Hello VJ,

I contacted my congressman's office regarding the delay on K1 approvals at VSC. The answer she received is that they are currently processing May 28 applications. I explained that was the processing date as of Oct 30 as per their website. She told me that they don't lie about these things and they process them in order. I told her that I'm part of a forum and I know others that got approved that are after my NOA1 date of June 4. She responded that if I could get names and case IDs (after June 4) then she would ask USCIS to explain why others are approved but I'm not. I understand that others may not be comfortable sharing their info. I'm kind of upset at my congressman at this point... Since their representative said they believe USCIS over me, a registered voter. I will remember this next election.

I thought about just checking case IDs after mine and sending without names... Not sure if she will accept that though? Any thoughts? Should I drop this witch hunt or see if anyone is willing to send the info?

I'd wait another month before doing anything. I went through all this with VSC back in 2008. I got my NOA2 right at 6 months while all the processing times were showing 5 months. I know it's frustrating.

Hi everyone,

I am a US citizen who, for the past 8 months, have had my first experience with the US immigration system. I married a Thai citizen and feel that the system punished American for marrying non-Americans. I wrote a public letter to USCIS explaining what happened to me and included resources for US citizens to speak up if you are one of the hundreds of thousands of people who has to go through the same agony as we did. Administrative processing is not about the authenticity of relationships, it is about homeland security?

Am I incorrect about this??

What does the 221g say? There should be a box checked.

thanks for replying Karee...I cant still get over the refusal...I just want to retrieve my certificate of no marriage and birth certificate coz i'll be needing that if in case we get married here...Frankly speaking, I'm praying so hard that we'll be able to pass this stage positively, coz waiting is killing us...the distance, time zone, and loneliness...hope Consular Officers/ Adjudicators can think of these things...They're giving much hard time to those who are in real relationship and legally following the rules... It's not really a refusal if they gave you 221g. They just want more info. Give them that, and you should be fine.

I see, might be the reason why your lack of docs were easily resolved and visa was issued in just few days because it was spousal visa...mine is just K1...were just giving our best shot now, if this won't work, we'll get married here...am just crossing my fingers that this issue won't take much of our time...and I paid for the postage at the embassy, another thing...i just dont know if I can still get all my original docs like birth certificate, and certificate of no marriage, and police clearance...coz the embassy didn't give it to me, the lady told me that they'll keep it for verification...

I think the K-1 will end up working out for you. You really don't want to start all over with the marraige visa if you can avoid it. The police certificate is only good for 6 months anyway, and you wont need a certificate of no marriage for a marriage visa. They should give you your birth certificate back if you get the visa or not.

Am not sure, but I guess, everything now should be sent by post, coz after submission of the documents, we were told to pay at the thai postal service booth outside, you should do this before having the interview....

K-1s are a little different than CR-1/IR-1. We were IR-1, so we didn't have to pay anything at the interview. We had already paid NVC $400 for the visa fee here in the U.S.

Thanks for the reply Karee...The CO told me after the interview to mail it with my passport, so I sent it thru EMS last Tuesday, and was received by USEM on Thursday, and my status at ceac was updated on Friday...Am anxious for the possible result...how about your experience?were you told to submit the additional docs in person?and how long did you wait for the result to come up?


We submeitted our evidence in person and they told us right then to give them the passport. We picked up her passport with the visa in it the next day. You can read our experience here:

Is there someone here who experienced this...I was put under 221g because of Insufficient financial capacity of petitioner though he's earning above 125% of tihe guidelines....Then the consul ask for a letter from my fiancee stating that he'll be committing himself to me and support me all the way when I get to enter to US plus a copy of his bank statement...After sending all those papers, I even added another W2 and 1040 of 2011 & 2012, My status at ceac.state.gov was changed from ADMINISTRATIVE PROCESSING TO READY for interview...and when my fiance called DoS about the status, he was told that I have to wait for few days then they will send me something....

I'm worried & confused now, I don't want to face again the same consul who handed me that 221g paper, I was so frustrated knowing that I did well during the interview and we were well armed to face the battle...That consul just told me that, he didn't find any commitment and my fiancee is not financially capable, I was stunned knowing that my petitioner has been working at the same company for 3 yrs, and his income is above the poverty guidelines...

Does the status mean that I'll be having a second interview or the actual denial? Frankly speaking, visa refusal is such a pain in the ####, knowing that you are hanging at the moment and hoping for an uncertain thing, investing time, effort, and money...For me, it's a false hope, and actual denial is a lot better, coz you already know that you didn't make it but then you can proceed immediately to plan B....

More than likely you wont have another interview. How did you submit the new evidence? By mail or in person? When we had 221g, we submitted the new evidence in person between 1 pm and 3 pm on Mondays or Wednesdays, and they told us when to come back and pick up the passport with the visa. There was no further interview.

i never mentioned anything about fiance visa..... i didnt understand that .... well i am worried about the time, how much time will they take to process all this and what all documents they can ask for ..... because my wife is in india now a days with me ... she will be going back on 8th of october because she need to take care of her bills and job too..... but if consulate deny the visa that means being a citizen of america she has no right to bring her spouse because three or four people taking an interview are not satisfied .... but this is really making the life of a couple real hell

In your profile on this website it shows you filed for a K-1 visa. That is a fiance visa, not a marraige visa.

No, she didn't rack up the loan here. It was from her home. You only apply for what you need for schooling is how she explained it to me. When the Embassy told us they would not issue a NOS until she is clear of owing money to ANY government, she paid the money in full. We are waiting for an official statement/proof that it's paid off to send the Embassy before they issue a NOS. I thought I was pretty clear on that. Sorry. The Thai government is so slow... Even the Embassy told us that too. But I think we are going to send out the waiver this Monday anyways... It seems like being honest to a fault is making this harder then it is. They ask if we owe money, we are just going to state, "No" since we in fact, owe no money now. I was just trying for hopeful answers that there was a loophole in this process I think. The K-1 was for when she had to go back home and then return. Her J-1 expires end of June. Also program ends too. The K-1 was to get her back. Seeing how she needed to go back home to arrange things anyways. Just reading so many experiences, and different things, confusion was bound to happen. I am pretty sure the K-1 is the best, quickest, easiest route. We don't care about the measly $1,500 in fees after she comes back on her K-1. We just want to be together. Its the most important aspect of this whole process to us. I do appreciate your reinforcement that I shouldn't listen to her friends. I think I needed that. I believed from the beginning we were doing the correct steps.

I didn't take the time to read through everything. Don't take this the wrong way, but you can leave it all the stuff about how much you love each other etc. It's really not relevant, and alot of people wont take the time to read it, so you may miss out on some good advice.

Back to topic: I know someone that just went through something very similar to this regarding Thailand. You need to google 212( e ) and start there. Basically this person I know had to do all this from Thailand. She had to go through all the steps up to the visa interview, and then she was asked for the waiver then. She is now here in Florida with her husband. I'll ping her and see how she feels about sending you a PM.

Ok...  This is VERY VERY VERY confusing and making my wife and myself extremely angry right now.  We had applied for a No Objection waiver back in early June 2013.  Sent all papers to the Royal Thai Embassy, and the other forms that were needed to the Department Of State.  All fees paid, and documents accepted.  Took a little longer then expected, but turned out very well.  Embassy approved and gave their No Objection Letter to Department Of State.  They sent us a paper stating we had their FAVORABLE RECOMMENDATION. Then Department Of State, a couple weeks later, also agreed, and gave FAVORABLE RECOMMENDATION.  That was the 2 things we needed most.

 

From the very beginning, I had read forms over and over several times to be sure I was doing everything correctly.  Digging and researching before every step, no matter how small to assure that I was doing all the stuff for me and my wife the right way.  From my understanding, the J-1 Waiver based on No Objection was a 3 step process.  Embassy says YES.  Department Of State says YES.  Then they send their answers to the USCIS, and they determine the final YES or NO.  Well, the average processing time for USCIS to come to a decision based on No Objection afetr receiving Favorable Recommendations is roughly 6-8 weeks.  The Favorable Recommendations were sent out in late September to USCIS.  Now it's getting to the 12 week mark...  I decide to try to call any numbers I can, but most of them are not in service, or no longer active...  Go figure.  Very frustrated, get ahold of Department Of State, telling me to call Immigration or USCIS because they have the answer since they are the ones issuing the final say in this.  I call them.  For 2 hours, finally get through to someone for what seemed like the most disturbing conversation with a Tier 2 Immigration Officer...

 

Me - Aside from my pending I-130, I have another question regarding another issue...

 

IO - Oh of course, yes, how else can I help you?

 

Me - My wife has a pending J-1 Waiver applicat-...

 

IO - No.  I'm not helping you.

 

Me - Excuse me?  I have access to her case and she is my-...

 

IO - I can't talk to you...  About this or anything about this.  I can only speak to her.

 

Me - Please...  With all due respect, I check her cases daily for her since she is in Thailand right now, and I know the processes a lot better then her...  So it's easier for me to do things.  That, and she is in Thailand and not as easy for her to call.

 

IO - I can't allow you to have access to her case.  SHE is the applicant.

 

Me - I am the one that filled out her applications for her and with her.  ALL of them.  I have all case numbers.  I even have her case pulled up right now in front of me on the waiver website. (then I start to name off dates of when stuff was sent, and received)

 

IO - Hold on, what is the case...

 

Me - (i tell her)

 

IO - That's not a case number.  It must start with 3 letters..

 

Me - It's a waiver case, not I-130 or other petition.  And the processing time says its supposed to be between 6-8 wee-...

 

IO - No.  It's 4 months.  And if you filed your I-612 then you shouldn't worry.

 

Me - What?  What I-612?  This is for No Objection.  I was never to-...

 

IO - Not my problem sir.  You don't know what a I-612 is...  (She chuckles)  And nobody is supposed to tell you to file it.  It's not our job to tell you to file that form, and nobody is supposed to tell you.

 

Me - I was told I was done...  I never read anything about no I-612...  This is for No Objection and both Favorable Recommen-...

 

IO - NOBODY IS SUPPOSED TO TELL YOU ABOUT FILING THE I-612!!!

 

Me - I'm sorry...  I thought I knew the process good...  Maybe something I missed...  But to my understanding, I don't file to the Embassy, Department Of State, AND USCIS...  Can you by any chance explain to me what I should ha-...

 

IO - No.  That's not my job.  I'm not going to explain anything to you, besides that you should have done your I-612.  Your Recommendations are sitting in California right now and the USCIS doesn't know what to do to process for your waiver because you never submitted the proper I-612.

 

Me - I'm in Connecticut...  Are you sure you have my wife's case pulled up...?  I mean, something just doesn't se-...

 

IO - I'M NOT TELLING YOU HOW TO DO THIS SIR. DO IT YOURSELF.  YOU NEED TO FILE I-612 WITH USCIS PAY YOUR $585.  ALSO BECAUSE WE DON'T WORK FOR FREE.  WE NEED TO GET PAID TOO.

 

Me - Um...  I am very confused...  This is no persecution, or hardship waiver...  It's a normal J-1 Waiver with No Objection Basis...

 

IO - I'm done telling you.  I'M DONE. NOT MY PROBLEM IF YOU DON'T WANT TO LISTEN TO ME.

 

Now...  I politely apologized to this nice, oh so nice Russian accented woman about explaining to me the wrong doings of my life...  And am left with quite the confused thoughts.  Am I missing something?  According to everything I read, I am right, and this lady doesn't have a clue what she is talking about.  Do I fill out the new form, risk messing up my wife's waiver, and lose like $600 for no reason?  And why is processing taking so long?  It's been 3 months nearly.  And why is there NOBODY that ever knows anything about the waivers?  I Can literally find nobody from USCIS or any other department or office that to talk to.  My wife needs her waiver for her interview this spring time!

 

PLEASE, ANYONE HELP!!!

I'm confused as to why USCIS is involved in this at all.  The 2 year HRR is Dept. of State thing.  I know a member here from Thailand that went through this exact thing.  She dealt with the embassy in Bangkok after getting the no objection letter from the Thai govt. She was CR-1 visa also.  Her I-130 was approved in about 45 days.  The issue came up when it was forwarded to the embassy from NVC.  Getting that waiver approved set her back a couple months as far as getting the visa issued, but it never affected her I-130 getting approved.  You might want to send her a PM.

Hi everyone, I'm new to visajourney and I am attempting to start the process of obtaining citizenship for my wife who is in the USA now on a j-1 visa, she is from Thailand. Her visa has the two year residence requirement. We have been married since Jan 8th and her visa will expire on March 17th. I was under the impression that I could file an I-130 and that she could stay in the USA legally while that form was in process, but upon further research I realized we will first need to complete a ds-3035 waver of the two year requirement. So My question is how exactly should I request a letter of "no objection" from the Thai consulate? Furthermore if this waver process is not done before the j-1 visa expires in March will this cause problems with the rest of the process?  Any other info from any of you who have gone through this process is greatly appreciated. Thanks a lot.

Hi,guys

 

I would like to know  base of time about when you getting under 221g section?

 

I got interview today in Thailand,everything was great and fine,she said, but they asked me to re-submit about my surgery report.I'm Transgender,only made breast surgery but didn't have sex change at all.

 

I went to the doctor and my doctor has to called to the Embassy and the Consular told him to wrote down that I did my surgery.

 

I was very Clearly told doctor about my surgery when I did medical examination but I can't even tell whose faults between Doctor or American Consular or whatever.

 

Sometimes they mess thing up!! God, 6 months that we submitted paperwork but the decisions are took only 5 minutes,You know what!? They didn't looked at my evidence of relationship at all because they know who I am,so they only FOCUS on me about surgery !!!! that's it....

 

I was sent mail to them today.

 

Too bad that I have to change plan to have wedding ceremony.

 

Gosh,I wish they will know that I'm missing my man so badly !!!

When we got 221g in 2009, we gave them what they wanted and they issued the visa the next day.

I think the USEM in Bangkok spins a wheel with numbers 0-9.  If your case number ends in the number it lands on, they put you in AP.  Maybe they throw darts at a board.  Hard to say.

Ok, so I have an update. I contacted my senator here and asked them to contact the USCIS. my senator did this and a few days latter our status changed to approved. I'm so happy. our i-601 was filed at the nebraska service center on april 14 2014.  We were approved October 7 2014. My question now is will my fiance have to do another interview at the embassy? I've read about others saying that they didn't have to do it, but i've also heard others say they did. I'm not sure if there is a difference between the 1-601 and the 601A?

I forgot to come back and update this. 

 

I called them, and while they wouldn't divulge much personal information, they did tell me what I needed to do.  I took a highlighter and highlighted the parts that needed to be signed and notarized.  I also filled out the part concerning change of address to take my niece out of the mix so that any future paperwork would go directly to my sister in law.  I sent these to my niece and had her send that and the original to the mother in law and she had my sister in law sign them and they sent them to the UK pension service via EMS.  I was able to track the package online.  Once they were received, I called the UK pension service and they told me they had what they needed and they restarted the payments that week. 

 

I have to say that the folks at the pension service in the UK were VERY helpful while not violating any privacy laws.

It reads like there is a form she should be completing and returning.   I recommend you do that ASAP.  Also, call the number on the letter to talk to someone in person to ensure you can returns the forms late, because it looks like she'll be cut off 8 weeks from the date on that letter (about nowish).

 

You should remove the attachment. You've included her personal reference number and name that a fraudster could take advantage of.  In fact, I'm going to report your post and have a moderator do so, anyway.

 

Ok.  Yeah I probably shouldn't have posted it, but not sure what to do.  Do you think they'll have an issue with me calling?

I need some assistance on the best way to handle this.  I have no idea how things work in the UK, so posting here hoping for help.  A little background.  My Thai sister in law married a guy from the UK roughly 15 years ago.  They both lived in Thailand.  He died in Bangkok in 2006.  Since then my sister in law gets a direct deposit into her Thai bank account every month.  Some type of survivor benefits I assume.  She herself has been disabled and unable to walk since roughly 2012.  After he died she received his UK pension benefits every month.  I want to say it's something like 500USD monthly.  Back in November some forms showed up in the mail back in Thailand.  I JUST NOW got them scanned and sent to me, which I'm pretty  upset about.  There's never any urgency for anything in Thailand.  That's another topic I suppose.  It appears to be some kind of security check.  Here's the front page of 6 or 7 pages:

So I'm wondering if anyone from the UK can offer me any advice on what I should do about this?  She herself is bed-ridden and somewhat mentally handicapped.  I know the mother has gotten a letter from the doctors in Thailand stating this so that she can handle her Thai bank account.  I don't know if something like that would suffice for these folks.  Maybe I should call them?  They  probably would wonder why the hell some guy from Texas is calling about a dead British guy and his Thai wife though.  Although maybe they're not as suspicious of everyone like Americans are.

 

Anyway, any advice would be greatly appreciated.

President Vladimir Putin has waived visa requirements for athletes, coaches and other staff attending international sporting events in Russia.

Russia is hosting the Winter Olympics next year and the soccer World Cup in 2018. In August, the Athletics World Championships will be held in Moscow.

The decree Putin signed Tuesday said the visa waiver goes into effect immediately.

To qualify for visa-free status, athletes and others must have documents that confirm their identity and official accreditation from organizers of the sporting event.

Americans, Europeans and others normally have to apply for a Russian visa weeks ahead of their arrival in the country.

I'm an American Citizen and my girlfriend is a Chinese Citizen and we are just starting out with the K-1 visa process.  My girlfriend is still leaning English so she can speak very little English but is able to read and write it a bit better.  I on the other hand have been trying to learn Chinese but it is very slow going so I can not speak or read and write Chinese at all.

 

We are able to talk quite well over email but anything complicated seams to be very difficult.  I was wonder if there was any couple out there similar to us that is hopefully farther along with there process that would be willing to help us out.  I've been over this site and see it is very complicated to get a K-1 visa and being that she is from China it is even more so.  

 

It would be a great help to both myself and my girlfriend if someone would be able to help us with what needs to be done and also if there was a Chinese woman that is going through this also to help explain some of the things that need to be done to my girlfriend as some of the things that have to be done I am having a very hard time explaining to her.

I had a few of the red flags you mentioned in your first post.  My wife had never been to the US.  We met online.  I submitted our petition after the first meeting.  I'm divorced three times previously.  Our age difference is nine years. (not significant, imo)   I'm 48, she's 39.

 

We had no problems at any point in the process.  I used the RFE I got to do additional front loading.  We had chat logs from every day on MSN.  I printed one days chat log per week...for every week we'd been talking.  We also included QQ logs and emails that were exchanged.  That's in addition to all the trip information and the pictures.  We had pictures with her family from the trip I made to Guangxi.  At the time of my petition, I had made one trip to see her.  When we got the RFE, I'd made two trips....and so I sent evidence of that trip with my RFE response.

 

I will say this to warn you.  At the interview...there were several questions in both English and in Mandarin about me being divorced three times. That seemed to be the biggest issue for the CO.  I would assume it will come up in the interview.  They weren't pleasant questions.  The CO asked specifically, "Why do you trust someone that's been married three times"....several times.  Be prepared.

Thanks for the great information.  We have been going over interview questions.  The topic of the divorces we have spent a fair amount of time on.  Explaining to her about then.  She does not care about it much. She knows I was married three times before but as far as what happened she is like "Thats in the past let focus on our future."

Great,Thank you..that is one thing that i did not have evidence of and that is the chat logs from QQ..

 

It was real easy.  From your contact window right click on your contact and select "Message History" then "View Local Messages" from the menu.  Then right click on the contact icon tab on the left and select "Export Message History".  When the window comes up click on the "Save as Type" drop down and select how you would like it saved.  The rest you should be able to figure out.  I exported to mht then opened that file with internet explorer and copied everything there into a word doc so I could edit and format better as it is quite large.

alas, GUZ IV won't take anything on the casefile , for further intake, between the time that the casefile arrives to GUZ IV and interview day.  it isn't done.  She could bring a pile with her, but the time is limited on interview day for a consul to review this stuff - might get lucky with an evolution of relationship letter plus some photos reviewed during the 5 minutes that she's standing in front of a vice-consul.

 

did you include photocopies of your certified divorce decrees with the I-129F? if no, expect an RFE, and then send off your pile with that RFE submittal into USCIS.

 

 

IMO, though - these 3 prior divorces won't matter that much, at your age.  I was the same.  I can't say what I submitted matches what you submitted to the USCIS, I front-loaded based on a 5.5 year marriage with my wife and had a pile of evidence to send in, and even got a NOID at USCIS cause I missed something there.  Me. Darnell.  Missed Something !!  grrrrr. 

 

 

 

I do have to say this for sure.  You do rock.  Thanks for all the information I'm starting to feel a little better now.  I did send in most of the needed information already with the I-129F. There are just a few things that I wish I knew about before.  I think it would be nice to have the WIKI updated with a little more detail about supporting evidence to send along.  And to also adjust the note about front loading is not always necessary but in some countries it is 100% necessary.

 

Well now I have a plan and that does help quite a bit.  For others knowledge and for any possible suggestions here it is:

1) Brief letter to consulate explaining what i'm giving them below and why.

2) Life plan for when she gets here,  how we will get her settled and handle the culture shock.

3) Quick 1/2 page about past divorces and why they can be sure I will never get back together with any of my ex's

4) 1-2 page letter from me on our relationship progression and the reasons why I love her also cover how we talk with neither of us knowing each others language very well.

5) 1-2 page letter from her on our relationship progression and the reasons why she loves me

6) Be with her in China for the interview date.

7) While in China get together with her parents and get some pics of all us.

8) Get more pics of her and I with my parents and my daughter.

9) Recept for the Rosetta Stone software I purchased to lean Chinese.

10) More email messages between us

11) copy of qq chats showing her talking in chinese and myself in English visa text with messages about how long the video chat session was open.

12) proof of her taking English classes.

 

I think that should cover any of the issues they may have when combined with what I sent them already of:

1) Boarding passes for me going to China and for the trip we to together to Guangzhou to get my passport and visa replaced.

2) Boarding passes for her tip to the US to visit me for 1 month

3) Pictures of us together in China and the US

4) All three divorce decrees.

5) Letter of intent to marry from both.

6) Copy of cell phone contract for US based cellphone for her.

7) email message from between us

8) Copy of bracelet recept for gift to her.

9) Description of how we met and what we did while I was in China

10) I-134 with three years tax returns, W-2's, 3 check stubs, letter from work about my employment, statement from bank with average balance, current balance, length of time account has been open and owners of account,  Total rewards statement from my employer showing how much I have made and the value of the benefits they supply me.

 

I think that should cover everything.  If anyone has any comments or suggestions please speak up.

They Denied our K-1,So we got Married and are at the N.V.C. Phase right now.I put everything I had into the I-130,for Evidence and intend to add more at the N.V.C ,since I have filed.

 I have hired a attorney and my wife hire a attorney in China as well....we will be well Prepared this time

As for the Embassy,They did not look at any Evidence she took to the Interview and they had already made a Decision BEFORE SHE ARRIVED THERE! Trips to visit her ,i think is a Key to sucess and to have ALL the Evidence in front of the Interveiwer Before the Interview.

Best of Luck to both of us,the Officers there do seem to always be in Bad Moods..but don't ever give up,we didn't and we have been trying to be together for over 2 years and March 7 we will be married for 1 year ...and we are apart now!

How many trips have you made to China to visit her? Do you have pictures of you with her family? 

 

Follow Darnell's advice if you get an RFE submit a lot more information. 

 

If possible I would go there for the interview. If the CO is on the edge about approval it might just relieve a little of his doubt if she shows up with your passport on top with the Evolution of relationship letter in it.

 

When Yuan went for her interview the CO saw the passport and asked where I was. She said "he is drinking the overpriced coffee in the cafe downstairs please be quick so he does not spend a lot of money there".    This was at the "old" consulate.  you will not even get past the outside security building to get on the grounds of the new one. 

 

The CO chuckled and asked her 5 simple questions. 

 

She had 1 divorce, engaged after my first visit.  But It I visited her once during the process to meet her family, and I was there for the interview.  We had our Skype call log, lots of pictures he did not look at any of the evidence that we brought to the interview.  I agree they have their minds pretty much made up before the interview.

 

 

I'm past the USCIS stage now.  Here is the some history for those who have asked.

 

I went to China to meet her after talking via email for about 5 months.  I stayed there for about 10 days.  We were unable to visit with her parents because my passport got stolen but I was able to visit with many other family members.  We wanted for me to meet with her parents but did not have enough time after getting passport and visa replaced.

 

She can to visit me in the US for about 29 days.  She has meet both my parents and my daughter.  Was unable to visit with my brothers and sisters because of time and availability with them living about 900 miles from where I live.  My parents flew in from Milwaukee to where I live in Dallas just to meet her and stayed about 10 days.

 

She can speak a little English but note all that well.  She is able to read and write it better though.

 

I did front load my I-129f with some stuff but could have put more in there. I sent in about 9 pictures of us together and about 6 email messages.  Copy of boarding passes from her trip and mine and also the ones from while I was in China when we flew to get my new passport and visa.  Also include cell phone contract for US cell phone I purchased for her while she is in the US. 

 

We got engaged when she was here in the US and I also filed the I-129F while she was here.

 

I would love to go to China to be with her for the interview,  yes I know I can?t go to it with her,  but that would be about another $1,500 and I'm struggling to get the almost $3,000 together that is needed between now and when she gets her AOS.  Yes I make way over the minimum but funds are a bit tight right now with the cost of us seeing one another over the last 8 months being about $4,000.

 

I was thinking about writing a letter to the consulate and sending it to them explaining about my three marriages.  First was a train wreck we fought all the time and I was very young, second wife left me because she decided that she wanted to have kids after she knew I could not.  Third we found out that just because we were good friends does not mean you are going to be good lovers :(

 

We are both not young.  I?m 44 and she is 36.  She has never been married.  She is very independent and has 1 child and owns a house in China.  She never had a passport before she came here and applied for the B-2 visa and was given a full year multi-entry. The POE gave her a 6 month approval for her stay even though she only need 1 month.  To get the visa I gave her a letter of invitation, letter to consulate stating that we know she can?t marry while here and that we are planning on getting a K-1 visa, and the I-134.

We have known each other for about a year and a half now.  I?m trying to learn Chinese but is slow.  She was taking English classes.

After what seamed forever waiting for the NOA-2,  yes I know I have no right to complain as many have waited much longer than me,  we are starting to prepare for the visa interview now.  There is much to do and I have been scouring the net for any and all information I can find about what to expect and what we need to do for the interview at the Guanzhou consulate. 

 

Some of what I found scares me a bit but I have been unable to verify how old this data is or if it still is even true about the Guanzhou consulate.  From what I have found the Guanzhou consulate is one of the hardest consulates to get an approved visa through.  They are specially hard on K-1 visa applicants when one or more the following conditions are true:   Chinese applicant is unable to speak good English,  large age difference,  engagement with only one or on first visit together,   Applicant has never been to the US, or the petitioner or applicant has 3 or more divorces. 

I found this information on a China based website for a company that helps with immigration from China to us and this scares me very much because my fiancée English is not very good as she is still learning and my Chinese is even worse and I do have three divorces. 

 

You may ask if we do not speak each other?s language very well how we talk.  We muddle through in English and use google translate a lot.  Our letters are all in English as she can read and write English fairly well it just slow and difficult or her.  On qq or via text I type in English while she does it in Chinese and we both run through translators.  We do talk voice on qq a little but it is not very much.

 

We do have quite a bit of other evidence but I fear they may reject us just because of these two items.  I?m posting in the hope I can hear from others as to their experiences with the Guanzhou consulate and or get some advice as to how to overcome these issues.
