-I don't see any red flags regarding all the points that you mentioned, I don't think that the Us embassy will see some red flags.
But
Because you said that you were concerned, and when I read you post I didn't know if your were concern about we think about this case or what the us embassy may think about this case.
So
In the beginning i though that it was kind of her to be ready to give up the I-140, really kind. I'm glad that I waited to read the VJ members' opinions.
1) I met my husband online, it was on a website, they give you: the choice of the country, so when somebody find an American citizen on a website, they know what they are looking for: An American
I also think that they are more present online than other countries (maybe that changed, i don't know).
2) So you have the state also, and the location (not the address).
If you want to meet somebody in Buffalo, NY. You do a search of a man (single, divorced... like you want), Buffalo, NY.
And you have all the details, color of the eyes, height, age...
I don't think that the "randomly stuff" works for the dating websites.

You find what you are looking for on dating websites.

If some people met on a forum game, it can be more "by random" than a website. But... On facebook and Skype, I don't understand how the dating search functions.

3) I don't think that all those things are red flags or scams, it's more a security love (or sometimes economical love, don't know the difference) which according to me last longer that those kind of passion-2 year-love.


4) The last one is the I-140. It's more likely a scam, it's true that if you want to get out of your situation and anybody promised you a good job, it's normal for some people to be ready to pay some money for a better future, even 2000$.
If she paid 2000$, it's in the logical line of thought, I'm not worried about what is logic.

But my question if, "is it true that she paid this amount"? - I would ask to see those papers, or an address or phone number that I can call...and do my own research. I'm surprised that she never asked you to call, it will be one of the first thing I would ask you to do for me, if I were on her basket. I don't even give up 5 dollars.
So I don't understand why she is ready to give up 2000$ so easily. I would wrestle for it and ask you to check for me, and cry everyday for it.
It's a logical attitude, for me; so a part of me don't understand why she doesn't react in a logical way. The only way for me to give up this amount it's if I make 50000$ per month (lol).

Sorry, I don't want to be harsh, I have just this kind of technical view of everything.

If she paid this amount really, so she is a treasure of girl.

Since I will be the one flying over to the usa to meet my other half for the very first time, when I arrive back to Australia, can I just scan and send the copy of my entire passport which will show the entry and exit stamps to my fiancée as well as my birth certificate?

She can then print the copies and send them with the k-1 forms together. Will that be ok?

And another question, if the petitioner, in my case will be in the usa when I meet her, how can she prove she has met me, we will be taking a lot of photos together with herself and her family, when i being the beneficiary will have the hotel itinerary, passport stamps , luggage tags etc?

I think that your questions is not so much clear, you can:

-you can scan whatever you want and send them to her

-you can do some copies in usa and give them to her

 

you can scan or copy , using mail or e-mail- what they need it's the copy of the forms, scan, copy, or print they don't care.

He spoke with a lawyer and apparently this is a common mistake among k1 visa applicants. Possibly because marriages were scarcely documented? Per the lawyer, fill out the DS 230 form and submit as usual to Get inteview date. have a letter explaining the mistake on the i129f form and present our case. I'm aware my fiancé had previous relationships and of course I can't cant change the past. It just aggregating cause this is potential something that can hold the process even longer. Generation gap has different ways of thinking I guess.
And I know that people are forgetful but this is immigration involved. We say we forgot this. But they can look at it that we are hiding it from them.

My fiancé view is if we were to hide it we wouldn't try to correct it now. I'm just thinking if he was smart he would have told me. sleep.png


 

So the risk or forgetting a marriage is higher among K1 applicants? 

After that, if the lawyer sees that a lot it's normal for him to reach this conclusion.

But no need of a lawyer to make this assumption ...or excuse.

Scammers are patient. They also don't really care about the name of the visa, their goal is to come.

Whatever name you call the visa (K, IR, F...). If they care it's because one is quicker compared to the other.

221 B is the section of the Immigration law that deals with time frames for resolution of cases.  It provides for incomplete applications being denied for being incomplete . . . , (extraneous commentary removed - VJ Moderation)   She told me off line that she talked to a lawyer who said that it is best to let it go and refile.  She is going to use a lawyer.  I am not sure that the beneficiary is clear what happened.  Not everybody should handle a petition themselves.  The lawyer, starting with a clean filing, will see what is going on and, if there are issues, will know how to answer the questions before they get asked. That is the real secret.  Anticipate problems and answer them in the filing so that the petition only has to be read once at each stop and approved, rather than having them constantly asking for more information that the petitioner and/or beneficiary isn't completely clear about what is being asked for.

 

Why don't you check the scan? it's written 221(g).

I took a trip to VN in October...but due to the excitement of being in VN and seeing family and so forth, taking pictures was the last thing on my mind...I have pictures for the rest of my stay for the month but none of me and my fiance at the airport when we met...

anyone else forget to take pictures of that moment or is it just me??? :bonk:

I don't think that a lot of people think about taking pictures at the airport.
It doesn't really matter, so don't worry for that. They only want some pictures showing both of you, and even some family members with both of you.

Oui, c'est cela, la licence ( il est exactement ecrit sur le document ''affidavit, licence, and certificate of mariage'').
Mon mari et moi nous avons trouvé cela étrange lorsqu'ils nous ont renvoyé le package avec copie d'une licence de mariage, expliquant que c'est de ce document dont ils ont besoin.
Ce document nous l'avions soumis au ''court office'' apres notre mariage pour faire enregistrer notre mariage et recevoir notre acte de mariage, et ils nous ont fournis des copies certifiees conformes de la licence (c'est ce document que le consulat te reclame).

Nous avons reçu l'acte de mariage par courrier plus tard avec des certified copies of mariage.

Je pense que tu dois avoir une copie, sinon, il faudrait aller au court office et demander une copie.

I have the same problem with my new name, i chose to hyphen my maiden name and my husband name, but they just add the 2 names without the hyphen, when we called USCIS, they said us, that it is not a big problem, that they receive a lot of calls concerning that and they added that i can write my new name with the hyphen.

I'm a little disturb about the fact that USCIS removed the hyphen.

USCIS and the Consulat of France are two different things.
For USCIS I wouldn't worry about it too much. They tend to get rid of hiphens and usually skip also the middle name. As long as the social security has it right it's not a problem.
Plus you haven't had an interview yet and it will be a while anyway. When comes the interview, talk with the immigration officer and see if they can put the hyphen on your green card.

With the French Consulate it's a bit different because the livret de famille is also were you write down the name of the children and if the last name is not done write it could mess things up with the children's (not sure though).

The website for the Italian embassy in the US clearly states "The Consular office will evaluate the documents submitted and may request additional ones at its discretion. Furthermore, you should also be aware that submitting the required documentation does not automatically guarantee the issuance of a visa. " right under the requirements listed. I do not think you were discriminated against. (I also think the officer probably told you or meant to tell you it was discretionary, not discriminatory)Yes, your past travels may help make it easier to get a visa to some countries, but it does not guarantee you anything. Italy may not care you lives in the US so long or have been to Europe before.. they saw something with your application that just makes them want that extra check.

 

If you have your birth certificate then what is the big deal? Why all the anger for something they are just taking care to make sure all is well? If the trip to Italy is worth it then just supply them with what they requested and enjoy your trip.

 

Yea like Medroni said "discretionay instead of discriminatory".

When I read this part, i didn't catch it, but maybe it's "discretionary", maybe an open door for several things included "subtil discrimination" (lol).

I can't tell for the Schengen visa, but in France a birth certificate is necessary for a lot of forms.

I don't think that you were discriminated.

It would be surprising for me that France is a member of the Schengen zone and doesn't ask for this document. You need it to go to school, for the driver licence...everything which is government oriented.
