of protest against the government, which has become an acceptable practice in western democracies, should be done in a manner which causes the least impact on the general public.

The symbolic seizure of the Finance Ministry, the Public Relations Department and the Foreign Ministry by the protesters on Monday should be brief. They should be withdrawn quickly since they have achieved their goal, which is to send a message to government officials to join their cause.

Withdrawal would not be a sign of defeat. The protest leaders smust be well aware that the Thaksin regime is deeply entrenched and cannot be dismantled in just one big push, at least not without unpredictable consequences.

But the outpouring of the people?s power on Sunday. in which up to one million people showed up at Ratchadamnoen Avenue and nearby areas is indeed phenomenal and should serve as a warning to the regime, its master and its cronies -- that they should never ever take the people for granted.

We seemed to have hit a roadblock in the process of getting my Thai wife her spouse visa. We sent in the visa app along with all the required documentation about 2 months ago. I received a response from the NVC stating the following:

 

3 - BIRTH CERTIFICATE:_______________________________________
The document you submitted is not an original or certified copy of an original issued by the appropriate
government authority. The document must be an original, or a certified copy of the original, bearing the
original seal or stamp from the issuing authority.

I went with her to get this when I was visiting her 3 months ago and it was a copy from the actual birth logbook they keep at the Amphur along with the required stamp. We then took to and got it translated to English. When I first got the email from the NVC I called them and explained that it was a valid birth certificate and that it was the only one the Amphur will issue. The lady I talked to at the NVC said she would resubmit it to someone higher up the chain. Well happy thanksgiving I got the same response today stating the same thing. I have no clue what to do, my wife even went back to the Amphur after the first rejection letter and they told her that was all they can issue.
 
Has anyone else ever ran into this problem?

I'm not sure what type of visa you are applying for, but I'll assume it's CR-1 or IR-1 since you mentioned NVC.  My wife didn't have a birth certificate at all when we went through the NVC process.  She got a letter similar to yours for NVC from the Amphur and they accepted it.  It MUST be an original from the Amphur with an English translation.  NVC will not accept copies of the birth certificate or the police clearance.  PM me if you like, an I'll send you what we used for NVC as proof of birth.  See here for more guidance:

Yeah, Pui showed me that someone got killed from the protests.  Her Dad just passed away and one of her friends who works at airport said she should not travel to between Suvarnabhumi and Don Mueang because one of the protest groups is near Don Mueang.  She is leaving tomorrow.  I must say prices are a lot cheaper then they were 2 years ago when her brother passed away for a short notice flight.

 

 

Expect the exchange rate to get better as well.  They're cutting interest rates in Thailand, which means a weaker Baht.

At least four people were injured in Ramkhamhaeng University Saturday evening after gunshots were heard. The drama was thought to be related to clashes earlier with red-shirts from the nearby Rajamangala Stadium.

The Centre for the Administration of Peace and Order (CAPO) has announced the closure of Ramkhamhaeng Road from Ramkhamhaeng to Lam Sali Intersection, after violence in the area.

Earlier, in the afternoon, dozens of protesters in an anti-red shirt rally, harassed several men near the university by blowing whistles at them. The red shirts are holding a rally to support the government at the stadium.

Some protesters outside RU beat on a taxi transporting red shirts with their fists and sticks and later some students threw rocks and beat a passing bus.

Democrat leader Abhisit Vejjajiva on Friday joined a march of thousands of protesters who met in the Asoke area before heading to the US Embassy and Pheu Thai Party headquarters.

Posting a photo of himself riding on Skytrain on his Facebook page, Abhisit said, "See you in Asoke."

The march, which joined by thousands of people blowing whistles and waving national flags, started about 11am from Asoke skytrain. They then marched to the US Embassy on Wireless road.

The march was led by Abhisit and Democrat MP Korn Chatikavanij.

The protesters waved placards, some of them reading "stop serving Thaksin regime," and "Get Out, Thaksin's servants."

People along the road took their photos, blew the whistles and waved the national flag.

At the US embassy, protest representatives submitted a note to the US government, asking it to support them and stop supporting the ruling government of Yingluck Shinawatra.

They arrived at the Pheu Thai party headquarters about noon.

Interesting. I'll have the wife read it later. We'll be visiting the family over the holidays and since things don't look like they'll be settling down anytime soon, I want to make sure what "suspended to stay in the Kingdom." means.

 

My sense is that it is telling visitors if you participate in the protest you're going to jail. I saw similar signs up in 2010.

 

I guess I'd better take down all my photos of the protests in 2010 from my facebook page.  I was wearing a "truth today" red shirt given to me by the protesters though.  Maybe that will get me a pass.

Good advise to be sure, but I suspect the strength of the packet as a whole is what matters.  Just sending a bunch of photos without any other evidence will probably not get you approved. Likewise written evidence without photo proof of actually meeting won't get it done either.

 

Ning, how did your husband get inside for the interview?

Since we were IR-1, there was no packet.  In IR-1/CR-1 cases there is no packet 3.  They just send a letter (packet 4) saying show up on this date, bring the relationship evidence, and get the medical done.  Everything else is submitted to NVC in the U.S.  Police report, IV fee, Affidavit of Support etc.

I ran across this Bangkok embassy review from long:

 

She arrived early for her interview around 6 am and there was already a line about 15 people. She was first to be called for the interview and the CO had ask her why she only had 15 pictures of us together. The photos that we summitted were from Jan 2013 thru June 2013 with time and date stamps with the varies stages of her being pregnant. He didn't care about any other evidence of our relationship other than he wanted to see a lot of photos. He told her that the photos that we summitted wasn't her even though they were me, her, and her son. He had another CO come over to look at the photos and said they wasn't her which made her very mad. He asked her basic questions as what's your fiance name, how long have you know him, where does he live, and what does he do. As far as her son's interview they only showed him one of the photo's of us together and asked him does he know this man in the photo with him and his mom.

For some reason Bangkok has a hard-on for pictures.  This was the case in 2009 when my wife had her interview, and still seems to be the case today.  I lived with my wife in Bangkok for 2 years, and gave them all kinds of evidence of this, but only a few pictures.  They gave her 221g and made us submit more photos together.  So, make sure you go crazy with the camera whenever you're together prior to the interview.

Send an email to the embassy with the tracking number and the name of the person that signed for it, and ask them what's up.

Hi everyone,
My fiancé and I are currently on packet 3 and the last thing needed before we send back to the embassy is her Police Certificate. Is there a place in Chiang Mai to get this or does she need to travel to Bangkok to get the certificate? Can this be expedited or does it really take 3 weeks? She has called the The Police Clearance Service Center and no one is answering. Im worried with all the protests going on she won't ever get through.

Can't do it in Chiang Mai, has to be done in Bangkok.  Not sure if you can do it by mail or not.  My wife was living in Chiang Mai at the time, and I paid a lawyer in Chiang Mai 5k THB to get it done so my wife didn't have to go to BKK to get it.

I'll disagree with Karee here. I would send some new photos now and bring some photos to the interview. According to some, the decision is pretty much made before you ever show up for the interview.  I would want those photos in front of the CO during the review phase.

 

As far as how many is enough, I think quality is more important then quantity.  I believe photos of you with her family doing everyday things carry more weight then photos of the two of you at the typical temple and tourist trap.

 

I also believe you could send 1,000 photos but if the rest of your evidence is weak you still won;t get approved.  Photos are just part of the package.  Don't get so focused on pics that you neglect the rest of the P3 docs.


Curious about your police report delay, Did you pay the "real" fee of 100 bht?


In the case of a CR-1/IR-1 visa (our case), there's no opportunity to send anything.  There is no packet 3, so we didn't need to send anything prior to the interview.  They just send you a letter (email now) that says "here's your interview date.  Get your medical done and bring your relationship evidence to the interview."

Any way, while we wait I have 1 more question, should I send evidence of continued relationship ( most recent flights , hotel receipts and skype logs, and emails) with packet 3 or should I have my fiancée bring those to the interview with packet 4?

Bring the relationship evidence to the interview.  I hope she has a bunch of photos.  They want to see photos there.  They don't seem to care about the other stuff.  I lived with my wife for years in Bangkok and proved that, but only gave them a few photos.  They gave us a 221g and we had to submit more photos.

so an end to the thread, i guess.  I sent her the thread, and she read through and spoke to many of her friends who also recently applied for visas for other countries.  I also let her decide on how we would approach it, whether to mention myself, or to do it by herself, and after weighing the pros and cons, she decided it was best to be honest and mention me, although I only provided an invitation letter, she was denied.

 

she said her experience wasn't the same as others that were there.  apparently they have Thai people doing pre-interviews or something, and they had only asked her where she had planned to go as opposed to others who they asked many questions of.  In addition to this, we had requested the interview to be in Thai, however the consular officer only spoke in Thai.  Even when she attempted to change it to English, the consular officer still spoke Thai, which is rather strange since she had mentioned that the Thai spoken was not the greatest.  She said they asked her many questions, but almost everything was about me until the end when they repeatedly asked her if she had a kid, and as soon as she said "no," multiple times they gave her the denial letter with the failure to prove sufficient ties.

 

this whole process has definitely brought us together more, and she has suggested that we try for the k-1 visa.  so that will be our next adventure.  dancin5hr.gif

Yeah the tourist visa thing is crazy.  I've seen people get one that I thought would never get one.  And I've also seen people get denied that had a slam dunk case.  I have no idea what their criteria is.  I suspect they have a 10 baht coin they flip in the air and if it's heads you get the visa, tails you don't.  Looks like your girl got tails.

 You are correct that an I-864 is not required but please do not think that it does not help because it does.  The more information you provide during the interview the better your chances of a favorable decision. 

If I was a CO and a tourist visa applicant came in for an interview and gave me an I-864 filled out by a USC, I would deny the visa based on that alone.  In my mind that's almost as bad as walking in there with a completed I-485 and telling them you plan on adjusting status.

I decided not to post this in the main forum since I was hoping some of you have had some experience with the embassy in Bangkok.   I would like for my girlfriend to visit me here in the US and was hoping for her to get a B2 visa.  Usually I would just visit her a few times a year, however I will be having surgery this year on my ankle / foot this year and I will be in a boot for 5 to 6 months and getting around in Thailand with one of those would be rather tricky. 

 

My question is what, at least in your experiences, has the BKK embassy accepted for ties to return to Thailand? I know they take it on a case by case basis, but we are both a bit concerned that what we have is not enough. She does not own a house, but rather has quite a long lease on a condo.  She has a very nice paying, permanent job that she has been at for two and a half years and has all of the tax papers to prove its legitimacy. She does not have any family in the United States, nor does she know anyone other than myself.  She does not have any kids, either.  

 

I was planning to sponsor her, although she does have quite a decent amount of money in the bank, so she could easily pay for most things herself (airfare excluded) while she was here. We are just worried that our case, specifically proving exceptionally strong ties to Thailand, is rather weak compared to others, and were just looking to see if anyone else had some experiences that they could share to help us.

While it would seem that having a boyfriend in the U.S. to sponsor her would be a good thing, it will almost guarantee a denial.  In their eyes that gives her a reason to not return to Thailand and stay in the U.S. and adjust status.  I don't have any personal experience with this, because I never tried.  After reading about denial after denial, I figured it was a waste of time and money.  The burden of proof is on the applicant to prove that she will return to Thailand.  It's going to be tough to prove that having a boyfriend in the U.S.

 

You can give it a shot, it will only cost you the fee.  I'd post this question on Thaivisa if you haven't already.  You'll get better answers there, since most here on VJ are trying for family based visas.  You can post it here:
