Ok everyone need some help here please,

Last december i retained the help of an attorney to help my family get to the US. He advised me that we should apply for a k3 visa, so we did. Everything seemed to be going smoothly until I called nvc today. They advised me that my k3 and 129f have been closed, but that my i-130 will be sent on to the Peruvian consulate. In a few days here they will be asking my to pay the AOS and IV bills. I have only prepared the K3 packet and not the IR-1 packet.

I told my attorney this and he only replied with, he could help me with consular processing for an additional $2500. I feel as though I was lied to and am now trying to be a scammed in a way by this attorney.

My questions to the visa journey community are: Will i need to prepare another packet for the consulate? Should I consider paying this attorney anymore money? Do you think he knowingly did this? And just basically what should I do?

Since you filed both petitions separately, time shouldn't be lost as your I-130 will keep trudging along by itself. As others have mentioned, the K3 has been obsolete for about 2 years now. It was ordinarily used to bring the spouse in the country while the I-130 was being processed (it could take years for the I-130 to be processed). Since the timelines for the I-130 have decreased significantly since then, the K3 will arrive at the NVC stage at the same time or shortly after the I-130 and they will administratively close it and just proceed with the I-130.

Essentially, the money you paid for the K3 is non-refundable and the application won't help you. But it shouldn't hurt your chances either.

There is no fee for the I-129F (K3) when filed with/after an I-130.

Last year our employer paid us using 1099MISC and I don't know with line to use from my tax return on the "25. Federal income tax return information." of the I-864 form.
Do I use line 22 "This is your total income"?
Or do I use line 37 "Adjusted gross income"?

Background tax info:
1040 filed with Schedule C
One dependent child.
Only one 1099MISC with $36,763.00 on it.
Line 22 on 1040 shows $25,111
Line 37 shows 23,337

Also, will the income be a problem for a household of 3?
Will I need a joint sponsor?

My income this year will be higher since we were put back as regular employees with W2's on April 2012. Around 43K.

You use AGI. on line 37. For a household of 3 the minimum is $23,862. Looks like you're ~$500 short.

The guy I hired to assist my wife with the visa process on her end was already aware the police require some sort of paperwork prior to completing the background check. He told me to email him the NOA2 when I get it (it's still in the mail system at the moment) and already has all the other paperwork they could possibly want.

I'm feeling a bit better about the process after reading all the information on here and exchanging a few emails with the visa guy in Thailand. I sent him a bunch of paperwork today and he's getting everything together to lesson the time needed between now and the interview. With any luck, my wife and son will be in the States with in a few months. With work, college, this visa process, and going through everything required to purchase a home, I'm a bit over extended at the moment and could really use a bit of an easy streak.

The info on this post isnt about police reports. Try using the search block to find info on your subject. In just the recent past there have been a few on this very question you have.
Karee is correct but I would add that in several recent cases the police wanted to see a copy of the USCs front page of the passport along with the NOA .

That is true. It kinda comes down to being prepared. Send her everything. Chances are they wont ask for it. In case they do, have it all ready. At the end of the day, they are Thai cops. You're at their mercy.

Toss a cigarette on the platform at the Siam square BTS station. See what happens.

Thailand to Florida, i'm at a similar spot in this process, as you are, although NVC received my case on July 9, and I'm still waiting for the case number. Anyway, I'm a contractor in Qatar, wife in Thailand and we've run into a snag. I was preparing the docs for the second batch of paperwork needed by NVC, but the Police Check office in Bangkok refused to do the police check until she showed them a letter from the US Embassy with the "Visa Number" on it and a statement stating that my wife will be moving to the USA for residence. (their words, not mine). This may be a catch 22 situation cause before the case goes to the American embassy, you have to be completed at NVC, and the way I understand it, the police check is one of the documents required before the embassy interview is scheduled.

Anybody have experience with the Thailand Police Check? Is there a way around it, or is it not a requirement for beneficiaries who are living in Thailand until the package gets to the embassy?

Show them NOA2 or the notice from NVC. Either one will work fine.

You may be a little confused about the tax info. A transcript can be mailed to you, faxed to you or handed to you by the IRS. This is free and could be done very easily by fax in your situation. You dont need W 2s. All they need is the transcripts.
They are concerned about your present employment. Any future questions would be connected to the AOS meeting down the road. If you needed to do so you could use a co sponsor at that time.
My husband was able to attend my interview because he lived in Thailand at that time. This brought up the very question you asked. He sent them a short letter explaining what he was doing about employment after we got to the USA. He wasnt even asked about this at the interview but we must remember each case is truly unique. While its obviouse that you will be seeking you might construct a letter explaining what you will do and what you expect to find in your field of work. I would set this aside for now but have it if the need arose.
It seems to me that your plan for the initial time they have in the USA is solid and shows she has the support of your family along with your own. Many people dont enjoy this begining.

They don't allow this any longer. The USC will not even be allowed into the embassy.

Hi all,

I recently submitted our I-130 to the Chicago lockbox from abroad (hoping to get fast tracked) and its time to start preparing for the NVC step, which seems far more confusing to me than the USCIS stuff. So I've got some questions:


-First thing, I will be notified by USCIS and invoiced via email (or snail mail), correct?


-Once I pay the fee, I can begin sending in requirements, correct? Or do I have to wait for paperwork to arrive in the mail? Do the documents and forms all have to be sent together?


-If we send the original marriage certificate and birth certificate to the NVC, they will later be sent to the consulate prior to the interview and will be returned to us after the interview, correct?


-If we choose to send 'certified' documents, who can certify them? The issuing agency (local government)? The consulate here in Bangkok? A notary public or somebody else in the US?


-Is there anything specific we can do now to start preparing for this step to speed up the process?

What she will receive from CBP is a standard admission stamp on the page of her passport next to the visa itself. It is the combination of the visa and the admission stamp that is the temporary green card. CBP is no longer placing special I-551 stamps in passports in this instance.

You're right. I went and back and looked and it says this at the bottom of her visa:

"UPON ENDORSEMENT SERVES AS TEMPORARY I-551 EVIDENCING PERMANENT RESIDENCY FOR 1 YEAR"

I guess the result is the same. Still have the equivalent of a 1 year green card.

DIsregard the underlined above. I just noticed she is CR-1/IR-1. She'll get an I-551 stamp that's good for a year at POE, which is the equvalent of a green card.

What slows you down is having to send all of your documents to the lawyer and then having them send them to NVC, instead of sending them directly there yourself. Calling NVC isn't going to slow anything down.

We opened a joint bank account and each one of us got a debit card, that means that at anytime we can make use of the money in that account.

The evidence we have is the agreement we signed with the bank where states our names,and that my husband is the beneficiary of that account (in case that something happens to me)and we also photocopied our debit cards.

Basically the info that they need is to see that you trust each other enough (which is obvious if you got married)to share the money. I supose that it's what they want to know :thumbs:

NVC doesn't care about relationship evidence. They want an original copy of the marriage certificate. That's about all the relationship evidence they want.

The bank thing might come in to play at the embassy interview, but I know in Bangkok they want to see photos together more than anything. The bank stuff would come in to play when you file adjustment of status.

My wife has her interview scheduled for December 18th and I have a few questions regarding that...

1. Is there a fee she will have to pay at that stage of the process?

2. Since all the paperwork was reviewed at the NVC, what exactly is the interviewer deciding? Just if our relationship is valid and she's okay to be allowed into the U.S.? For example, I initially sent my previous pay stubs and a print out from my bank detailing how much money I had in my account (to show I won't have an issue supporting my wife). But, should I send my wife my more recent pay stubs from the past 2 months and a new bank statement so that those things are more recent, or will the guy/gal interviewing my wife not care about my finances since those were checked at the NVC stage?

1. No. You paid the IV fee to NVC already.

2. This one bit me in the a$$. Make sure she has alot of photos of you together. They seem to put alot of stock in that at the BKK embassy. I hope you sent tax transcripts to NVC when you filed your I-864.

Here's what happened to me:

It took 3 tries to get the visa. She went in alone on Feb 23, 2009. They gave her 221g. They wanted more proof, and said that my I-864 was below the guidelines for 2007, since I owed the IRS 10k. I fixed the I-864 issue by sending my 2008 IRS returns with W-2s and 1099s which showed me to be well above the limit. I sill haven't figured out how they found about this, or why NVC didn't deny me at that stage. Went back in March 2 with the updated tax returns and more proof. The accepted the tax return, but denied her again. We want to see more photos! Ok then 2 disposible cameras, photos together all over Bangkok, off to the 1 hour photo shop. Went back in AGAIN on March 3 with these photos. Visa approved, come back tomorrow to pick it up.

I lived with my wife in Bangkok for 2 years. I showed them utility bills with both our names, at the same address in Bangkok. I also showed them two passports with about 100 entry stamps into Thailand. I guess the issue was that I only proved to them that I lived in Thailand, not that I lived with her. So next time you are together, go crazy with the camera.

K-3 visa is dead. You filed for an IR-1/CR-1 visa when you filed the I-130. The I-129F will be closed at NVC if it arrived at the same time, which 99% of the time it does these days.

ETA: Looking at your time line it looks like you never filed I-129F, so you never filed for K-3. Also you have been married a short time, so it looks like when your spouse enters the U.S. it will be less then 2 years. You are on the path towards a CR-1 visa. Follow the steps in the link I posted above. From your time line it looks like your case is already NVC, so get moving!! Good luck!

I talked to a co-owner at Rapid Visa today and he said that the USCIS sometimes asks for criminal records for CR-1 petitions. He said it is a 50/50 chance. Has anybody on this forum that had filed a CR-1 petition ever received a RFE for their criminal records???

I've never heard of it for DWIs, and I've been on this site since 2007. I guess anything is possible. Maybe I should buy a lottery ticket tonight.

This whole IMBRA thing started because a few guys petioned for some women overseas and then the guys ended up killing them. It is merely to let the beneficiary know the chances of getting their head lopped off and buried in the backyard upon arrival to the U.S.

Thank you, guys for info. KDH u r correct. Rapid visa sent me a cover letter that said to include my conviction court records. But I do not have them and honestly I do not think that these documents are needed for I-130 when applying for CR-1. Does anybody know the answer to this?

I gave you the answer. The answer is no. You don't even need to mention it. In fact there is nowhere on the I-130 where it even asks.

I have 3 DUIs on my record and just sent my CR-1 packet to the USCIS and used "Rapid Visa" to help with process. They sent me a cover letter to include my court documents concerning these DUIs. But I did not have them and sent it anyway. Is this a problem? I thought that this only was for K-1 cases only??? At least that was what I had read on here. Any help? Thanks guys.

If you are filing an I-130 for a CR-1, you can have 20 DUIs. It doesn't matter. Only time DUIs come into play is when you are filing an I-129F (K-1/K-3) and you have 3 more drug or alcohol related convictions. This is part of IMBRA and is there to inform the beneficiary of your past history. IMBRA does NOT apply to CR-1/IR-1 visas.

However, the Adam Walsh Act does apply to CR-1/IR-1 visas. I believe the AWA concerns things like crimes against children and women etc. etc. It does not have anything to do with DWIs.

he claims that whatever info he gets, i will get at same time. the difference now is that i will be the one sending the information. nvc says wait until i get email and if i need any help to call them, they will walk me through it

His claim is wrong. I never saw one document from NVC because I had a lawyer. The only thing I ever got from them was a coourtesy notice saying they had my case at the very beginning. I never got notice of case complete or anything from them.

Ask your lawyer if he has filed DS-3032 with NVC yet.

You need to read that link I posted earlier. This lawyer is a real winner I see. Affidavit of Support and Police Clearance go to NVC. Medical is presented at the interview.

Also Afiidavit of Support is seperate from the IV package. You are on two paths at NVC once you get this choice of agent thing straightened out.

1. Affidavit of Support path. This is the I-1864 and supporting docs. Tax transcripts etc.

2. IV path. This is the DS-230 and everything that goes with that. Police report, marriage certificate etc.

You really need to call NVC and find out what they think is done. You should have a case number that starts with BNK2013. You'll need that to enter into the IVR phone system they have to get to a live person.

I emailed him and let him know i filed a compliant with the bar, and told him i contacted the news and planned on picketing his office, and posted bad reviews for him. he responded instantly and we agreed that he did 50% of the work needed. check will be cut for half of money paid as soon as google reviews are taken down. all documents will be mailed to me today.

Right on. Those documents are the important things. Don't forget to call NVC and make them aware!!!!

I have a question. my lawyer withdrew from my case a couple days after my NOA2. i gave him all my documents, birth certificates, marriage certificates, w2, pictures, everything i had. do i need all this all over again as he has all my paperwork. does nvc have it now? what do i do?

He needs to send it all back to you. Hopefully he just sent copies to USCIS and has the originals. You will need the original marriage certificate for NvC.

Well, then it was $7000 well spent if you are happy with the results. You could find a second lawyer if you'd like. You probably have some forms to fill out with the NVC soon, depending on which ones they ask you for.

He has alot more to do with NVC since he is IR-1. He needs to make sure he has an original police certificate for his wife from Thailand, an original marriage certificate, and more.

She told me she was going to approve me 15 minutes after my conversation pending a "threat check" background check. i explained i was a felon from 1999 for delivery of cannibus over 500 gram under 5,000 and various other charges, i explained that i had a rough child hood and hadnt got in trouble since then. she told me not to worry about that, it would not hold up my case, and if thats all i did, she would approve me . my lawyer is in chicago

Charging $7,000 for an attorney to obtain a CR1 visa should be criminal. That is why so many people feel that lawyers are a bunch of protected criminals. Be sure to file a complaint with the attorney general in your state. Tell the lawyer that if he does not give you the money back, you will file a formal complaint with the attorney general.

I went down this road. There's really not much you can do. About the only thing that can be done, seems to be fling something with the Better Business Bureau.

If the lawyer refuses to give you any of your paperwork back, then that is another story.


I'd chalk it up to an expensive lesson, and also a warning to others here on VJ.
