Charging $7,000 for an attorney to obtain a CR1 visa should be criminal. That is why so many people feel that lawyers are a bunch of protected criminals. Be sure to file a complaint with the attorney general in your state. Tell the lawyer that if he does not give you the money back, you will file a formal complaint with the attorney general.

I went down this road. There's really not much you can do. About the only thing that can be done, seems to be fling something with the Better Business Bureau.

If the lawyer refuses to give you any of your paperwork back, then that is another story.


I'd chalk it up to an expensive lesson, and also a warning to others here on VJ.

People need to understand that the I-130 is used for multiple things. It's also used for people to adjust status here in the U.S. from tourist visas, work visas etc. In those scenarios, then yes you need to send all kinds of relationship evidence. Joint lease, Joint bills, co-mingling of finances etc. There is no interview at a foreign embassy in those situations. In the OPs scenario, no green card is issued due to an approved I-130 and there is no I-485 involved.

I have no idea why someone from USCIS would approve an I-130 petition and then make a phone call stating more relationship evidence is required, when they are turning around and sending it to DOS (NVC) Once the I-130 is approved, it is out of the hands of USCIS in the OPs scenario. It's very odd.

There is something very strange about the OPs story. In our case we only sent in the marrige cert and had no problems in that regard. During our AOS meeting USCIS did ask for further documents that showed a bonafied marrige.

Yeah Nigeria aint Thailand. I've never heard of someone needing to front load a petition for Thailand. Plus he got NOA2 anyway, so the petition is approved. His wife will have the opportunity to submit all the relationship stuff at the interview.

The officer called me for a telephone interview. She made a statement regarding my need to prove bona fide marriage. I asked why my western union transaction history for since 2010 totaling 30,000 use, 150 pictures, detailed travel logs provided from korean air, passport stamps, telephone records, skype printouts, and credit card records diddnt prove it. her reply was that none of this was included in my application. she told me he sent in a bare bones application. naturally, i was pretty angry and let him know what she said to me. she told me to fire him and file a complaint. his reply was that he felt threatened and would withdraw from my case and that I was on my own. not sure what happens now. i asked him about the money i gave him 7,000 usd, and have gotton no relpy

I'm still wondering why USCIS needs to see anything proving a bonafide marriage. All they should care about is a copy of the marriage certificate. The embassy will want to see the proof of the bonafide marriage.

Approved from uscis feb 8th, uscis recommended I fire my lawyer and file complaint. I shared this information with him, his reply was that he is withdrawing and that I'm on my own. What do I do now? Am I capable of doing this on my own?

Absolutely you can do this on your own. First thing you need to do is go here:

First step is to get a hold of NVC and let them know what happened. You will need to file DS-3032 and designate yourself the agent. You may have to do something about the G-28 you filed with USCIS naming your attorney as your agent, but not sure.

NVC is much easier to deal with than USCIS, although that's not saying much.

My "lawyer" set me back 3 months minimum, and it would have been alot more if it were not for this website.

Incorrect. USCIS looks at it as the person MAY have committed the crime and that's why they were arrested, there was enough to arrest them. Being found not guilty only means that they didn't have enough evidence to convict. It's not fair, especially when you ARE wrongly accused, but that's how they work it. The OP's husband will most likely need to prove WHY he was found not-guilty. The Order should state why he was, but it only proves he didn't live there so they didn't have enough evidence, not that he wasn't involved.

It wasn't in the US. It was in his country, Dominican Republic. His police certificate is clear, he has nothing. He was completely proven not guilty. He has no criminal record, just this court record of the not guilty verdict.

I don't know how the CO would know about the tax lien, unless the OP disclosed it to him. Does the USCIS forward the results of the Petitioners name check to the Embassy? I don't believe a tax lien would show there. Does the USCIS perform a credit check?

I was wondering the same thing. The odd thing in my case was that I was an IR-1 visa. I filed the I-864 with NVC, and they approved everything and sent it to the embassy. Why they didn't bring it up at the NVC stage, I have no idea. I was on a payment plan with the IRS at the time, but it didn't matter. I ended up showing them my 2008 income which was 50+k which was well over the limit even with the lien, and she got the visa. Once my wife came I still owed the IRS about 5k and the end of 2009. WHat I did was go all the way back to 2006 and amend my tax returns as married filing jointly. That meant they OWED me 10k USD. They wiped the 5k I owed them off the books and sent me a check for 5k.

For example, if you have 50k in income and a 40k tax lien, the Consular Officer will consider your income to be only 10k, BECAUSE, (theoretically and this is the theory they use) the IRS can simply take their 40K all at once and leave you with nothing, after taxes.

The above is EXACTLY right. How do I know? It happened to me. I had a 10k USD tax lien and made ~19k USD for 2007. The CO looked at it and said because of that, I really only made 9k for 2007. And trust me, they will know about it.

As long as your tax transcripts show you're 125% of the poverty line, then you are fine.

I see you filed for K-3. If you followed the K-3 path all the way through, and not the IR-1/CR-1, you should have an approved I-130 sitting at NVC waiting on documents from you. If that is the case, this is a good thing. This would mean you could continue down the IR-1/CR-1 path. You still need to find out what the problem was at the interview, and what caused the 221g and overcome those issues.

Very frustrated at this point. Here's my story. My wife went for her interview on March 8th. She did a fantastic job of organizing all papers and documents. She was ready. The office started her interview and asked the minimal questions, how we met, what I do, etc. After a few questions the Officer glanced through her documents and only looked at a few of them. He then opened the medical envelope and after a min he said that the documents were not in order, that the doctor had not signed the document and that my wife had to go back to the hospital to get the doctor to sign. She asked if she was approved for the VISA and the officer replied that the only issue was the unsigned medical form. My wife went back to the hospital, had the doctor sign and place back in the envelope and then the medical document were mailed back to the embassy along with her passport. This was all completed the same day, March 8.

Now when I go to the CEAC website the status says that my wife is in "Administrative Processing" and say this could take several weeks.
I've read that people can stay in Administrative Processing or years.

Anyone have insight as to how long this will take. My wife is staying with her sister and not the most comfortable or advantages places to stay. If we knew it would be a month or two she would go back to her city and relax a bit, but as it stands now she's just waiting and we don't know for how long. She does want to leave because she put her sister's address as the place to mail the documents and thought it would only be a 1 week or so.

This process is Very frustrating.

Well after about 3 1/2 weeks the NVC finally got a response from the USCIS regarding my approved petition which has not shown up at the NVC after around 47 days.

Has anyone gotten a response like this before?

 

I contacted the USCIS and talked to an ISO and all I got out of him was that I possibly entered the wrong city on item 22 on form I-130. I was at work at the time so I started to think that maybe I did but once I got home I checked my copy and it has the correct city where my wife's embassy is located. So now I know where my petition is but I cannot find out from anyone as to why it has been sitting there 1 week shy of 2 months. He submitted a help request or something like that to inquire about it but of course they told me I have to wait 30 days for a response before I can ask them about my petition again.

 

I am starting to get really frustrated with all the bureaucracy one has to deal with just to get a simple answer from the USCIS.

 

My senator's USCIS liaison said she would inquire about the status of my case-file. I just hope she can get a straight answer from someone soon.

 

 

I don't really have anything helpful to say.  What a monumental screwup on USCIS part.

Pictures are not just secondary evidence at our embassy. They are proof of your relationship being around other people. Take pictures of you being out and about,in JA, but pictures of you being around friends and family. They asked who was in our pictures and what is their relationship to us. Such as family, friends, even my husband's dogs. They want to see your life as husband and wife told through pictures. Remember you are proving to them a real relationship.

I read through a couple pages of this thread with people saying pictures are just secondary until I got to your post. Your are 100% correct. Pictures were not considered secondary in my case. I lived with my wife in Bangkok for 2+ years. I had 100+ entry stamps for Thailand in my passport. we gave them all that and 5 photos. They said that wasn't enough, and gave my wife 221g at the interview saying they wanted more photos. We simply ran around Bangkok and took a bunch of photos that day and turned them in the next day and she got the visa.

Point is, it's whatever the CO feels like accepting as evidence. I don't know much about the consulate in Jamaica, but that age difference would be a huge red flag in most countries. If they think that that the relationship is SOLELY to obtain an immigration benefit, you can forget it.

The immigration visa is a single entry visa so it no longer matters.

The green card and your wife's Thai passport is all she needs to enter the US. She does not need a visa for the US when she has a green card.

For the cruise, make sure that your wife meets all the necessary visa requirements for a Thai citizen with a green card. Ask your cruise agent. Those foreign countries may not let her in without the proper visas.



Everything above is correct except for the visa being single entry.  The OP is IR-1/CR-1.  Those visas are actually multiple entry and act as a green card for 1 year or until the green card arrives.

sad.png I know, right? I wish there were a way I can tell fedex to not deliver it tomorrow and to send it back to me!  But at least I sent in originals of my I-129F form and my G-325A form. Hopefully they just won't care if my fiance's is the only one scanned and they will just ask him to sign it at the interview :'( TEARS!!!!

 

Well like they said in other posts the one from the beneficiary is not needed to be signed or original as they can sign at the consulate.  So if the rest are original signatures then you should be good for that at lease.  But no telling with USCIS they may loose something of yours just because they feel they have too much work.

UGH. I guess it's true, OP--you can double check everything and you still miss something!

 

A little trick I use for documents.  Print three copies and sign three times.   All are original now.  Sorry to hear you did not send original forms I hope that you do not receive an RFE for them as I know first hand how much it sucks to get them.  Mabie you got someone that is lazy and does not even notice the signature is not in ink.

I was the mistake part I was more worried about.  I know I sent in the forms and if they lost them that is one thing and yes in the pig picture of things it is not big deal, just have to send them in again.  But if there was an error and I send the same forms as before then I have done nothing but wast time.  

 

I decided to send the copies of what I have here that I sent in before.  Include a new filled out form with her alien registration number on it and a cover letter.  Along with that I send in new passport photos.  Yes they did not request them but I think the passport photos are needed with the G-325A form.  

 

Hay just like when I send in the entire I-129f I was very careful to make sure I did everything correct to avoid the dreaded RFE.  I had Min come here from China and we went over all the papers in person together to verify everything and packed it all up with both of us verifying everything.

 

I just sucks because all of my hard work is for nothing if they so easily loose part of the packet that I bet was verified to be there when they do there little pre-check before it goes on someone else's desk to work.

 

Yes you are also correct that if the web site had said they send out and RFE there would have been nothing I could have done until I got it but once again this is about them not doing the job correctly again. Along with the RFE sitting on there desk after it was written for three days or more before it was mailed out.

 

Oh and yes it is a good idea to have coppies of everything.  I made three of the I-129F.  One for me, one for USCIS and one for Min (the original)  to take back to China.

OMG I could not even come close to writing her name in Chinese.  I've tired and it looks like #######.  But that is a good idea I will send in the old one and the new one without her signature on it too.  I will put in the letter that that they have the orgional signed one and the updated one with only the alien registration number that is diffrent.  Thanks for the advice.

Tomorrow I'm sending the RFE and the original G-325A forms that we willed out back in November to them via fed-ex.  I will call USCIS back tomorrow also to talk to a level 2 teck since there are not any info-pass appointments available in my area to find out if they need an updated G-325A signed by Min with her alien registration number on it.   If not then all is fine.  if they need that well I sending the updated form to Min tonight to have her try and get printed and sent back to me via express mail.

I'm not worried about the fexex I'm more worried about the time.  It takes over a week to send stuff to or from where she lives in China .  She does not easily have access to a printer either.  It just ticks me off with USCIS.  I checked the website several times a day and I'm also signed up for email notifications for everything I can sign up for.  Website still says what it said over two months ago and never got an email about this either.  Knew nothing until I checked the mail today.

 

I did call USCIS and was able to talk with someone as it was not yet 6:00pm.  They did not even know about it and as far as they were concerned the status was still the same.  The alien registration number was changed back on 11/25/2013.  

 

I work for an insurance company and if we did anything like this the government would be all over our company and fining us too,  but they do ####### like this and we just have to suffer.

My issues are:

1) was there something wrong with the first set of forms?  If I send the same ones again and there was something wrong with them won't they just say they still need them again.

2) Now she has been assigned an Alien registration number so don't I need to put that on the new G-325A.  If so then I need to have my fiancee sign it again and mail it to me which is going to takes weeks to get done.

Well today I just got an RFE in the mail.  They are asking for the G-325A for both myself and my fiancee.  This is bull because both myself and Min checked the packet we sent in three times to make sure everything was in it.  I went and checked my copy of the it and they are both in there.  

 

It gets worse.  The letter is dated 1/29/2014 but was not mailed until 2/3/2014.  The web site says nothing about this RFE either so they are not updating there online system at all.  Which makes there stupid online system useless for anything except to try and keep people from contacting them

 

Now I have to call them tomorrow since I got the RFE after they were closed and find out what there problem is because I need to know if there was something wrong with the G-325A's I sent them or they lost them.

 

I bet this is just some way for someone to say they are doing there job when they are in fact not doing it at all.

Hi, I want to be a little more specific , because I really hope this will work. Some Lawyer associations response to my email and told me that " as for immigration visa , it will be govern by the state that the petitioner reside, not where you were married" :( . I am a U.S citizen and want to marry my first cousin who live in Vietnam. Both TX and VN are prohibited such marriage, but I did research and found out that we will be legally married in Hong Kong. I just wonder when I file for his immigration visa, will there be problem with the state of TX ? since they say such marriage is consider criminal offensive here.

Because when she get's denied entry at POE because of failure to maintain residency, she'll be on the next flight back to Thailand or some other country outside of of the U.S.

Hello.  My wife passed her citizenship interview today, yeah!!  Now let me give some background before I pose my question:

We are moving to Thailand, and have been planning our departure for months.  We've sold everything and have just been waiting for the N400 process to be completed. Right now, staying with relatives, and very anxious to make our move.  The N400 was scheduled for June 2nd, but was then cancelled by USCIS.  uggghhhh, delay.  Later rescheduled for 6/23.  After my wife's interview, the IO officer was able to get us the next available Oath Ceremony on July 11th, 2014.  My understanding is we will receive the Certificate of Naturalization on Friday, July 11th, after the Oath Ceremony.  I'd love to have a flight to Thailand booked on July 11th, but what to do about the passport?  A traditional passport application can take weeks to process.  An expedited passport can be achieved by visiting the nearest passport agency, which is Washington DC, and we could exit the US from there.  But this would mean at least 6 nights in a Washington DC hotel (expensive) US Embassy.

Now on to my questions:

The US Embassy-Bangkok website says they can process applications for US Citizens, and that the Certificate of Naturalization will suffice as proof of citizenship.  I called the 800 US State Department Passport number to double check, and asked if my wife could travel on her Thai Passport and make US Passport application once in Thailand, and they said that she must travel on a US Passport since will be a US Citizen on July 11.  I'm sure that is the correct "official" response.  Now I know that she will be "asked" to surrender her Thai Passport on becoming a US Citizen, but she will not be doing that.  And, I know lots of US/Thai citizens carry two passports.  So, could she leave the US with her Thai Passport and apply for a new US Passport at the US Embassy-Bangkok?  If so, how will that impact our return to the US? People carrying two passports, do they leave the US with one passport and return with the US passport?  How does that work?

First of all no one is going to ask her to surrender her Thai passport for anything.  Only the Thai govt. can do that.  We just traveled to Thailand twice in the last couple months.  In both cases, my wife entered the U.S. on her U.S. passport, and entered Thailand on her Thai passport. 

 

As far as getting her U.S. passport, we did it here in the U.S. and it took about 2 weeks to get the passport in the mail.  It took a week after that to get the Naturalization certificate back.  You have to give them the original.  It sounds like you're in a hurry to get back to Thailand ASAP, but if you could wait a couple weeks, she'll have her U.S. passport.  If not, it comes in the mail.  Have someone at the address forward it to you via Fedex to Thailand.

Hello Ladies and Gentlemen,

 

It has been a few years since I have posted on Visa Journey, but have always been checking in and keeping up and reading posts. I haven't posted, but have always kept up.

 

Well, since my wife and I got married in September of 2007, we have had a wonderful marriage and are growing together everyday. She is the best thing that has ever happened to me, that is for sure. She has and always will be the greatest and biggest part of my life. I can't imagine a life without her now. She has had a great job as a pharmacy tech since 2008 and is enjoying living here in the USoA. We have made 4 trips to Thailand to visit her family since we were married and plan to go again the end of this year. She loves it here, but she always misses her family that is 12,000 miles away; as I am sure all of you that have spouses far away from their home can attest to.

 

Anyway, the reason I am posting is that I have the N-400 package and all supporting documents ready to mail. One question I do have is, is it necessary to send the package in with a cover letter? I know the answer might be somewhere here on VJ, but to be honest I did do a search, but didn't spend a lot of time doing it, so I thought I would just ask the question by this post. I did not see anything about a cover letter in the N-400 guide, so I am assuming I don't need to send one, but want to make sure first.

 

Well, the cover letter question is the only one I can think of asking, but if anyone thinks of anything else that I might need to know before sending, please don't hesitate to tell me. I plan to make copies of everything today and probably mail it out tomorrow or next Monday. As far as "supporting documents", I have, >last 3 tax returns, bank/charge account statements, marriage certificate, her two photos, copy of MY passport, current mortgage statement, color copy of permanent resident card, and a few more docs. All of the bank/charge/tax and mortgage docs have her name on them also.

 

Again, thank you for all of your help over the last few years and I am sure I will start posting again as soon as I file the N-400. Glad to be back! Everyone take care and good luck with your journeys you are taking at this time.

I read this tidbit while taking a break from filing out our DS-230's today. Has any member had experience with this at he Bangkok embassy? I originally obtanained my passport with my birth certificate 30 plus years ago. If I do indeed need it it looks like at least a month to obatain a certified copy. A heads up from USCIS sure would have been nice. Trying to get specific information such as this like pulling teeth from the Bangkok embassy.


 

"You (and any family members immigrating with you to the United States) must obtain an original birth certificate issued by the official custodian of birth records in your country of birth, showing your date of birth, place of birth, and parentage. Important Notice: All Immigrant Visa applicants must submit a long form original birth certificate. Short form birth certificates will not be accepted.

The certificate must contain the:

  • Your date of birth
  • Your place of birth
  • Names of both parents
  • Indication by the appropriate authority that it is an extract from the official records
  •  
Birth Certificates"

 


 

The Thailand birth certificate thing is somewhat tricky if the beneficiary was was born outside of Bangkok.  My wife didn't have a birth certificate at all.  She went to the Amphur with her mother and they gave her an official letter in Thai stating her parents name and date of birth, my wife's place of birth and the date.  She had this translated to English (which I don't think is required in your case since your DCF at Bangkok, but I'd get it done anyway)  PM me with your email and I'll send you the document in English and Thai.

CanadaUS citizen pulled into immigration at Canadian Border

We live within about 10 minutes of the border and go to Montreal frequently and I go to Canada even more often since I often work near the border and sometimes go there for lunch (viande feu! Mes OUI!)

I have been pulled out and searched, warned, lectured on three occasions for no particular reason (once because they saw sawdust in the back of my truck and had to determine it was, in fact, sawdust) Last time, just before Christmas I was warned about the perils of "human trafficking" No kidding. I was entering by myself and to this day I think they confused me with someone else. The woman even called me to the counter and showed me the penalties for "human trafficking" Um, OK. I promise, I will not traffic humans into Canada. :unsure: They gave me the lecture, gave me my ID and released me into the wilds of Quebec!

I was once accused of atempting to immigrate illegally when I said we were going to visit a friend in St Lazzar. Go figure. NO! I did not have a copy of our mortgage with me! How negligent of me! I did happen to have a check stub inmy clipboard fromwork and I guess that was enough. I got one of those visitor records on that trip also and turned it in when I left.
99% of the time it is something like passing through a toll booth and nothing more. every so often they get a bug up their behind and do this.

As much as we take easy travel to Canada for granted, and we do, imagine many of our favorite restaraunts are in a foreign country...how fortunate are we as Americans?...it IS a different country and they WILL do this at times. Just be polite and go along, do what they say, smile. I have never been doing anything wrong or illegal and I know that it will be over and I will be allowed to pass.

I have lived in Ukraine and believe me, I sleep much better than I would this close to Belarus. OK?

I used drive to Plattsburg to get me some taco bell and Marlboros. Can't get either in Montreal. If you go the Vermont route there's a ####### bar on the way back. I highly recomend it. St. Jean sur Richalieu.
