K-1 Fiance(e) Visa Process & ProceduresImmunizations

The vaccines needed to get an immigrant visa to the US are TD, MMR, and varicella. People can get them at the doctor's office during the medical exam if they want to, some people have said it's more expensive while others have said it's just about the same as getting them somewhere else. They can also get them at the Red Cross as someone else suggested or through thei EPS if they're covered.

If they do choose to get them before their medical make sure they don't do it more than 4 weeks before their appointment since these doctors are famous for rejecting vaccine records claiming those new vaccines are too old to qualify.

Diana

my wife had her medical exam and she got the vaccinations from the panel physician on 1/4/2011. We had to wait for an I-601 to be approved, and she has a new appointment at the consulate May 14, so obviously she will need a new medical exam and lab work. Are they known for rejecting their own records from over a year ago, and requiring new vaccinations?

K-1 Fiance(e) Visa Process & ProceduresQuotas on fiancee visas for the Philippines?
I think it's naive to think the amount of K1 and CR1 visas are unlimited and that it's the slow pace of USCIS petition adjudicators that make things take so long. If I remember correctly, K1 and CR1's have an interview at a consulate abroad. Add up all of the interview appointments available on a given day at all of the US consulates around the world that conducts such interviews, and you have your quota for that day.You can figure it by week, month, and year, too. Not all visas will be approved, so the quota would be a little lower. Read consulate reviews, and people usually say to get there early because it gets crowded, not many unfilled appointments.

K-1 Fiance(e) Visa Process & ProceduresQuotas on fiancee visas for the Philippines?
I often wonder if there are unwritten quotas, especially on K1 and CR1's. Good way to stick to the unwritten quota is to wait to release approved petitions to NVC.

Maybe some of the emails submitted mention wedding plans in the US? Would make your case more plausible that "hubby" is just an endearment, while by no means proof you aren't married

Why go through the trouble of clearly demonstrating the difference between a non legal wedding celebration and the legal one at city hall? Any plans if the interviewer for ROC takes a good look at some of the photos from the "celebration" in Singapore and thinks it looks like two people getting married? Were you wearing a celebration dress and exchanging celebration rings? If you have to be careful how you word something, somethings not right.

K-1 Fiance(e) Visa Process & ProceduresIs K-1 the best way for us?

I really dont see the issue here.
We framed our non-legal wedding as a "celebration"...to the US consulate....to my friends and family.
We explained to them that because my husband worked in Singapore for a while, so we have a lot of friends there, and most of family was there..his family flew from USA to celebrate with us.

If the "words you say to each other" makes a "wedding", why is there and issue about FAKE/REAL?

We told my family that the wedding is a celebration together with the family, the one in the USA is purely for legal purposes.
It is just a piece of paper, the legal work, what needs to be done to get the visa for me to stay here.

Whatever it is, you just have to make it clear, its a "real wedding" in the eyes of the law, because of the piece of paper.
The words you say to your partner, the commitment you make to each other, it is a celebration of your union. "real" wedding or not.

My husband and I consider our "celebration date" as our wedding date.... but thats between us and our friends and family.
In front of the legal folks, just be smart about the words you choose. this is NOT misrepresentation, this is not fraud.

I think it's fraud writ large. Like not telling the IRS about cash income. The issue about real or fake is that you're not supposed to be married before you enter the US. The reason the visa was created was because some countries prohibit marriage to foreigners. For people who would have been applying for spousal visas, but law wouldn't allow them to marry, so they could never apply for it. Now it is often used by couples who would have been applying for spousal visas, but don't want to be separated after they get married and wait for a petition and interview. But I think exceptions should be made for couples whose love for each other is so profound that it would be tragic for them to be apart for a single day after they're married

Some of these issues that are grey areas are consulate specific. What might not raise an eyebrow at one consulate may mean failure at another. I was just reading in the adjudicators field manual, and it's kind of grey there, too. "As a general rule, the validity of a marriage is judged by the law of the place of celebration." My read on that is that if it would be valid, it is valid.

but all a call to city hall does is show they don't have a record of a marriage. It does not prove a marriage has not taken place. there are no documents you can provide to prove you aren't married

K-1 Fiance(e) Visa Process & ProceduresIs K-1 the best way for us?
Dude, nobody wants to spend time far away from their spouse or fiancee. If you totally agree with me that it's the words you say that make you married, then both you and your fiancee will have to lie about it to the US gov. Is a lie of omission, but a lie nonetheless. Are you selfish enough to ask the person performing this non legal "ceremony" to lie about what took place if asked? The likelihood they would ever be asked is extremely low to nonexistent, but they would be lying if they said you were not married. Would you ask your fiancee's mother and father to deny their daughter was married before she left Korea if asked? To cover your bases and pull this off, you should take these preparations. Even if you do this non legal/registered wedding after your fiancees interview, she will have POE to get through, hoping for a CBP agent who will expose her to a low risk of material representation. With a K1, you may or may not have interviews with USCIS for AOS and ROC. Would suck to have someone post a Happy Anniversary wish on FB for the wrong wedding date, and have that come up at one of the interviews.
Another poster suggested getting married before you leave Korea, and filing for a spousal visa. You had legitimate reasons for why that wasn't an option. But how about a legal civil wedding, and you and your fiancee make up your own words to say to each other, like a legal engagement ceremony, but a legal marriage under the eyes of the law allowing for the CR1 visa, which is the right one. Have a big ceremony for your wife's family when you renew your vows, only you and your wife will know they are not the same vows. Not sure how big of a secret you and your wife would have to keep from her family and for how many years, but you would always be able to tell the truth about it in an immigration related interview.

Do you plan to tell your fiancee's family that you are having a FAKE wedding for them, and the REAL wedding will be in the US? Or will the REAL wedding be in Korea and the FAKE one in the US for visa purposes?

When people do what the OP wants to do, it makes a mockery of the institution of marriage. It's the words you say to each other that make you married, not the lousy piece of paper that can be flushed down the toilet, rent into little pieces or burned into a pile of ashes. I hope it doesn't work

like others have said, all you have is an approved NOA2, which means about as much as a stop sign on a country road at three in the morning. you sent a document that wasn't valid yet. try cashing a post dated check. it may work once in a while, but you have to count on the teller at the bank overlooking something important. Go to the same bank the following week with another post dated check, and I'll bet the bank manager will want a word with you, letting you know that what you did last week was illegal. The adjudicator of your petition will not be the last person to look at your documents

This sounds like a situation where a K3 visa would be the best choice if you married first in Brazil, but unfortunately these are not really available any more. If I remember correctly, the K3 was a multi-entry visa for two years before AOS was required.

K-1 Fiance(e) Visa Process & ProceduresK-1 app while living with fiance out of country: expedited?
CR1 is a better visa than the K1. Besides the guides and timelines, check out some of the threads that come up in the K1 forums. Depending on the state you will live in, getting a driver's license can be a real hassle. People get jerked around at the social security offices, not able to get a card for months. There may be another interview for the AOS, and there will be another fee of over $1000. If you're living together now, I'm sure you will have plenty of evidence for the interview. And living together means you won't have to spend time apart. The average timelines show that the K1 may be a little faster, and for couples who may live apart while the process is going on, this seems like a better option, but I don't think it is because of all the hassles related to the things I mentioned earlier. I think it's like picking the nickel instead of the dime, because it's bigger.

Am I the only one who thinks that seven denied tourist visa applications will raise major red flags with the CO at Kingston if this guy were to have an interview? Baby on the way will not remove doubts the CO will have about this guy's intentions. I find it hard to believe he would be granted the K1 after just one interview.

Mexico, Latin & South AmericaJamaican Dual Citizenship?
Since you are married to a Jamaican citizen you are entitled to be a Jamaican Citizen through that marriage. If you go to any Jamaican Consulate's webpage it will tell you as such. Different ones serve different areas of the US, the one in new York serves my state, their website it http://www.congenjamaica-ny.org/ so you would just need to find the one that serves your area. I know there is one in Chicago and Miami. If you go the New York Consulates webpage as an example they tell you to apply for citizenship you need the citizenship application (which I had to mail them a self addressed envelope to receive) notarized copies of your and your husbands birth certificates & current passports, copy of marriage certificate, a police record, and two passport sized photos. The application costs J$7,000 which is like $80US so compared to what we have paid for our husbands we get out cheap! I am sending in the paperwork shortly for myself so if I have any updates I will let you know. I have been talking to a woman at the Consulate in New York and she told me once I git my certificate of citizenship I can apply for a Jamaican passport. PM me is you have any other questions.

Hello December Filers! Hoping you can help me... my brother and his fiancee filed their I-129F at the end of November and their NOA1 is dated December 5, 2011. They still have had no action on their case, no RFE, no approval, NOTHING! When my husband and I did our paperwork back in 2007-2008 it only took 3 months from NOA1 to get our N0A2. Unfortunately it is the CO at the consulate who makes the call on the affidavit of support. The NVC checks for completeness, but final approval is not theirs to give. Consider yourself lucky that they gave you the heads up now, and aren't dropping this on you at the interview. You still have time to get this worked out before the interview. And you're dealing with the US Embassy in Jamaica, not the Jamaican Embassy.

USCIS Service CentersIs this Fraud by definition
I think the Department of State has more of an influence on these NOA2's that people have been waiting a long time for. For a spousal or fiance visa, your SO gets in line for an interview at a US embassy or consulate. There are only so many interviews that can be given each month all over the world, and it's different for each different country. I don't want to offend anyone, but the US doesn't have the same diplomatic relations with every country in the world. I think USCIS sorts petitions by country of beneficiary, before the "in the order they were received". I think the DOS only wants so many people waiting in line for a visa each month. They know how long it takes from petition approval to interview, for each different country. The DOS doesn't want people calling asking what's taking so long, they don't care if USCIS is busy. I think that's why some petitions are easier to approve, if it's for a beneficiary from a country where the wait time and the line for interviews is shorter. USCIS can just hire more people to answer the phone and say, "they're working on it, they'll let you know when they're done, don't ask again for one, two, three,or four months."

USCIS Service CentersProcessing order
Petitions are said to be processed in the order they are received, I don't think it says they are adjudicated in the order they are received. An important factor has to be the country where the beneficiary will have their interview. All consulates cannot handle the same amount of interviews each day, week, or month. Anybody that has called USCIS should realize that they run interference, they may say something different every time, but basically they say, "Wait longer before you call us again". Is just my theory, but I think petitions are approved or denied a lot faster than we would think, and USCIS finally releases them to NVC in a steady rate so that interviews may be scheduled and such. There are said to be no numerical limits to the amount of spousal and fiancee visas that may be issued, but I'm sure the number is not unlimited, or determined by the amount of petitions awaiting interviews.
