K-1 Fiance(e) Visa Case Filing and Progress ReportsMay 2009 VSC K-1 Fillers
Heh, yeah, I was hoping to go over before all the good ticket prices end on Dec. 9th... that's not going to happen, and ticket prices spike up to $2700 in January. Even if I get the visa in December I'll have to wait till March for planes to be affordable again sad.gif Oh well, I suppose it gives us time for my wedding dress to be ordered in and the invitation design finalized...

I was able to find a shipment sent to the Sydney, Australia consulate without knowing when NVC sent it... just messed around with the reference and dates, found out that one shipment was sent to SYD and arrived there on Monday. I sure hope it's mine! Although I haven't recieved anything from the Consulate yet, apparently Sydney emails you, but not sure where they'll get my email from...

Well, I guess that touch I got was lucky - I JUST got the email saying we are approved! (funny considering it was just before 11pm there when I got the email).

Onto the next steps, and to think, I was just looking at all the paperwork I'll need for Packet 3 yesterday... I guess I'll get a head start on that smile.gif

Still waiting on our NOA2, no touches, but we're sitting tight and hoping it will come through soon smile.gif We hope to have the visa in time for me to go over there on Boxing Day (Dec 26) since I want to stay with my family for Christmas. I just got back from two weeks in the States with my fiance, very exciting trip, we went to the Blink 182/Weezer concert in Connecticut, and I got mugged! (almost... he tried to grab my laptop and I wouldn't let go!) And to think I'm going to go live in such a crazy place for the sake of love... laughing.gif

Consulate doesn't have anything to do with things at this stage, unfortunately... Sydney Australia consulate hands out visas like candy laughing.gif They like us Aussie types!

I hate that we are filing through VSC because I don't realistically expect an approval until later October.... but I am going to the US for 2 weeks on Saturday to see Jesse, it is our 2 year anniversary on the 26th so I wanted to be with him then. Knowing I get to see him in a matter of days makes me feel a little less impatient smile.gif

Thank you smile.gif He's a real sweetheart. Pedigree, papered, show-winning pug, got him for $1000 because he broke his hip and his owner/shower wanted to retire him to a good home (he was only 1 year at the time). Even though he doesn't have a real hip joint anymore - his hip works like a spring socket with tendons and muscle holding the joint together rather than bone - you can barely tell and he's the happiest, spunkiest dog I've ever met. Going to cost me a bucketload to fly him over to the States but he's worth it!

I've been watching us creep further and further up Igor's list this week smile.gif It's heartening! Go VSC!!

I'm in a chair in front of a computer most of the day too, so guess who sneaks onto VJ when they get a chance? laughing.gif But I also spend a portion of the day hauling freight around in high heels because my couriers are never around to do it for me (and they insist on bringing me huge, heavy boxes instead of just giving me the number and leaving them in a cage).

I also get "casual" Fridays, which really translates into nice jeans and our sponsored team's rugby jersey. Mind you, I got the jersey for free and it's warm so I don't complain.

Going over to visit Jesse in two weeks, hopefully by the time I get back (Sept 6th) something exciting will have happened happy.gif

My birthday's also in late November... so I would love it if we could actually spend my birthday together for the first time ever.

So, your having a ceremonial wedding in May 2010. Is that like a wedding reception?

Yeah. We're just going to have a non legal wedding, since we're legally getting married when I get there.
My mom is trying to push the wedding to when I enter so she can see me sign the certificate (Since it's the "Actual Marriage" to her), but I don't want a December/January wedding.
So, I hope my mom understands, or I'm not really having a family wedding.

Haha, my mum is the same! "We're all coming even if you go to town hall in a pair of jeans!" I'll just have to keep reminding her that this relationship/wedding isn't quite as straightforward as she'd like it to be and we have extra obstacles we have to hurdle in order to be together...

IR-1 / CR-1 Spouse Visa Process & ProceduresI came to the US with K1 visa and didn't go back. What do I need to do now?
QUOTE (Mahsa8181 @ Jun 23 2009, 03:29 PM) <{POST_SNAPBACK}>
Do you think if I planed to do this, I wouldn't know that I wouldn't be able to adjust my status here? I do remember they told me if you don't get married you have to come back, not if I get married with someone else, I wouldn't be able to go back. When I talked to the attorney in here, she didn't say if you don't go back and get married with my current wife, I wouldn't be able to adjust my statues. I called her before we got married, and she said you can get married and you have to wait for her to get her Citizenship, and then she can adjust my status like other people who stayed in US illegally and after getting married they adjust their status. Until a few months ago, I didn't know that K1 visa was different that other visas.

What she should have told you was that you would need to leave the US while your wife petitioned for you.

It's legal to marry on any visa, however it is illegal to enter on any visa but the K-1 for the specific purpose of marrying and adjusting status. The K-1 goes on to specify that you must marry the petitioner to adjust status.

You were perfectly fine to marry your wife, then return to your country and wait for her to become a citizen and petition for you. If you had left after the wedding, you'd be fine now. It's purely because you didn't leave and have slipped into illegal status that you are facing problems now.

I would be prepared to face the ban which is likely coming your way, in the meantime, try to find a competent lawyer wink.gif

K-1 Fiance(e) Visa Process & ProceduresRecently in US on J-1, applying for K-1...
I didn't believe I was subject to the HRR, and checked it with the agency while I was over there... I'm going to do a little research and double check though. Thank you for the link, I had a read through and it was fairly helpful.

I'm planning to bring as many ties as I can - unfortunately, being young and relatively unattached to anything, I don't have a lot to show at this point. I definitely can get a letter of employment expecting me back (and hey, perhaps I should start paying my parents rent!).... I was wondering, since my boyfriend intends to visit Australia with me when I come back, if we booked his ticket before I left could I take that along as proof that I would be going back? (you know, since he is... doesn't make sense for him to go by himself ^^)

K-1 Fiance(e) Visa Process & ProceduresRecently in US on J-1, applying for K-1...
I have just returned to Australia from the US, where I spent 13 months on a J-1 visa (working as an au pair). The J-1 visa was in effect from April 10, 2007 to April 10, 2008, and as I was permitted a 30 day "grace period" before I had to leave the country, I left on May 8, 08. The agency I worked for (Cultural Care Au Pair) arranged all my flights (and technically sponsored my visa) for me, so I'm certain I did everything correctly on that trip.

While I was in the States, I met and developed a relationship with someone. We've been together over 9 months now, and are planning to file for a K-1 visa in the next couple of weeks. I intend to visit him on the VWP while the K-1 is processing, and he'll most likely come back with me to Australia for a short visit.

My question is, since I spent such a long time in the States on my previous visa, will they have a problem with me entering on the VWP for 2 or 3 months? Or will I be ok because my last visit was on a long-term visa?

I want to visit around July, possibly as late as August... which will make it 2-3 months since I left the US. I figure that's a decent amount of time. The reason I ask is because I've read that some people get questioned as to the amount of time they spend visiting the States when they either come back very quickly after a trip or they're spending a majority of their time in the US (ie, 4 months out of 6, etc.)

K-1 Fiance(e) Visa Process & ProceduresTravel advice and proof of relationship
As to the Skype History, you'll see a tab in Skype called "History", up where the other tabs for Contacts, Live, SkypeFind etc are. Simply click on that and it'll show you every call you've made or received (as well as all Skype chats made/received). It's how I plan to show communication with my boy while I've been back in Australia.

Since we both play mmorpg's (although, surprisingly, this ISN'T how we met!) I'm also screenshotting the chatlog in-game. I don't know how much help that will be since we're under character names, but who knows, it may help. I'm just grateful I have a LOT of photos of us together, since I was physically with him for over 8 months while I lived in the States.

Try United Airlines, they're usually decent with price. You won't find a cheap flight anytime soon unless you leave before December 9th, since the holiday season is coming out. I found out that January 19th seems to be the day they prices start to drop back down again, but in between you'll be paying around the $2000+ mark. Qantas is a better airline, but definitely expensive =/

Well, I have some not-so-good news...

This takes a little history - For as long as I've known him, Jesse has had some pretty deep-seated issues and has suffered from depression. It was never really much of a problem for me, and the longer our relationship went on, the better he seemed to be getting. A few months ago he moved into a new apartment with a friend of his, and since then he's been on a slippery slope back into a bad depression. While he's been a pot smoker since he was 14 (and I've been ok with that), he hadn't been on hard drugs since we started dating, however he's been using them a lot since he moved into the new place and I can only assume it has contributed to his downward spiral.

When I went to visit him in August, he realized how messed up his life had gotten, and how much all the bad things were getting in the way of his feelings for me. A few days ago, he said he couldn't go through with a marriage the way his life was - it would be condemning the relationship to failure. I am heartbroken to do it, but I agreed that the best thing we could do was end the relationship so that he can focus on getting better and getting his life back on track. We are at a pretty awkward stage of not talking at the moment, even though I miss him like crazy and want nothing more than to hear his voice, but I'm hoping that things will smooth over a bit later and we can at least go back to our friendship. I want to help him as much as I can, but I don't have high hopes of us ever getting back together as a couple.

It sucks, because we were so close to finally being together... but it is what it is. I am sad beyond words, and he is ashamed of himself for how much he's hurt me because he's let his life get so out of control. So we are abandoning the visa at this point, I will try to get on with my life here in Australia, and hope that he has the self-discipline to get himself into therapy and get his life together. Above all he is my best friend, and while he still loves me and wants me in his life, it looks like it cannot be as a couple at this stage.

I might still hang around these forums to help out where I can, but if you don't see me for a while... you know why smile.gif I am trying to stay positive, trying not to let depression get to me, trying to stay busy and get through the grieving process.

Just wanted to say thanks to everyone for all the wonderful help and reassurance they've given me - this is a ####### of a process - and good luck to everyone still going through the motions.

-Soph.

Jesse only just got our packet 3 emailed to him (a bit over 2 weeks after approval), I was never even sure what day NVC received/sent it... good to know that Sydney has it now though, I DHL'd my DS-230 to them on Friday and it was delivered yesterday morning.

Packet 3 was emailed? We didn't put email addresses anywhere on the I-129F.
And the DS-230 you emailed to the Sydney consulate after getting packet 3?

Yep. I'm pretty sure I remember there being a spot on the I-129F where we put Jesse's email, down the bottom near where you sign it. I haven't gotten anything snail mail from the Consulate.

I downloaded the DS-230 off the consulate website, filled it out by hand, and mailed it (via DHL, but that's not necessary... I just happen to get free shipments with DHL) to the consulate.

And yeah, all the petitions go through NVC before being mailed to the consulate smile.gif

Wow, congrats! That was quick! Mine took 100 and something days, I guess VSC is really speeding up happy.gif

I'm emailing the consulate to see if I have to wait for my medical results to mail packet 3 back, or if I can send it sans medical... I'll let you know what they tell me. I still haven't actually received Packet 3 from them, but then, I'm not 100% sure if that shipment from NVC-Sydney the other day was mine.

That would be great! good.gif
I guess i can go and book the police check and get that done....but confused about when to get the medical done though. I'm still planning to head over and see Janet between October 17 - November 21

If you look on the instruction page on the Sydney Consulate website, it will give you a list of approved panel physicians for the medical... I would recommend calling all the ones in your area just to see how far ahead they're booking. When I heard mine was booking a month ahead, I went ahead and booked it, figuring I'd have what I need by then.

You'll need to take any paperwork you receive from the consulate (I'm going ahead and assuming I'll need a copy of the NOA2), your passport, 3x passport size photos (Aussie PP photo size is different from the US - US photos are 2" square, so that's what size I'm taking), and any immunization records you might have. The lady I spoke to said not to worry too much about the immunizations as the doctor is likely to order a blood test to determine your immunities anyway.

THankies

Hi Chris and Mara, apart from the Aussie govt visa site, I have taken to watching two forums, the british expats and poms in oz, as there doesnt seem to be as much knowledge re USC applications.

If you are applying for a fiance or spouse it looks as if its a 4-6 month timeline once you have completed the application and got all the documentation submitted. (I called the Washington Embassy and thats what they told me) but people in the UK seem to be getting them within a month in sime cases. SO it could be another cya comment from a mis information line.

I am collecting stat decs from friends and rellies and that seems to be taking me the longest, as most of the other proof of relationship is in my copies of the US applications.

Hope it helps, good luck with whichever journey you embark on

I found a US -> AUS immigration site not long ago... try Yanks Down Under. Looks like a lot of people on that site are doing prospective spouse visas so they could probably walk you through it.

Do I HAVE to wait for my medical results to send Packet 3 back? Bingo you gotta have the Australian passport to get into Australia and the US one to get back into US

Yeah, that makes more sense. I honestly think you'd be silly if you were a dual national and used your Aussie passport to get into the US, or vice versa >_<

I think that my package has been sent to the consulate - tried the DHL tracking by reference trick and I know one package was sent to Sydney on the day I was approved, and it was signed for on Monday. I keep hearing Aussies say that Sydney consulate emails Packet 3, but I'm wondering where they'll get my email address from laughing.gif

Oh well, I'm trying to get a jump start on things anyway. Just called to see how far ahead I'd have to book my medical - luckily there's a panel physician in Canberra so I won't have to go to Sydney - she said they were booking a month ahead so I went ahead and booked it for Oct 20th. She also said it would cost $150, I hope she's right, that's cheaper than what I was thinking smile.gif

Now I've got to call that AFP ###### back to try and organise my police check =/

Hi Guys, congrats to you all on the progress you are making, I thought I'd just post a quickie, to let you know that I have completed this journey that started in 2004.

Today 176 people from 46 countries were naturalized in the 1st ceremony of the day. I arrived at 7.20am for my 7.30 appointment to find few parking places left (there is a multi there) and a queue right through to the back of the carpark. The ceremony was officiated by the Head of the USCIS office and was finished well before 9am.

Since then I have been to the SS office to change my status and completed my voters registration. We copied my certificate and gave it over at the passport office with the application, it seems strange to let the piece of paper that has cost approx $2000:00 and so many frustrations out of my hands after less than 3 hours. Because you have to hand in the green card on
naturalising and can only travel on a US passport after, I feel it is important to get the passport without delay, so another $100:00 had to be budgeted for.

It may seem a long way off if you are at the beginning of your journey, but thought Id drop in to let you know there is an end to it! Unless of course like us, you now have to turn around and get the Aussie spouse visa.

Interesting you say you can only travel on a US passport - I thought that Aussies who are dual nationals are supposed to enter Australia on their Australian passport. Unless you mean you have to use the US passport if you travel elsewhere or use it coming back into the US?

Here's an interesting little tidbit for anyone who pops into this thread from Canberra...

I called ACT Policing today to ask about the police check, theu put me through to an inquiries line to ask... apparently we need to make an appointment, and not all stations are available on all days (there are only about 5 stations in the ACT). So I've got to call back to make an appointment and in all likelihood take a day off work to go do it, since none of them are available on weekends -.- What a pain. The woman I was speaking to was real crabby, she hesitated when I asked for her number (since I'd been transferred) to call back and make an appointment - then gave me the number in a big huge rush like she was hoping I'd miss it laughing.gif Sorry honey, but my visa is more important to me than your bad day!

Oh boy, you guys are going to get sick of me, I have so many questions! laughing.gif

Just looking at the police check stuff - did you guys have to mail a form in, or were you able to hand it in in person at the police station? (if so, at the same time you went to get fingerprints? I'm assuming there's no appointments you need to make). I live in Canberra. I'm confused about the fingerprints too, is there anything specific they need them for / should I get a copy of them or do they just go with the completed check? I don't remember needing fingerprints for my J-1.
