but my petition was reaffirmed in a week and shipped promptly to NVC which would be the most rare case i have never heard or seen a petition which is being approved within a week because uscis needs 160 days to review the petition. looks like nothing was wrong with my petition likely a minor error which CO could have ignore it and approve me visa we have already written an email to consulate but haven't written to NVC since my case is still on the way to NVC. so should i also email to NVC. do you think my reaffirm K-1 can help my CR1 go smoothly and if i expedite for CR1



Umm....how do you qualify for an expedite? It cannot be USCIS error since they didn't so anything wrong, and it can't be the CR-1 because YOU decided to file it, and it can't be the K-1 because you don't qualify for it

What sort of visa will you use to visit? I am assuming it would be a tourist Visa? It will be against the law to get married after going in with a tourist visa, you would want to do that either with the K1 or elsewhere then apply for the K3. If you do get married going in with a tourist visa, you risk deportation and also risk re-entry denial.....it is not against the law though to get engaged. Whatever you decide, good luck.

Op - being married or engaged to a US citizen can often lessen your chances of entrance into the US. While being truthful is a MUST, do not divulge any more information than necessary

2. Copies may be sent to USCIS (did your read the instructions regarding this?) but originals will be needed

3. I would put something like "Smith Construction Dallas, TX/Denver CO Something along those lines. I'm sure your tax returns for the last 3 years will indicate the move correct? Just keep it simple

Your mom dies
He leaves the US and gives up the green card
He works 40 qualifying quarters ( which IS NOT the same as being here 10 years)

Also some immigrants have divorced and used the I864 to justify support post marriage

note that divorce does not terminate the I 864

Absoulty try, but be prepared to show health insureance already established in the US - in fact I would include that in your expedite

One potential problem with asking them to stamp your passport is this. They might ask 'why'. And if you then tell them, oh, we have a K1 petition, they might very well deny you entry into the US. They can and apparently often do if they know you are engaged to an American.

In this case, better to rely on secondary evidence. I admit, it's a lot easier for people flying overseas for the K1, they have flights, passport stamps, etc...

You'll have to get creative and get as much as you can.

But I would also think, to a large degree, Canada must be about the easiest place to do the K1 from. I mean, since Canadians can already come and go nearly as they please, not so much reason for a fraudulent petition from a Canadian...


Honestly, I've asked for stamps before and simply answered "just becuase I want stamps in my passpot". Largely it depends on the border agent but by land they are pretty relaxed

Passport stamps aren't necessary, per se, and it is rare that a Canadian will get a stamp, espeically if crossing at a land bridge

now, you do have to prove that you've met in the last 2 years, what else do you have? Hotel receipts?

If you don't have any other proof (pictures aren't good proof) then ask next time you cross to have them stamp your passport, if asked why, tell them the truth

I can't afford a lawyer at this point, so we're looking at doing this on our own. I just want to make sure I don't screw anything up and take the best route possible.

He surrendered this GC, meaning that route (using his old one) is gone. He abandoned his residency and lost that route. He can absolulty reapply, now it will be through you

However, he needs his divorce decree before you can do anything as that needs to be submitted.

K-1 is good, but we opted for the spousal visa.

Canadians are special beasts when it comes to visiting the US. USCIS (and NVC when it comes to listing all your vistis to the US) understands this.

You still have to show proof that you've physically met in the past 2 years. I would include a letter stating how often your bf visits even though he only has 1 passport stamp

Agreed with the above posters that he should not need a waiver, will need to travel back to the UK (he needs a medical there too so he should leave before his interview for the medical and police certificate if necessary)

Although it has happened, it is rare that he'll be denied at the POE and he shouldn't worry about that as long as he is truthful at his interview about his overstay.

I honestly wouldn't push it and piss anyone off, leave as soon as possible

I did not change my last name. In this day and age a good majority of women keep their last names. I am married to a Muslim and in his culture women do not change their last names when they marry, they keep their family name. I don't think it proves that you love him any more or any less(my love or my husband is immeasurable). The proof is in your relationship not in a name. You need to find out the reason for his case being sent back and I think I can safely say it wasn't because you don't share the same last name. I really wish you the best.

I-95? It's an interstate along the East Coast

I think you mean the I-94. Now, Canadians rarely get this but everyone else will when they travel to the US as tourists. It is an 'entry and departure record' which is exactly that, a record of your entry and departure in the US. When you cross over on your K-1 you will get one as the K-1 visa itself will be void once you cross and your I94 will be marked for 30 days - your legal stay in the US. This is what I think you'll need

Read the guides and see what visa is best for you. You need to figure out what is most important to you. Some do not want to be separated after marriage so they go for the K-1. Some, like myself, needed to be able to work and travel once I entered the US so we went for the spuosal visa. Cost was also a factor for us, the Cr-1 significantly cheaper, but that doesn't matter to some

In some instances, apparently, some petitions are approved quickly if the USC sponsor is residing abroad with spouse. Maybe you hit the auto-expedite queue everyone seems to be talking about in the IR-1/CR-1 section. If your USC spouse doesn't reside abroad with you, then what a blessing! Congrats! Well, hopefully congrats! Sounds like things are going to work out for you faster than you originally thought! A blessing either way!

Don't forget to add additional fees if there are children involved. My fiance petitioned for my and my two children. We are looking close to $6000 in fees and expenses just to get past the AOS. :blink:

Im not really good at answering things like this but ill try. From what i read in other posts the fees have changed. Im not sure if the fees have changed for everywhere or just for certain countries. Try calling the consulate where you need to send your documents they should be able to tell you the exact amount. :thumbs:

We are more than likely going to need to use another family member, and as I understand the co-sponsor needs to be a U.S. citizen.

Is there any specific guidelines for this? Or do we just have a member of his family submit a supplemental affidavit as well as his?

It will be about 9-10 months ish before you will be issued the visa and able to return to the USA to live.
