K-1 Fiance(e) Visa Process & ProceduresI-94 Arrival/Departure Record Number

I-94 arrival/departure document will be given to all people entering the USA... either a visitor/immigrant... even your fiance is from Canada.

Before the airplane landing, all passengers will be given a small sheet of paper to fill out, and that's the I-94. She will then be interviewed by the Immigration Officer and will stamp his/her passport and I-94 will be attached to his/her passport.

Not necessarily. Canadians are not required to show a passport when entering the USA. The only time I showed my passport was when I moved to the USA, on all other visits I used other identification. The only time I was given an I-94 was when I moved.

nickypeas, where are you in the process? Have you filed for the K-1 yet or are you at the AOS stage?

Are you asking about question 12 on the I-129F? If she wasn't given an I-94 when entering the USA, put "none" as your answer. If she was given one it would be attached in her passport.

An RFE is not necessarily IMBRA related, it could be for a myriad of other reasons. Please check the pinned thread at the top of this section for examples.

K-1 Fiance(e) Visa Process & ProceduresCongressional Inquiry

All I can say is that the more people who want to post here and say "have patience" or something similar the more I want to puke. Everytime I get that advice it seems to come from someone who's spouse or fiancee has been in the country for months or even years. If you got caught up in this IMBRA mess and want to tell me to have patience fine I'll accept that. If not I won't accept it. I had one congressional inquiry when the whole IMBRA thing popped up and now I have one more. I guees some of you may think that is 2 too many. I disagree. ;) Some people here seem to think we should accept that USICS is screwed up and all we can do is just sit and wait. There is a time for patience and a time for action. If no one ever speaks up (congressional inquiry) nothing will ever change.

We tell you to "have patience" because some of us have already gone through a similar lengthy wait.

For some yes, IMBRA has been a mess but there have been other 'fiascos' and I'm sure there will be more. Last year the CSC came to a screaching halt for approx 4 months for no apparent or posted reason. Check the archived AILA posted processing dates from April - October 2005.

Also keep in mind that it may not get any easier or faster either, there are wait times of 2 months - over a year just for an interview based on where you have to go, and all you can do is wait it out.

Vent all you want, that's why we're here :) but try to think of the end result. You also have a lot of planning to do for when your SO arrives and your AOS stage, maybe that can help keep your mind occupied.

Yes, but it could be considered immigration fraud if she entered the US on a tourist VISA with the intent to marry.

 You can marry on a tourist Visa.

fewquestions, your friend better do his homework about the immigration process.

K-1 Fiance(e) Visa Process & ProceduresHelp please...last minute change

We have known each other a year. I did not agree to marry him until June. I was given the choice where I wanted to live...in Morocco or in the US. As I am an only child and the only grandchild that grew up near my grandparents (they are getting older and are ill) I picked living here at least as long as my grandparents are alive. I have chat logs from June until now saved. I doubt after reading then anyone can doubt that there is a relationship there. I could be wrong though...Plus there are letters and the relationship that I have with his family there and here. My relationship with his family is one of the reasons we are as we are. Between our families and our religion that is what brought us together. I don't know how you explain that to someone, or show someone on paper that. And I guess I didn't expect someone here to think he had bad intentions toward me. The funny thing is he says he will wait however long he has to wait for us to be a family. I cry because my daughter woke up crying the other night thinking he would never come. So it is me that is more concerned with how quickly he will get here.

Dawnnette

Have you met him in person at least once within the last 2 years? You cannot file for a K1 without doing that.

With the exception of Halifax*, if you fly from Canada you will clear customs and immigration in Canada so JFK will not be your POE. Further entering from Canada POE information can be found in the Canada thread in the Regional section of VJ (towards the bottom of the main forum page).

*Halifax might've changed and finally become a clearance airport.

If she wants to go home, let her. If it was meant to be you can start all over again.

K-1 Fiance(e) Visa Process & ProceduresFirst post... Canadian/American, police checks, etc.
I'm new here, but I have SO many questions. I've been researching this stuff for awhile, but sometimes, I still get a little confused. I'm really eager to hear/read about all of your experiences.

My fiancé is an American citizen and I'm a Canadian citizen. We agreed about a month ago that it was time to get married, so we finally started doing some serious research on the visa, so I can come to the States and marry him, and live there with him. He filled in the I-129 petition and the G-325A forms, and I just filled mine in and they're going to be mailed to him today by express post.

I'm curious what your experiences have been with visiting after the petition has been received by the USCIS? Reason being, I have a flight to the States on March 17, but we want to send the petition as soon as possible. If he sends the petition as soon as he receives my signed forms, and they receive and approve it before March 17, will this cause any problems for me entering the U.S.? He talked with someone from the 1-800 number on the form, from USCIS, and he said it would be fine as long as I went back to Canada for the interview...but I seem to be hearing mixed messages (ie., some people say it will cause problems for me to visit...others say it won't.) Thoughts?

Also, for those of you who got or are obtaining a police check, how long did it take to obtain? I contacted the RCMP and they said that currently for a fingerprint based police check the processing time is in excess of 120 days. Which I think means I should get it as soon as possible, because it sounds like it will take almost as much time to get the police check as it will the visa! Any fellow Canadian/American K1 couples out there? I'd love to talk with you through email, AIM, msn, googletalk, LiveJournal, whatever! :)

K-1 Fiance(e) Visa Process & ProceduresWhat do I say??

Did you travel here on a one-way ticket? I'm so confused

Hehe.. I was confused at first too but then I think I figured it out!! I think she's saying she came to the States [she DID come on a round trip ticket] but decided to stay longer, but she booked a flight from the States to England and BACK, so she's asking how she should answer if they ask about her ticket at the airport in customs. And the reason she got the return flight is because it's much cheaper to get a round trip then to get a one way to England and then a one way back to the States if she's approved for her visa and gets it in March. ;)

Hope that helps!

K-1 Fiance(e) Visa Process & ProceduresWhat do I say??
Just tell them the truth if they ask, and specify that you have your interview on March 13th. :)

I did something similar, except it was a bus ticket and not a plane ticket. I went to visit my fiancé in October, and he came to Canada with me in November. I went back with him when he went back after staying in Canada for a week, and then I returned again to Canada in December. Both of my bus tickets were round trip, but one of them was round trip from the States to Canada and back. I got that cause it was a lot cheaper. I was afraid they might say something about that or find it suspicious, but they didn't say anything.

K-1 Fiance(e) Visa Process & ProceduresG-325A for K1

A copy signature would work? can she scan and email her signature and I'll just paste it in the form? any thought guys?

No, I don't think that would work. :(

K-1 Fiance(e) Visa Process & ProceduresG-325A for K1

I'm in the process of filling out I-129F packet, and notice that the G-325A from my fiance needed to sign with her signature. Is it required to sign by her now? I searched at USCIS and it's not required to sign by her yet. Please give me some info.

http://www.uscis.gov...325A_110105.pdf

My fiancé called the USCIS and they said he could sign them for me, and then I could sign them at the interview. BUT after talking with others who went through the process, we decided I should fill them in myself and sign them (also, the letter of intent needs to be signed.) Someone I was talking with told me her fiancé made the mistake of not having her signature and USCIS sent him back the whole package. Anyway, my signed forms and letter of intent were sent by Xpress post yesterday so he should have them today or tomorrow. It's not really that much extra time compared to if you sent the package and get it returned just because you lack the original signatures. And it might be true what the USCIS person said about my fiancé signing the forms for me but we didn't want to risk having the whole package sent back, knowing that has happened to others!

K-1 Fiance(e) Visa Process & ProceduresI really wish CSC would stick to '1st come 1st serve'

Well, I don't know when you filed your I-129F since you don't have a timeline or signature.

It hasn't been filed yet, which is part of the reason my timeline seems empty. My fiancé is waiting for my signed forms and letter of intent, which were mailed by Xpress post today. So hopefully he will be able to send the petition by the end of the week or by the middle of next week.

The NOA2 isn't the end of the road, the case then goes to NVC (National Visa Center) and then over to the appropriate embassy. I don't know what the waiting times are for the interview in Canada, so I'm not much help here... Maybe try to ask around on the Canada forum or look at the Immigration Timelines section again - look for info about the embassy you will go to.

Yes, I did realize the medical exam and interview don't happen right away once receiving the NOA2... well, I guess we'll find out soon enough how long that waiting time will be :)

"Melytha, yes, you are one of the lucky ones going through Vermont. You should check the Immigration Timelines section of this website. The average time between NOA1 and NOA2 in VSC for the last 6 months was 44 days and for the last 3 months the average was only 32 days. You better start getting ready for the second leg of your K1 journey! ;) "

44 days and 32 days?! Wow! That leaves me with another question... I have been planning to visit in the U.S. from mid-March to mid-May, but if it only takes 32 days then I might have to leave the U.S. earlier then mid-May for the interview, right? Am I understanding this correctly?

K-1 Fiance(e) Visa Process & ProceduresI really wish CSC would stick to '1st come 1st serve'
Is Vermont really speedy? I was getting anxious because my understanding was that I might not get my visa until September and maybe even later, based on numbers from the USCIS website. I can't really complain though - I know of a couple where the bride was from India and it was a year and a half before she was allowed to enter the U.S.! And I'm sure a lot of you here had to wait a lot longer than 6 months!

It only took 3 months? Wow... I'm hoping mine will be quick too (I'm hearing it will b/c it's through Vermont) but I don't want to get my hopes up, just in case. :S

K-1 Fiance(e) Visa Process & ProceduresG 325 A

Dont be afraid to ask that little sign comes up alot for discussion, i believe most either abbrevated or just left that line blank, and went back filled in with pen.

I guess what I'm wondering is if the forms are sent with the little + signs will it cause problems? Because I thought to leave it blank and fill it in with a pen, or abbreviate, but not soon enough, and by the times my forms were printed, I didn't want to use up more paper than I was already using (it wasn't my paper or printed unfortunately so I felt bad!) So I already sent the signed forms with the + sign to my fiancé... should I do it over again and tell him to wait??? The only two spots are a city which was too long and also I tried to write I-129F Petition for Fiance but it didn't fit so they just show up as something like Riviere-Beau+ and I-129F Petition+

Oh, and I was afraid to ask, because I'm afraid the answer is that it will cause problems and I have to do it over, which is fine, but I just feel bad! :( Just a stupid little mistake if so!

I wish I had thought to ask the same thing here before I filled in my forms, but I think I did them okay - at least I hope I did cause I don't want them to get sent back and have to start over! :o(

My situation: I'm a Canadian. I live in Canada, and have only worked in Canada. I work as a nanny but over the past couple of years I've taken jobs in different cities. It's weird though because I've ALSO visited the U.S. sometimes longer for the amount of times I worked/lived in certain places. So at first I was just going to put my residence in Ottawa but then I realized my form might be incredibly confusing...they'd see I said my residence was in Ottawa, but I worked in Calgary? That doesn't make much sense does it?

So in the end, I listed the different cities in Canada that I worked AND LIVED as my residences, even though I was only at a couple of places for 2 months. For when I was just visiting in the U.S. I listed my regular address as my home address during those times and didn't list that I was visiting, because I didn't exactly have an address in the U.S. I didn't have enough space to list all my employers so I just wrote them on an attachment. BTW, I had the problem of not being able to remember all the addresses of my employers, but thankfully, I was able to contact some of them, tell them why I was asking and get their addresses, and for those I did not get in contact with I was able to look up their addresses. (And I didn't find this the easiest form to fill out, although I haven't filled out any others yet... so you're not alone! ;))

I hope I did it right...another thing I had a slight problem with was that I filled the forms out online, but one of the cities was too long so when I printed the forms there was a + sign that printed over top of the end of the box and it only showed the first part of the city (I should have thought to abbreviate it...) I was wondering if anyone knew if that would cause problems but was afraid to ask...does anyone know?
MelyssaNot TellingCanada2007-03-02 14:10:00
K-1 Fiance(e) Visa Process & Procedures+ signs in G-325A forms

You can just either use an electrical typewriter (like i did) or hand write all the fields on G-325A if you have problem with the + signs and don't wanna download the new Adobe. I was using 7.0 and the plus sign still came up...then I just got bored of it and decided to type down the answers manually. It won't be a problem.

Go figure, I was using Adobe 8.0 ;)

You only write down places where you have lived for 6 months or more under residences last five years.

That's what I thought originally...where can I find an official statement saying that, out of curiosity?

serendipitous - that's pretty cool. Thanks. I'll keep that in mind if we decide I should do them again (and I think I should cause it would be a pity to get the whole thing sent back just cause of two plus signs, lol)
