I'm sorry my bad,  I looked at the wrong post when writing my response for the name of the poster.  The post that had outdated information was done by  Merrytooth not you.

Also from what I know there is nothing to send in from the P3.  You need to take the stuff to the interview and take care of filling out the online app and going to the medical interview.  There are a lot of things that she is going to need to do in China so she will need to head back home soon to get all of this done so she can be back with you sooner perminatally.

ChinaTransferring money between the US and China

In that scenario, mail the ATM card to china and send the Pin separately. She will have access to your checking acct in china. Wiring money from any major chinese bank has a limit of $50,000 in a year.

Thanks but that is what I'm doing now.  I got a prepaid debit cart to do just that was sharing what I found with others and also looking to see if anyone found any better way.  Still trying to figure out how to send money from China to the US easy too.

ChinaTransferring money between the US and China

I believe BOA and/or CITI's atm cards can be used to take money out in major Chinese banks atm machine. I use HSBC personally. I found that ICBC has better exchange rate than HSBC machine coincidentally in SZ. The other trick is to load your credit card with cash and use it in China without carrying any currency or declearing it.

I'm talking about sending money to China without being there or sending money to the US without being in the US.  Example,  Wife here in US and friend wants her to get something and send it to her.  How to cheaply have them send us the money.  Or waiting for K-1 visa to be processed, need to send money to help with the cost of getting K-1 how to send money to China to help out.

ChinaTransferring money between the US and China

Here is the thing.  She is still in China because we are waiting for K-1 to get approved.   She can not afford all of the cost so I want to help.  She has also come here and friends are like well while you are there can you get "this" cause it is cheaper in the US.  So how to get money to China that is cheap and how to get money from China that is Cheep.  This is not about how to use your Chinese money in the US or how to use you dollar while in China.

ChinaTransferring money between the US and China

For the China to US route, my wife uses her Bank of China Debit card to make our purchases, it takes the funds directly from her BOC account instantly without fees. I will then give her US funds to put in her US account. The debit card works in most stores in the US.

Do you mean open an account with Bank of China here in America?  If not how do you get the funds to the Bank of China account international wire transfers are a larger fee then most of the other options I have seen and are very slow too.

ChinaTransferring money between the US and China

I have not yet found a good way to send money from China to the US so I?m only going to cover the US to China route.  I thought I would open up a thread on this issue as I?m sure there are others out there that have or are trying to do this.  I?m going to post here what I have found out in regards to this.   I found several different methods that all have costs and I have been trying to find the fastest and cheapest way to do this that is still easiest at the same time. This is all very completed as there are three ways they can charge you a fees.   The first is a flat rate fee for any amount transferred, then they can charge you a % of the amount and finally there is the exchange rate you are being offered for the transfer.  I?m using googles exchange rates when figuring out this hidden charge that is used.  At the time of this writing the current exchange rate on google is 6.0433 Yuan to $1.

PayPal costs about .5% when using a linked checking account or Paypal balance and 3.9% when using a credit card.  This is by far the cheapest way but requires both people have a Paypal account and a checking account linked to the Paypal account.  This takes 3 to 5 business days to send the money and then another 3 to 5 days to receive the money once sent to China for a total of 7 to 10 business days.  This means that for any emergency this will not work at all.  Paypal does not make it easy to figure out the exchange rate being used.  They claim it is completive but don?t give you a way to figure out what it is before you send the money.

Western Union at the time of this writing they exchange rate is 6.0450 Yuan to $1 which comes out to about .03%. If you use a credit card the transfer is done in minutes and costs about $12 to send $100 and $88 to send $2,000 for a total of 4.6% at $2000 or 12.4% for $100.  When doing it via Bank transfer or WU pay takes about 3 business days and costs $10 to send $100 or $15 to send $2,000 for a total of $19 or .95% or $100 for 10.4%.  That makes this better for larger transfers but for smaller ones it too expensive.  The money must be picked up from a Western Union office so that makes this more difficult to use.

The next option is the one I?m using is a nice balance between cost and ease of use.  I obtained a Akimbo card.  This is a prepaid Visa debit card that offers good rates, allows international use and gives you multiple cards in different names.  I?m sending on card with her name on it to China and I keep another here.  You have a few options to put money onto the card of (direct paycheck deposit, ACH check, Green Dot).  Both direct deposit and ACH are free to use and take about 3 business days to complete.  Green Dot cost money to do but is instant transfer if needed.  To use in the US it costs nothing as a visa debit card.  To get cash from an ATM it is $1.98.  If you use as a ATM for a purchase it is $0.99.  For an international transaction it is 3% more than the US fees above.  The exchange rates used the published by Visa and are very close to the same as the ones used by Western Union or Google.  This makes this cheaper than Western Union for small amounts under $500.  The card can be used just like we do in the US to purchase anything that you can use a credit card for and at many ATM?s in China.  I used my US debit card quite easily while in China to get cash from an ATM and I was paying 2.5% + $5 so this is very close to what my bank offers me to get money.  I use Chase Bank and they will not do ACH transactions with this bank so I have to transfer the money to PayPal then transfer the money to my Akimbo card taking me about 6 days to complete.

Please let me know if you have found any other way to do this and how much it costs and how long it takes to complete the transactions.

ChinaForms that are needed to be filled out by beneficiary

I wish to double check some things since I know some of the information on the site is a little outdated with the new DS-160 form being used now.   I'm asking this so that I may help my fiancee fill out these form ahead of time.

My question is to those that have recently gone through the K-1 visa process were you required to fill out any of the following forms either before going to the consulate or at the consulate on the day of the interview.  DS-156K, DS-156, DS-230.

Thanks much for you help.

Sent them and email.  Go onto the web site for the consulate and go to contact us.  You will find a link to drop them a line.

I just recently sent a message to them (Please note I was not expecting an answer very fast as I figured I would have an answer to question via other means before the got back to  me),  But low and behold the very next day I got my response to my question.

I just said I'm checking on my case status to see if you have received it yet.

What I got back was yes we got it.  And we sent out the P3.  I get the answer in less then 24hrs.

Give it a try can't hurt.

Btw:  I'm at the Guangzhou consulate.

USCIS Service CentersApril filer transfer

Just a quick update for the new transfers. No your case did not go to local office. Wait until you get your hard copy to find out where it went. Most likely to TSC. TSC by the way is still working on first batch of approvals from May 24. So far, VSC has sent 2 batches of I-129f petitions to TSC for processing. The first batch was filers from Dec and up to Jan 24. Then VSC transferred cases that filed from Jan 24 to end of Feb. These cases still wait to be processed.  Once the cases are approved, unfortunately the cases have been left in limbo and were not sent to  NVC. Many cases approved 4 weeks ago by TSC are still there. There has been some info that recently TSC shipped the cases back to VSC who in return shipped them back to TSC for final processing. So what does this all mean? 1. Nobody is for sure where all of these cases are. 2.Once approved -  calling the NVC daily will not help until the problem at TSC is corrected. When problem is finally corrected, then waiting about a week after your approval would be a good time to call about your case number. 3. to help things at TSC improve, call your US Congressman and Senator and have them inquire about your case . This will help put pressure on TSC to get their act together. As it currently stands, once your case gets approved - your file could be delayed up to 8 weeks before it goes on to the next step of your visa journey. I'm not writing this to bust your bubble, I'm just letting you know what  problems lie ahead in this broken system. Just be prepared to do some more waiting.

Thanks for the information. It looks like my fiancee coming to the states before the end of the year is out of the questionsad.png . Oh well.....

VietnamEngagement Ceremony - First Cousin Marriage

We had family dinner with about 15 family members. Took few pictures and we labeled them "engagement ceremony" for evidence. We didn't get any problem with that at the interview.

I think that's the least you can do if you can't have the traditional engagement ceremony.

You're right. I should have at least some sort of ceremony to celebrate the engagement. I just hope enough people will show up.

VietnamEngagement Ceremony - First Cousin Marriage
Hi,

Is an engagement ceremony really necessary in obtaining a fiancee visa? I understand that having an engagement ceremony is quite significant in the Vietnamese culture, but I also understand that marriage between cousins are highly frowned upon. I'm so stressed out as to what I have to do in my situation. If we don't have an engagement ceremony, chances are that they will automatically deny our petition. any advice guys?

US embassy's new visa delivery system causes problems

Confusion over

Two Sunday's ago I was meant to be on a flight to Washington to attend the Microsoft Cyber-crime Centre's media tour. Yet, even though I was granted a visa, I couldn't go. The weak link in my plans was the US embassy's new visa delivery system.

I had never before encountered any problems with delivery of US visas.

I was scheduled to fly on March 16, and was called in for my mandatory interview at the US Embassy on March 12. I asked that my passport be delivered to the Rong Muang Post Office rather than my home.

While I was at the embassy interview, I realised that the visa-delivery process had changed: "People who have got the visa can go home without buying an envelope," read the helpful sign.

Previously, applicants had to buy an envelope, pay for the EMS delivery service at a post office inside the embassy compound and get a tracking number and receipt.

But on this day, the post-office counter was closed, so I left. I thought the process was a bit strange, but I assumed that I would be alerted to pick up my visa at the Rong Muang Post Office.

One day before my flight (March 15), I logged on to the US embassy tracking system and typed in my passport number, only to receive the strange news that it had already been picked up.

Yet I remained optimistic, hoping it would show up. It didn't. After missing my flight, I called Rong Muang Post Office on March 17 and was asked for the "tracking number", which I did not have.

As a last resort, I e-mailed the embassy and received an auto reply: "The current status of your passport is 'Picked Up'."

A follow-up call from the visa section informed me that my passport had been delivered to the Rong Muang Post Office, and I was provided with a tracking number. I read this number out to the Rong Muang Post Office, who said "my" package had been delivered on March 14 via the Samsen Nai Post Office. I then rang the Samsen Nai Post Office, and they said a package with my tracking number had been delivered to a house in Intramara 51. I later learned that said package had been delivered to a man who had already flown to the US on March 15.

I then wrote to the embassy to say I had been given the wrong tracking number. An official rang to apologise and told me they had just put in place a new passport delivery system. Soon after, I was told that my passport had been at Rong Maung Post Office since March 13 - one day after the interview.

When I went to the post office to pick up my passport, I was told that I was not the first to have suffered with this issue. Upon further inquiry, it appeared that the problem stemmed from the new visa delivery system in which the visa staff should have reminded applicants to jot down their tracking number, which is on the application form.

Obviously, if I had been told to jot down my tracking number, I would have been able to make my flight.

US Embassy spokesman Walter Braunohler told me that more than 600,000 visas to the United States are approved, printed and mailed to Thai travellers every year.

"But we regret any delivery delays and are constantly reviewing our visa application and passport delivery process and appreciate all feedback," he said.

ThailandDoes my wife need a visa to travel to Mexico?

I was wondering the same. My husband would have a Indian passport. But he would enter the USA Sometime in May and we have a trip booked for end of June in May, but would he be able to enter Mexico with a greencard (depending if he gets greencard by then) or what??

Some guys I worked with used to go to Mexico to get their H1B visas re-vallidated without any issues.

Here's an update tho. We went there today and he said that this situation happens a lot for people and then he explained the process to my girlfriend for what happens. Something like: she goes to the interview, brings the receipt thing thing from the police and then they'll give her the notice for evidence and we'll have to go back, get the certificate, and send it to the embassy or something. I'll reply again after this actually happens, assuming all goes well with the interview.

Umm that's not how it works.  You get the police certificate before the interview.  Seems the cop doesn't have a clue, which isn't surprising.

Ya, they know so little about the immigration process, but they know about VAWA. Actually Jin came here with a packet of information on it, written in Thai. She said it came from the Consulate.

Man that's insane.  It's been almost 6 months since you filed the I-485.  The average here is 121 days.

She doesn't have her green card yet?

Somewhere I read the time in country is 18 months before filing ROC. Guess I remember wrong.

Heck, Jin still has people telling her I'm going to sell her. The one that really bugs me is when ever we have an "issue" she talks about it on Facebook. Right away she is being told to file VAWA. That is getting really old.

I wonder how the hell they even know what VAWA is?  That's scary.  VAWA doesn't apply once she has a green card anyway.

Thanks Karee, I was thinking along the lines of needing 18 months of residency to even file for the ROC. Baby steps. smile.png

I've actually been having this discussion with my wife. She has been getting "advise" that we can split our time 6 months and 6 months and she can still file for ROC at the 1 year and 9 month point.  She isn;t grasping the need for time in actual residence.

Nope, 21 months from the date on the green card for ROC.

Technically you can do the 6 months living there and 6 months living here thing.  There's a couple issues with that.

1.  Upon returning to the U.S. after one of your 6 months in Thailand, it's up to CBP to determine whether or not residency is being maintained.  This can get tricky.  I know a couple that took off to South America for 6 months immediately after she got her 2 year green card.  Then we she returned to the U.S., she was here for a month or so and then went to Thailand for a month.  She didn't have an issue that I recall.  (I pinged the guy on Skype to verify the timelines)

2. When you file for citizenship you have to list ALL trips out of the U.S. for more than 24 hours.  You can file for citizenship after 2 years and 9 months of permanent residency.  However, I think that if you stay out of the U.S. for 6 months, that may mean that you can't file for citizenship until 3 years and 3 months, so you're really delaying any kind of permanent move you may want to make.

If it were me, I wouldn't plan on any part time living situations until your wife has citizenship.  After that you can live wherever you want for as long as you want.  I don't know when Jin got her 2 year green card, but I'd tell her to plan on freezing her a$$ off for a couple more winters.  Also, tell her to stop getting advice from Thais when it comes to this.  They had my wife convinced I was going to sell her the minute she got off the plane.  That's not the only crazy advice she got from them.  rofl.gif

Do you know: can people with ssn numbers who are permanent residents can collect social security benefits, or just citizens?

I guess either way we are going to try for us citizenship and get rid of the expensive almost useless Burmese passport.

I've actually been looking at that recently.  It's not real clear.  I know there's something to do with 40 qualifying quarters (10 years) of work.  We plan on moving back to Thailand sooner rather than later.

I did find out that they use your highest 35 years of earnings when calculating your benefits.  If you don't have 35 years, they just put zeros for the years where you don't have an earnings.

ThailandPacket 3 Help

The SSN does not allow her to work. She needs an EAD. (employment authorization) About two months after filing AOS

I've seen people who think they can come to the US, get married, then head back home. She will need to accumulate resident time before she will get the 10 year card. You didn;t state what your long term plans are. Sounds like you plan to stick around for a while.

As far as residency requirements are concerned, there is no difference between a 2 year green card and a 10 year green card.  They both require the PR to maintain residency in the U.S.  The only way to make a move back to Thailand is to have U.S. citizenship, which will take roughly 3 years from getting the first 2 year green card.

It goes like this:

Arrive on K-1

File for adjustment of status

Get 2 year green card (The date on this card is important)

1 year 9 months from the date of the above green card file for removal of conditions.

Get 10 year green card

2 years 9 months from the date of the original 2 year green card, file for citizenship

Get citizenship and U.S. passport.  At this point you can leave the U.S. for 40 years and come back with no issues. (Of course you'll need a valid passport)

ThailandPacket 3 Help

I should have put more info at the bottom.  We haven't received the physical packet yet but I made an enquiry to the Embassy and they have sent Packet 3 on March 11 to my fiancee's home.  The e-mail said the packet just has instructions but whoever sent the e-mail also included a link to the packet which he said was identical to what we will get.

NOA1 - Jan 25

NOA2 - Feb 14

NVC Rec - Feb 24

Cosulate Rec - March 6

Packet 3 sent - March 11

Extremely fast as we were warned it could take close to a year but just 3 months here.  Crazy.

The attorney said I met the requirements even without the income and I don't need the co-sponsor according to what she said so I believe I'm okay about this.  I met my girlfriend when she entered the USA on a J-1 visa and now I've been in Thailand for 5 months since I finished college and these Thai girls take loads of pictures and she's been keeping all of them.  We have travel proof, conversations, plane tickets, and pictures from every trip so proof of on-going relationship couldn't be more obvious if you ask me.  Which is the main concern isn't it?  Along with the Affidavit of Support.

I think I will go ahead and have photocopies of my bank and investment accounts sent and bring the originals to the interview.  Police said it'd take 2 weeks for the clearance and I want to get that interview date set if I can.

Does anyone object in the extreme to the idea of sending photocopies in Packet 3 and supply originals at the interview?  I don't want to push my luck.

The packet also the petitioner is not allowed to be at the interview which kind of sucks so is there a suggested way that they can know I am there supporting her (maybe it would further show proof)?  Maybe give her my passport to take in there or have her just tell the officer subtly that I am awaiting the result outside?

Thanks again for the help.  Hope this helps other people as well.

A couple things:

1.  She can download the packet 3 from the embassy website.  You don't need to wait on Thai Post to get it to her.

http://photos.state....on_packet_3.pdf

2.  J-1.  You might want to make sure there's no 2 year Home Residency Requirement.  A couple people have gotten burned by that one.

Yes they are!  BKK is weird about it for some reason.  I proved that I lived in Thailand for 3 years, and gave them 4 or 5 photos with my wife.  They gave me a 221g and said "we want more photos"

ThailandPacket 3 Help

Thanks for the replies. Sorry my first post was a bit dumb as my brain was turning to mush at 3am after reading countless posts. Every embassy is different and has different requirements and sticking points. I now realize this so the difference in packets is understandable.

I've already had an immigration attorney check my finances before submitting the I-129f and I met the financial requirements through my significant savings/stocks. But being that I just finished university and am currently in Thailand with my fiancée I was wondering if the letter for future (and current online) employment would help even tho I haven't received any income from the position waiting (but have received some from my website/database management for their system online).

These documents will have to be sent to Thailand. Same with the financial documents and we're waiting on the police report. I was hoping to get an interview set up sooner than later so I was hoping I could send photocopies of the documents in the packet with a note that I (my fiancée*) will supply originals at the interview. Also a note that the police clearance will also be supplied.

Is it too risky to go this route and I should just wait till all the docs and originals are sent here?

Side note, I'm annoyed this process has been MORE difficult with me being in Thailand with my fiancée. Wish there was some middle ground here with a cleaner filing process. Have had to rely on too many people to do too many jobs to get this finished.

Thanks everybody for the help. NOA1 was Jan 25 and NOA2 was Feb 14 so I'm a bit caught off guard with the recent speed of the system. It's nice but now I'm scrambling for perfection.

In the rare cases where I've seen the BKK embassy accept a co-sponsor, it has been situations similar to yours, where the petitioner has just finished university.  It's the 50 year old guy living in his parent's basement and then wanting to use a co-sponsor where they have a problem.  So you might consider getting a co-sponsor if you're worried about not meeting the financial requirements on your own.  You should be fine if you explain the situation when submitting the I-134.  Sending evidence of your waiting employment should help as well.

ThailandWill my finance's Thai cell phone work in Los Angeles ?

I have my DTAC prepaid with me here and it is still working. Before leaving the country, the phone number owner needs to activate international roaming with DTAC service center first. Not sure about other service providers, but it should be similar. Congrats and good luck cool.png

Interesting.  I didn't realize you could activate international roaming on a prepaid phone.

ThailandWill my finance's Thai cell phone work in Los Angeles ?

Back in the old days when I traveled a lot. I would carry little handy wipes just for the pay phones.  The big airports had banks of them. Doesn't seem that long ago, but I guess it was. Of course, I also remember rotary dial phones. happy.png

I work with this guy that has never had a home phone at all.  Only cell phones.

If the phone supports all bands she should be fine.

He's asking if her phone with a Thai SIM card in it will work in the U.S.  If it's a prepaid SIM card, the answer is no.  Thai prepaid SIM cards do not support international roaming.

ThailandWill my finance's Thai cell phone work in Los Angeles ?

Hi everyone here at VJ and thanks for all your help. It was a marathon on ours, over 14 months but she has the visa and is flying Friday. I'm wondering now if her Thai cell will work at LAX? I can call her through my 800 (to Thailand then back to the States I guess) if her phone can get a signal. I'm not sure if she can set up wifi there for us to talk on Line which would good too. I'll be at the gate but you know it's a big place. Thanks - T

Not unless she has international roaming on her Thai phone.  If she uses prepaid scratch cards, she wont have it.

ThailandCan't send money to Thailand via Western Union Online

I was able to open a Bangkok Bank account yesterday with no problems at all.  However, another VJ member was told no way at a different branch.

They're supposed to send me an email with the login info for Ibanking and they're sending the login PIN to my mother in law's address.    Next I  setup the Bangkok Bank NY routing number and account on my wife's gmail (google wallet) account.  Waiting for the test ACH to go through.  If/when this happens, I should be able to send money with no fees from my google wallet account to my Bangkok Bank account via ACH and not have to bend over and take it from BoA every time I want to do so.
