K-1 Fiance(e) Visa Process & ProceduresMiscarriage/spontaneous abortion from the past can affect interview??
Abortion is legal in the United States

You will not fail because of terminology the doctor used

Good luck

PS - I suggest telling your fiance about your miscarriage. Failure to do so can create havoc in your 'new life'.

K-1 Fiance(e) Visa Process & Proceduresjust curious what the purpose of copying the package is
If you get an RFE you can see exactly what was sent so you can fix it before the hardcopy letter arrives

If the beneficiary travels it is good to bring a copy to show that it has been filed

K-1 Fiance(e) Visa Process & ProceduresCan you enter using Visa Waiver even when you have your K-1 issued?
The only real way to know for sure is for her to board a flight and attempt to cross using her VWP instead of her K-1. If refused...then what? Will she chose to return to Korea or will she choose to enter on her K-1, thus ruining your trip to Canada

Play this safe, postpone your trip to Canada

K-1 Fiance(e) Visa Process & ProceduresWorst Case Scenario
To answer your question, if you are denied you must address the issues and reasons of the denial before you move forward. Sending another peition or marrying does not erase the reasons for the denial.

They probably won't outright deny you for financials, they will ask you to provide more information and delay your case

First thing you need to do is tell your fiance, because with the documents you have, he'll find out anyway

2nd, you probably need to submit the death certificate AND the annullment papers.

You need to change that on the petition as well, you must NEVER lie on anything on the papers

How long ago was it? how much drugs was it and what type of drugs?

Guns and drugs are big no nos in US immigration. Marijuana is weighted differently than, say, heroine or cocaine.

K-1 Fiance(e) Visa Process & ProceduresAfter the interview, do they take your passport to process the visa?

When you post here, it does also post in the Canada Portal as well, from what I've seen when I post. :)

No, it does not

OP - it SHOULD take a few days, but it may not. Vancouver could be backlogged or, like a case in Montreal, the beneficiary had to go back and do the fingerprints again.

Now, you want your passport back, with the visa inside, then go for a visit, then come back to Canada, THEN enter using your K-1? If this is the case, I'd rethink your plan. It will be up to the CBP if you are permitted to enter before activating your K1, if not, then you will not be permitted to enter as a tourist

K-1 Fiance(e) Visa Process & ProceduresNeed help with K1

I have a job, finances are fine. What I wanted was advice for proof of relationship. Thanks anyways.

The only 2 consulates that deal with these sorts of visas are Vancouver and Montreal for K visas and ONLY montreal for spousal visas. So if you were planning on getting married, you would HAVE to go Montreal. And montreal is strict about domicile so if you got married, you'd probably have to separate.

You've been living in Canada for 3 years, i wouldn't lie about that. You mention a visa, do you have a visa? Is your passport stamped? Do you have pictures?

K-1 Fiance(e) Visa Process & ProceduresNeed help with K1
How long have you been in Canada? What province are you in?

My husband got all our documents to get married, all he needed was a passport

Regardless, file for the K-1. Separation is to be expected. If you are 'very much in love' a few weeks apart won't matter too much will it?

You need to list all the information correctly, if you are living in Canada, you need to list that. Failure to do so could complicate your case

You do not have sufficient proof of domicile for Montreal - please visit the pinned topic in the Canada forum. This is a major issue for Canadians

Do you think that it would be advisable to hire an immigration attorney in my home state or hire one in the philippines? By chance would you know how long does it take on average in order to an annulment?

Consult Laurel Scott. She offers free chats on Wednesdays.

I'd hire qualifed US immigration attorney, who specializes in inadmissability - like Laurel

This process will not be easy for cheap for you. FYI

K-1 Fiance(e) Visa Process & ProceduresK-1 visa problems
She was fingerprinted to get her first visa. She'll be fingerprinted again and then the jig is up. They'll know

They'll know she got a fake CENOMAR and they may find her guilty of misrepresentation for immigration purposes. Which is a lifetime ban from the US. Before they even ask her a question - the deal is done

So I'm not sure why you say you dont' know what to do. I'd pull the peititon and refile, with the help of a qualified immigration attorney

First things first, drop the K3 from your vocabulary. It's been obsolete for the past 2 years. Although technically on the USCIS books, NVC will close it.

Secondly, for your situation, having him return to France after the marriage, a Cr-1 spousal visa is for you. Perfectly legal to come to the US, marry, then leave

K-1 is a visa, it is void the second he enters the US as it is a single entry visa

i send the first one in dececmber 2009 and now reapplied in march 2012 in different state

Since immigration is federal, does it matter what the state he lives in recognizes in terms of marriage? Just question as I am curious. You can move to a state that recognizes same-sex marriage, doesn't mean USCIS will approve the petition.

Anyway, OP - how closely are you two cousins? 1st? or like 6th twice removed?

Being from the UK it is unlikely that you will be in AP for 5 years.

K-1 Fiance(e) Visa Process & ProceduresINQUIRY K1

If i am denied my right to have a visa and marry my fiance, is there a law that the consulate will have broken? and if possible is it ok to take them to courts of laws in the USA and compensate for the stress and the long wait they have placed on our happiness?

You do not have a right to a visa. No one is stopping you from marrying your fiance. The consulate will have broken no laws if you are denied.

No, you cannot take them to court for decisions YOU made. If you didn't want to wait long, then your fiance should move to your country. USCIS is not concerned about YOUR happiness.

Not to sound cruel, but the US government doesn't owe you anything and you have no right to anything regarding immigration

Will it count? USCIS does not have a minimum for knowing each other before you file. You are required to have met in person in the last 2 years, not know each other for 2 years. Do you understand the difference?

K-1 Fiance(e) Visa Process & ProceduresVisiting???
Filing the I129F, when worded correctly, is actually ties to Canada so you should absolutly mention it. As in "We've filed the I129F fiance visa packet and I plan to return to canada for my immigration medical and interview"

Yes, bring any ties you can, visiting is a privledge, not a right, so anytime you can make your crossing easier, you should. You want to plan for everything and hope you don't need any of it.

The letter from your employer is also a great tie

I once crossed and was asked to produce ties to Canada. I had nothing prepared but managed to find a dr. apt card in my wallet. I said "well, I have a Dr. apt in 2 weeks" the BP agent asked how that was a tie to Canada, I said it was socialized medicine, why would i go to the US pay for it if I can get it done for free. He laughed and admitted me without issue

K-1 Fiance(e) Visa Process & ProceduresConsidering Grad School during K-1 visa process
I'm sorry, maybe I am confused, why is it an issue for you to attend graduate school or move to PR? You are a US citizen, why shouldn't your fiance mention it?

The issue will be financials, if you cannot prove you make above the requirements then you'll need a cosponsor.

Secondly, the second adjustment of status is not an adjustement of status. It is a removal of conditions and read up on that process

Could you provide me with more details about how you believe you the USC moving to PR to attend graduate school (aside from $$$) will be an issue?

good luck
