IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsPlease help - Our lawyer says NVC have made an error and NOT her?

Before you and everyone else goes and blames the attorney I did it all my self. Double checked and triple checked everything and know I sent in everything to USCIS.  I got an RFE for missing G-325a's.  I know I sent them as they were in both the packet I give to my fiancee and the packet I have.  When she was with me we verified that each packet was the same and had everything in it yet USCIS says I did not send it.

 

USCIS can and will loose things.  Do not worry you attorney will sort it out and get them what they lost.  I was all upset about this myself and it actually only delayed me by 30 days and in the end for the total process it does not seam to effected my final date by much from what I predicted.

OF-169 is not used any longer. It is now called DS-2001. It is a checklist form letting the consulate know you have all the documents required.

My husband is a Thai passport holder with a permanent residence green card (10year) and we are going to Spain and Portugal for a family vacation. Based on this information I believe he needs a Schengen visa, and an FBI background clearance. Does anyone know where I send the results of the background check to get the "apostille" required for the visa application?

Delta used to have a real nice web page for questions like this. Unfortunately, it seems they sold it to some visa service company which has made it unusable. However, it seems KLM has something very similar. According to their website, yes it looks like a Schengen visa is required. The FBI thing is news to me. Here's their website:

I haven't heard anything as yet. Friends have suggested patience considering the time of the year and how busy they and the postal service may be.

 

Since you know they received the application, it is probably in process. In my experience, the Singapore CoC was very quick to reply to our initial application that more information was needed. So perhaps if all is okay they just don't reply. They must be a very busy or understaffed group.

There was a member here from Thailand that had a rough time with the same situation you're in.  The problem wasn't so much the Singapore police certificate, the problem was they would only send it to the Embassy in Bangkok.  Once they sent it there,  they couldn't find it for a couple months.  I'll see if I can find the thread.

I have a question...I just received the NOA2 in the mail yesterday. So today, I called the NVC, just in case. I asked for my case number, which they provided to me. When I asked for an estimated processing time at the NVC, they operator told me that our case is under additional processing? That doesn't sound good. But when I asked what that meant he only told me that soem cases go through additional processing. What is that really mean? Has this happen to any of you? If so, how long did it take your case to be forwarded to the Embassy? Thanks for your feedback.

Since we're waiting for our case to be arrived in NVC and is already been 34 days since NOA2, i don't want to waste a single day during NVC process. Since i hired a lawyer to go through the full process when filled I-130, i know his name will be there already as an agent and i also heard some horror stories about lawyers wasting a lot of time during NVC process.
So how do i remove him from my case and add myself (petitioner) as an agent. Do i need to wait for NVC case No and then inform them over the phone and email DS3032 from my wife's (beneficiary) email address? Should i do this as soon as i get the case no? If NVC already generate IV and AOS bill and sent to my lawyer, do they send same bill to my email also. Please help.

You're pretty much stuck once you sign that G-28. I went through this. It's gonna delay things quite a bit if you fire the lawyer. My advice is to just grin and bear it. Stay on the lawyers a$$.

From what I understand, they don't send the packet 3 via post any longer. You have to download it from their website.

Okay an update. As suggested we just went ahead and downloaded Packet 3 from the web and have since filled out all the forms (I also sent Nat the I-134 and related info as well as some proof of my latest trip and some current skype records..ect incase she needs it). She has just this week made the trip to Bangkok to request her police records and to do the medical exam. We are waiting for the police report to arrive which should take a few weeks but we have ran into a bit of an issue around the medical exam.

Since Nat didn't have any records of her past Vaccinations, they ran her through a full course of vaccinations over the last 3 days (3 separate trips to Bangkok to see the doctor) now they want her to come back in 2 months for her final set of vaccinations. This is fine other than the fact that we won't have the medical paperwork filled out until that time (so won't be able to send in Packet 3) and we will be coming up on the NOA2 expiration just a week after that appointment and there is no way we will be able to finish up the interview process before that happens.

Reading the forums having to get an extension seems to be pretty common but I'm wondering if anyone with Thailand experience could give some advice on the best way to contact the embassy to see about getting an extension. Ning, if your still there, I"m sure you have experience with this given the length of time your case took.

Unless something has changed recently, you are good to go on the vaccinations. Make sure you keep the medical/vaccination records so you can finish them up in the U.S. for adjustment of status.

On Sept 26 I received a letter from the NVC stating they had received our approved I-129F petition and were forwarding (within 1 week) to the "appropriate visa-issuing post" which for us is Bangkok. This letter had a Case number attached so I assume we are all done at the NVC and just waiting to hear from the Embassy? It's only been a couple weeks but I'm wondering how long does it usually take for the embassy to send the package and checklist to my fiance?

So far everything has gone much quicker than I was expecting, we made it from NOA1 to NOA2 about 2 months faster than average so now that were almost to an interview date I'm getting anxious and just want to make sure I am on top of any problems. I am a little concerned because Nat moved to a new appartment prior to the I-129F approval which I notified the USCIS of with a letter as recommended here on the forums and now I just want to make sure that the package ends up getting to my fiance at her correct address. I tried calling the NVC number listed on their site and on here and all I get is busy signal.

Any help or info would be appreciated.

Just download all the forms from the embassy website. From what I have been seeing lateley, that is what everyone has been doing once they get thier BNK case number which you have on the notice from NVC.

I'm in the same boat. My case was completed at NVC on 1/24/2013 and sent to BKK. I was also wondering how long it takes to get a visa interview.

My wife's interview date was 3 months from the date of case complete. The 3 months fell during the Christmas holidays, so that probably had something to do with it taking so long. Also, NVC seems to assign the interview dates around the 3rd week of every month. So I'd check with them now, and if you don't have a date yet, check back 3rd week in February. Unfortunately, it seems the embassy schedules all the interviews for tourist and K visas first, and then what ever is left over they give to NVC for immigrant visa interviews. I don't know this to be a fact, but looking at time lines here it seems to be the case.

It takes a week or two for the case to arrive in BKK. All cases sent to BKK arrive first at the consulate which is across the street from the embassy. This is important because it takes a few days for the consulate to transfer the case. During that time if people contact the embassy they will be told the case isnt there. This causes a lot of confusion.
When the embassy has your case they will place it in the schedual for interviews and request the P 3 info. You can work on this aspect right now. Its best to send in with the P 3 a tax transcript for at least the most recent years filing ( 2011 ). The police report takes a couple of weeks to obtain for example. The medical can be done at anytime now or just prior to the interview. This is done in one day and she will have the forms when she leaves the hospital.

The OP is IR-1/CR-1. There is no P-3 for IR-1/CR-1 visas. Only K visas have a P-3. He's already submitted police and tax (affidavit of support) info to NVC. OP only needs to worry about medical and presenting proof of ongoing relationship at the interview.

2)Im a little confused about line 31a and 31b. My wife and her daughter will go the USA but it says who will accompany you (persons listed in line 14 and 29) I am listed in line 14 and my daughter is listed in line 29. Are they implying that I(USC) am trying to immigrate? or Im just going along for the airplane ride? Would if I'm just buying them a ticket and Im picking up at POE? not sure how to fill that line out.

For your wife's DS-230:
1) Yes, it is a visa application form for the foreign beneficiary (Your wife)

2) In 14 it asks about spouses, in 29 it asks about children. 31a it is asking if either are accompanying you. (by you they mean the person filling out the DS-230, which is your wife). So 14 is you (the USC spouse). 29 is her child. So if her child is coming with her, than list the child in 31a. Don't worry about the spouse part. Keep in mind this form is used for all kinds of visas, not just marriage visas.

3) Yes that is you the USC.

Make sure she DOES NOT SIGN PART 2 until she is in front of the consular officer and asked to do so. They'll make her raise her right hand and all that.

It's been 3 long years, I've lost 30lbs, alienated myself from my family because I couldn't answer questions about when my family would arrive. I could've had my wife here already but refused to seperate her from her daughter while I got her paperwork in order. There is resentment over all that has happened. I hope all works out in the end, I've put everything I have on the line. The hope that my mother in law will one day call me by my name and not farang, as I am the one who feeds her daughter an her grand daughter . The hope she will understand that the roads are not paved in gold and Obama doesn't pass out bags of money to poor people . I feel so small after doing very good things. Still trying to cope with the fact that my daughters "real" father who hasn't seem her since she was 4 months old would try to sell his signiture to me, I'm praying every day that our custody paperwork will allow my daughter to come to America. I won't know until the final moment. What I do know is that if she's not approved this dream is over for me. Sorry for rambling but I need it to survive, you people know what I'm going through. Ok why would a case undergo Admistrative processing?  That is happening to our K-1 visa right now. Another post said because the que to process is lagged behind. But if others are going out that were received AFTER ours, what is going on?  There is nothing I can think of that would cause a problem.

I've been around VJ since 2007, and I've never seen a good reason for Administrative Processing at NVC.  It seems random.  My guess is they just pull a few out of the pile randomly every so often, and decide to take a closer look at them.

Good news for everyone who was transfered from VSC to TSC.

 

We were transferred from VSC to TSC on 9/4, we were approved

NOA2 on 9/19 and TSC forwarded our case to the NVC

on 9/23.

 

Just got my mail today and saw the envelope from NVC they receive my

petition on 10 /3 and now have my case number. Petition is being forwarded

to Embassy this week

 

So from time the petition left Texas 9/23 until 10/3 is 10 days

Wow!!!!!!!!!!!!!!!!

K visas hardly spend any time at NVC unless they undergo Administrative Processing which is rare.  The average time a K visa case stays at NVC is 5 days.

I received my NOA2 November 21st & NVC is still awaiting my petition. I thought you are not supposed to do police report until 30 days prior to the interview? I also thought the Embassy is supposed to send you a packet that includes a list of embassy approved doctors to get your medical performed at? Now I'm confused? I have tax transcripts & letters from my employer but nothing else yet. I'll be at 8 weeks next week.

Also, how do you register for updates from the service center?

 

As far as the police report, I think it varies based on the country.  I know in Thailand the police report is valid for 6 months.

I am a US citizen. I will be filing for my wife in Thailand soon. Most, if not all my friends, live in Thailand. I am having a problem finding a way to getting my friends in Thailand affidavits notarized there. Does anybody know how to get around this problem?

Are they Farang? If so, you can get statements notarized at the embassy for a fee. Not sure why you would need that though. If you have proof of relationship and photos etc.

Thailand and Cambodia have recently passed laws which discriminate against older men marrying younger local women and in some cases prevents it!

This is not a one way street.

As others have said, work on getting proof enough to satisfy the embassy and reapply. Your husband may be a genuine man and it may seem unfair but Nigeria is a high fraud country so you just have to wait it out and work extra hard.

Reread what I wrote the first time. They do talk to eachother and the NVC closes the i-129F on purpose. The K-3 saves no time anyway, and is more expensive.

If they are talking, why is USCIS sending I-129F petitions to NVC with the I-130?

Wow ... what a pain!! If they are going to be that ####### about staying on the CR-1 path, they should just take down the page on their website about the K-3 visa so people don't keep getting their hopes up!

Just got off the phone with my boyfriend and had to let him know that this type of visa is no longer an option. So not fair, LoL. :crying:

The issue isn't with USCIS, it's with NVC. USCIS will approve both the I-129F and I-130 and send them to NVC at the same time. NVC then closes the I-29F. It's kind of a situation where one agency doesn't know what the other is doing.

In 2012, out of all spousal visas, 0.33% were K3.  That's about 210 out of just under 50,000.

cocolucho.. you are part of the 0.3% (or was it 0.03%) have have gotten a K3.  Rather like a Unicorn.  Granted it is more common this year than it was last year, but that is to say it may be .3% this year and 0.03% last year. 

 

Exactly.  I definitely wouldn't go making any plans based on obtaining a K-3, because the chances are slim to none.  I personally wish they'd just do away with it.  There's always an outlier that is granted a K-3 and it makes people think it's still a valid option, when in 99+ % of the cases, it is not.
