I'm sorry, maybe I am confused, why is it an issue for you to attend graduate school or move to PR? You are a US citizen, why shouldn't your fiance mention it?

The issue will be financials, if you cannot prove you make above the requirements then you'll need a cosponsor.

Secondly, the second adjustment of status is not an adjustement of status. It is a removal of conditions and read up on that process

Could you provide me with more details about how you believe you the USC moving to PR to attend graduate school (aside from $$$) will be an issue?

Since, as you say, the residency requirement does not apply, then you could file for the fiance visa now. Just make sure you state clearly that you will be interviewing in the consulate abraod.

She'll need to travel with ties to Japan and entrance and duration of stay is never a guarentee

280 is conservative, many make it through in 7-8 months.

thanks for all the input, At this point i was told to see a congressmen and see if they can look into it and find out what the OC really thought. Since the visa hasn't expire yet i might be able to get some kind of response by then. I might have to just go back again and do the CR1 and what is this DCF does that mean i go live there for 6 months? Will that work 100%? If me going to live there for 6 months will work 100% i will do that. I would end up losing my job but i can use family member for affidavit of support if that way work. I'm still not even sure what i have to do i'm just so depress about it still. thanks all


Nothing is 100% and expect your spousal visa, if you go that route, to be scrutinized a little more after your K-1 denial

And you must be a legal RESIDENT of the country for 6 months, not simply a visitor on a tourist visa. And I'm not even sure if DCF is available

Yes, there is a HUGE risk! Do NOT get married until you are in the US. Not even a traditional one or one without paperwork. Just dont' risk it. You signed documents that said you would marry in the US...so get married in the US.

As for traveling from the UK to our home country, I don't see why not, just as long as you don't conect through a US city

First of all, it hasn't been INS for a long time, it is now USCIS

while you were in the US, did YOU file taxes? I think that might be an issue and you should ensure you do that.

There shouldn't be a problem with your new fiance visa as long as you are free to marry (apears that you are) but expect the previous relationship and green card to come up

USCIS won't speed up your petition and I doubt the UK consulate will, but once your petition reaches London, you can always call.

That being the case, please look into the CRBA for your child if your husband meets the residency requirements. Your child will need a US passport to travel and that can take a few months.

First of all, it is a VERY long letter which is full of colloquialism (such as you saving "like" $400). And in parts it sounds defensive (defend her honour). And speculative (teach her a lesson). You weren't even there, I assume, so why are YOU writing this letter? If you really want to send it, shorten it up and make it a much more formal letter.

Secondly, why do you need this letter? I was denied entry twice (in a VERY short amount of time). Was it a simple denial of entry (as in was anything written in her passport?). If it was, it won't even have an impact on her K-1 visa, so why the lengthy letter?

I am sorry this happened, I know how humiliating it is to have it happen.

Good point. Mine's purely religious in nature. I could probably explain it to the officer at the interview. When I studied the doctrine of the Trinity in some theology courses I took, I decided to get it because I used to be a modalist and eventually came to believe that the New Testament taught trinitarianism. Now that I think about it, that really makes it sound more nerdy than what I intended.

Whatever. My friend gave me the tattoo. If anyone would have known if it could be misconstrued, it would have been him and he wouldn't have done it.

lol. Don't worry. No one is going to accuse you of committing a crime. As long as the letter is readable, you should be okay. Also, they will already know you are coming because they set up your interview. So they'll know that you are there for the interview.
