K-1 Fiance(e) Visa Process & Procedurestranslation of papers
QUOTE (Steph25 @ Jan 7 2008, 08:52 AM) <{POST_SNAPBACK}>
One question i have to translate a divorce paper from german into english. Can somebody tell me where i can do it? Iam located in Kaiserslautern Germany. Does a court in Germany can supply you with an international divorce paper so i dont have to translate it? Does somebody have experience with it already?

From what I heard anyone ( other then family ) can translate a document
he/she will have to state at the bottom that its a true translation of the original document sign it and date it , ( maybe have it notorized )
am not sure if this information is correct , so plz anyone with more knowlege on this subject feel free to correct me smile.gif if this information is incorrect you can look up a professional translater ( Dolmetscher ) on google , or call the courthouse see if they can do it smile.gif
( I am german citizen. when I got divorced in canada I had to have my english divorce certificate translated into german , to have the divorce registerd in germany , I went to a professionel translater to do it , just to find out they could have done it at the german consulate )

So when I submitted my I-129f in late November, I hadn't found this site and I am sure that I could have done a few things differently, but oh well. My question is, I sent in my passport as proof of my citizenship, not thinking that I will travel out of the country any time, but now I will be (My plane ticket was purchased for me). Will I get my passport back any time soon? Or will it be with the NOA2? (or never, lol) Thanks if anyone can let me how this works!

OH OH thats not good hmmm am not sure if you will be able to get it back ,
maybe you can call them , my advice is in the future what ever they ask for never send original documents in mail , always send in copies and keep the originals when you sit in front of an officer and even then give copies ( unless its the police cert )
other then that maybe you can ask YU and Dan hes extreamly knowlagable here ( I take his advice a lot hes right on the dot smile.gif )

see like I said YUandDan is right on the dot yes.gif

This is probably a ridiculous question, but for the sake of my soon to be wife.... I "printed" my name in the signature box. (I-129F form app.) On any legal form this is the way I "sign" my name. Is this a possible problem?

Printed as printed using the computer or hand printed
if its hand printed it shouldnt be a problem
if its with computer , you might get a RFE since the signature isnt your handwriting and they require the real signature

I'm curious about marrying a foreigner but what if it doesn't work out? Do you only get 1 chance to bring someone to the usa for life? What if you get divorced can you remarry and go throught the whole process again? I'm just wondering if this is a one shot deal. Thanks for the advice. Newbie! huh.gif

my advice is if your not sure the marriage will work , take some extra time to get to know your future spouse more , why think of divorce when the marriage doesnt even exist yet , marriage is a comitment and shouldnt be taken lightly I say if your thinking it might not work out eather get to know your fiance more or forget about marriage for now

yes I had to include my kids too , one was 21 the other 19 at that time , when it was time to get package 3 they send an aplication if i wanted to add the 19 year old , i said nope he will reside in canada , they took note of it , that was all
now thinking of it , I think it can be they have to know incase you file for advanced parolle when it comes time to file AOS so they know right infront you have a legamite reason to file cose you got family to go back too

K-1 Fiance(e) Visa Process & Proceduresdivorce and proof of relationship
QUOTE (HighwayStar @ Feb 1 2008, 11:26 AM) <{POST_SNAPBACK}>
Yesterday I was reading the thread about an interview gone very wrong, and a doubt came suddenly to me. My fiancé got his official divorce decree about three weeks ago, which means we started our relationship when he was still not free in a strictly legal sense. We met online in the spring of 2006, and met in person for the first time in October of the same year, when he had been legally separated for about three months. He was married in North Carolina, and is now a resident of Virginia - both states in which a full year of separation is mandatory before one can file divorce papers.

From what I have been reading here, it seems to be rather common for people to start relationships during the period leading to a divorce, and to have to wait until the divorce is final before they can file for a K-1. However, I wonder if the fact he was not free when we started our relationship may jeopardise our chances of getting a visa. Another thing is, I am almost 9 years older than him, though it should be quite evident to the adjudicators that I'm not out for a Green Card scam. (they just have to look at my current employer). Do you think either of these factors could cause problems? I would be especially grateful for contributions by 'older' members (I am 47), or those who are or were in a similar situation.

as long as you can prove that both where legaly divorced when you filled the I 129f , there is no problem , I met my husband when both of us where legaly seperated and where going trough divorces , just include a copy of the divorce certificates ,
as to the age I dont see it as a problem neather both of you are of age and legaly able to get married without parental aproval , so good luck

K-1 Fiance(e) Visa Process & ProceduresDisparity Between VSC and CSC and
QUOTE (Chris Future @ Mar 1 2008, 03:14 PM) <{POST_SNAPBACK}>
....general rant...

Is anyone else being driven crazy by this? Why are we out of luck simply because we happen to live on the left side of the Mississippi? Did the chocolate bomb people sent to the VSC in November start this off? I noticed that the VSC kicked up their numbers in November, right after the got sent a bunch of chocolate kisses. Doubt if we do that to CSC that we'll get the same speed increase, eh?

I seem to be seeing a pattern of approvals with UK based visas from VSC seeming to go faster - do you think theres been some special deal struck?

With our luck, President Obama will bring in the North American Union just as our visa is approved and all Canadians and Mexicans will become citizens overnight, and wont need a K1 at all. wink.gif

Sorry, but I'm frustrated with all of the speedy approvals. It not fair to the rest of us. There should be a standard, across the board, speedy approval rate and total clarity into the process at every step of the way. I read somewhere that it takes about 15 minutes to review an application. If thats the case, why is their "standard" of service 6 months. Some people have postulated that its because they want it it take a long time - they want us to just give up.

I don't want to rain on the lucky VSC folks with their speedy approvals, but I'm sure that the rest of us stuck in the slow line are feeling the frustration and are depressed by all this. Its almost making me want to stop looking at VJ, its that depressing.

Folks, I've been waiting 26 years to be with my fiance, shes my high school sweetheart - we met back in 1980, dated in 1982, lost touch and then reconnected in 2006. Because of the vagaries of all the processes we've had to go through, it might be 3 years before we are together for good. We are very tactile people, and talk every day via Skype and webcam, but its not enough. Its torture not to be together, and I don't think that the processors understand that they are dealing with people here, us and all the other couples on VJ, who love each other deeply and just want to be together and don't understand why they have to suffer through this extended torture of being apart.

I mentioned once to an attorney friend that I was planning on bringing my fiance down - she said - oh now that you are an American citizen it should be really quick. If you ask me, illegal immigrants get more care and support and speedy processing than those of us who want to do everything by the book and honor the laws of the country.

Anyways, sorry for the long rant but the frustrations sometimes get the better of you, don't they?

Thanks...Chris

Hi everybody. I have a very simple question. When filing Affidavit of Support, I have to get it notarized by a Public Notary. I was told that it should be done by some sort of special Public Notary, who is certified to take oaths. A regular Public Notary is not enough, because he/she only verifies your signature, but does not take your oath. Does anybody have any experience with this issue? Your advice will be greatly appreciated.

thanks,

I had mine done by my bank ,just give them a call see if they got a public notary avalable there

if not, try the city hall thats responsible for your area and ask for a notary there , good luck

K-1 Fiance(e) Visa Process & ProceduresFillable G-325a for purposes of I-129F; Multiple questions
QUOTE (minibadger @ Jun 30 2008, 02:13 PM) <{POST_SNAPBACK}>
I'm beginning to fill out and assemble my I-129F packet,.

I downloaded the fillable G-325a from the UCSIS website: http://www.uscis.gov...form/g-325a.pdf and filled out one for myself and am helping my fiancee to fill out hers, but ran into some problems and questions, both from technical/computer standpoints and just general ones.

I'm hereby posting funny mock-copies of each (80 Kb .GIF) according to how I have them filled out (but with nonsense names, etc), and will ask the relevant questions, some of which are probably very stupid.

http://www.leethaxor...325a-usa-xm.GIF -- This is the form I, the US Citizen, have filled out.

1. Is the capitalization okay? In other example forms, the family name was often CAPITALIZED.
2. For Citizenship/Nationality, "American" is acceptable?
3. Should I write "None" in the Other Names, Husband/Wife, Former Husband/Wife, File Number, etc other fields or leave them blank? If so, should "None" go into EVERY field of those requiring a name but which aren't applicable, or just one, like the way I have mine?
4. In the fillable form, it's not lining up the family names of my mother and father correctly, as displayed on some other forms. Should I space my father's name farther out so that it's properly aligned with mother's maiden name?
5. For my employer, do I combine everything onto one line as I did in the form, or have them on separate lines like is written on an envelope?
6. I was told on another visa site to, in the "THis form is submitted in connection with" area, to check Other, and write "In support of spouse's I-129F" in the field. On this site, however, it told me just to write "I-129F Petition." Which is correct? Or could I just write "I-129F?" I can't get "I-129F Petition" to fit fully (as you can see) in the fillable form, and there's no way in hell the longer description would fit, or if I could even write that small with a pen.
7.For "If native alphabet" blahblahblah, leave blank or put N/A?
8. For the bold-edged box on the bottom, do I, as an American citizen, fill this in? "None" for Alien Reg, or blank?

NEXT, http://www.leethaxor...325a-hrv-xm.GIF - This is the one for my foreign fiancee.

1. My fiancee's last name contains an accent marked C (?), which will not work in the fillable form. Should I add it in with a pen? And because of this, should I write the name in the "If native alphabet is in othe than Roman letters..." area?
2. My fiancee does NOT have any legal middle name. Should I leave this blank, or write N/A, or None? I certainly wouldn't want her name to become Ima None Kunavic. Is this a problem?
2. For her Province or State, put None, or N/A, or leave blank? Croatia has no states or provinces, really.
3. For the "this form is submitted in connectoin with," what should I write? This site said "I-129F Petition," which won't quite fit in the fillable form, and another site tells me to write "Fiance Visa Application." Would just "I-129F" or "K-1" work? Which?
4. For the bolded black box at the bottom, does she have an Alien Reg #? Also, same problem with the middle name.

That's it, thanks! I hope these annoying questions will be of use to others who may have questions in the future, and perhaps the mockup forms will also help. On this site, the "Example" for the form is only one version, apparently the one for the foreign fiancee to fill out.

I used the example forms provided here on the VJ , had no problems at all trough all my process ,good luck

the A # is the Alien registration number they will asign once you send the application

Hi Guys,

Thank you for being so helpful anytime I have needed a question answered. Everyone has been helpful but especially my fellow Cannucks smile.gif

I hate having to post these questions on VJ, since I'm sure it is so straightforward but maybe I just feel overwhelmed. I keep reading conflicting posts but I will ask my questions in a neat and organized manner.

1) AFFIDAVIT OF SUPPORT- Although my finace and I are both lucky to be steady on our feet financially, due to his position as a student we will need to find a sponsor to file affidavit of support. We have found one, but now the problem that I am facing is that when I went to find the forms that I thought I took to the interview, it turns out that somehow I have to send them to NVC?! I am so confused about this. I was thinking that I would send it to my sponsor and she would send it back and then I would bring it to the interview. Am I wrong? If so, how do I go about fixing this?!?!

2) POLICE, BIRTH CERTIFICATE, MEDICAL, FINANCIAL- Do I bring these to my interview or do I mail them back in with the DS 230, DS 156 and DS 156k?

I never thought this could be so overwhelming- especially since I've read that after the NOA2 it gets easier. Thank you so much for your help, and once again I am sorry to post two separate questions in the same day. wacko.gif

to my knowlege how I remember ( its been a while so if I'm wrong someone with more knowlege feel free to correct me )
as to your AFFIDAVIT OF SUPPORT you can still send it to your sponser have it signd returnd back to you , and bring it with you to the interview thats where they will ask for it

to question B when I was in that stage of my proccess I send all that info back with the checklist they send me including the ds 156 ( dont forget to make 2 copies of the DS 156 )
i only brought an updated DS 156 the medical ,and the full folder of my copy that I send them to the interview

K-1 Fiance(e) Visa Process & ProceduresTwo different stories, one ruined wedding.
omg wow that brings back memories , same thing happend to us before we started the k1 i use to go to visit every other month till some boarder guard told us we could get married in the states now and save all the left and right travelling to be together ,
luckely i had kids in canada who depended on me to return at that time ,
thats what i told the guard then he mentioned the K1 ( he didnt say anything about the K1 before i told him I have to return to canada )
i looked it up and found VJ did a lot of reading and asked alot of questions here we found out the guard was wrong to advice us to get married here since he already knew we where engaged ( am so glad we didnt listen to him and so thankful for the people here on VJ )
right after we filed the I 129f they almost denied entry luckly i had a copy of the NOA 1 with me proving we did file for the correct visa ,
i showed them lots of prove that I had every intend to return to canada ,
they let me trough but told us there will be a flag and to bring more prove of intent to return to canada,
so we desided it would be saver for me to take the train and always show the return ticket as prove ,
which we did till our visa was aproved ,
anyhow long story short i agrea with the others who said you can still have a great wedding with the K1 ,
and also since you planned to have the wedding in canada its not a total lost ,
you can still get married as planned then file for Cr1 and visit while the visa is in process just make sure you bring suporting documents showing you have to return to canada ,

Having a har dtime deciphering your English. Do you mean your divorce will not be finalized until March, 2010? And do you mean that she will be visiting you before that?

I don't know if this will present a problem at the interview; you seeing her and agreeing to become married to her while you are still not officially divorced.

seeing his fiance before the divorce is finalized is not going to be a problem at the interview ,
since his divorce will be finalized before he files
i was seperated from my ex ( for 5 years ) when i met tony then started the divorce ,
as long as he has the final divorce degrea when he files I 129f
it wont be a problem at the interview

but my advice is go visit your fiance or for her to come see you it is needed to have met in person at least once when you file for k1

if you do become a borden your fiance is responsible on paying back the gov any amount that you might collect in the future .
thats why they require the finacuel info on your fiance so they know she got enough income to soport you and her
dont forget the suporting documents she has to add to the i 134 ( bank statements , income tax , employer letter ectr )

K-1 Fiance(e) Visa Process & ProceduresPossibly lost NOA1 - is this a problem?
QUOTE (Adrian+Mike @ Dec 29 2009, 07:37 AM) <{POST_SNAPBACK}>
Heya,

My fiancee sent the NOA1 in a letter about 2 weeks before christmas from the US - however its still not here yet. Understandibly with the christmas post being what it is im crossing my fingers that it'll be here in the next week or two, however is the NOA1 needed when I go to the interview or at any other stage now between packet 3 and the final bit? If so does anyone know how much it costs to replace, and where should I go to do this as ive been all around the USCIS website and can't find a thing, just replacement NOA2's.

Cheers!

NOA is not needed in the future but it carries your application number
where you would be able to check on any updates for your case ,( so i hope he made a copy before he mailed it out )
my advise is in the future to make copies of everything you recieve or you mail out
so you always have a backup incase a doc gets lost ,( also i would never send any orig in mail always copies )
specialy the NOA 2 wich will be needed at the interview as well as after the K1 is aproved and you have to file for AOS

ok am confuessed you ask if it will effect the interview ,
what i can see from your timeline , you already had your interview on DEC 4th today is Dec 29
why are you asking this today ,was your interview aproved or not ?
if not i guess they did find out and you have to go for spousal visa ,
but am just wondering why would you ask if it will effect the interview process ,
when your timeline states that you already had the interview ?

Thank you so much as i am a bit relieved.
I would like you to assist me please. My hubby filed for K1 visa but we've been engaged traditionally 2009. We had our introduction 2007 and we had our court wedding den too. however, we agreed to get married in US too as it was our parents wish, but in 2008 i got my e-passport as being married and when my hubby alerted me he filed for k1 visa, i had to go to d passport office and change back to my maiden name, he had to send a "to whom" to proved that it was his whole idea for me to change it not as a divorcee and a got a new one. I really want to no if the consulate would detect it and would it affect the all interview process and i hope it wont be counted as fraud attempt too.
Please help.

if you got married in 2007 why would you get engaded in 2009 ,
since you are already married you was supose to have gone with the CR1 or K3 spousal visa not K1
what will you say on the part where it asked if you have ever been married ?
my thinking is you have to withdraw the K1 and apply for spousal visa ( CR1 or K3 )

K-1 Fiance(e) Visa Process & ProceduresAnother "Starting the K-1 Process" Thread.

Hi everyone. Just found out about this website and it's been a HUGE help and has answered most of my questions. I thought I'd ask a few just to be sure that I'm understanding things properly.

My boyfriend is an American citizen and I'm a Canadian citizen. Our process should be pretty straight forward as there's no criminal records, no previous marriages, no children involved.

I am seeing him at the beginning of March which is when we're going to start the paperwork process. My questions are these:

01. Once the process is started, I am coming back to Canada probably until August when my job is ending. Will I have any problem getting into the United States without a Visa in August? Or should I get a visitor's visa? How long would I be able to stay without one? If I DO need to get a visitor's visa, how long does that process usually take? I read the B-2 (I think) form and it needs an address I'll be staying at. The only problem is that he's planning on buying a house in the next few months so I'm not positive on the address where we'll be staying. Should I just give his current one?

02. In August, I'd like to be able to at least move most of my things there, even if I'm not staying permanently. Will this be an issue? There's nothing major except like four pieces of furniture and some clothes. The rest will be brought or mailed at a later date when everything's permanent.

03. I'd like to bring my dog with me in August. He's got all of his shots and I have all of his records. Again, will I have a problem crossing the border with him?

04. I'm not sure how I'm supposed to prove my intent to return to Canada once my visit in the United States is over. I don't want them thinking that I'm moving everything down there with no plans on coming back. But like I said, my job will be over in August and I don't know what "evidence" to give them. Any advice?

I think those are the major questions I have. Any help would be much appreciated.

hi and welcome to VJ
Q 1 ;as a canadian you can stay 6 month - 1 day without a visitor visa ( make sure you dont go over 6 month as this will be concidert overstay and can lead to a ban .
you can give the current adresse where you will be staying

Q2 ; you wont be able to bring your furnitures as this will cose them to belive you will stay permanent in the US
and can cose a denial at entry
you can bring your belongings once you get the K1 visa

Q3 ;am not sure but someone can correct me you need the vaccination rec and prove of rabbies shot

Q4; as i answerd on Q2 , but even if you wont be able to bring furnitures you should still bring documents that proves you have no intent to stay
( docs like open lease or current bills anything that shows you have an open account

K-1 Fiance(e) Visa Process & ProceduresI 134

An employer letter or pay stubs. Both would be better.

The I-134 is not a binding document. Later when adjusting status the I-864 is used and it IS binding. Read the contract contained within the I-864 for clarification, noting the joint sponsor is second in line after the primary sponsor.

ok thank you very much for the info ,I will pass it on

K-1 Fiance(e) Visa Process & ProceduresI 134

Chances are slim and none, as the I-134 asks about current, not past income. A new job or a qualified cosponsor is what will be needed.

ok thank you for the answer
so if he where to find a new job he would still need the emplyer letter right ?
also if he would have a qualified cosponsor ,
he himself would be the primery sponser
if for any reason the fiance would become a public charge how would that effect the cosponsor ?

K-1 Fiance(e) Visa Process & ProceduresI 134
am asking in reguards to a relative , he got his interview comming up ,
my question is about the I 134 ,
he got the last 3 years of tax returns , he got bank statements where he can prove 125 % over poverty limit ,
the thing is he just lost his job few month ago and has no letter from the employer or income comming in at this moment ,
what are his chances to get aproved for k1 without employer letter ,paystubs , or employment ?
