I send mine overnight express with signature
one advice there was a member here not to long ago he mailed it in a flat rate box , got his pakage returned to him stating not enough postage
( I know flat rates are one price but somehow the postoffice messed up for that VJ member )
so i would take jigis advise and pay the extra fee bucks to make sure those important documents get there safe

Thanks, millimelo, for the tax input. We have the same addresses.

Lona: YOU may be saying in in "simple words" but Bob was not, hence my repeat posted questions, especially about the "4 month" issue that you too have wrongly used.
I repeat... What is this "4 month" time-frame you both mention? Maybe you're trying to say we were only married for 4 months before she walked out?

Anyway, none of these unexplainable comments answers my original questions.

PS. Maybe it would help clarify and correct things if I state the following. (Same info but re-stated)
1) Married 1st March 2008.
2) GC received 10th Dec 2008
3) Walk out 1st April 2009

Therefore we were married and living together 13 months.
Second WEDDING anniversary 1st March 2010.
April 1st 2010 = one year since her desertion/walk out.

I hope this help to identify my status and histiry better?

the 4 month was calculated ( before you posted your history) from GC recieved till your wife ( sad to say walked out )
therefor 4 month short timeframe
I was just trying to make bobs words simple to read ,
not that the 4 month makes a differance ,
as long as you have enough effidance and divorce cert you can file anytime even before the 90 day ,

i think what bob is trying to tell you in simple words he dont see a problem of not getting aproved once you got the divorce cert ,
even with a short 4 month timeframe of marriage after you recieved the GC ,

Hi everyone!

We're gearing up to apply for the I-751, petition to remove conditions on residence. My husband did his biometrics when we applied for the permanent residency; does he need to have them done again?

The wording on the USCIS is not quite clear to me- I guess I'm a little rusty with all the bureaucratic procedures! After all, it has been almost two years since I've had to fill out any forms. ;)

Thanks in advance for any input.

sorry to say but yes you will need to do bio again
( once they recieved your i 751 about a week later,you will get the 1 year gc extension letter ,
also around that timeframe 1 or 2 weeks after they get your file ,you will get the bio apt letter )

my guess is her husband pays for it and suports her with finances ,

but you say you want to go back to your country in july/aug thats about the timeframe when you have to file ROC
I hope you know you will get a biometric apt wich is usualy send within a month after you file ROC ,
sure you could ask for a later date ,
also take into considerations they choose people for interviews at random ( doesnt happen often but it does happen )

I dont realy have an answer for you but wanted to say
if you are planning to go for NATS ( US citizenship ) you are eligible now
since you have been resident for over 3 years
you could apply for it and it would eliminate the GC aplication once you get the US citizenship
( GC residents are eligable to apply for NATS if still married after 3 years
if divorced the waite time is 5 years ) good luck

to see if he gets diferant answers
most of the time new VJ members are getting addicted to posting and are not satisfied with one answer

once you got all the effidance together go to Doncin doughnuts and pick up some yummy daughnuts add them with your application heard they will spead up the process ,

My case was i-751 waiver after divorce and i had interview but officer didnt tell me it was approved or denied, she said that they will let me know by mail.
I just check my status online and it says that my case is Post-Decision Activity 02-22-2010
If someone knows what does it mean Post-Decision Activity

saying something like for aproved aplications USCIS sends it to NVC for forther processing
for denied applications they send it to department of state where you can apeal so they reconsider ,
how did the interview go ??

Only citizens can serve on juries.. My wife received a notice for jury duty. We sent the card back stating she wasn't a citizen. They excused her from serving!!

yup same here i recieved a sommon right before i had to file ROC ,
I send the card back stating am not a citizen and also filled out the online form to be excused ,
send a copy with my ROC application as effidance of adresse

I'm getting all my papers together for my ROC and I just want to make sure I have enough evidence. So here is what I got:

-Cover letter
-Payment($545 + $80 K-2 child)
-Form I-751
-Copy of mine and son's GC front and back
-Copy of mine, son's and husbands SSN
-Copy of mine and husbands driver's license's
-Copy of rental agreement
-Copy of joint credit cards
-Letter from Capital One and Chase credit card company stating who is on the account
-Letter from bank stating me and my husband have a joint checking account
-Letter from bank stating my husband and son have a joint minor's saving account
-Copies of a few bank statements(joint checking account)
-Tax transcripts from 08 and 09(married filed jointly)
-Copy of auto insurance change in policy(with me added and new car added)
-Copy of auto insurance policy card(mine and husbands name on policy card)
-Copy of birth certificate of our son born November 08
-Original affidavits from 2 friends(signed, stamped from notary)
-Original affidavit from mother in law
-Copy of receipt from hotel from when we went to Savannah for our honeymoon
-Numerous pictures from Nov 07 to March 10

I hope this is enough. We live with my mother in law and she owns the house. All the bills(utilities) are in her name. There are a few bills in my husbands name(cell phone, land line phone, car insurance) but she gets them paid and then throws the bills out after they are paid. I have in her affidavit though that all the bills are in her name. My husband has lived at this same address his entire life, so I hope I don't get no RFE for not enough evidence. I was wondering though if I should send in a copy of my son's immunization from the health dept. He needed to get more vaccinations to be enrolled in school and I have a letter stamped and signed from the health dept. Do I need it? Also I have a letter from Kaiser when I got pregnant stating I was pregnant. It is also signed and dated. We don't have any health insurance anymore because my husband lost his job, so I don't have anything for that. Any help will be greatly appreciated.

Before remarrying make sure you are also officially divorced in Germany. As long as you are a german citizien your marriage is automatically valid in germany. I found out about that when i renewed my passport. Big surprise. The thing is once you get remarried germany want see your second marriage as valid and you would be married to two man legally in germany.

yes as schatzi said you also have to make sure you are officialy divorced in germany
before you remarry
( I was in canada when I divorced my EX so yes the traditionel divorce in canada then got the divorce cert and had to go to the consulate,
to well lets call it divorce again by german law ,
what a fun time the run around was :whistle:
if they dont have your divorce in the german registry,
you will not be aloud to marry again in germany it will be considert poligammy ( or how you spell that thing )

your case sounds a little complicated i would seak advise from a laywer ,
but as vanessa said you could try to file ROC with a waver ,
but I doubt that will get aproved if you deside to stay out of the country longer then 6 month
since you been out of the country since oct thats 5 month ,
( someone correct me if I'm wrong ) to my knowlege you cant stay out of the US longer then 6 month or it could be concidert abbanden status ,
also as vanessa said be prepared to answer some questions if you abbonden your status now,
and aply for another GC right after divorce , so keep all the police records and every doc you got proving you where abused

and copy of GC
other then that yes I would add him to bills and try to get affidavits
maybe even open a libary card where it shows date and both names ,
or maybe go together to donate blood at the red cross ,it will be for a good cose and you can ask for reciept wich shows date and both names ,
( I included flu shot reciept where it showed same location date names )
any junk mail in both names
those are for some people considert overkill ,
but in your situation I would mail anything and everything that comes to the house

I agree with second stage about the intent of the question.

Her 2 year green card is in her maiden name? You could have changed it at the time of AOS, but at any rate - I'd fill out the I 751 with her married name. Then include documentation to prove the reason for the change (certified marriage certificate) and a letter from her explaining that she would like her 10 year GC to reflect her married name.


I belive the wife has to sign in married name if thats the name she uses to sign documents anywhere,
reguardless if she is the USC it is her legal name
you just sign with your name since there was no name change for you after marriage( since your male )

I just have a concern about the vaccination requirements. My wife has a conditional gc based on a k-1 visa. We had to get two vaccinations done at that time. I believe one was the HPV...and the other one was a flu vaccine. One of these was a series. We haven't had that series completed as of yet. I'm wondering if we will have to complete that series before we can file for ROC? Is there any proof of the vaccinations that are even needed? Thanks
