if your case is in the mess regardless of NOA1-RFE-Proccessing (dates) they will not look into your case untill you reach a 6 month mark from your NOA1 and then and only then will they do an inquiry of your case.


what does that mean? They won't respond to inquiries until after 6 months have passed?

That sounds like an FU by people who are tired of getting requests. :angry:

I believe that it says directly on the RFE that you should hear something within 60 days. If not to contact USCIS



and then when you call them, they will tell you not to bug them until it is 6 months from your NOA1 date....

I have to say that personally, I've given up for now. I can't see approval happening for me in the next few days, and after that my USC is on the road for 5 weeks so he won't be able to deal with any RFEs that may come in, nor will he be able to get the affidavit done and signed and that other form too... it is all looking very unlikely for us until he returns at the end of Spetember, so ... yeah, whatever.

Hey folks, although I was not affected by this IMBRA thing, as you can see by my timeline, I just want to let you know that I feel for you. This process is a huge task from the get go and I just want to give you all a vote of confidence to let you know that you can do it. You can hold out, you can wait, it can be done.

And to let you know that there are so many of us that read your posts every day, even if it doesn't affect us. I don't respond personally but I read-boy do I read.

If there's one thing I've learned-it's patience. I don't like it, but I've learned it. ha.

Anywho, I just wanted to give you all a big giant hug from me to let you know there are lots of people out here who read your posts about the IMBRA, RFE's, everything....and I for one think everyone deserves a congratulatory nod (or drink) for making it thus far!!!

I'm also from Toronto, hubby (we are married with an I130 mailed) lives in Orlando. Mine's a little different since I actually need to travel to Florida for business since my company has an office there. I have a flight out on Saturday to Orlando. Technically I'm going on business, but I've tacked on a week to stay with my hubby. What do I tell immigration? I don't want to lie, but I definately can't be denied access for any reason... My job would suffer if that were the case...

Looking forward to hearing the answer on this one as I fly out on Saturday at 10am :dance:

Hello,

I am not sure where to find info in Arabic but maybe someone else will.

I would also suggest getting married and then filing a petition for your spouse to live in America which is an I-130. Once you receive a notice NOA1 that they received your application which normally takes a month or so then you can apply for a K3 visa. Once your husband is in the states on a K3 visa he can apply to adjust his status to a permanent resident using the I-485 form and a few others. The good thing about a K3 visa is it usually is the quickest way to get to the states legally and you can enter and leave the country as long as the visa is valid (2 years) so he could still visit home.

I think it's a good idea to look at the walk throughs and helpful hints at the top of the forums. I personally used the K3 and the Adjustment of status one to help me out.

Also have a look at the timelines section. You can filter out the embassy section to get an idea of how long K visas take in your husbands area.

I don't understand what you mean by non civil. Does that mean you will just have the ceremony for family but not actually sign any legal papers? If that is the case then yes you can file for K1 and then marry in the US in the June timeframe if your timeline goes on plan. You can not be married in Mexico legally and then file for K1 since that is a fiance visa with the intention of you marrying in the US.

Going to the states with a K1 visa in process could be a problem but not necessarily. I used to cross into the US from Canada alot while I had my K3 in the process. Just be honest with the crossing guard and have proof that you are filing paperwork and that you will be returning to Mexico.

I traveled several times during the process. Just always be honest and bring plenty of proof that he/you will return home after the visit. IE letter from employer, mortgage, lanlord statement, etc...
