lol. Don't worry. No one is going to accuse you of committing a crime. As long as the letter is readable, you should be okay. Also, they will already know you are coming because they set up your interview. So they'll know that you are there for the interview.

my employers been paying through personal checks, for the new job i started this month and i need to send my fiancee pay stubs. As far as im concerned a personal check or money order isn't a pay stub so do i still make copies of the checks that only have my employers name and send that to my fiancee, or will my notarized bank statement be fine?

I'd send as much proof as possible. Yes send copies of checks, money orders, bank statements, etc.. Consider asking for an employment verification letter, too (or make one up and get your employer to sign it).

I received my NOA1 and was trying to check my status. My receipt number which starts with EAC########## is invalid. Has anybody ever experienced this before?

Weird. Did you try it multiple times? You may need to jsut call into USCIS to let them know you're having these issues. Maybe you have the wrong number. Maybe they just didn't update the system.

Your fiance did the correct thing. The DS-230 Part II is ONLY for spouses. As a K1 you have to got the SSA.

**Edit - it's not needed to apply for a marriage license. A lot of sites mention it, but once you go in person they'll tell you the passport/birth cert is enough. That's how foreigners can get married here.

To the best of my knowledge SS cards are not generated automatically. Immigration has a database that SS accesses after the K1 enters the country, but you still need to apply in person and fill out a short form.

Why does it state that you can request one in question 43 of the DS-230, then?

Hello all!

Need some advice...

My Fiance had his interview for the K-1 Visa in Madrid. It was approved. Yay!

But he said he did not have to complete Part II of form DS-230. I wanted him to complete Part II questions 43A and 43B, so that the Social Security Admin(SSA) would automatically be notified of his approved K-1 Visa and he would receive a Social Security card(SScard) within 3 weeks of arriving here. <<details on SSA website - this site wouldn't allow me to post the direct link>>


Has anyone else experienced this? Can he mail in Part II or complete the online version (DS-260) so that he will automatically receive his SScard?

I am nervous about timing... waiting for a SScard so that we can get married and then filling for an Adjustment of Status. Eek!

No one is saying that it's not possible. They are just saying that it's not usual.

However, if I were to vote, I'd say either it did happen, or that the fiance is lying. Doesn't seem likely that someone pranked him.

Hello there.

The wait is already god damn long enough and my fiance and I have decided that we don't want to lose time after we are approved so we can get to the consulate as soon as possible, get the visa and go back home (because i have lived in the US for over 3 years before filling so I am very upset at the whole procedure)

So i need your help in order to know what to do and what to get for the interview.
I know there is a medical to schedule. Can i schedule it now before NOA 2? Where can i find a list of civil surgeon?
From what i have read i know there is an affidavit of support, how do i get the form? where to send it? what do i include with it (pay stubs, tax return etc...)

Also we need police reports, i know how to get one in my country but since i have lived in the US i guess i need one from there too. How can i get one while I am away from the country? That doesn't make much sense for me. Also for USC, how does my fiance get his?

Is there anything i forgot? (besides proving our relationship is bona fide which i won't have a hard time proving)

Also, is the consulate going to contact me for an appointment or do i contact them? How does it go after NOA 2?

Just call USCIS and they should be able to look up your file by the info you sent to them. They'll give you your receipt number.

Hey so I'm in the process of the k-1 fiance visa currently waitin for noa2.
I realize I have to meet 125% of the federal poverty guidelines to sponsor my fiance. I got hired as a server today and my question is do the tips I report count as normal income to determine if I meet the 125% of the federal poverty guidelines?
I don't know if that's the correct place to ask. Hope anyone can help!!

I think tips count as long as you can prove that you are receiving them AND as long as you report them on your taxes at the end of the year.

I had printed out my phone records on rebtel in preparation for my interview but this rebtel records dont have my number it shows my names i have two phones my fiancee reach me on and she stored my name differently some of them shows just my full name some shows my initial some shows the numbers but the ones with just my name and not the number are where we have more of our call records on rebtel please will this be a problem? do they want to see just the phone numbers?

You can just explain all of this in a cover letter to your phone records. I don't think it will be a problem.

I petioned for my then fiance, now husband to to come to the States in November 2006. When I moved to Senegal to be with him in 2009, I was told that the application was reapproved for processing. I never received any information/letters from them since. I called last week to find out the status of the petition and I was told that it "expired". When I questioned it, I was told that they had no other information and to call Department of State. I called Department of State and was told to call USCIS. I called USCIS and was told to call NVC. No one can give me any other information besides it being "expired". Can someone please help me to understand what is going on? Also, please offer any advice. Thank you.

I think you'll need to resubmit for an I-130 petition. The fiance visa is an I-129F. So it wouldn't be feasible now anyways. You should look into applying for the I-130. They are being approved quickly through NBC right now. Perhaps that's a consolation. Sorry to hear you're going through this. Did you update your address with them since you moved? Why did you never submit a service request?

There has been a petition created to hire more workers for the VSC and there are only 43 signiturare so far. We need many more before January 21 2013 but it is worth a try and it just takes a minute. It was started because the VAWA (violence against women) petitions are so far behind, so it is for a good cause. No matter what type of visa you are filing for it is beneficial to all if Vermont had more workers. Please check it out, thanks.

I recieved my NOA2 today by text and email! I was so excited to read it that I kept rereading it thinking i was seeing things! July filer at VSC. Finally this is one step closer for my fiance and me to be together and for him to see his baby boy for the first time. Skype is a godsend but can only substitute so much.

Today I received a call from a attorney who is following our K1 visa case and stated that he recived an email that requesting additional 2 passport photos for me (Beneficiary)!! We've been waiting 5 months at USCIS and fter such a long time asking Photos??
hopefully someone can give me some insight. :cry:


They probably lost them or the original ones you sent weren't adequate. It sounds like a RFE to me. Just get them to your lawyer asap. The quicker you get them to him the quicker you'll be approved. Should only take 15 mins at a photographer.

***disclaimer*** I feel like I wrote a post similar to this a while back but I could not find it in my post history...so I'm posting again...

so with the NOA2 date supposedly coming in about 2 weeks or so, and my fiancé (and friends, and co workers, and family...) are trying to figure out how long after NOA2 and the interview could take if we had everything ready to go when she was sent the package. We are going through Madrid, and I believe that they have one of the shortest interview wait times or turnaround times or whatever...

She has her birth certificate with apostle from Colombia (she was born and raised in Colombia until she was 14) but it is about 3-4 months old at this point. I'm not sure how long it is valid, although i would think an official birth certificate shouldn't expire! haha...

She is going to get her police certificate done soon. If their validity is good for more than a few months she'll go ahead and get it this week (I think it takes 2 weeks to obtain it).

So what else can she do to get ready? Can she go ahead and fill out some of the forms, or do they send them in the packet to fill out? If she sends back the packet the next day after receiving it, how long or short of a wait could we be looking at? I'm optimistically telling her late march, but I really have no idea

So we have our package all put together, duplicated and ready to send off to begin the process, but just before we do that, I have a couple of questions I want to be sure on before we mail it off.

1: The photo of me (beneficiary) were taken using a UK Photo booth and are the regulated passport style size for the UK. I know American passport photos however are in a slightly different format/size. Will my UK passport photo be acceptable or will I need to send one in the American size? I had a couple taken just as a back-up when I was last visiting. My fiancee's (petitioner) photo is in the American format, just to clarify.

2: My passport photo, along with the forms I have filled out, were signed and dated some time ago, August 2012, along with the forms the petitioner has filled out. Will that prove to be a problem sending them off now? My circumstances and hers have not changed at all since filling them out originally.

1) You'll need to send photos in American sized as the instructions are for an American visa.

I don't think your issue here is going to be proof of meeting... I think your issue is more of proof of domicile. You have lived in Canada (legally or otherwise for 3 years). When they ask you on the I-129F petition what your current address is, what do you plan to put? Because technically your current address is in BC right now... not your grandmother's house in USA.

If they find out you lied on your petition, it's bad news all the way around.

The above petition has been approved, and forwarded to the listed consulate. It has been noted this is your second approved I-129F petition and as such, your information has been entered in a multiple visa petition tracking database.

Ok, my question is . . are they saying that I have applied before for a K-1 visa and was approved? This is my first time going through this procedure . . . should I contact the California Service Center and advise them of this or leave it alone? Thanks for your advise.


OMG, my fiance got ours on Friday and it says the same thing - yet he has never filed for an I129F before. Our petition went through Vermont.

We were wondering if it was because we included my children on the petition. However, their names are not listed on either the NOA1 or NOA2. (This is worrisome to me :huh: ).

I was under the understanding that it was one(1) I129F for me and the two kids, and then three (3) separate visa applications at the consulate stage.

Also, it says that the petition has been approved and forwarded to the listed consulate. However, there is no consulate listed anywhere on the I-797. :unsure:

My fiance (the USC)will be calling them on Monday, but any thoughts, anyone?

Thank you for all the answers! We know it's going to be a long and hard process. It helps having forum to hear everyone's stories and know we are not alone. Just to clarify, we were more curious as to effects of getting a congressman involved if it takes too long. We've seen there are a lot delays right now.


The Vermont Center is showing avg processing time of 6 months now. Honestly, I would wait and if they get past that time with your case, then call and ask for a service request. When my fiance called and asked for a service request (after our RFE), they processed our NOA2 within 5 days.

It is because you are at 7 months... which is outside of processing times. Nothing can be done one month into the process.

We had to wait almost 8 months for our NOA2 from Vermont. Might as well settle in and wait like everyone else. We got our congressman's office involved only after they were outside "normal processing times". It did not speed up our process in any way. I am in Canada, also a relatively easy Country... and it looks like it will be about a year before I can POE.

Just an update...

We got the RFE in the mail on Saturday. And thanks to all your advice, I was able to submit the response today (Monday). I included:

* A timeline with key dates in our relationship
* A color screen shot of each of our profile pages in Filipino Cupid
* A little write-up about each of our important dates. (All in all it was about 1.5 pages)
* Many more photographs than I had in the original petition (41 pics now, only 19 in the original) grouped by day and a short description

I also resent the following stuff from the original petition just in case they were "misplaced" by USCIS
* Resent copy of the flight itinerary/receipt
* Resent copy of the boarding passes
* Resent copy of passport with entry and exit stamps
* Resent copy of receipts from our activities while I was there

SO......Let's see if that passes muster. Hope so! Wish us luck :-)

The way I read this is they want to know how you met... how did the relationship start before you physically met her in person? You have given proof that you actually did meet... but how did the meeting come about?

I did this with no problems. I took them to Staples and photocopied them on plain white paper. No RFE, no issues.

I just realised something and I am wondering if this might have anything to do with it.


A couple of weeks ago I went to Social Security to file for a SSN. When I had all my documents the clerk at the window advised that USCIS had my name down wrong (they search the system with your I-94 to validate)

They had my first name as [First Name Middle Name] at USCIS instead of [First Name] [Middle Name] if that makes sense. The clerk advised me that he would submit information to the USCIS for them to correct my name.

Do you think this might have something to do with it? Though I did get my SSN 2 weeks after that with no problem.

It shouldn't. My name was entered that way too. Just caused a hassle when I got my SSN. They just sent my info to DHS and it got resolved.

With the CR1, (feel free to correct me if I'm wrong anyone) I believe you can marry whereever/whenever you want, and then when you are ready to live in the US (say, like in 6-8 months ready) you file for that visa as it is for a spouse of a US cit. That way, since you'll be in Korea and whatnot for however long, you can plan your wedding without waiting for USCIS to do your paperwork! Its less stressful i think if you can just plan your wedding, get married, and get on with life. :) check out the visa guides for a run-down of each one. more info there than i can give you, as I was a K-1.

ONly if you enter the US and get married and try to adjust your status. Of course, if you tell customs your purpose of travel is to get married, they may not let you in :o I would think either route would be ok for you. BUt if you want to get married sooner rather than later, I would go the CR1 route as opposed to K-1. Then you can just file when you are ready to live in the US, and won't have to worry about Adjusting your status and such. This is what I would do if it were me, just so i could better plan my wedding, and carry on with life. Since you'll be in Korea anyway, being outside the US while you wait doesn't seem like an issue. I'm not the authority on CR1 and if its less of a pain in the @$$ than K-1 but that's what I'd do. :) good luck to you!

I was the beneficiary and when I came to that question, I put in my current address (that is, the address I was living at in Canada at the time) and I put the date from when I moved into that house for "From", and filled in "Present" for the "To" section. If I remember right, I chose to attach a separate page for it. Make sure you adhere to USCIS's attachment conventions if you attach a separate page.

The G-325A is a standard form that USCIS uses for a lot of petitions--not just K1, so it has a few questions in there that seem like they don't make much sense for your case.

Are you planning on using your continuing income or your assets to sponsor your fiance? If you meet the minimum requirements with your two jobs then there is no need to fuss with your assets like the money you have in your bank account.

If you do need to use assets because your jobs do not meet the minimum requirement then I believe, you will need 3 times the difference between the your income and 125% of the poverty level for the household size. So for example, let's say Joe makes $12,000 a year, has no substantial assets otherwise and wants to sponsor his fiance over. Let's also assume the poverty level income is set at $18,912 for a family of 2 (Joe and his fiance).

You'll need to subtract Joe's income ($12,000) with the poverty level income ($18,912) to get $6,912. Then take $6,912 and multiply that by 3 to get $20,736--which is approximately the minimum that Joe must have in his bank account.

Keep in mind that as soon as you introduce assets into the affidavit to try and prove eligibility, you will have to provide a lot of paperwork to prove that you actually own those assets. Finally, money in the bank is kind of iffy to some consulates because people sometimes just borrow some money from friends or family to put into their account and make it look big for USCIS then return the money once they get what they want. Or they have a lot of money in the bank one month and then have to pay a ton of bills and end up with no money the next month. So money in the bank isn't the best evidence to provide anyway.

My fiance (now husband) and I did it all ourselves. We thought we would have to hire an attorney, but then I discovered this website and we went through everything with ease. Seriously, I owe so much to Visajourney and the awesome people who helped us get this far. We also did AOS ourselves and plan to do everything including the citizenship ourselves. Hiring an attorney will not make anything easier or faster because no attorney has more sway with USCIS than you, yourself, to get things moving. You would only need an attorney if your case is complicated, like one of you has a criminal background. Otherwise, save your money for the wedding or a plane ticket to see your fiance! :-)
