Finally filed our 1-129F petition with the help of this site. VJ is really a big help to those who are new on the process. You cant find step by step detailed instructions in any other site but here only. Kudos to all the members who are giving all their support to help each and everyone here. And to add, i followed the advise to "do it yourself" by following the guide here which are clear and complete. Am very happy i found this site. Saves me money and worries.

When we filed our I129F, both my fiance and I included divorce decrees only.
I do have copies of my marriage certificates which I will file when I get to the consulate stage.

I have found this site extremely helpful in being able to go through this process ourselves and
getting the paperwork completed so far.

I'm not sure which U.S Service Center your petition was filed at... but there are delays now in the petitions being processed. Vermont went from a 5 month processing time to 8.7 month processing time for a K1 / K2 Visa. I know this because we are also waiting for our NOA2...

I was hoping to move sometime in Sept / Oct.. but now I'm thinking that isn't going to happen. :(

Hey man don't worry ok. We got the NOA1 on Dec 30, 2011 and just this morning (Afghanistan time). We got the NOA2 email from the USCIS. Gosh I was so happy. I started freaking out too when I saw the 8 months it went up on the ESTIMATOR. But happy now. Just be patient

Texas22, I am also a January filer and my fiance and I have everything done for the Packet 3. He has his medical scheduled already for Mid May, (in Ireland they will schedule your medical without a case number) He is getting his police certs this week and I have given him all of my financial info and the affidavit of support (signed and dated for late May) None of that info is going to change between now and his interview... We figure, this way he send the embassy his notice of readiness right after he gets his Packet 3. :thumbs:

Kim, I waited to get my medical done 2 weeks before my interview. Dr Seiden's office in TO will usually have the results ready 2 days after available for pick up. The I-134 we did on April 11th (interview was on the 25th). The police certificate I did in the middle of March (you will need this for AOS and it is valid for a year). My immunizations were done in February and in March. You should call the Dr's office where you will be having your medical done as you may not be required to have all immunizations done depending on your age.

Once you receive the NOA2, you can start calling DOS and see where you are in terms of packet 3. I found calling DOS very helpful and it gave me a timeline to work with to give me an idea of what paperwork to start gathering.

Don't stress. The interview is the easiest part. You should also check the Canada forum as it is really helpful.

I have printed off the list for Packet 3 requirements.
I have started to gather everything needed. (in an accordian file all neat and filed properly - ready and waiting)

So far I have:
- mine and kids updated passports
- mine and kids long form birth certificates - (certified copies)
- previous marriage certificates
- previous divorce certificates
- my custody order already in place showing I have sole custody and the kids father had agreed to the move - with visitation
and child support agreed upon and in the court order.
- continually collecting skype logs, phone bills, photos and boarding passes from when we have been able to visit since filing the petition.

Still need to collect:
- police certificate
- immunizations for the kids and I - got info from Dr. Seiden's website and going to family doctor next week to get started on those to see exactly what is needed.
- passport photos (is it 3 or 5 of each?)
- DS-230
- DS-156
- DS-156K

Once I have an interview date I will get my fiance to send me:
- photocopy of his passport biographic page
- affidavit of support I134
- letter of intent to marry

I'm still not quite sure what they mean by "Evidence of domicile in the United States". And I am a little concerned because when we received our NOA1 it shows that the I-129F petition for alien fiance has been received and it lists my name only, even though my fiance included my children in his petition for K2's. :unsure:

I have paperwork X 3 because my young children are moving with me... it's a lot to deal with sometimes, but I'm a stickler for being prepared. I feel like the wait time is long enough without it being held up because we are waiting for stuff we could have collected while waiting...

Every time I check it said 5 months, never 8.7 months. I check it today and still the same 5 months.

USCIS National Average - 5.7 months
Vermont Service Center - 5.0 months

View national volumes and trends for all applications if you click on it and just select 1) a form type 2)office you will see how many petitions has been completed in Dec 2011 at Vermont Service Center.

Note: the timeline on VJ is only those who joined the site and updated. There are more and much more we don't know about since they don't join VJ.

When I read your post I thought perhaps I was going nuts, so I went back to check again this morning.. and I got the same thing as I did yesterday, with an effective date of Feb 29, 2012. I have attached a screenshot below.
So I'm completely confused by the accuracy of the information.

Touch: When the UCSIS "Touches" your petition or file it means that an action was taken which required your file to be physically touched or moved. Example: Your file is touched when it is given to an adjudicator to process.

I wouldn't pay too much attention to it. Some people are approved with no updates at all.

I am working on the immunization records now... but not quite sure which immunizations are needed for myself and my children except the usual?

The Lockbox in Texas is where all I-129F petitions are sent, then they reroute them either to California or Vermont, usually by the state where the petitioner lives. :)

In your timeline you have Texas Service Center, that's why your estimate date is as above. Change it to the center your petition is at and it will change! ;)


I have it as Texas because that is where we originally filed... but they moved it to Vermont. Visa Journey says to put original Service Center there... I will change it and see what happens...thanks.

Well I guess I'll be cheering you up then! VSC is well ahead of the CSC as far as approvals (VSC Currently reviewing Dec 7, 2011 and CSC Nov 30, 2011) so that timeline you looked at makes no sense! Trust the timelines you see on this website, because people who get approved update them daily. That timeline you looked is NOT updated - it might be based on historic data - rather than actual "live" data. Cheer up and call them once the 5 month mark hits (if you haven't received anything yet)!

My fiance originally sent our I129F petition to the Texas Lock Box on January 25th and it was transferred to Vermont Service Center. We received our NOA1 dated January 31st. At that time, USCIS website said that the processing times in Vermont for K1/K2 petitions was 5 months.

I checked today and it is now 8.7 months. :( UGGGG!!

So I guess my question is... Should I wait until we receive NOA2 before requesting a police check and completing the I134?
Are there any other documents that are date sensitive that we should hold off on for now?

I also have sole custody of my children, but I went back and got a new court order stating that I was allowed to relocate the kids to the United States. My ex and I mediated a new custody agreement with this in place and a new visitation schedule and child support etc..

I would check with your consulate just to be on the safe side. You would hate to have problems in future. Best of luck to you! :)

I am sure it wouldn't hurt to get that second job at Starbucks while waiting for your NOA2. I am not sure if they would actually transfer you or not (I managed a McDonalds back in Canada, and I don't think we did transfers...at least not in the time I was there). Anh map is right, you can not work in the USA until you get your EAD or Green Card. You have to file for your AOS first (which is how you get those things).

However, as I said, getting a second job while waiting to move here will not hurt you at all. You can make some extra cash and gain experience at a Starbucks, which can help you get a job at a Starbucks down here, once you are eligible to work. If you do a good job at the store in Canada, I am sure your managers will give you a great reference. I know when I hired people at McD's, if they had experience at another McD's, they usually got hired (if they had a good reference that is). I actually hired a swing manager who was a swing manager in the USA. He had to go through the same hiring process as everyone else, but it made it a little easier.

I think CR-1 option is probably better as you get more bang for you buck so to speak. As far as interview goes, not sure if you can interview abroad! If you have these obligations, you may just want to wait on filing as he can visit you as much as he likes as long as he has strong ties to Canada! Maybe file after his conference, and you won't have to worry about any complications? good luck! :)

Just wanted to add--you may want to wait to get married and file, not just file as I said previoiusly. And to be clear, as a Canadian he can visit the US for up to 6 months per Calendar year total. He must have strong ties to Canada to do so, and it is ultimately up to the border officer to determine whether he can enter or not. If you'd like some specifics on strong ties, feel free to PM me. :)

i thought that the co sponsor would have to meet the 125% for not only their household size but the petitioner/beneficiaries too.

please tell me if i am wrong. ! my fiance and i have 1 daughter together and he also has one other daughter/dependant. MY COSPONSORs family size is 4 people and mine also would be 4 people. i thought that the cosponsor would have to meet the 125% ( in my case ) for a household of 8.

am i wrong?? if i am im not sure why i thought this was correct.

oh no we signed the letters of intent for sure. just not the supplemental sheets we used for question 18 on the i129f and possibly the supplemental sheets we used for employment history for the g325a.

so just the extra sheets we added onto the petition.

in blue ink? really? i was sure the instructions asked for black ink NOT blue for all sheets. (because black photocopies better)

i was just looking over my copy of our i129f etc. and realized that we did not sign and date our supplemental sheets! hopefully we will not get an RFE for this. but if we do, would they just want an updated sheet signed and dated?!!

also am not sure if my fiance was supposed to sign all photographs included in our petition. TOO LATE NOW! but we labeled every photograph on the back of who is in the photograph, the place it was taken and the date it was taken. but diddnt sign his signature on them.

im trying not to worry about all these details, as there is nothing i can do about it now. just trying to be prepared for a possible RFE, and things that they may ask for. any help would be appreciated.

As many have said before: be completely honest and always have evidence that you will be returning home (return flight, bank statements, letter from your university or employer, leasing evidence...)

From personal experience, as long as you're upfront and have a return flight home, they won't ask for other proof. Note that it was the case for me. Your situation might be different. I have always traveled with a return flight, a bank statement and a letter from the dean of my university, just in case. They do ask more questions after someone has petitioned for you. Answer truthfully and smile.

If the USA allow citizens from your country to travel for pleasure without a visa, technically there shouldn't be a problem. As other have stated, it is discretionary. With proof and honesty though, you'll find you come a long way.

You would need to call USCIS after 5 months to submit a service request because it would then be outside their processing goal.

You have a long way to go before you can even think about calling them. Submit your petition as soon as possible and then fill in your timeline to get an estimate on when you should get your approval notice.

Honestly, it is luck of the draw. Unless you get a RFE for missing documents you should be expecting it with the 5 month mark. I know that isn't what you want to hear but USCIS at this stage doesn't do anything special other than to confirm that the USC is eligible to petition for you. USCIS checks background of the USC for criminal record as well as previous petitions and proof they are free to marry.

As long as your petition is not complicated (previous petitions, still married, recent divorce, previous overstays) then you should expect it within 5 months or less. After 5 months you can submit a service request to USCIS and they generally try to work on any backlog as quickly as possible.

As long as you meet the minimum requirements, you shouldn't get denied outright. You may get an RFE (request for evidence) if they are missing something from you.


Important things you need to include with I-129F peition to avoid denial

- meet your partner within 2 years of filing the petition (boarding passes)
- must not be currently married (divorce decree)
- be engaged and willing to marry your partner (letters of intent)
- include pictures and other evidence of relationship

Important things you need after NOA2 (petition approval)to avoid denial

- income must meet requirements for 2 people ($18,912)
- Proof of income (tax returns, pay stubs)
- must not have contagious diseases (or have proof of treatment from Dr.)
- no criminal background/or provide documents regarding record

I think those are it and if you have all that, you should be able to get the 1-129F approved. Also check the guides for exactly what to include...I am too lazy to type out everything lol
