K-1 Fiance(e) Visa Process & ProceduresGetting really frustrated
I am so dicouraged. Its great CSC is finally rolling out March applications, however there has been no activity on our file since July. We have contacted 2 senators and a congress rep...and noone has gotten back to us..as a matter of fact one senator office LOST our paper work!! The Congress rep has not gotten back to us at all and she was certain she would be able to find out information for us within two weeks..guess what is been over two weeks! Anyway just wanted to get that off my chest. Just want them to approve ours already!!!!

Just wanted to say to all those still waiting from the early months of this year. I look everyday to see if I see that you guys have recieved your approvals. Especially you Iceyspots. You have been such a stronghold to the VJ community. Never fretting always giving out congrats to others while you wait patiently. Always know that there are still some of us that think about you and hope that your approval will come soon. Good luck to you guys and I'll keep praying for that approval for you.

After all my complaining earlier..thank you everyone for listening/reading...someone heard me somewhere..and my fiance got 3 emails stating that we are APPROVED!! Finally! The bizarre part of it all it says we were approved September 8/06...but got the email today! Ah, who cares.. I am so exstactic right now...my fiance called me at work but I was in with a client and came out to the message to check my email and voila! Thank you everyone this has been a great online community for support to us over the past 6 months. All those who are in the same boat and haning on.. you are in my thoughts and we look forward to seeing your approvals posted here..in the next day or so! :energetic:

I think its great for people to get excited about being touched. However...I dont think its fair to be told that this means you are about to be approved. Like someone mentioned in another thread it shows life at CSC. My case has not been touched in nearly 2 months. Im not gonna lie, when I see someone who applied long after me like say in the last few months getting touched and saying that this means they are going to be approved it really PISSES ME OFF! Simply because THIS IS NOT USUALLY THE CASE!...Be excited that you got touched for sure but dont go spreading you are about to be approved especially when there are so many more cases that appear to be rotting on some CSCers desk. <_<

We are using a Lawyer. It doesnt make the process any faster really..just makes is a little less overwhelming. Basically they make sure all the T s are crossed i are dotted that sort of thing. It has it positive and negative aspects...we really just needed someone to give us direction on where to being.

In our case we did use a lawyer. However most of the correspondence comes to myself and my fiance. Usually we have ended up sending copies to her. For our NOA1 the lawyer sent us each a copy of the NOA 1 and copies of all the evidence she sent off with our K1 application so we could see what was happening with your case. From there all other correspondence seems to be coming to us directly and we usually have to send her copies. So far the only thing our lawyer got that we didnt was the IMBRA RFE. My suggestion would be contact the lawyer demand some answers and see what they have done so far on your case. If they arent willing to provide with any information, you might want to seriously consider another lawyer.

What do I do with the case number? How do I track after that? How do I get the DHL tracking number once the petition is on the way to the consulate?

Once you get the Case # from the VSC then it usually is passed on pretty quick to the consulate, from there you can use the same VSC case # to contact the consulate and find out when they sent out the finaly packet 3. As far as DHL tracking they don't give you that information. If you call the VSC they can tell you the date they approved and passed on to the consulate. The consulate can tell you when they sent out your packet 3 but they usually do not tell you when they received the original form from the VSC. At least that was our Experience. The time ours took to get to us from the consulate to me..was about 3 weeks. But that can vary depending on the consulate. goodluck.

As soon as I got my packet 3 we decided on a date. But like the previous posters, we sort of laid the ground work before hand. My fiance found a place to have the wedding; and then basically told them our situation. Then as soon as I got the approval we booked it, found and officiant. Mind you the wedding we are having is very small..about 20-30 people who can make the trip since we didn't have a whole lot of notice. Most people do the courthouse then plan bigger shindiggs later on.

Basically you can contact NVC to find out when they will forward your information on the the Embassy. From there the Embassy sends you your Packet 3 which is the "Checklist" ie: Immunizations, medical all that jazz..you send it back to the Embassy as directed and they will notify you of your interview date. Beaware though NVC can be tricky to get through to..and it does take a 2-3 weeks for them to pass it onto the Embassy.

You will need to have a copy of your Long for Birth Certificate, they will ask to see the original at your interview when you get there. So I would try going on line and see if there is another way to get your birth certifcate or ask another relative to do it for you. The long form is basically the version where it shows the name of both parents and their place of origin. Also they will want to have it translated. Goodluck.

FYI- It usually is a minimum of 120 days before you hear if your NOA2 was approved or not..so just hang in there. Most likely you will hear about it any day now..the waiting game is the worst part of this whole process....good luck

If you have any pictures of the two of you together I would recommend sending copies of those as well for evidence, Copies of Itineraries or boarding passes are also good. Emails that you have exchanged. Those sorts of things are all good to include.

We hired a lawyer and then found this site afterwards. If you case is straight forward save the money and do it yourself. It didn't change our processing time either way...due to the IMBRA fiasco we were delayed anyway..and got and RFE due to that as well. So really if you can follow the guides go for it.

Speaking from personal experience of hiring a lawyer before I found this site....not really worth it. They CANNOT speed anything up..you go through the hoops like everyone else. We just hired one to make sure everything was okay....total waste..and yes I kick myself now..but what can you do she is holding our hands through the AOS once we start that.

If your case is straight forward..then you can really do it yourself. Follow the guides ask questions ; and Save the money, for when you want to travel after you get AP. :)

On my form I listed all jobs I had within the last 5 years as they requested. There is a second portion where they will ask you what schools you went to. They aren't interested in if it was full time partime type job..just the company, position held that sort of thing. If he was unemployed at some point then you could just put umemployed. There is another form coming up later will they will ask you for the educational institutions, and employment for the last 10 years. Hope that helps. :)

I don't have any proof, but I don't see why you couldn't keep your name. That is a personal choice in my opinion. Worst case scenario if someone should come back and say that it is a red flag. You could always keep your maiden name as your professional name..and change it on the legal forms. This is an issue I struggled with as well. I gave in and took my husband's name since I knew it meant a lot to him even though he never made a big deal about it..I could just tell the way he asked.

We hired an immigration lawyer just to help make sure all our forms were in order t's crossed, i's dotted that sort of thing.

Best advice I can give, get a credable lawyer, one who deals only in immigration law. My fiance interviewed a few and narrowed it down to one. We for the most part a happy with the work, particularly now that we are starting the AOS process.Not that its so complicated cause I know there are a lot on Vj that do it all themselves. But it is overwhelming after a while.

It will not speed the process up. That is a common misconception. It is just someone really to hold your hand through the legal process. You go through the same channels at the sametime as everyone else, if all is done correctly.

I sent our I-129f to NSC and it arrived on 7/24/06 What is totally bizare, I got an NOA1 from CSC that dates our "Receipt" at 7/26/06 No transfer notice. I still don't know if this is normal but pray it's all for real :yes:

Yes this is for real. They still tell you to send it to NSC but then they will transfer you to CSC. We did get an email stating the transfer..and you still might as well..but this has become the norm. Goodluck in the process...
