Hehe - no worries. Head on over to the Cdn forum and ask, a few people lately have had that very situation, but I think they had to get written permission from the ex (no matter how much of a deadbeat) in order to proceed with the child. Unless they come up with some kind of court order.

Girl - you are 2 days ahead of me. I too have been keeping mountains of documentation. bills, tickets to events etc etc......it's a novel for sure!

Miss ya too - glad all is well. I take it Boston is treating you well

QUOTE (MonicaMexico @ Sep 9 2009, 10:24 AM) <{POST_SNAPBACK}>
Do you have a US address that you're using for your immigration paperwork? If so, I'm not sure how they will know that you're not living in the USA. I think the child's birth certificate and maybe a few pictures will be enough to prove relationship for the ROC. I'm not sure they'll be checking that you're still a resident - their main priority is proof of bonafide relationship at this junction. I could be wrong, though, I've been wrong before!

not that good of an advice ,. since he said the child was born abroad wich meens the child is probly not a USC
how you supose they explain that to the immigration when they ask when they returnd after the childs birth and want effidence ( boarding pass ) , ??

Congratulations

I can relate of being a proud german , I am german lived in canada for almost 20 years before moving to the states
yes many asked me why dont you become a canadien ,
my answer was always mom made me german she passed so thats who i stay ,
I am proud of who i am thanks to my mom ,
doesnt mather where you live the pride is in your blood not where you set your foot on
so doesnt mather where you live its just a country like any other its how you feel deep inside
and once someone finds theyr true soulmate and is willing to leave everything they had behind to begin a lifelong happyness in another country, the country shouldnt be the subject of your happyness
its your relationship and the way you present your self thats what makes anyone happy no mather if they live in a villa or a doghouse , a poor country or a rich . so anyone that is proud of where they come from dont change cause you live in another country ,a country can not change on how you feel deep inside ,
we came here to have a happy life with the love we found not to say yes i came cose I wanted to be a proud americain .
I Love my Husband forever and will always stay german ( even if i concider becomming a US citizen in the FARRRRRRR future I will keep my german citizenship too
again congrats

Removing Conditions on Residency General DiscussionSeparated while awaiting 751
QUOTE (kipalkot @ Oct 17 2009, 11:55 PM) <{POST_SNAPBACK}>
Hi guys, my husband and i just separated!!!! We have been having issues. I found out he was cheating on me and i questioned him. He is been seeing this girl for a while now. He keeps visiting his family our of state a lot without me. He does not keep a job. I support him and my 8 year old son. We filed for my removal of conditons in May and my file am told has just been transfered to the local office. I told him we might be called for an interview but he said he is done with me. We have had such huge arguments lately about him not keeping a job and visiting home so much. I suspect he is using something because some days he will be so sweet and at times mean on the phone.
Now am confused what do i do if he does not want to go with me for the interview. I have a son to support and morgage to pay. I have no other family here other than him and his sister who lives out of state. My husband has just changed and seems to enjoy something he does out of state with this girlfriend of his. Please advice.

without a timeline it is hard to give good advice
but am sorry you going trough this ,and to the comment he gave you " he is done with you " well he actualy is not done with you , he was your sponser and therefor is financeuly responsible ,so he cant say he is done with you .
and since you got transfered there is a good chance you might not need an interview ( but like I said no timeline so i dont know if you came with K1 )
but am sure someone with more knowlage can answer better

Removing Conditions on Residency General DiscussionI751 Documents Ready and Couple of Questions
QUOTE (beakon20 @ Oct 26 2009, 09:02 AM) <{POST_SNAPBACK}>
I have the following documents almost ready to submit with the I-751 form, what am I missing?

*Mortgage Statements (one from Sept 2009 and December 2008)
*Copy of health insurance card (showing both names)
*Copy of auto insurance policy (showing both names)
*Copy of note for auto loan from bank (both names)
*Copy of property tax bill 2009 (showing both names)
*Copy of car title (showing both names)
*Bank account statements with both names. (statements from two different banks)
*Pictures of the two of us and family pictures, from 2002 to present.
*2007 & 2008 Joint tax returns.
*I-751 completed and signed.
*Fee

Do I need to include any of this information? I know they already have it from the initial application, but I didn't know if I needed to resend.
*copy of birth certificate.
*copy of passports
*copy of marriage license

The only documents I don't think I have included are any receipts, besides pictures from any vacations because I don't really have anything that I can find. Also, some people were getting affidavits is this required? Here on VJ where instructions are provided they do not list any affidavits in the required evidence.

When combining all of these documents how did everyone assemble them? I was thinking of using one of those project portfolio organizers (binder like) and putting a labeled divider in front of each document (I'm not sure if this would be too much) or instead just send the documents all together without any separation.

I am in the middle of gathering documents too ( i think am ready to file just waiting for the date 22 NOV )
I found out that you dont have to include the passport ( I did cose i got a new one with our currnet adresse and marriage name in it )
you also have to include a copy of the GC front and back
I dont have a drivers licence so I included my state ID card and husbands DL other then that
I also included mortgage Deed and insurance , life insurance ,pay stubs showing marital status, uttility bills with both our names , some junk mail showing both names and same adresse ,, and some affidavits ( heard its not nessesary but good to have if you think you dont have enough documents )
I didnt include birth cert or marriage cert
I got everything in a binder i put each section in a plastic protecter and labeld

I am sending my I751 next month. I was wondering if there is any way I can get my biometrics in a different office. My local field office is located in Atlanta, but the one in Charleston, SC is a lot closer than Atlanta, even the one in Jacksonville, FL is closer.
Is any way I can get my biometrics in SC instead of GA??
Thanks in advance
Lis star_smile.gif

am not sure you can choose the location , but for example when i went trough AOS ( i live in Mass ) my bio was supose to have been in Boston , but since we are closer to the CT border they send us to CT , 30 min drive instead of 1. 1/2 hours to boston we didnt have to do anything ,
am hoping it will be the same thing when i file for ROC end of Nov

you could also type in your zip here
https://egov.uscis.g...office_type=ASC
it will show you where they might send you

If USCIS is sending mail to your old address it is likely that they do not have your new address on file, A11 should be done both online and mailed in paper form to USCIS. Calling USCIS might be a good idea in this situation tho they will probably tell you to submit the address change both online and by mail again.

ok will get on it right away , hope it wont be a problem :S

It shouldnt be a problem really if you can get it changed before you mail all the ROC stuff off to them. Hope you can get it sorted out before then!

thank you Inky , yes i just called he said he cant confirm the personel information over the phone ,
but since I dont have a case pending i can just send in the ROC in Nov with the new adresse and attach a copy of the AR 11 and a copy of my husbands adresse change as well ,
or i could make a info pass with the local office and confirm the adresse change ,
he said those letters are auto generated and usualy processed 45 - 60 days before they mail it out .
we moved end of may so they should have our new adresse , but am not worried will just file in NOV with the new adresse and attach the copy of change of adresse confirmation

HI AGAIN,

WELL SINCE THE NOA1 TAKES LIKE 2-3 WEEKS AND SINCE I DON'T HAVE MY GREEN CARD WITH ME, SO I NEED THE ONE YEAR EXTENSION TO GET A STAMP IN MY PASSPORT, SINCE I NEED TO MAKE A TRIP TO MY COUNTRY ON DEC. 11, MY QUESTION TO EVERYONE IS:

SHOULD I BUY MY PLANES TICKET FOR ME AND MY DAUGHTERS NEXT WEEK EVEN THOUGH I DON'T HAVE MY NOA1 YET?????????

I DON'T THINK THEY WILL DENIED TO REMOVE MY CONDITIONS SINCE WE HAVE TWO GIRLS TOGETHER. WE DON'T OWE A HOUSE AND ALL THE UTILITIES BILLS ARE UNDER HIS NAME. TOMORROW I WILL OVERNIGHT MY PACKAGE TO THE VSC SINCE I AM IN LOUISIANA.

I REALLY NEED TO BUY 3 PLANE TICKETS BECAUSE RIGHT NOW THEY ARE AT ALMOST $500.00 EACH AND IF I WAIT TILL THE LAST MINUTE THEY WILL BE AT 800$ EACH. ALSO I HAVE HAVE HAVE TO LEAVE ON DEC. 11 THIS IS WHY I WAS JUST WONDERING IF ITS TOO RISKY TO BUY THEM WITHOUT AN ANSWER FROM THE USCIS.

PLEASE ADVICE ME ON WHAT TO DO. THANKS smile.gif

if you are sure you wont get denied , my advice is buy the tickets while they are cheap if worst comes to worst and you dont have your extention letter in time ,
you can call the airline and postpon your trip pay the extra when your ready to go

wife was arrested for assault. It looks like it will be a misdemeanor. I know we will have to be honest on the i751. But will this ruin her chances for getting 10 year card ?

Please help!!!!!

your timeline says your not in the US
so incase your not here yet , does your wife have a 2 year GC ( I doubt it since you just got married in 08 ),
cose to my understanding the i 751 is to remove condition on the 2 year GC
incase you go for DCF you would need a police certificate for filling DFC ,if the aussault is listed on the police cert ,
i belive it could effect your case if your wife is the immigrant
but hard to give advice without knowing your timeline

I don't mean to hijack the thread but this troubles me. My wife had the house before I ever moved here and we would have had to refinance to get my name on it. It simply isn't going to happen. Also, no utility bills in both our names. We have car title, car insurance, she's the beneficiary on my IRA, we have things like car and furnace repair bills in our names and can get affidavits. Does anyone think we should be ok?

No refinance required. Go to the county courthouse, ask the clerk how to do it. It's a type of addendum, the mortgage company can be notified, if you desire, but it's NOTHING to do with the mortgage company.

Ok thanks for the tip Darnell. Much apppreciated.

I don't know what it's like where you live but my wife has experienced a lot of grief trying to change names on utility bills. One of them is still in her previous marriage last name. It's not "simple"...at least it hasn't been for her.

Sounds tedious and painful. I am sorry, I don't live where you live. I had no issues getting it done, and my wife lives out of the country.

For me, it was a phone call. I know, there are variances all over the place, so I'm not knocking yer experience - but ... Sometimes GRIEF will bring SUCCESS, I've seen it happen !!

Yeah, they've given her a lot of problems. She just got sick of it. I'm glad it worked better for you.

Hi joe you can also include Joint Tax return , joint bank accounts ,Visa statements , health insurance ,
bills from doctor visits that show your adresse , anything you get in mail that shows your adresse
but I think you know that just wanted to trow that at you smile.gif

What about FORM I-865, SPONSOR NOTICE OF CHANGE OF ADDRESS, as i am a sponsor do i have to mail this to the USCIS too. I read the instructions and as per that we have to mail within 30 days? Can i mail it now. Will i be in troulbe if i mail it now?

Appreciate your advise.

It almost time for us to file the removing the condtion..........card expries on MAR 27.......BY WHEN do we have to file the petition..........is DEC 27 is a good time..........90 days before

thank you

as to the question if you are going to be in trouble sorry i dont know ,
but i can tell you from my own experience we moved end of may we did the change of adresse for the both of us ,( i recieved a hard copy for my husband who is my sponser )
i printed out the copy of the online A11 , my ROC is coming end of this month ,
now i resived a reminder letter send to my old adress concerning my ROC
so i askd here many sayd not to worry , which I wasnt
but i had to make sure so i gave USCIS a call they said
since I have no case pending to just file with the new adresse when i remove condition , and it will be fine ,
but maybe someone can correct me if I am wrong ,
you could file now for the address change so they have it in theyr system when you have to file ROC
yes your time starts after DEC 27 (I will send it a few days later as many who send it on the exact date get the pakage send back stating they send it to early )

Hey guys.

Thanx for all the input. You have given me much to consider. I never planned to get this into so nasty a situation. Therefore, I think we should end this thread. Besides, she has her own laptop. Should she stumble on this, there would not be love and kisses in the evening!

I think I will just wait a little longer, and when she says I should do the I-751, I will just tell her, at that time, I am not going to do it. If she goes ballistic, then I will dial 911.

Besides, she is not always bad. When she is in a good mood, she is very sweet. I just have to be careful not to "push her buttons" as she says. And, she often apologizes and says she will never do it again.

I suggested that we might try a councilor, yesterday. Yes, she lost it, but this morning, she said she was sorry. She feels that counciling will help me to deal with this. She doesn't feel she needs it. Maybe, she will go, if I go!

Maybe, there is hope.

tom

wow sounds to me she might have bipolar ,
am sorry to say but she got you wrapped
if she doesnt realize she has a problem and is not willing to go to counceling with you ,the problem wont stop
but if your willing to walk on eggshells in your own home its your life
I just feel bad that you take the wrap for her mistakes ,
if she cant accept her faults now she never will change you married her to be happy not to have a mommy figure dictating your every move .
so my advice is talk to her on how you realy feel , you love her and counceling will only benefit if both of you go
if she loves you she will go with you she has to learn it cant always go her way she is not a little child anymore shes a growen woman
marriage is a two way road not a one way ticket to the road of missery

I wouldn't worry too much.

When I received the reminder letter they sent it to the address we lived at 2 rentals ago, and we updated the new addresses with USCIS.
I think it's probably just the address the had on file from when you first did AOS.

I had no problems just sending my paperwork with our current address, and all has been sent correctly. smile.gif

congrats on your aproval
I know i did the AR 11 I think i also mailed mine when i mailed my husbands but am not sure ,
but like you said dont worry , am just goin to mail the whole pakage with my new adresse
your experience worked out great , so i dont see a problem when its my turn smile.gif
again congrats on the aproval smile.gif

Lona dear - I was just wondering teh same thing - I haven't received one either, although I'm filing later this month.

somehow - I guess I was concerned that they don't know my new address from last year, but My husband and I got confirmations that our address changed so I guess I won't worry

heu udella nice to see you again , yes we did get the confirmation too, but find it strange that they require to file a online A 11 then still send it to the old adresse ,
but oh well am not worried will mail them a copy of our confirmation plus adresse change at the post office confirmation , when i send it with my new adresse

yes i just called he said he cant confirm the personel information over the phone ,
but since I dont have a case pending i can just send in the ROC in Nov with the new adresse and attach a copy of the AR 11 and a copy of my husbands adresse change as well ,
or i could make a info pass with the local office and confirm the adresse change ,
he said those letters are auto generated and usualy processed 45 - 60 days before they mail it out .
we moved end of may so they should have our new adresse , but am not worried will just file in NOV with the new adresse and attach the copy of change of adresse confirmation
