K-1 Fiance(e) Visa Process & Procedures	HELP: G-325 A biographic sheets	I was just checking my copy of the I129f and the A# appears to be in a section for the USIS. Then you will each have forms to sign and send back. Your alien fiancee is the beneficiary. the person applying on their behalf is the petitioner from what I can see done here...hope this helps you out a bit...before you send it all in make sure you get lots of evidence of your relationship to go with it. At the advice of our lawyer we sent as much as we could get together...letters from family members stating they know of our relationship...and pictures of us as a couple plane tickets, stubs, telephone bills, emails, card, announcements..anything you can think of. K-1 Fiance(e) Visa Process & Procedures	Proof of Intent to Marry	Oh dear! I didn't realize that. I just thought they wanted how we met and where (I included that we met online as well but also included the weeks we spent together). I figured they read so many that they wanted just a short and simple answer ("Just the facts, Ma'am." as my dad always likes to quote from Dragnet). Did everyone else add about how they decided to get married and love stuff? I did put about 12 pictures in the packet and put the best one on top (the one everyone looks at and says, "wow, you two are really in love"). In our letter of intent our lawyer had us talk about how we met with dates if possible. It also mentioned the dates that we saw eachother and in what city. We made a small mention of possible plans for the type of wedding we were hoping to have. We were also advised to have the letters notorized. For evidence we used a few pictures spanning our relationship, and a few emails, phone bills, tickets, passports just to back up the letter. Not sure if this is mandatory or not but we each got a letter from a family member saying that they met us and knew of our engagement and intent to marry. K-1 Fiance(e) Visa Process & Procedures	K-1 visa confusion	My fiance and I are in the midst of all this caos ourselved. Ironically our lawyer after we paid her retainer fee advised us that we should have just had me move to the US then get married and do the paper work. BUT the problem with that way is not only is it technically illegal..but the US government can really tie things up on you for a couple of years. Which means you cant work or anything that time. Which is why we have opted to go the K1 route. Initially all signs said start to finish 6 month..but with current delays in the processing centres this is not as accurate. My fiance actually called the service centre today and they were not really giving us any information..truth be told I dont think they really know. Also we were told that I had to be in Canada at the time we filed the application. Once the ball is rolling I am not allowed to enter the US until the process is over.But where you are a teacher you might want to look at going over on a special trade visa to teach..from there see the legistics of getting married and changing your visa status..I dont know much about this route..but I have heard of cases like that. With the K1 visa you will eventually have to have a medical done here in Canada by a USCIS specified doc, and then you have to do an interview in either Vancouver or Montreal depending on which area of the country you are in. So you would have to have to be in the country. It does take a bit of time, but if you can hang on its better this way in the long term. K-1 Fiance(e) Visa Process & Procedures	Are California Transfers Going to the End of the Line	To add to the confusion. My fiance called CSC on Monday and asked them that very question, whether or not we were put the bottom of the list since we were transfer or would we still go by our NOA1 date. Their answer was there usual aloofness...they are not put the bottom but they are not exactly at the top either...so basically I think what they were trying to say was they are going through the CSC and the NCS are thrown in the mix...so it should be by NOA1. K-1 Fiance(e) Visa Process & Procedures	Case transferred from Nebraska to California	[font=Book Antiqua] My finacee and I originally had filed our papers in the Nebraska Office and then he got 3 duplicate emails telling him they transfered our papers to California. We have since heard that there is a new proposed I129F form as of March 26,2006, and they are deciding whether or not to prorate this to those who filed as of March 4,2006. Apparently it involves more of a Criminal background check. So basically from what we understand it they have our paper work and are holding onto it until further notice. K-1 Fiance(e) Visa Process & Procedures	On the NSC to CSC move, emails, transfer notices	So I just found this forum today and yeah I sent my petition in March 3rd got first notice this month that it was in CA now and I called USCIS and spoke with a real pleasant lady (Sarcasm to the fullest here). I guess when it only takes a high school education to get your job of phone monkey, we shouldnt expect they might want to be helpful and polite. Anyway couldnt get any info out of her other than the fact she is a raging B$*%@...so I took my own route and found you all....which I have a question...my fiance is supposed to go to the USA and visit but we are worried she will be blocked from the USA does anyone know the answer if she will or not? I have wondered about that whole crossing the border during the process situation myself .My fiance was told by our lawyer that I was not allowed to enter the US until our process was complete. K-1 Fiance(e) Visa Process & Procedures	NEBRASKA IS GETTING THERE FRE	This is really frustrating...we had everything in there on march 9/06 and got noa1 date march 24/06....then they tranfer a whole stack of us to california from Nebraska..and word was going around that Nebraska was not handling these visas anymore..and now I read people who have got there NOA1 far later than us getting their RFEs and the kicker some are coming from Nebraska....what the? Got a bit of goodnews...my fiance just got a call from out lawyer and our RFE just arrived at her office..he is going there tomorrow morning to fill it out and send it back. So those who were tranfered from NCS to CSC this is a good sign..I am sure you will get your RFE Today or by Friday...goodluck! We hired a immigration lawyer to help us out with this whole process..and as soon as we filed, and paid a nice chunk of change for her assistance, the whole IMBRA fiasco took place, she had the *brilliant* idea to tell my fiance to have me come there (to the US)and we just get married...he had to explain to HER no less..that, that would be illegal..her respose was *yeah it may cause some problems at the border* Gee you think?! K-1 Fiance(e) Visa Process & Procedures	RCMP background check for Canadian alien?	Yes you will have to get a Canada wide criminal record search....and if you lived anywhere else in the world for 6 months or more. The hitch here is they might not allow you to do the criminal check until after you have gotten your NOA2 paper work so that they have proof of reason for the search. As far as cost and time goes it varies office to office but if you need a international search done it can take anywhere from 2-6 months. From what I have seen on VJ most RCMP Canada wide checks take no more than a week sometimes it can be done the same day..again just depends on the office..hope that helps! FYI..there is a great discussion forum here..for regional groups...and on the Canada one there are a lot of helpful people who have gone or are going through this as well...http://www.visajourney.com/forums/index.php?showforum=93 in the meantime my fiance and I have just been putting together more proof of relationship/evidence for the interview...keeps our minds from dwelling on the time....Goodluck! It will be exactly 1 month tomorrow since we were touched and since they got our RFE..which means 1 more month before we can call them and find out why they cant seem to pull their head out of their #######! The wait is for them to enter US. The wait is to ensure that you can take care of them in US, they dont have any criminal background and they are safe for the community they are going to live in. What do u think is the proof of a long standing relationship. You may feel strongly in the proof but the USCIS has to evaluate those. So the wait Really? Do you think none of us have jobs or committments in the US and we have unlimited bank accounts therefore we can simply fly to our fiance's country? The wait is not because USCIS is trying to ensure that we take care of them or to check backgrounds. Where on earth did you come up with this logic? The wait is due to the sheer incompetence of USCIS and their implementation of IMBRA. If you filed before March, the average wait time in Nebraska was 60 days. The average wait time in Vermont was 30 days. That proves the wait we are now experiencing (not 3 months my friend, we are at 5+ with no end in site not to mention the additional 6-9 months we face at the consulate in Mexico) has zero to do with the work they are doing and 100% to do with their ineptitude. HERE!HERE!!! KITKAT!! Tell it like it is! IF it was as simple as a background check, WE (beneficiaries and petitioners for that matter) would not be sitting here with our lives on HOLD! We all understand where you are coming from. I think in reality its not so much how fast some applications get processed, its howlong we are kept away from our loved ones. I live in Canada and yeah Paul and I are very lucky to see eachother often. We try to make the trip every four-6 months. Unfortunatly I have found that a lot of people who are not in our situation (IE long distance) dont often understand how painful it is to say goodbye...and how difficult it is to be in a situation where you life is essentially on hold. I dont think anyone on VJ holds anything against you for feeling how you feel. When it comes down to it we all just want the samething, to end the seperation. Its great CSC is finally rolling out March applications, however there has been no activity on our file since July. We have contacted 2 senators and a congress rep...and noone has gotten back to us..as a matter of fact one senator office LOST our paper work!! The Congress rep has not gotten back to us at all and she was certain she would be able to find out information for us within two weeks..guess what is been over two weeks!
