I posted this in the correct forum-but to no avail and I know folks peruse this one as well so maybe someone here will know this. I wanted to mail out today but I'll have to wait till Monday for this one.
Hey all, quick question here.

I am filling out my AP to go back to Canada to visit family whenever over the next 2 years, but we may take a vacation to Mexico next year.
Do I need to add Mexico somewhere in my application?? Or, is AP just for anywhere??
Does it specify the country on the AP??
I have filled it out only to reflect Canada, but Mexico is just a maybe and I want to cover my bases.
Should I be putting Mexico anywhere on the application?? Or can I just use my AP when I get it and go to Mexico?

I came across the same problem when listing my visits. I listed all the ones I could remember on a separate piece of paper and I wrote a paraggraph before stating that since the age of 18 I had made many various weekend trips to the US for shopping, etc seeing as I was only 3 hrs from the border.

Hey there, I hope I can help you seeing as I went through Montreal not too long ago.
First off, take a look at my timeline to see when I sent my checklist back and when I got my interview letter.
I'd say 2-3 weeks before you get anything from them. Then once you send your checklist back, give it at least 1 month to hear back for an interview date.

As for filling out your employers, yes you need to be exact. And even if it's a hassle figure it out now while you are in Canada becuase you are going to have to fill out the G325A again during AOS.
Same goes for places you've lived. I think it only asks for the month so try to be as accurate as possible. I spent some time digging around to make sure I was correct and it paid off. I can't tell you how many times I've referred back to it. You never know, you may use it down the road to get a job. And if you don't have a resume, then you can use this to make one!

As for times you've visited the US, this one I did special. I lived near Toronto so I had been going across the border all the time. I added a supplemental page and I listed all the big trips I could remember that had to do with my relationship with my now husband. So, Thanksgiving, Christmas, whatever.
Before my list of trips I wrote a paragraph explaining that due to the close proximity of the border I had been across to the US many times for shopping and day trips etc. I also put that I had recalled to the best of my ability all recent trips. So, add a page, explain first, then give a list. My list looked something like
March 2005- 2 weeks-March Break- Cape Cod
and so on.

As for the visa. You need to bring 100US Cash with you. That's the cost, and you pay it before you get to do anything else, so be sure to get to a bank and have it in hand.
When I went, they don't issue the visa same day. You could have it mailed to you back at home, or you could go back the next day after 2:30pm to pick it up. I opted to have it mailed, and if you do that they will tell you exactly what envelope to buy etc etc in order to have it mailed back to you. This all comes in Packet 3 so don't worry about details.

You make the appointment for your medical yourself. I was in the Toronto area and there were 2 Dr's that did it. I went to a place called Medysis and it was only a few days wait to do it. The medical costs money (about $200).

You will need your case number for your medical so once you are approved get your case number MTLxxxxx (can't remember how many x's) and book your medical.

Also, make sure you have your long form birth certificate. It's like a big piece of paper that shows all your parents' information as well. You will have to have that birth certificate. If you don't have it, mail away for it now because it can take a while.

It depends on where you have lived. If you have only lived in one province you are probably fine. I just posted in the Canada forum about this one.
The RCMP use a database called CPIC. It covers all of Canada. As long as your name is being put through that database you are ok.

If you have had any past convictions or anything else you'll need the fingerprinting etc and I'm not sure about that one.

You can ask your local police department if they give you a records check does it go through CPIC, and if it does you are fine.

Everyone has had different experiences on this one so I can only tell you mine. Every place is different. Check out the Canada forum for more details.

You should list everything that they ask for. As for your previous addresses you should try and recall them to the best of your abiltilty.
Ask family members to help, or try to remember where you were when you worked certain jobs. Sometimes that helps.
You will need to list the places you have lived for the AOS part as well, so I suggest you do the footwork now while you can and get it down on paper, and then it'll be smooth sailing.
Wheny ou send back the DS230 Part1, you also send back the checklist. Make sure you checkmark all the applicable boxes and sign it.

Hey there, I hope I can be of some help here. I'll try my best to answer your questions.

1. Yes, when you receive packet 3 you send back the checklist and DS230 Part 1. You can get a DS230 Part 1 from the Dept. of State and fill it out so you have the form all ready. Note though-Montreal wants you to fill out the form they send you-so make sure you fill out their DS230 Part 1.

The Checklist is just that, it has things like police certificate, long form birth certificate, passport pictures, medical, past divorce decrees, etc etc. They want to make sure you have all the things they will need for the interview before they schedule you one. However, Montreal is a little slow so even if you don't have these documents you can check it all off and send it back, and then go about gathering it all. Just make sure you photocopy the checklist before you send it back!.

2. You can book a medical with just your case #. You don't necessarily need your letter. Some Dr's require it, some don't. Depending on where you are you shouldn't have to wait too long for the medical so don't sweat it.
Same goes for the police report. I didn't have to show them anything!! I just had a good old regular police report done. As long as they are putting your name through the CPIC database you are fine. That's the Canada wide database the RCMP uses. Again, everyone has different experiences and I can only speak for myself. I was in Toronto.

3. Yes- Once they get everything, assuming it's all correct, they put you in queue for an interview date.

4. When you finally go for your interview you will receive your packet 4 and in that it will tell you what all to bring. You need everything you've done so far. Bring it all! And you'll need the originals from the I129F, if you are a K1-er, your approval, and all the stuff from your checklist.

I did a combination of both. Mine was in paragraph form and I put how we first met online, then how we met in person. I then spoke briefly about trips e had both taken and how we had met each others' family. I also included a timeline to the times we had met, or vacationed together.

I kept the letter very formal, not at casual, but I still did it in letter format and like I said, I included a rough timeline with mine.

Looks good to me, just make sure you copy the back of the birth certificate-even if there's nothing on it. This is a weird one, but be sure to do it, ours had a basically blank page with it.

You know based on the online status of your petition. You need to make an account at the USCIS website, put in your receipt number. If the "last updated" date changes, that means someone has "touched" your case.
This often means someone has been looking at your case, although it doesn't guarantee that anything is happening. It's a good predictor though.

March 17, 2006 Received the packet with the checklist of things

Not sure if I have done our timeline correctly.

Gotcha. Well, we're still only thinking of moving, nothing's set in stone yet which is why I haven't started the process. And I don't want to unless I'm sure we'll be moving.

So, OBX, what you're saying is that I can still enter Canada for up to 180 days? Because I have no intention of coming back barring a horrible emergency. Am I right in thinking that I need to get a K3 so that I can wait in the U.S. for my Green Card application to go through? Am I also right in assuming that this could take up to 5 or 6 months?

No because K-3 is no longer processed, you will file a CR-1 spousal visa, thos are interviewed for ONLY in Montreal, Quebec. It will take around 12 months so file NOW.

You wont be waiting in the US till your application comes through but you can visit the US while your petition is pending.

You must have your medical in either Toronto, Vancouver or Montreal.

The USC files the CR-1 in the US. You have the interview in Montreal. You then move to the USA, a few weeks after your green card will arrive in the mail.

If the USC is currently living in Canada, you might qualify for DCF, you would then file in Canada instead of in the US.

How are you moving as soon as this summer but have not started any process yet? being Canadian does not let you just automatically move to the US. If you arrive at the border with no visa and say you are moving they will turn you around and say no you aren't and send you back home.

sorry that happen, thats why we tell petitioner to ALWAYS MAKE TWO OR THREE SETS OF FILES COPIES, for this same reason and don't send orginials send copys. bring originals to the interview to show the io ask for it back to you leave him the copy, he wants to see if it maches togather the same.



Spousal CR-1 /IR-1 are required to send original documents to NVC otherwise yes, always keep copies and you can ask for originals back at the interview.

Have you tried calling the NVC and getting them to request a look into the file further to see if they have the original marriage cert? Could it be that they don't think it is an original?

Being employed or unemployed wont hurt the case or anything, if the forms are correct from the time he filled it out then thats fine as well, He can always do up a new 325 form and bring it to the interview or you can do up a new one and send it to the NVC later on when you send the rest of the paperwork they request during that part of the process.

No it means someone opened your folder or put a paper in it or took something out etc.

A touch is when someone moved your file in some way so that THEY know where it is and it doesn't get lost.

Oh! good then! she can use the SSN and look for a job right away.

When she gets accepted for a job she will need to bring her passport with her when she fills out the I-9 employment form, they will take a photocopy of the passport page with her I-155 stamp and she will fill in her other employment forms and be good to go!

once she gets her green card in the mail she will want to bring it to her employer and have them make a photocopy to put in her files, they will need to update her I-9 as well I believe with the green card evidence. Fairly simple.

( I have to update my I-9 in sept for removal of conditions with my NOA1 then with my new 10yr card )

She needs an SSN that takes about 2 weeks after entery. Her green card 2 weeks or more.

Sometimes the SSN does not arrive 2 weeks after and takes longer - I would suggest you go to the SSN office after waiting 2 weeks and see if you can get her SSN number from them so she can look for work.

Canada you don't get fully naked tho you do have to take your top and bra off(if it has metal wire in it ) for the Xray but they let you put a paper gown on and theres only women in the Xray room.

In the doctors office its paper gown and underwear underneath it because the dr needs to feel your stomach and listen to your heart and lungs.

Nope, there is no fast way.

You want to marry outside of the USA so you will need to marry then file for CR-1 visa which would take about a year. You cant marry and then move to the USA and wait for a visa. You have to wait in your country but you can visit while the process is going on. With the CR-1 you will get a stamp on your passport that you can use to work with until you get the green card in the mail. That is the faster rout to working when you arrive. K-1 has to wait quite a while before they can work and have to marry inside the USA and file AOS after marriage.

THe I129F is filed with the I-130 when one wants to petition for a K3 visa (and there is no cost associated with it). However, since the K-3 visa is no longer a viable option, no it does not speed up the process

In fact, it will slow down your process considerably.

Don't bother yourself with the I129F, it won't do you any good and may slow you down

If you file directly with the consulate, keep in mind that Montreal is EXTREMELY strict on domicile - meaning you have to show how the US citizen has moved already to the US before the interview

You CANNOT move to the US without an immigrant visa. So do not intend to 'live' in the US without proper authorization. Being Canadian menas you have to follow the rules like everyone else.

Don't plan on leaving Canada with no plans to return 'barring a horrible emergency' as it doesn't work like that. You may visit (up to 180 days if allowed) but you must return to Canada. Read what Inky said again, good advice in there

Your best bet would be to file the I-130 and have your spouse wait until he gets the visa to attend school. This is because it will be next to impossible for him to get a non-immigrant visa (such as a student visa) while married to an American and obviously no intentions of returning to his home country. Non-immigrant visas are for people who want to study in the US and then leave, the he would be required to show proof of his intent to return after his studies.

Also, the fees for an international student are MUCH higher than that of a green card holder

You can file for the Cr1 visa as soon as you have your marriage certificate, which can take 6-8 weeks after marriage if you are marrying in Ontario

K-3 is no longer an option and K3 is not a fiance visa

Congrats on the upcoming marriage. Read the guides. Sadly, it seems for a Canadian that the process takes 10 - 14 months. The interview will be in Montreal, the medical can be in either Vancouver, Toronto or Montreal
