Wont matter with an IR visa. The next step after an IR visa is citizenship, and they don't ask anything about medical or vaccinations.

Thanks for the great suggestion about the DCF. Looks like that would be fastest/hassle free route to take if we were already married and I was a legal resident, which I'm not. (I've had 6 consecutive 1 year O-A visas here in Thailand).

Actually, neither my girlfriend or myself want to relocate back to the U.S.A. full time. I usually spend 2-4 months in the U.S.A. every year, and each time I go it's a forced separation. To get around this, I'm thinking the K-1 is the easiest option considering the limited choices, and would give her a chance to experience life in the U.S.A. and see if she wants to live there part time. If she does like it after 3 months, then in order to satisfy the legal requirements we would get married and spend 2 years in the U.S.A, and then be free to have a split residence maybe 6months in each location? So that's the scoop.

The embassy will consider the O-A visa as residency. I was on a Non-O there, and that would have worked out fine.

The part time thing living in both places may cause some issues. Any time out of the US for more than 6 months without a re-entry permit raises flags about abandoning residency. Also, if you go K1 she'll be stuck in the US until you get either advanced parole or the green card. After 2 years 7 months she can apply for citizenship and all the residency requirements go out the window. My wife can apply for citizenship in 7 months. Once she has that in hand, we will be going back to Thailand on semi permanent basis and wont have any issues since she will have a US passport.

Thanks for all this great info! Really helps. So I guess the plan is: we'll file the I-129F now and I'll go back to the usa alone soon. She'll do the K-1 process in Chiang Mai without me, and hopefully the income and domicile in usa will not be a problem, then she can join me there in the usa maybe in 4-6 months with K-1 visa in hand , or a year if it takes that long. Like everyone else said, DCF is the quickest, cheapest, and best option. I was married and living in Thailand and didn't know about DCF. It took a year to get my wife here filing from the US.

We were approved for a visa (NOA2) and need to still follow the requirements that lead to the interview in Bangkok. I have been interviewing for a job in a different state and I believe a job offer is coming this week and I will be moving to a new state and obviously address. I need to give 4 weeks notice to my current employer and so I am probably 6 weeks from moving at the soonest. When I know I am moving (offered and accept the job) when, how, and who do I notify?

I don't know about Manila, but Bangkok said passport stamps don't mean anything. I had like 100 cause I lived there and travelled throught Asia for business. They said that just meant you lived in Bangkok. They said that didn't mean you were together with your wife, even though we had been married over 2 years by the time of the interview. They wanted pictures!

Hi, has anyone received notification from the NVC for NOA2 for June 5 or later from CSC? I just called today and they had no record yet of my case and told me to send a copy of my NOA2 to NVCresearch@(State?).gov. I'm curious if anyone else has received it yet?

From what I've been reading here, seems like NVC has slowed down considerably this last month. Not sure why. Maybe someone else can chime in.

As part of a recent job application my husband was subjected to a criminal background check. It took just three days. In our immigration case the same thing took about 3 months. It isnt your background that will cause the delay as much as the time they need to simply do the work. There doesnt seem to be any way to know how long these things will take. Many cases we see here never endure the check at all or go thru very quickly if one is done.

Got NOA2 on July 2, 2012, NVC entered into their system on July 6, 2012. They have now had it for 17 days. I called today for a status and was told that the petition is undergoing "additional processing", anybody know what that means? What is the typical turn around time for the NVC? Thanks.

We filed the petition on Octber 2nd. We received NOA 1 that said the case being forwarded to CSC on October 11. I check my online status everyday and the case is still in 'acceptance' process until now. I thought it would moved to 'initial review' after almost a month. Anyone has any idea on this matter?

the USCIS doesn't do a very good of updating their website. I received a letter from NVC dated 23 MAR that said they passed on my approved packet to the Embassy, and she received the letter from the Embassy stating to go ahead and send in packet #3, yet the USCIS website still has us listed as initial review.

Laugh. My wife has been here for over 3 years and it still shows pending.

After much emailing activity with the Embassy I got this:

"Thank you for your inquiry.

Immigrant visa applicants must demonstrate that they have a bona fide qualifying relationship with the petitioner and that they are not pursuing such a relationship solely for immigration purposes. Specifically, as a K1 applicant, XXX needed to show that she was the legitimate fiancée of you, the petitioner.

Our records indicate that XXX was as interviewed on November 7, 2012 and was asked a number of questions about her relationship with you. She was also given an opportunity to present documentation, photographs and other evidence to substantiate her case. The Consular Officer who conducted the interview determined that the applicant was unable to provide sufficient evidence of the required bona fide relationship. Accordingly, the Consular Officer returned the petition to the Department of Homeland Security's U.S. Citizenship and Immigration Services (DHS/USCIS) with a recommendation to revoke the petition. In most cases DHS/USCIS will not contact you, the petitioner, because of the short validity period of K-1 petitions. You are free to file a new petition for XXX to immigrate as your spouse. Any further inquiries regarding the processing of the current case may be directed to DHS/USCIS. Contact information can be found at www.uscis.gov.

Please be assured that the Consular Officer made the decision based on U.S. immigration law. Under Section 205 of the Immigration and Nationality Act, an approved petition can be revoked if there is good and sufficient cause (ref. INA, Pub. L. No. 82-414). Okay so the evidence that she presented was as follows:


All the requried forms
Letter from my employer
3 years of tax return
Photographs of us on two trips to Nigeria, pictures of me with her family, her with my family
Personalized license plate of her name on my car
Rebtel and AT&T phone record , daily calls at least 3 times a day since April 2011
Snail mails
Receipt of package shipments between the two of us

I am not sure what else she could have presented. But she was at the mercy of the intepreter so who knows.

I;m just insulted personally that I was accused of havinga sham relationship. I mean this allegation if proven has considerable penalty to me as a USC and it shouldn't be thrown around carelessly like this particular CO did.

Just wanted to update you Guys. I've purchased my flight and I'll be doing the Spousal visa as "they" recommend, so we'll see what they have to say next time.



That sucks! At least you have your answer from them. Go crazy with the pictures when you go to get married. Look at the bright side. You wont have to deal with adjustment of status when she comes here, as she'll get a 2 year green card right off the bat. We've seen this alot in recent years, especially at Lagos. Simply filing for a CR-1 visa will not resolve the issue. You need to find out somewhow (apparently it doesn't seem easy at that consulate) exactly why they thought the relationship was not bonifide. If you don't overcome that hurdle, they will just deny the CR-1 for the same reasons. I would try to get as much information as possible about questions asked at the interview, and what she thinks the red flags might have been.

After it was approved by USCIS it will do a quick stop at NVC. If lucky, it will stay there for few days then MNL case number will be assigned. For us unlucky ones, it took them 3 weeks as it went through their 'additional processing' prior to forwarding to Manila consulate. Once completed, you'll receive a separate letter stating it was completed and forwarded to the corresponding consulate.


Yes I know all that. Kazuile was advising the OP about steps that concern CR-1/IR-1 visas. Those steps have nothing to do with K visas.

Don't wait for NVC to send you something with your case number on it. You will waste a LOT of time. In a week or so, start calling NVC asking for your case number and IIN number. Once you get those 2 numbers, you can move on with the NVC process.

I have had a NOA2 approval now for 36 days and have recieved NOTHING in the mail from NVC. But I have already sent in my AOS packet, because I called them every day until I got my case number.

Look for the NVC Filers - January thread on here and study the first 2 posts.

Don't waste time and GOOD LUCK!!!

Here's my take on all this for whatever it's worth. I can see Ning's point and I can see Googled's point. I've known plenty of people both here on VJ and people that I knew in Thailand (myself included when I lived in Thailand) get taken for a ride. Scammed if you will. I would agree with pretty much everything Ning said if were not for that $4k. The OP hasn't come back to clarify that, but in my mind that's a huge red flag for someone that does not even have the K-1 visa in hand.

Here's a little of my experiences in Bangkok:
My first relationship there was with a 19 year old that I met in a bar after being in Bangkok for a total of 2 hours. Of course I was gonna change her. Fast forward 18 months and I'm sitting in the Lad Phrao police station with a superficial knife wound compliments of her sister, and the cops drinking my whiskey telling me if I don't sign this "confession" they're gonna lock me up. Of course this document was in Thai and the supposed US Citizen phone number at the Embassy just rang and rang. I signed it and that was the end of that mess. The drunk cop was nice enough to give me a ride all the way back to my apt. on Sukhumvit on the back of his motorbike. After that ride, I was thinking I should have took my chances in jail. :wacko:

At this point I pretty much figured out the game. I ended up hanging out with alot of different "bar girls" etc. Helping them send emails to their 5 different farang "boyfriends" all over the world with the usual sob stories. Brother cracked up his motor bike is in the hospital, parents farm is in trouble in Isaan etc. etc. I usually got "favors" in exchange for my help. Today I'm not real proud of that, but at the time my mindset was #### it! I got screwed over.

I met my wife through a British guy that I hung out and drank with. He was married to her sister. The British guy eventually drank himself to death in Bangkok along with a few other farangs I knew there. I was living there on 30 day tourist visas until one day the Army got tired of Thaksin and took over. One of their first moves was to say no more living here on tourist visas. 3 in a row and your out for 6 months. Obviously that wasn't go to work with me living there for my job. I didn't really work in Thailand, I traveled throughout Asia for my work, so a work visa wasn't going to fly. I told the wife if we don't get married so I can get a Thai Non-O visa, i was screwed. We got married at the Bang Rak Amphur, I flew to Singapore and got my 1 year non-O Thai visa. She told her parents, and shockingly, they didn't ask for 1 Baht for sin sod. To this day I think I've probably sent them 10k THB total in 4 years and they're pi$$ poor farmers in Si Saket (Isaan) The running joke is when people ask me if my wife married me for a visa, I say no I married her for a visa.

I myself ended up unemployed and broke in Bangkok. I went from clearing 7k USD a month to nothing in a day. (My first girlfriend "helped me" spend that 7k quite easily) My wife supported me on about 7k THB a month cutting hair. All of her friends (and her sister) were saying "get rid of this broke farang" I ended up coming back to the U.S. to start over. My wife still sent me $50 here and there from Thailand. My farang friend made the joke that they should put a statue of me in Bangkok, because they never heard of a Thai girl sending a farang money. I got back on my feet here in the U.S. and my wife is now a citizen.

So anyway, not sure why I posted all that (Maybe to remind myself how lucky I am to have my wife.)

My point is this: It's really hard to know who or what you are dealing with over there. Even if you live there. You shouldn't assume all women there are scammers, by the same token alot of them are. Being a bar girl there becomes a lifestyle. The closest thing I can compare it to, is being a drug addict. I'm sure there are girls there that truly choose that profession to send money back home and all those sob stories. They are few and far between. The name of the game is to extract as much money as possible from as many farangs at one time as you possibly can. I've seen them take K-1 visas all the way up to the interview, while getting money the entire time and then bailing out right before the interview.

My wife's sister now has a terminal disease and my niece is in one of the best private schools in Chiang Mai that we pay for. You do marry the family when you marry a Thai girl, so keep that in mind.

Honestly I might sound like a jerk for saying this, but maybe you fiance has gotten cold feet. Before you think I am crazy look at what I am seeing. You say that you sent the evidence and the 221g says that they never got any. Your fiance was the one who is supposed to give it to them. You said that she said the CO said that you did not love her and would never marry her. My wife is Thai and she tells me all about the crazy stories of her friends back in Thailand and that sounds like the ####### they would say when they are trying to take advantage of some "dumb farang". I also think that mentioning the 4K was a bad idea and from my experience from giving your Thai inlaws money, they are not saving it for your wedding. It is probably half spent on gold and Thai Whiskey by now.

I am not saying that you should accuse her of anything. I hope the everything she says is true and that this is a big misunderstanding by the embassy, you get it straightened out, and you two are together here in the U.S. Just be careful and protect yourself.

I wasn't gonna go down that road.... yet. Of course it was the first thing that popped into my mind as well. Especially when I saw 4k USD. I hope everything works out as well. Experience tells me otherwise.

Maybe see and get advice from an immigration attorney.

Probably a waste of time and money IMO. Attorney's in the U.S. have no idea about the way things work in Bangkok. Attorneys in Bangkok are pretty much over priced scammers in my experience.

This is quite the situation. I suggest you step back and think before you act because you will get only one more chance at success.
She was given notice of exactly what they require already. There is no question about that. Providing letters about a Romeo and Juliet story wont help becuase it wont be read. Even if it was does it sound to you like this jerk would really care about what you said? Dont waste your time on such trivial pursuit. Dont expect them to become emotionaly involved.
You need to write a statement to HER indicating that ONCE before you entered into a petition for a K 1. I would tell her that relationship ended well and the petition ended within a short time of the NOA 2. Make some refrence to the RFE as well. Keep this short and remove any sign of emotion.
This is what they asked for: Evidence of your relationship with petitioner (i.e. photographs, letters, e-mails, phone bills, old household registration books etc.)
Confine what you do to a thoughtful responce to these items. There is a reason they kept the other info that was submitted. The further submission of evidence will be added to the case file and they will approve her visa. Keep it simple and easy for this clown to comprehend. Hopefuly the case will be reviewed by a different officer as is done at times. Do not make any comment about what was said or done last time.
You made a huge mistake with the comments about sending 4 K to her. You intentions were correct but play right into the red flags they look for. Could she be extorting you? Are you trying to buy her? Of course not but the drama makes them feel that have found what they are trained to find.
Let us help you by reviewing what you are going to send if you want. Evidence of your relationship? How about writing in your statement to her that you have arranged the wedding to be within a certian date that complys with the 90 days limit. Then something about your understanding of the AOS procedure, when and what you BOTH will do to get that started. Write several letters to her about all your plans to incorperate her into life in America asking her opinion. Things like this should help. If you need help with any of this send me a P M.
Photos? They have 26. Another 50 wont change anything. They did care about the ones she had and wont react any different to another box of those.
Formulate a better plan and lets get this done.
In the end if none of this works you can still have what you want. It just takes more effort. Marry her there and file the CR 1.

Yeah that 4k threw up big red flags to me as well. It's a little early in the game for a sin sod, so not sure how to explain that one.

No, we changed clothes of course. Only once though. Basically had motorbike taxi drivers snap the photos.

Good point about the blue book. Maybe they're worried about HER past marraige if she has one. I know when we got married, my wife took her blue book to the Amphur and they just put a line through her last name, and then wrote my last name under that in Thai.

First thing I would do is send them an email to find out exactly what they want. Also, explain the previous K-1 filing. Send the email to visasbkk2@state.gov. Make sure the subject line of the email looks like this: IV Inquiry BNK2012xxxxxxxx. (The BNK2012xxxxxx number is the case number you got from NVC in the mail.) They're pretty good about responding. Once I get to work, I'll dig up my my embassy experience and post it here. It's somewhat similar to yours. There was a jerk CO there back in 2009 that was pretty much handing out 221g to everyone for awhile. Sounds like they got another one.

Thinking about your situation on the way to work I was wondering about the $4000 wire transfer. That seems a little odd. I understand sin sot and all that. I personally would've left that out. Also, found it odd they asked for old house registration books. Not sure what old blue books have to do with anything.

LIke I said previously, send them an email. That's what I did and they sent me an email back saying we want more photos. So I gave them more photos, granted I took the photos all that same day :whistle: but they didn't need to know that.

Also, you can take more eveidence back to tthe embassy between 1-3 pm on Mondays and Wedensdays. I think I read here that you can do that any day of the week now, but not sure.

My fiancee had her K1 interview yesterday at the Thailand Embassy and we received a 221(g) refusal white paper:

"This office regrets to inform you that it is unable to issue a visa to you because you have not been found qualified to receive a visa under section 221(g) of the Immigration and Nationality Act or regulation issued pursuant thereto. Further consideration will be given to your visa application after you obtain and present the documents listed below (only the marked sections apply to you)"

X Evidence of your relationship with petitioner (i.e. photographs, letters, e-mails, phone bills, old household registration books etc.)


We were both shocked by the decision and by how short the interview lasted before the CO left and then came back with the 221(g) document and ended the interview. She had come to the interview with a mountain of evidence to prove our relationship and other necessary docs including:

  • 26 photos taken during three different trips all over various locations in Thailand, including photos of us at dinner with her Mom, Dad, Sister and several other family members
  • A photo of us taken on the night when we were engaged and she is wearing a 1 Ct engagement ring which I used when I proposed to her. This is the same ring she is also wearing at the interview
  • Several hotel bills from several different locations throughout Thailand
  • Evidence of three different airline itineraries for trips taken to see here three times in the last 13 months
  • A stack of Skype phone calls showing that we talk on the phone at least every day for the last 15 months and another stack of MSN chat logs from between 1 and 2.5 years ago
  • A wire transfer document from my bank in USA showing that I wired $4,000 USD to her which she then transferred to her father's account for a down payment on our wedding later this year after the AOS is completed (I hope!). This was done after I proposed during our 2nd trip but before my most recent trip.
  • All sorts of my financial documents like last three years of tax returns and W2's, Employment verification including salary on company letterhead, final pay statement from 2012. Her pay stubs and letter from her employer in Bangkok showing high performance reviews.
  • Thai police record and medical transcript document
She did the interview in English as her language skills are quite good. She works in an office as an accountant and handles transactions by computer and over the phone in English with foreign clients and she has a stable employment record and a decent salary for a Thai person of her age and education (college degree) working in her field. She had documentation of all that too. The CO only glanced at a couple of the photos and did not look at any of the other documents mentioned above before beginning to attack her regarding the legitimacy of our relationship and told her that he did not believe that we had a real relationship. She told him that we initially met almost 3 years ago in 2010 on a Thai dating website but we were not really that interested in each other and things did not really click until 2011 (all completely true) after which we started to chat and then speak on the phone regularly until we first met id Sept 2011.

He told here that "...your fiance has many, many women and he is a player! He doesn't love you and he's not going to marry you. Do you know that he has filed many K1 petitions for women in the past? Why would you think that he is ever going to marry you? I don't believe that you are telling the truth about going to the US to marry this man"

The truth of the matter is that I filed one K1 in the past and it was almost 5 years ago, in 2008. That relationship ended amicably before any visa was issued and in actuality. immediately after the NOA2 was issued in Dec. 2008 she just got cold feet about leaving her family and sent me a letter telling me that I was a great guy and we should stay friends... blah blah blah. I correctly noted this previous I-129 in the appropriate section in in my most recent I-129F filing but since it was more than 2 years ago and there was only one, I thought I was fine under IMBRA Act. I have never been married before and have no dependents. I received an RFE to explain the previous K1 filing and did so in great detail explaining all of the above and showing the cancelled petition statement from her embassy. They reviewed my RFE and issued the NOA2.

My fiancee tells me that the CO seemed to have disdain for her from the start of the interview. I think that she was asked to put a finger up to do a fingerprint scan and she placed two fingers or her index finger and the CO said "You just told me that you can speak English but you can't even understand a simple command?" Well she was nervous, and the CO continued to berate her throughout the short interview of only approximately 5 minutes and as stated, he never looked at any of the documents except a couple of the photos. He did retain all of the documents including the photos and only returned to her personal items such as passport and ID card.

The way she was treat really makes me upset, but I realize that these CO's have absolute authority and there is nothing that you can do except play the game. By the end of the interview she was almost in tears and frankly I don't think she is used to telling someone in a position of authority that, "Look, you're wrong and here's why. Look at this!", and so she never really asked him to consider any of the documents that she had brought.

I've done quite a bit of reading on the 221(g) on this website and other places, and realize that its somehwat considered a 'soft denial' while the K1 is going through Additional Processing. they have asked for more documents to be presented by registered mail, but what more can we give them to prove that we are in a committed relationship and plan to marry? have heard that Thailand is very heavily weighting applicant on photos and if it's photos they want we can provide 50 more. Does it help for me to write some sort of letter stating all of the reasons why I love my fiancee and assure them that I will marry and file AOS within a week after she arrives in US? Is there a way to request another interview or drop off the follow-up documents in person and ask for a Thai interview in the hopes that she will get someone more reasonable and rationale?

I told her that this is probably just a tactic employed by this CO to rattle her and make us lose hop and that submitting more photos and documents will get us past this 221(g) but would really appreciate any guidance from other VJer's familiar with a similar situation of denial due to a previous K1 filing and what other document may help besides the obvious, which I've read is a lot of photos. After all, he didn't even look at the current stack of documents and they still need to be reviewed by somebody.

First thing I would do is send them an email to find out exactly what they want. Also, explain the previous K-1 filing. Send the email to visasbkk2@state.gov. Make sure the subject line of the email looks like this: IV Inquiry BNK2012xxxxxxxx. (The BNK2012xxxxxx number is the case number you got from NVC in the mail.) They're pretty good about responding. Once I get to work, I'll dig up my my embassy experience and post it here. It's somewhat similar to yours. There was a jerk CO there back in 2009 that was pretty much handing out 221g to everyone for awhile. Sounds like they got another one.

I just got off the phone with one of my congressional aides. Pleased keep in mind I am paraphrasing and I have no idea if her information is correct. But here is a summary of our discussion.

 

Up till about a month ago CSC management was unaware of any processing delays. The flood of congressional inquires caused an internal review. The result was a decision to hire additional staff. That staff is currently going through training.

 

The dream act has had no effect on work load at CSC in regard to K-1 applications. The increased load has come from an increase in K-1 applications being filed and the internal water problems.

 

No work has been shunted off to Virginia.

 

The Goal of the hiring is to get processing times back down to 5 months.

 

Many aides are keeping as close eye on CSC which should keep the pressure on.

 

The dates on the CSC website are useless. She said as long as there is one July application still in the system the date will continue to show July even though later months work are being approved.

 

She told me with a January NOA1 she would not expect an approval until July-August even with the new hiring.

 

Applications are processed out of order because every officer has a stack and will work from oldest to newest in that stack.  Additionally some officers work faster then others.

 

As the backlog at CSC is moved down the line, processing times at NVC are expected to increase to 3 months. New policies require the Embassy to set an appointment date BEFORE the paperwork is sent from NVC. In my case appointments are being scheduled at Bangkok out about 3-4 months.  Which means after the appointment is set and the paperwork is forwarded, it will be an additional wait of 3 months. During that time she can get her physical etc.

 

In the opinion of this aide, with a January NOA1 she would expect us to have everything complete and ready to travel no earlier then January 2014. She said she could be wrong, but looking at her other cases and recent history, 12 months from NOA1 to completion is about what we should expect.

 

 

 

 

If you haven't seen it already, take a look at Igor's list.  It should give you a pretty good indication of how things are going.  The processing times posted on the USCIS website are useless.  Always have been.

19 days from the time we received NOA2 to the time we mailed the Packet 3 to the consulate. We're making progress now. It will be interesting to see how long we need to wait for an interview appointment.

 

Probably looking at late June or July for the interview date.

Tell him to take the pictures and suck it up.  Not have any will most likely look like a red flag.  I myself do not like my picture taken very much at all but know it is important.  I'm also finding out that the more that are taken the more relaxed I'm starting to look in them.  After a while he will get used to them.  I sent in 6 of us with the K-1.  We will have many more that will be brought to the interview.  The first set it just to get through the approval to apply for the K-1.  The real proof is going to be at the interview when you other half is going to have to prove they are in love with you.

I'm also at TSC and kind of wondering the same thing.  Keep this in mind as they may be delayed.  1,  Thanksgiving holiday, 2 Christmas Holiday, 3) New years Holiday.  We had a ice storm here in TX that shut them down for three days.  So add that all up and you can expect not less then 9 day delay.  I've been watching other timelines for people on this site and I have not seen anything approved for what I'm submitted (1-129) since the end of October.  I'm adding in the 9 days to the processing and that means that I'm still not over the average time.  

 

So because of all this expect some delay.  Sorry for the great news.

Before you and everyone else goes and blames the attorney I did it all my self. Double checked and triple checked everything and know I sent in everything to USCIS.  I got an RFE for missing G-325a's.  I know I sent them as they were in both the packet I give to my fiancee and the packet I have.  When she was with me we verified that each packet was the same and had everything in it yet USCIS says I did not send it.

 

USCIS can and will loose things.  Do not worry you attorney will sort it out and get them what they lost.  I was all upset about this myself and it actually only delayed me by 30 days and in the end for the total process it does not seam to effected my final date by much from what I predicted.
