Yes I am from Thailand, I got married in 2004 and got my 2 years GC in Sep 2005 , got my 10 years GC in Jan 2008.
The base of 5 years residency counts from the first GC , correct?

I just hoping that the officer see the same think like you guy. I am personally really honest person hope for a good karma :)
But cannot help it with thinking negative result.

Yes it does count from the date on your first green card. (2 years green card)

Hello everyone,
I went for my interview on Aug 30, 2012 and passed the English and American history test but the decision cannot be made and they requested more evidence.
Here is some of my background ;
I met my ex- husband in 2003 while we working together in Wyomng state for 5 months.(I was on J1 visa)
I then went back to my country and continue the relationship ,also for the proper procedure on K1 visa
A year later I came back to the US to get married and we were fine in the first 2 years.
The third year where all the issues begin, My ex got fired at work then another after another. He then claimed for disability help from the goverment and not working (He gets monthly check from the gov). He claimed he has mental problem and cannot woth with others.
I worked 2 jobs at the time to have enough money to spend in the family.
He started to drink alot and become alcoholic and we (His mom and I) asked him to go to rehab which he did and promised he will never drink again.
He still drinks and to me he beomes 2 personality and rude to me in verbal (I told him I would call 911 if he ever hit me and he didn't) so I never report the verbal abuse.
I was so sick of the whole situation and I wanted to get out of the relationship and didn't think about it will effect me now.

I filed for my 10 years GC in July 2007 and got it in January 2008.
I then filed for divorce in May 2008 and it ended October 2008

The interviewer felt like my marriage was a sham and I told her all of my story how we met , how I went back to my country just to apply for K1 visa the right way.
And they asked for original petition of my divorce.

I am thinking of getting help from the attoney, do you think I need one?
I am so worry that my case will get deny.

I take it you went to the citizenship test? I think all you can do at this point is wait for a response from USCIS. You have the same name as my wife. Are you from Thailand?

No delay. Everything went fine. Make sure have a copy of your green card when you go to the biometrics and the interview. They never asked us for a copy, but better safe then sorry.

I forgot to sign my N-400 and they returned my entire package back (even included my original opened envelope). I felt like such an idiot but it was returned in less than a week and as soon as I put it back in the mail I got my proper NOA in less than a week again.

Laugh. I feel the same way. We've been on this road for a year. I guess a couple extra weeks wont hurt. I almost want them to return the whole thing. As long as they don't cash my check! :)

If they have enough to start processing your case, they will just send an RFE for the missing stuff. Otherwise, they will return the whole package. My guess is they will either send an RFE, or just process your case without the missing stuff and ask to see the missing stuff at the interview. If they send you a biometrics appointment, they really don't need the photos for anything anymore, and they will take her green card away at the oath ceremony.

It doesn't mean everyone, it outlines basically who would have to do this and who wouldn't.
Its just like a regular biometrics appointment, finger prints and a photo to prove you are who you are.
I would not be too concerned about it. If you have to take the biometrics then you do them.

Yeah my wife had to do all of that for her N-400 bio appt.

Citizenship and ROC are apples and oranges.  Since your filing under the 5 year rule, you wont have any issues regarding your marriage.  You can file the N-400 4 years and 9 months from the date on you original green card which would be April 2013.  You can file the N-400 now.

 

ETA:  You wont need a lawyer based on the information you have provided here.  It would be a waste of money.

I think at this point all you can do is wait. Also this probably needs to be moved to the Citizenship forum since it is not related to K-1. I'll ask one of the mods to move it. You'll probably get better answers there.

My interview for citizenship was done on December 12, 2012 For n 400, I passed the test but the officer gave me a letter saying that the decision cannot be made now.. Two days later I received request for evidence letter.. They requested my petition for divorce.. My green card is based on marriage that only lasted two years.. The condition was removed after the divorce.. I sent a copy of the petition for divorce on December 21.. After not hearing from them for a month i did the e request thing online and they replied today with this

Based on your request we researched the status of this case. We are actively processing this case. However, we have to perform additional review on this case and this has caused a longer processing time. If you do not receive a decision or other notice of action from us within 6 months of this letter, please contact customer service at the number provided below.


I am confused what does this mean, may it take another 6 months to be approved??? Oh my god i am crying its been already 7 months.. I dont know what to do..

After entering the U.S. on March 10, my wife received her IR1 permanent resident card in the mail yesterday.  It's good for 10 years.  My question is, now what?  I take it there aren't any removal of conditions required and she's free to work or do whatever else (although we're still waiting for her Social Security Number).  Do we just have to wait the mandatory three years and then she can apply for citizenship?

That's the nice thing about IR-1.  Nothing to do until 2 years and 9 months from the date on the green card.  You can file for citizenship then if you want.  There is no requirement to do that though.  We actually waited until 3+ years from the date on the green card to file for citizenship.

Finally got a text stating that status has been updated. As of Nov 1, have been scheduled for interview. It took exactly 3 months to move from " in line to be scheduled" to actually being scheduled. How long do you think it will be to get the actual letter stating time of interview?

There's really nothing to update until you get the interview date.

My status says now that they scheduled me for the Oath ceremony and sent a notice on October 19th. There was no placed inline status, and I did not get any notification e-mails (yes, I subscribed). So, if you are waiting for any type of notice, make sure to check the status online from time to time and do not rely too much on e-mails and text messages.

My wife's status for her I-130 still shows pending online from 2009.

@RedMustang. I noticed you did early biometrics, 10 days earlier than us in Dallas. However, I see that your oath date was 2 days after us. I was wondering did you delay the interview or oath ceremony? I'm just wondering if the early biometrics has any impact on the dates.

Your passport from Iceland? They don't care about that. The only reason my wife even brought her Thai passport was to show how many trips she took out of the country. I don't think they even looked at it.

That is good. I think they ask like 5/6 question all together from that 100 question. Usually the interview is not long. They just check all the documents and ask those question from that book. There is nothing to worry about the interview. :dance:

They give you a chance to get 6 out of 10 right. If you answer the first 6 right, they end it there. My wife answered the first 6 and they moved on to the reading/writing thing.

Good day July Filers!

Im so happy to say that I'm finally a US CITIZEN starting today!!!! :dance: :dance: :dance: I got interviewed today at Seattle USCIS, it was a quick one. Arrived at 1:50pm, I got called inside at 2 :25pm, The interview lasted for 20 mins. It was a brief interview, ask personal information from n400, ask 6 civic questions like what does the cabinet do, when is the last day filing of income tax returns, what did the declaration of independence do? if president and vice president can no longer serve who becomes the president?, we elect us senators for how many years? how many justices? I got them all correct so the IO stop asking, made me read When is Columbus Day? and then write, Columbus Day is in October., lol it was easy and then the IO ask for some supporting documents for verification like tax returns and lease, good thing I had it all. And then the IO started making random conversations with me like, what do i do for work? where do we went camping, and I seriously had pictures of us family so I showed them all and started asking where is this or who is this, yeah basically he made me feel very comfortable even if he's asking too much. It was okay because Im not hiding anything, he could ask whatever he wants, I dont care! hahaha, but seriously he;s nice and joke around too, its like an ordinary conversation. And then after that he made me sign my pictures and a paper and he congratulate me andsaid wait for an hour for my oath taking.The oath taking started at 4 lasted at 4 45, Got my certificate of naturalization and now im ready for pssport application.

Atlanta office seems to move at a snails pace.....I would have loved to vote, but I'm pretty sure that won't happen!

We've booked a 2 month trip to Europe in February..... would love to use a US passport, but may still end up having to use my GC.:wacko:

You're from the UK. I'd rather use that in Europe than my U.S. passport. :) You'll have your U.S. passport way before February.

For those who have received interview appointment letters, is the interview scheduled for before or after the 3rd anniversary of obtaining the green card?

We won't be eligible until mid-October, and I am wondering if we'll be waiting until then to get an interview, or if they'll interview earlier and postpone a decision until then.

Either way, looks like we have at least 6 more weeks.

Looking at everyone else's time lines, you're probably right on target.

No, it still shows initial review and she had her fingerprints on 8/15. We got the interview letter a couple days ago.

There's people that have gone 10 years or more. Some folks are cool with having the 10 year green card and renewing that over and over. There's no limit on it. You're fine.
